Siguiendo la propuesta paradigmática formulada por Giorgio Agamben en torno al estado de excepción como dispositivo constitutivo del orden jurídico estatal, este trabajo confronta críticamente una de los sustratos básicos que siempre ha rondado la teoría republicana, tanto en sus vertiente vinculadas a los trabajos de Hannah Arendt como a los de Phillip Pettit, y que es habitualmente presentada como un pregunta inclusiva, a saber: cómo hacer posible la política y la libertad no solo para algunos sino para todos/as. Sostenemos (...) que la propuesta de Agamben establece un pie forzado que obliga al republicanismo a repensar sus condiciones de posibilidad de manera más radicalmente crítica de lo que habitualmente lo ha hecho – una radicalidad que incluso podría obligar a ir más allá de la forma estatal que por siglos ha acompañado a la promesa de inclusión republicana. En este trabajo se propone, en primer lugar, un análisis informal de las principales ideas de la concepción filosófica de Carlos Alchourrón en torno a la naturaleza de los lenguajes derrotables, en especial de los lenguajes normativos. Esta concepción que, a su vez, conforma el trasfondo de sus propuestas en el ámbito de la lógica de condicionales derrotables, supone que la derrotabilidad es un rasgo que se ubica en la dimensión pragmática del lenguaje. Se discuten sus consecuencias con relación a (...) diversas cuestiones, teniendo en cuenta la tesis de Alchourrón según la cual las proposiciones y las normas son el significado de las expresiones usadas en contextos definidos. En segundo lugar, se sostiene que lo que Alchourrón denomina "concepción disposicional de la derrotabilidad", en su artículo "Sobre Derecho y Lógica" representa -al menos en lo que respecta al ámbito normativo- un cambio sustancial de su idea de la derrotabilidad. Esta modificación supone, en relación a las normas, adoptar una versión de la teoría disposicional del valor. Se sostiene que, sin embargo, la nueva propuesta no es plausible, porque no puede superar a lo que puede ser denominado "el problema del límite de las disposiciones", por un lado, ni tampoco "el problema de la indeterminación necesaria", por el otro. The purpose of this paper is, in the first place, to provide an informal analysis of the main ideas of Carlos Alchourrón' s philosophical conception about the nature of defeasible languages, and in particular about that of normative languages. This conception, which constitutes also the background for his proposals in the field of the logic of defeasible conditionals, assumes that defeasibility belongs to the pragmatic dimension of language. Its consequences in relation to several questions are discussed, taking into account Alchourrón' s thesis according to which propositions and norms are the meaning of the expressions used in defined contexts. Secondly, it is maintained that what Alchourrón denominates "dispositional conception of defeasibility" in his article "On Law and Logic" represents a substantial change of his ideas about defeasibility, at least in what concerns the normative field. As far as norms are concerned this modification entails the adoption of a version of the dispositional theory of the value. Nevertheless, it is argued that this new proposal is not plausible because it cannot solve neither what can be called the "problem of the limit of dispositions" nor the "problem of the necessary indetermination". This study was aimed at examining the impacts of the Sharing economy on the individual and community Quality of Life and wellbeing by looking at their associated influencing factors using Village Savings and Loans Associations as a model of sharing economy in Malawi. An online community-based cross-sectional study design was conducted from November 2020 through January 2021. In the survey, 402 Village Savings and Loans Associations members from the Mzuzu City area participated, recruited using snowball and respondent-driven sampling techniques. The (...) sample size was computed using a single population proportion using the Yamane formula. Descriptive statistics and ordinal logistic regression model techniques were also employed. Additionally, we used the Chi-Square test, two-way ANOVA, and Ordinal regression model to determine statistical associations between socioeconomic data and QOL and wellbeing variables with a 5% level of significance. On the aspect of community wellbeing, the findings of our study indicated that income provided members with options to live a better QOL and wellbeing within the community by either facilitating payment for better education, eating healthier foods, acquiring assets, etc. Further, the absence of discrimination provided a platform for voice, inclusion, and social trust, enhancing freedom of expression. We also found that education facilitated better earnings and knowledge of public health-related issues. As for the contribution to the sharing economy, our study has emphasized the role played by trust in enhancing sharing economy. We recommend and encourage people to join these VSLAs so as to improve their QOL and wellbeing. However, there is a need to replicate the study on a larger scale to validate our study findings for effective policy formulation and implementation geared to improving the overall quality of people’s lives. Based on these findings, we