RESUMEN Dentro de la enorme cantidad de temas reinantes relacionados con el desarrollo científico-tecnológico actual, se encuentra indudablemente el del empleo de la ventilación mecánica no invasiva como medida de soporte vital. Aunque no se trata de una obra especifica que presente un panorama completo y exacto, de todos y cada uno de los problemas relacionados con el empleo de la misma, los autores pretenden con el artículo realizar una breve reflexión del tema desde el enfoque de la ciencia, la (...) tecnología y la sociedad en el momento actual, de manera que constituya un marco útil para el examen de estos temas, su debate, reflexión e intercambio de opiniones en el contexto de los servicios de la salud. ABSTRACT Among the huge number of current issues related to the current scientific-technological development is undoubtedly the use of non-invasive mechanical ventilation as a measure of life support. Although it is not a specific work that presents a complete and accurate picture of each one of the problems related to the use of it. Authors intend with the article to make a brief reflection on the subject from the perspective of science, technology and society at the present time, so that it constitutes a useful framework for the examination of these issues, debate, reflection and exchange of opinions in the context of health services. I argue that both Mary O'Brien's celebratory analysis of motherhood and Simone de Beauvoir's critical one fail, due to biologism and a lack of historical sense. Both approaches, I claim, are complementary: motherhood need be analysed both as alienating-Beauvoir-and as a potential ground for feminism-O'Brien. I conclude by suggesting that feminism can only reappropriate the female reproductive experience in a critical way.

This paper examines potential predictors of ethical decisions regarding insider trading. An interactionist perspective is taken, in which person variables, situational variables, and the interaction of these two sets of variables are viewed as influencing ethical decisions. The results of our study support such a perspective. Ethical decisions regarding insider trading appear to be a function of a complex set of interacting variables related to both the person and the situation. The implications of these findings are discussed.

In this paper we summarize observations bridging the declared aspirations of pictorial semiotics and its real achievements. Pictorial semiotics is here understood as the general study of pictures as signs and it constituted a fundamental step beyond the art historical captivation with individual images. In the first part of our contribution we present a review of the most important methods that have been proposed as an answer to deal with several pictorial problems (multiple instances, segmentation, non-figurative meaning). In the second (...) part, we offer some positive and on-going implementations designed to remedy the shortcomings observed. What is suggested is the proof of concept that human researchers need the assistance of computing methodologies. We propose to discuss about the possession and expression of a capacity that empowers individuals to act as citizens. First, elements of Aristotelian politics are presented as arguments for civility as a capacity inherent in the social nature of human beings. Then, according a contractualist interpretations, the individual becomes a citizen to the extent that he forms an agreement with the other members of society. A first finding refers to the fact that with contractualism, the individual has lost the inherence (...) of his civic action and must define himself as a citizen if he meets the extrinsically given requirements Likewise, it is indicated that the expression of civility has been interfered with by an idea of individual freedom understood in negative terms. However, before returning to Aristotelian perspective, it is necessary to redefine the idea of freedom that guides civic interaction, advocating for a social and intrinsically motivated citizenship. Proponemos discutir sobre la posesión y expresión de una capacidad que faculta a los individuos para actuar como ciudadanos. Primero, se exponen aspectos de la política aristotélica como argumentos en favor de la civilidad como una capacidad inherente a la naturaleza social de los seres humanos. Luego, desde una interpretación contractualista, el individuo se convierte en ciudadano en la medida en que establece acuerdos con los demás miembros de la sociedad. Así, una primera constatación se refiere a que, con el contractualismo, el individuo ha perdido la inherencia de su acción cívica y es definido como ciudadano en la medida en que cumple requisitos dados extrínsecamente. Asimismo, se indica que la expresión de civilidad se ha visto interferida por una idea de libertad individual entendida en términos negativos. Sin embargo, antes de retomar una perspectiva aristotélica, es necesario redefinir la idea de libertad que guía la interacción cívica, abogando por una ciudadanía social e intrínsecamente motivada. Research Integrity (RI) is high on the agenda of both institutions and science policy. The European Union as well as national ministries of science have launched ambitious initiatives to combat misconduct and breaches of research integrity. Often, such initiatives entail attempts to regulate scientific behavior through guidelines that institutions and academic communities can use to more easily identify and deal with cases of misconduct. Rather than framing misconduct as a result of an information deficit, we instead conceptualize Questionable Research Practices (...) (QRPs) as attempts by researchers to reconcile epistemic and social forms of uncertainty in knowledge production. Drawing on previous literature, we define epistemic uncertainty as the inherent intellectual unpredictability of scientific inquiry, while social uncertainty arises from the human-made conditions for scientific work. Our core argument—developed on the basis of 30 focus group interviews with researchers across different fields and European countries—is that breaches of research integrity can be understood as attempts to