How far should we go in protecting and promoting public health? Can we force people to give up unhealthy habits and make healthier choices, or does everyone have the right to decide their own lifestyle? Should we stop treating smokers who refuse to give up smoking? Should we put a tax on fatty foods and ban vending machines in schools to address the obesity epidemic? Should parents be required to have their children vaccinated? Are some of our screening programmes unethical (...) Downs syndrome screening, for example or should we be screening people for more conditions, such as Huntington disease? Such questions are at the heart of public health ethics. Holland shows that to understand and debate these issues requires philosophy: moral philosophies, such as utilitarianism and deontology, as well as political philosophies such as liberalism and communitarianism. And philosophy informs other aspects of public health, such as epidemiology and health promotion. Born in Vienna in 1864, Bernard Hollander was a London-based psychiatrist. He is best known for being one of the main proponents of phrenology. This title, originally published in 1916, deals with "the nervous defects of children, and the various forms and degrees of mental and moral deficiency that may occur from infancy up to the age of twenty-one." Very much of its time, it looks at both what it calls the "subnormal" and the "supernormal" child, the causes of abnormality, (...) and suggests ways of educating children in order to minimise their defects and maximise their abilities. We present a case study of two scientific perspectives on the phenomenon of nerve signal propagation, a bio-electric and a thermodynamic perspective, and compare this case with two accounts of scientific perspectivism: those of Michela Massimi and Juha Saatsi, respectively. We demonstrate that the interaction between the bio-electric perspective and the thermodynamic perspective can be captured in Saatsi’s terms of progress in explanatory understanding. Using insights from our case study, we argue that both the epistemic and pragmatic dimensions of scientific (...) understanding are important for increasing explanatory understanding of phenomena. The epistemic dimension of understanding is important for increasing the number of actually answered what-if-things-had-been-different questions about a phenomenon, the pragmatic dimension for pointing out the potentially answerable what-if questions that have been overlooked or purposefully neglected thus far. Exposing the limitations of the acquired understanding within a particular perspective can be achieved by criticizing the assumptions that have been adopted to make models of the perspective intelligible, but that are considered problematic from a rival perspective. Information is clearly vital to public health, but the acquisition and use of public health data elicit serious privacy concerns. One strategy for navigating this dilemma is to build 'trust' in institutions responsible for health information, thereby reducing privacy concerns and increasing willingness to contribute personal data. This strategy, as currently presented in public health literature, has serious shortcomings. But it can be augmented by appealing to the philosophical analysis of the concept of trust. Philosophers distinguish trust and trustworthiness from (...) cognate attitudes, such as confident reliance. Central to this is value congruence: trust is grounded in the perception of shared values. So, the way to build trust in institutions responsible for health data is for those institutions to develop and display values shared by the public. We defend this approach from objections, such as that trust is an interpersonal attitude inappropriate to the way people relate to organisations. The paper then moves on to the practical application of our strategy. Trust and trustworthiness can reduce privacy concerns and increase willingness to share health data, notably, in the context of internal and external threats to data privacy. We end by appealing for the sort of empirical work our proposal requires. (shrink)

Adopting a view of utilitarian ethics in which motivation in the public interest takes on greater weight than is generally appreciated, this book explores the extent to which the philosophy of Immanuel Kant is consistent with this nuanced version of utilitarianism. Kant's requirement that full ethical merit needs an agent to act purely 'from duty' to forward 'the universal end of happiness' rather than from a personal inclination to achieve that end clearly distinguishes his position from the version of utilitarian (...) ethics adopted here. But this book also argues that Kant's approval of a secondary category of conduct - conduct 'in conformity with' duty - entailing other-regarding or 'sympathetic' motivation to advance general happiness, differs from the utilitarian position only in its meriting a qualified degree of ethical credit. After comparing Kant's position with those of eighteenth-century utilitarian writers from Locke to Bentham, the book evaluates reactions to Kant by J.S. Mill and Karl Marx and proposes Michel de Montaigne (1533-1592) as a 'precursor' for maintaining a 'Kantian' doctrine of conduct 'from duty' and for other shared features. In terms of public policy, the work demonstrates Kant's justification of poor relief and reduced inequality, his proposal for a state education plan, and his opposition to paternalism. We establish an equiconsistency between (1) weak indestructibility for all $\kappa +2$ -degrees of strength for cardinals $\kappa $ in the presence of a proper class of strong cardinals, and (2) a proper class of cardinals that are strong reflecting strongs. We in fact get weak indestructibility for degrees of strength far beyond $\kappa +2$, well beyond the next inaccessible limit of measurables (of the ground model). One direction is proven using forcing and the other using core model techniques from (...) inner model theory. Additionally, connections between weak indestructibility and the reflection properties associated with Woodin cardinals are discussed. This work is a part of my upcoming thesis [7]. (shrink)