further recommend that authorities reinstate programs like National Strategy for Financial Inclusion 2016–2020 and Savings and Loan Groups Best Practice Guidelines 2016–2017 that could further enhance the future of VSLAs, which are vital for QOL and community wellbeing of the people in developing countries like Malawi. Resumen En esta nota presento la teoría unificada de las oraciones copulativas propuesta por Andrea Moro, quien sostiene que el verbo ser no es más que un soporte para la flexión verbal, independientemente de las peculiaridades gramaticales y semánticas de las oraciones adscriptivas, identificativas y existenciales en que aparece. Primero contextualizo la propuesta de Moro; después explico la manera en que Moro aclara una anomalía sintáctica que parece corroborar la supuesta polisemia del verbo ser. Por último, comento algunas omisiones de (...) relevancia filosófica en la historia del verbo ser contada por Moro.In this note I present the unified theory of copular sentences proposed by Andrea Moro, who maintains that the verb to be is nothing more than a support for verbal inflection, regardless of the grammatical and semantic peculiarities of the ascriptive, equative, and existential sentences in which it appears. First, I contextualize Moro's proposal. Then, I explain how Moro clarifies a syntactic anomaly that seems to corroborate the alleged polysemy of the verb to be. Lastly, I comment on some omissions of philosophical relevance in the history of the verb to be told by Moro. (shrink)

O presente artigo fundamenta-se em uma pesquisa bibliográfica com o propósito de instigar debates acerca das estratégias adotadas por instituições e figuras proeminentes na tentativa de obscurecer ou mesmo negar a significativa contribuição das multidões de africanos escravizados que chegaram a estas terras, em larga medida, para o enriquecimento do país. Adicionalmente, baseia-se em uma pesquisa netnográfica com o desígnio de analisar as controvérsias e polêmicas presentes nas plataformas de mídia eletrônica relacionadas às alegações de envolvimento e benefício do Banco (...) do Brasil com o sistema econômico escravista e o tráfico ilegal de escravos. Ademais, o estudo almeja evidenciar que as frequentes tentativas de obliteração ou negação dos episódios de abuso, violência e perseguição contra os africanos e seus descendentes reforçam a percepção de que o reconhecimento e a valorização da contribuição dos negros dependem, em grande medida, de um contínuo exercício de revisão histórica e de um tratamento fiel e apropriado da narrativa histórica. Festschrift in honor of 60th birthday of Āgamānaṅdasvāmikaḷ, 1896-1961; collection of his speeches and writings on Vedanta and other aspects of Hindu philosophy.

This paper explores two persistent questions in the literature on presumptions: the place and the nature of presumptions in law and legal argumentation. These questions were originally raised by James Bradley Thayer, one of the masters of the Law of Evidence and the author of the classic chapter devoted this subject in A preliminary treatise on Evidence. Like Thayer, I believe that these questions deserve attention. First the paper shows that the connection between presumptions and argumentation is a constant feature (...) in the literature on presumptions, since its foundation in the Middle Ages to modern times. James Bradley Thayer was probably the last jurist who clearly saw that presumptions belong to argumentation. Second, the paper examines two sources of controversy in the language of presumptions. First, “presumption” is an ambiguous word in the legal discourse. As a result, it is almost impossible to provide a clear and succinct answer to the question “What is a presumption?”. Second, there are at least four reconstructions of the concept of presumption whose merits and shortcomings are relevant to explore. The analysis presented here may be of interest for legal and non-legal scholars and, hopefully, it may help to shed light on the possibilities and limits of an interdisciplinary dialogue about presumptions. Human life in contemporary society is extremely complex and there are various external factors that directly affect the realization in the individual ends. In this work I analyze the effects of the global market economy, manifested by a mode of production and distribution of goods and services in the form of a global network of economic relations, which involve people, transnational corporations and political and social institutions in moral sphere of people, affecting their choices and the realization of these choices. Individual freedom can be understand as a freedom to realize our choices in the environment of a global economic market, but it is still problematic in the sense that the choices of goods and services available in this market do not reflect individual choices, but a set of preferences standardized according to the market itself. In this paper I will reflect about the individual freedom in economic globalization pointing from the debate between Pettit and Berlin that social freedom advocated by Republican Petit can be satisfactory for a start. Amante de la verdad y de la libertad personal. Entre sus obras más profundas se encuentran las que componen su Curso de teoría del conocimiento y su Antropología trascendental.