loosen overly tight coupling between the two forms of uncertainty. Our analytical approach is not meant to relativize or excuse misconduct, but rather to offer a more fine-grained perspective on what exactly it is that researchers want to accomplish by engaging in it. Based on the analysis, we conclude by proposing some concrete ways in which institutions and academic communities could try to reconcile epistemic and social uncertainties on a more collective level, thereby reducing incentives for researchers to engage in misconduct. ABSTRACT:The profound influence of Thomas Donaldson and Thomas Dunfee’s integrative social contracts theory on the field of business ethics has been challenged by Andreas Scherer and Guido Palazzo’s Habermasian approach, which has achieved prominence of late with articles that expressly question the defensibility of ISCT’s hypernorms. This article builds on recent efforts by Donaldson and Scherer to bridge their accounts by providing discursive foundations to the hypernorms at the heart of the ISCT framework. Extending prior literature, we propose an ISCT* (...) framework designed to retain ISCT’s practical virtue of managerial guidance while answering the demands of Scherer and Palazzo’s discursive account. By subscribing to a suitable portfolio of discursively justified hypernorms, we argue, companies unlock the valuable moral guidance of ISCT*, which says to treat these hypernorms as unequivocal outer bounds to the pursuit of business and as a starting point to tailor local norms through discursive stakeholder engagement. The article explores the moral conflict between individual animal rights and the value of species conservation, using the culling of kangaroos to save earless dragons in Australia as a case study. The author argues that species do not possess nonderivative final value and thus cannot justify the infringement of individual rights. While recognizing the instrumental and contributory value of species, the paper rejects philosophical arguments that claim species have nonderivative value, such as the replication argument and the last person argument. The Patients’ Rights and Duties Act, promulgated in Chile in 2012, has made the informed consent process a critical step to respect the patient’s autonomy. It is then relevant to test health workers’ knowledge of the subject, especially in the surgery department. We carried out a quantitative study on 90 specialists from the surgery department in a public tertiary hospital, to whom a questionnaire was administered to test their knowledge of informed consent. This paper discusses the introduction of fraudulent “molecular detector” technology into Mexico. The case is used to argue that contemporary science and technology studies’ approaches to scientific policy-making make basic assumptions about the societies they operate in that are inconsistent with the Mexican context. This paper also argues that contrary to what happens in the so-called Global North, the relative power of Mexican science in government and policy circles is as much limited by its relatively weak position as much as (...) it is by self-censorship and unrealized impact in the country’s fragile democracy. The case is also used to highlight the necessity for more politically involved scientific institutions in Mexico, as these become critical safeguards against incoming destabilizing technologies from more powerful nations into the local “peripheral” context. Patient narratives from two investigational deep brain stimulation trials for traumatic brain injury and obsessive‐compulsive disorder reveal that injury and illness rob individuals of personal identity and that neuromodulation can restore it. The early success of these interventions makes a compelling case for continued post‐trial access to these technologies. Given the centrality of personal identity to respect for persons, a failure to provide continued access can be understood to represent a metaphorical identity theft. Such a loss recapitulates the pain of (...) an individual's initial injury or illness and becomes especially tragic because it could be prevented by robust policy. A failure to fulfill this normative obligation constitutes a breach of disability law, which would view post‐trial access as a means to achieve social reintegration through this neurotechnological accommodation. Dystonia is a movement disorder that can have a debilitating impact on motor functions and quality of life. There are 250,000 cases in the United States, most with childhood onset. Due to the limited effectiveness and side effects of available treatments, pediatric deep brain stimulation has emerged as an intervention for refractory dystonia. However, there is limited clinical and neuroethics research in this area of clinical practice. This paper examines whether it is ethically justified to offer pDBS to children with (...) refractory dystonia. Given the favorable risk-benefit profile, it is concluded that offering pDBS is ethically justified for certain etiologies of dystonia, but it is less clear for others. In addition, various ethical and policy concerns are discussed, which need to be addressed to optimize the practice of offering pDBS for dystonia. Strategies are proposed to help address these concerns as pDBS continues to expand. (shrink)

