In the first part of this paper, two arguments, one by Chomsky, and one by Bar-Hillel and Shamir, are examined in detail and rejected. Both arguments purport to show that the structure of English precludes its having a finite state grammar which correctly enumerates just the well formed sentences of English. In the latter part of the paper I consider the problem of supporting claims about the structure and properties of a natural language when no grammar for the language has (...) yet been accepted. While the paradigm of utility maximisation has formed the basis of the majority of applications in discrete choice modelling for over 40 years, its core assumptions have been questioned by work in both behavioural economics and mathematical psychology as well as more recently by developments in the RUM-oriented choice modelling community. This paper reviews the basic properties with a view to explaining the historical pre-eminence of utility maximisation and addresses the question of what departures from the paradigm may be necessary (...) or wise in order to accommodate richer behavioural patterns. We find that many, though not all, of the behavioural traits discussed in the literature can be approximated sufficiently closely by a random utility framework, allowing analysts to retain the many advantages that such an approach possesses. At the forefront of international concerns about global legislation and regulation, a host of noted environmentalists and business ethicists examine ethical issues in consumption from the points of view of environmental sustainability, economic development, and free enterprise.

In recent decades, neo-republican philosophers have developed a theory of freedom as non-domination, which, they claim, is conceptually and analytically distinct from the “liberal” concept of freedom as non-interference. However, neo-republicans have intervened in constitutional debate almost exclusively in relation to structural issues of institutional competence, and have made little impact on the analytical jurisprudence of constitutional rights. While judicial review seems ill equipped to respond to the distributive dimensions of republican freedom, republicans like Richard Bellamy have argued that (...) the whole edifice of countermajoritarian, strong-form judicial review is itself an affront to freedom as non-domination properly understood. Republican freedom, in this lens, is defined structurally, procedurally and politically rather than in relation to a definite set, concept or theory of rights that is put outside and beyond politics. And partly for this reason, there has been little commentary concerning how the theory of freedom as non-domination might inform constitutional-rights doctrine. This article will argue, first, that the neo-republican view can usefully inform constitutional-rights doctrine notwithstanding republican reservations concerning judicial power. Second, it will propose a number of specific ways in which the jurisprudence of constitutional rights might account for the central concerns of the republican idea. (shrink)

This designation, human, can be used beyond the mere identification of a species to underwrite exclusion, denigration, dehumanization and demonization, and to set up a pervasive opposition in Othering all deemed inhuman, nonhuman, or posthuman. Obscurity is not the worst failing, and it is philistinism to pretend that it is. In a series of brilliant essays written over the last fifteen years Stanley Cavell has consistently argued that more important than the question whether obscurity could have been avoided is whether it affects our confidence in the author. Confidence raises the issue of intention, and I would have thought that the primary commitment of a psychoanalytic writer was to pass on, and (if he can) to (...) refine while passing on, a particular way of exploring the mind. Indeed this is how Lacan himself proposes that his work should be judged. “The aim of my teaching,” he writes, “has been and still is the training of analysts.” For decades now Lacan has been insisting that the nature of this commitment has been systematically obscured, particularly in North America. Training has become “routinized”, and analysis itself has become distorted into a process of crude social adaptation. There is much here to agree with. Yet two questions must be raised. Has Lacan devised a more effective method of training analysts? And, would one expect this from his writings? Neither question gets a favourable answer. All reports of his training methods, over which he has now brought about three distinct secessions within the French psychoanalytic movement, are horrifying. 13 It is now, I am told, possible to become a Lacanian analyst after a very few months of Lacanian analysis. And what pedagogic contribution could we expect from a form of prose that has two salient characteristics: it exhibits the application of theory to particular cases as quite arbitrary, and it forces the adherents it gains into pastiche. 14 Lacan's ideas and Lacan's style, yoked in an indissoluble union, represent an invasive tyranny. And it is by a hideous irony that this tyranny should find its recruits among groups that have nothing in common except the sense that they lack a theory worthy of their cause or calling: feminists, cinéastes , professors of literature. Lacan himself offers several justifications for his obscurity, about which he has no false modesty. At times he says that he is the voice, the messenger, the porte-parole , of the unconscious itself. Lacan's claim stirs in my mind the retort Freud made to a similar assult upon his credulity and by someone who had learned from Lacan. “It is not the unconscious mind I look out for in your paintings,” Freud said to Salvador Dali, “it is the conscious.”. Biographical account of Thomas Merton who was one of the leading Christian spiritual leaders of the 20th century. He authored more than 60 books and many reviews and essays primarily on spirituality, social justice and pacifism. His autobiographical account of his spiritual journey in The Seven Story Mountain proved immensely inspirational to many and is listed as one of the 100 best non-fiction books of the 20th century by the National Review. In later life, Merton engaged in dialogue with major (...) Eastern spiritual figures like the Dali Lama, Thai Buddhist monk Buddhadasa, Vietnamese monk Thich Nhat Hanh and Japanese writer D.T. In the early 1920s, the German mathematician David Hilbert (1862–1943) put forward a new proposal for the foundation of classical mathematics which has come to be known as Hilbert's Program. It calls for a formalization of all of mathematics in axiomatic form, together with a proof that this axiomatization of mathematics is consistent. The consistency proof itself was to be carried out using only what Hilbert called “finitary” methods. The special epistemological character of finitary reasoning then yields the required justification (...) of classical mathematics. Although Hilbert proposed his program in this form only in 1921, various facets of it are rooted in foundational work of his going back until around 1900, when he first pointed out the necessity of giving a direct consistency proof of analysis. Work on the program progressed significantly in the 1920s with contributions from logicians such as Paul Bernays, Wilhelm Ackermann, John von Neumann, and Jacques Herbrand. It was also a great influence on Kurt Gödel, whose work on the incompleteness theorems were motivated by Hilbert's Program. Gödel's work is generally taken to show that Hilbert's Program cannot be carried out. It has nevertheless continued to be an influential position in the philosophy of mathematics, and, starting with the work of Gerhard Gentzen in the 1930s, work on so-called Relativized Hilbert Programs have been central to the development of proof theory. Angell's logic of analytic containment AC has been shown to be characterized by a 9-valued matrix NC by Ferguson, and by a 16-valued matrix by Fine. We show that the former is the image of a surjective homomorphism from the latter, i.e., an epimorphic image. The epimorphism was found with the help of MUltlog, which also provides a tableau calculus for NC extended by quantifiers that generalize conjunction and disjunction.