The phrase 'beyond historicism' is usually associated with Bielefeld historians like Hans Ulrich Wehler and Jürgen Kocka, who attempted to turn the study of history into a social science, but a better candidate would be the sociologist Niklas Luhmann, who happened to teach as well in Bielefeld during the 1970's and 1980's. Luhmann had little affinity with the project of his colleagues from the history department. He took the opposite view that the social sciences suffered from a naive enlightenment view (...) and should become more history minded. Like the historicists of the early nineteenth century Luhmann was indirectly inspired by the philosophy of Leibniz. Although Luhmann's theory of social systems may seem miles away from the daily interests of most historians, it can be interpreted as an Aufhebung of historicism. This will be demonstrated for two important concepts, the autopoietic system which incorporates the historicist notion of individuality and the concept of second order observation which can be read as an abstract redescription of what historicists meant by the historical method. O'Brien maintains that ‘only the two Mills, apart from Bentham himself, were really Utilitarians’. This letter responds to the article “On the Authority of Advance Euthanasia Directives for People with Severe Dementia: Reflections on a Dutch Case,” by Henri Wijsbek and Thomas Nys, in the September‐October 2022 issue of the Hastings Center Report.

Au cours des deux dernières décennies, les études sur Stanley Milgram ont connu une véritable renaissance interdisciplinaire, qui a conduit à modifier profondément le débat sur ces expériences de psychologie sociale parmi les plus controversées du xxe siècle. L’intérêt considérable pour les conditions expérimentales de ses travaux constitue une nouvelle perspective, qui a des implications pour la philosophie de la psychologie sociale. L’ontologie sociale (ou ontologie historique), de différents styles, peut mettre en lumière les caractéristiques contingentes de l’« obéissance à (...) l’autorité» et d’autres expériences classiques de la psychologie sociale nord-américaine. Dans ce numéro de Philosophia Scientiæ consacré à Milgram, ma contribution consiste à montrer comment une approche empirique de l’interaction sociale peut aider à éclairer – « à partir de la base» -– les relations de pouvoir dans le laboratoire de Milgram, ainsi que les résistances à la poursuite de l’expérience. Tout d’abord, je présente le pouvoir comme une caractéristique multidimensionnelle de la sociabilité humaine, en soulignant son aspect performatif. Dans le laboratoire, les sujets jouant le rôle des Enseignants sont contraints à exercer leur pouvoir de différentes façons très contrastées, soit en exerçant ce pouvoir sur l’Apprenant (en se conformant à la volonté de l’expérimentateur), soit contre l’expérimentateur (c’est-à-dire en lui résistant). Deuxièmement, je propose que, comme la moralité, le pouvoir au sens performatif peut être compris à l’aide de la distinction entre premier-plan et arrière-plan (dans le vocabulaire Gestaltiste, la distinction figure/fond), les deux aspects du phénomène étant empiriquement fondés, et orientés vers les pratiques concrètes des agents en interaction. Troisièmement, je précise la notion de pouvoir performatif, en relation avec la pratique de ceux qui, parmi les sujets en position d’Enseignants, s’opposent à la continuation de l’expérience. En conclusion, l’article illustre la valeur de l’analyse éthnométhodologique conversationnelle, en tant que style d’ontologie sociale adapté tant à l’étude des relations de pouvoirs, à celle des prétentions à la connaissance en psychologie sociale, qu’à la reconstruction des présupposés de la psychologie sociale nord-américaine classique. This article considers Hugo Grotius’s ideas on a specific topic of commercial law, analysing his position and potential contributions to early modern Dutch insolvency legislation. It might be questioned how ‘Hollandic’ Grotius’s interpretations of legal solutions for insolvency as presented in the Inleidinge tot de Hollandsche Rechts-Geleerdheid actually were. Grotius’s treatment of cessie van goede is relatively strict, whereas compositions are hardly mentioned. A rather different image rises from his later work. Here, Grotius displays a more radical view, in specific (...) cases allowing the sovereign to interfere in private property rights and to restructure debts for the common good. It is an intriguing question if and to what extent these ideas can be related to contemporary Dutch insolvency practices. (shrink)

This paper presents a sequential search model where consumers look for several products and multiproduct …rms compete in prices. In such a multiproduct search market, both consumer behavior and …rm behavior exhibit di¤erent features from the single-product case: a consumer often returns to previously visited …rms before running out of options; and prices can decrease with search costs and increase with the number of …rms. The framework is then extended in two directions. First, by introducing both single-product and multiproduct searchers, (...) the model can explain the phenomenon of countercyclical pricing, i.e., prices of many retail products decline during peak-demand periods. Second, by allowing …rms to use bundling strategies, the model sheds new light on how bundling a¤ects market performance. In a search environment, bundling tends to reduce consumer search intensity, which can soften competition and reverse the usual welfare assessment of competitive bundling in a perfect information setting.