La filosofía, más que ser una tarea que busca crear e instaurar una teoría absoluta de la verdad, como fue el caso, en la historia de la filosofía misma, del pensamiento cartesiano, el hegeliano,el husserliano, entre otros, es una actividad, es decir, una praxis dialógica que se entiende como introducirse en el medio de un camino que ya otros han recorrido, lo cual presupone, inmediatamente, una concepción de la filosofía como un camino de experiencia siempre abierto. Así, el presente artículo (...) busca analizar el hacer filosófico como una práctica hermenéutica que no sólo se presenta como familiarización con la tradición, la cual se ejemplifica en el texto con la teoría de la reminiscencia platónica, sino también bajo la forma del rompimiento inherente a dicha familiarización. Por tanto, el artículo busca presentar el saber y el hacer filosófico desde una visión hermenéutica, lo que de suyo implica concebirlo como una acción dialógica mediante la cual se estimula el hacer filosófico como recuerdo, es decir, no sólo como mera aprehensión de conceptos e instauración de verdades totalizantes, sino como praxis humana, que es donde la filosofía y, en suma, la experiencia hermenéutica, encuentran su verdadero topos. Cet article explore un parallèle entre deux innovations fondatrices des épistémès contemporaines, celles de Marx et de Saussure, en constatant l’isomorphisme entre les concepts de valeur d’usage et de signifiant. Après un rapide repérage de l’emploi du terme « valeur d’usage » dans la tradition marxiste, on examine la valeur d’usage comme corps, plutôt que comme besoin ou fonction utile. En considérant le concept de valeur d’usage au prisme de celui de signifiant, on met à preuve les questions de l’arbitraire, (...) de l’indivisible, du versatile. L’auteur observe que les deux concepts désignent des moments d’une activité : maillons d’une chaîne. Les chaînes signifiantes auraient un rôle fondamental, comme automatisme de répétition, dans la reproduction sociale. (shrink)

Despite the ongoing consideration of the ethical nature of human resource management (HRM), little research has been conducted on how morality and ethics are represented in the discourse, activities and lived experiences of human resource (HR) professionals. In this paper, we connect the thinking and lived experiences of HR professionals to an alternative ethics, rooted in the work of Bauman (Modernity and the Holocaust, Polity Press, Cambridge, 1989; Theory, Culture and Society 7:5-38, 1990; Postmodern Ethics, Blackwell, Oxford, 1991; Approaches to (...) Social Enquiry, Polity Press, Cambridge, 1993; Life in Fragments, Blackwell, Oxford, 1995) and Levinas (Otherwise than Being, or, Beyond Essence, Duquesne University Press, Pittsburgh, PA, 1998). We argue that the study of HRM and ethics should be contextualized within the discourses used, the practices and activities of HR professionals. Through the analysis of interview data from 40 predominantly Canadian HR practitioners and managers we experiment with Bauman's notion of 'moral impulse' to help us understand how HRM is both a product and perpetuator of moral neutralization in organizations. We suggest that HRM as it is practiced is concerned with distancing, depersonalizing, and dissembling, and acts in support of the 'moral' requirements of business, not of people. However, we also recognize that HR practitioners and managers are often confronted with and conflicted by actions and decisions that they are required to take, therefore opening possibilities and hope for an alternative ethical HRM. “History, forgetfulness and remembrance in Hegel and Nietzsche”. Albeit the evident distance between Hegel´s and Nietzsche´s philosophical projects, there is a shared terrain from which both authors respond to the excesses of modern illustration, which reacted against history and tradition, in the name of a subjective conscious understood as the unconditioned nucleus of reality. This paper wants to contribute to show how close to each other are this so called antagonists, showing that in their doctrines there is an intuition about (...) the fundamental temporality that lies in human existence and experience. From this common point of view, articulated in both cases with the notions of “remembrance” and “forgetfulness”, it is the purpose to generate a living dialogue, however full of tensions, between Hegel and