The ArgumentFocusing on the celebrations of Newton and his work, this article investigates the use of the concept of genius and its connection with debates on the methodology of science and the morality of great discoverers. During the period studied, two areas of tension developed. Firstly, eighteenth-century ideas about the relationship between genius and method were challenged by the notion of scientific genius as transcending specifiable rules of method. Secondly, assumptions about the nexus between intellectual and moral virtue were threatened (...) by the emerging conception of genius as marked by an extraordinary personality – on the one hand capable of breaking with established methods to achieve great discoveries, on the other, likely to transgress moral and social conventions. The assesments of Newton by nineteenth-century scientists such as Brewster, Whewell, and De Morgan were informed by these tensions. (shrink)

Physicians have for some time been questioning the prevailing view of medicine as applied biology. It is urged that medicine needs to be reconceived so as to provide appropriate emphasis on the patient's experience and understanding of illness. After reviewing these arguments and the scientific paradigm underlying the received view in light of certain themes in medicine's history and of current thinking, Pellegrino's thesis is analyzed: medicine should be understood as an inherently moral enterprise, a form of praxis focused on (...) "the healing relationship". Understanding the illness experience and the professed healer's "compassion" supports Pellegrino's view, and suggests that the healing relationship is perhaps best conceived as a form of dialogue. Schmitt finds that national sex ratios predict levels of sociosexuality, but how we should interpret this result is unclear for both methodological and conceptual reasons. We criticize aspects of Schmitt's theorizing and his analytic strategy, and suggest that some additional analyses of the data in hand might be illuminating.

It analyzes step-by-step the ways in which authors such as Immanuel Kant, George Milbrey Gould, Herbert George Wells, Thomas Henry Huxley, Howard Phillips Lovecraft, Vladimír Hoppe, Jacques Monod, and Eugene Thacker appropriated Pascal’s images of despair from the “eternal silence of infinite spaces”, which they have then used to develop their own arguments in favor of defending (or disparaging) the relevance of a human presence in the universe. The notion of a “query” occurred in legal, medical, theological and scientific writings during the early modern period. Whereas the “questionary” (from c. 1400s) sought replies from within a doctrine (such as Galenic medicine), in the 1600s the query posed open-ended inquiries, seeking empirical information from travellers, explorers and others. During the 1660s in Britain, three versions of the query (and lists of queries) emerged. Distinctions need to be made between queries seeking information via observation and those asking for experimentation, (...) and between those aiming to keep theory to one side and those that framed theoretical conjectures. My examples are drawn from the work of the Royal Society of London (founded 1660) and from some of its leading members, especially Robert Boyle, Robert Hooke and Isaac Newton. (shrink)

That India once had a sustained ‘dialogue’ with Scottish Philosophy is not gener- ally known, or that the exchange occurred in the medium of Sanskrit, not English. The essay explores an important cross-cultural encounter in the colonial context of mid 19th-century Benares where two Scots, John Muir and James Ballantyne, served as principals of a Sanskrit college established by the East India Company. Educated toward the end of the Scottish Enlightenment, they endeavoured to translate such distinctive concepts of ‘Scotch Metaphysics’ (...) as Externalism into Indian philosophical categories. The ensuing ‘dialogue’ with Brahmin interlocutors shows that the prob- lems they faced were less terminological than conceptual, having to do with contras- tive ways of understanding ‘mind’ and ‘man’. Between the two Scots, there were also signifi cant differences, although both had gone to India as Scottish Calvinists. While Muir remained largely impervious to Indian infl uence, Ballantyne was profoundly changed, becoming, in effect, a ‘Vedantic Calvinist’. (shrink)

Where there is controversy, the book presents the case for each side, but highlights where the key difficulties with them lie. While eminently student-friendly, the book makes an important contribution to the debate regarding the acceptability of the various philosophical methods, and (...) so it will also be of interest to more experienced philosophers. In Heidegger's Way of Being, the follow-up to his 2010 book, Engaging Heidegger, Richard Capobianco makes the case clearly and compellingly that the core matter of Heidegger's lifetime of thought was Being as the temporal emergence of all beings and things. Drawing upon a wide variety of texts, many of which have been previously untranslated, Capobianco illuminates the overarching importance of Being as radiant manifestation - "the truth of Being" - and how Heidegger also named and elucidated this fundamental (...) phenomenon as physis, Aletheia, the primordial Logos, and as Ereignis, Lichtung, and Es gibt. Heidegger's Way of Being brings back into full view the originality and distinctiveness of Heidegger's thought and offers an emphatic rejoinder to certain more recent readings, and particularly those that propose a reduction of Being to "sense" or "meaning" and maintain that the core matter is human meaning-making.