Nietzsche, as critics of Modernity. Se propone una reflexión sobre el método clínico y sus etapas, la relación médico-paciente y la presencia tecnológica en la Cardiología Pediátrica. La ecocardiografía transtorácica no puede sustituir el pensamiento médico, la anamnesis, ni el examen físico. Como medio diagnóstico realizado e interpretado por humanos, está sujeto a error, el cual se minimiza según la calidad de los datos clínicos aportados por el médico que lo solicita. El presente trabajo tiene como objetivo analizar los aspectos éticos del método clínico en (...) relación con la utilización de la ecocardiografía transtorácica en niños con cardiopatías congénitas. It is proposed a reflexion about the clinical method and its stages, the doctor-patient relation and the presence of technology in paediatric cardiology. The transthoracic echocardiography can4t substitute medical thought, neither the anamnesis nor the physical examination. As a diagnostic medium carried out and interpreted by humans, it is subject to error, which it is minimized according to the quality of the clinical data provided by the doctor who requests them. The present work has the objective to analyse the Ethical foundations of the clinical method in connection with the use of transthoracic echocardiography in children with congenital cardiopathies. The language of physics is mathematics, and physics ideas, laws and models describing phenomena are usually represented in mathematical form. Therefore, an understanding of how to navigate between phenomena and the models representing them in mathematical form is important for a physics teacher so that the teacher can make physics understandable to students. Here, the focus is on the “experimental mathematization,” how laws are established through quantifying experiments. A sequence from qualitative experiments to mathematical formulations through quantifying experiments on electric (...) current, voltage and resistance in pre-service physics teachers’ laboratory reports is examined. The way students reason and justify the mathematical formulation of the measurement results and how they combine the treatment and presentation of empirical data to their justifications is analyzed. The results show that pre-service physics teachers understand the basic idea of how quantifying experiments establish the quantities and laws but are not able to argue it in a justified manner. Detractors of Searle’s Chinese Room Argument have arrived at a virtual consensus that the mental properties of the Man performing the computations stipulated by the argument are irrelevant to whether computational cognitive science is true. This paper challenges this virtual consensus to argue for the first of the two main theses of the persons reply, namely, that the mental properties of the Man are what matter. It does this by challenging many of the arguments and conceptions put forth by the (...) systems and logical replies to the Chinese Room, either reducing them to absurdity or showing how they lead, on the contrary, to conclusions the persons reply endorses. The paper bases its position on the Chinese Room Argument on additional philosophical considerations, the foundations of the theory of computation, and theoretical and experimental psychology. The paper purports to show how all these dimensions tend to support the proposed thesis of the persons reply. (shrink)

The ἐκπύρωσις, or world's conflagration, followed by the restoration of an identical world seems to go against the rationality of the Stoic god. The aim of this paper is to show that Cleanthes, the second head of the School, can avoid this paradox. According to Cleanthes, the conflagration is an inevitable side-effect of the necessary means used by god to sustain the world. Given that this side-effect is contrary to god's sustaining activity, but unavoidable, god's rationality requires the restoration of (...) an identical world once the conflagration subsides. The paper also deals with the relation between Cleanthes and other early Stoics on the topic of conflagration. In particular, Cleanthes' position seems to differ from Chrysippus'. For in contrast with the Cleanthean god, who causes the conflagration as a side-effect only, the Chrysippean god, according to an influential interpretation put forward by Jaap Mansfeld, causes the conflagration as his ultimate cosmological goal.