Psychiatry is rapidly adopting digital phenotyping and artificial intelligence/machine learning tools to study mental illness based on tracking participants’ locations, online activity, phone and text message usage, heart rate, sleep, physical activity, and more. Existing ethical frameworks for return of individual research results (IRRs) are inadequate to guide researchers for when, if, and how to return this unprecedented number of potentially sensitive results about each participant’s real-world behavior. To address this gap, we convened an interdisciplinary expert working group, supported by (...) a National Institute of Mental Health grant. Building on established guidelines and the emerging norm of returning results in participant-centered research, we present a novel framework specific to the ethical, legal, and social implications of returning IRRs in digital phenotyping research. Our framework offers researchers, clinicians, and Institutional Review Boards (IRBs) urgently needed guidance, and the principles developed here in the context of psychiatry will be readily adaptable to other therapeutic areas. Con apoyo de algunas ideas de Deleuze y Guattari, así como de Schérer y Hocquenghem, a la par de fragmentos de novelas, se busca establecer una crítica a las nociones de ontología y libertad establecidas en torno a la infancia (...) por la modernidad. In ways accentuated by the global coronavirus pandemic, corporations constitute vital instruments of the acts of beneficence needed by the people of the world to make progress in public health and increase collective and individual well-being. This article contributes to understanding the variety of moral forces that may lead corporations to commit acts of beneficence, including Friedman’s business case for corporate beneficence, the duty of beneficence as developed by business ethicists, and Dunfee’s social contract account of corporate obligation. Whereas Mejia (...) recently contributed to scholarship on corporate beneficence by expressly adopting shareholder primacy’s conception of corporate governance, this article embraces a stakeholder-oriented, managerialist picture of corporate governance. I extend the literature on beneficence by incorporating what I argue is the intuition underlying Dunfee’s contractualist formula of minimal contribution, namely that management’s duty to do good is awakened and unshackled to the extent management judges the corporation can afford to commit acts of beneficence, all stakeholders considered. The all-stakeholders-considered case for corporate beneficence compels management to act, I argue, when inaction would undermine the moral integrity of managers personally committed to promoting the well-being of humanity. Versions and extensions of intuitionistic and modal logic involving biHeyting and bimodal operators, the axiom of constant domains and Barcan's formula, are formulated as structured categories. Representation theorems for the resulting concepts are proved. Essentially stronger versions, requiring new methods of proof, of known completeness theorems are consequences. A new type of completeness result, with a topos theoretic character, is given for theories satisfying a condition considered by Lawvere . The aim of this work is to respond to the following question: how did Charles S. Peirce find unity for his pragmatist philosophy through the formulation of Scholastic Realism? The author proposes the said doctrine to be a reading guide, leading us through the different stages of Peirce's work as a philosopher. By understanding his realist doctrine, we can see why he believed it was a viable theory for understanding the problem of Universals. This book demonstrates why, in Peirce's mind, (...) such a problem has pervaded the history of philosophy. The author's line of argument reveals that Scholastic Realism is crucial to the understanding of his philosophy, which is a new approach in Peirce scholarship. It provides a useful framework for asking questions about reality in the same way that Peirce himself did. As a result, the author shows that Peirce's realism addresses different yet related philosophical problems, leading Peirce to brand the final version of his philosophy as «Scientific Metaphysics». The conclusion offers an interpretation of the Scholastic Realism principle as a solution to Peirce's concerns - a useful idea to achieve a better theory of reality in his struggle to realize metaphysics a posteriori. Peirce's doctrine is presented alongside some of its uses, especially in the fields of abstraction theory, and also in the fundamental principles of mathematics. This work should advance our comprehension of the problems related to Peirce's philosophy as well as shedding light on pragmatism and its origins as well as the battle between realism and nominalism. Este artículo se propone dilucidar algunos aciertos y errores respecto a la concepción de la cosa en sí schopenhaueriana, a través de un análisis desde su filosofía hacia algunas lecturas del idealismo trascendental de Kant. Con esto se espera sostener la hipótesis según la cual Schopenhauer parece interpretar la cosa en sí bajo un punto de vista idealista dogmático “pre-kantiano” o “a-crítico” equiparable a un realismo trascendental, lo que trae consecuencias importantes tanto para su afirmación de ser el único heredero (...) del idealismo trascendental de Kant, así como para su metafísica de la voluntad de vivir y sistema ético pesimista. El objetivo de este artículo es realizar un recorrido sobre la tramitación parlamentaria de la Ley Orgánica 8/2021, de 4 de junio,de protección integral a la infancia y adolescencia frente a la violencia. Se reflexionará sobre el olvido inicial de los y las menores víctimas de violencia de género ysu primer impulso de dar entrada a aquellos planteamientos en los que se pone la atención en la protección del interés superior de la infancia y adolescencia en los casos de ruptura (...) familiar, escondiendo los daños sufridos por la infancia y adolescencia derivados de la violencia de género. Mostraremos cómo, para paliar los daños derivados de la “alta conflictividad” provocada por la ruptura familiar, se está asentando jurisprudencialmente la coordinación de parentalidad. Mediante un análisis jurisprudencial, comprobaremos cómo este método de resolución de conflictos se aplica en contextos de violencia de género, con el objetivo de restablecer o normalizar la relación del padre que ejerce violencia de género con sus hijos e hijas. Mostraremos cómo, para paliar los daños derivados de la «alta conflictividad», se está asentando jurisprudencialmente la (...) coordinación de parentalidad. Mediante un análisis jurisprudencial, comprobaremos cómo este método de resolución de conflictos se aplica en contextos de violencia de género, con el fin último de restablecer o normalizar la relación del padre que ejerce violencia de género con sus hijos e hijas. El objetivo de este artículo es realizar una revisión de la categoría jurídica de Patria Potestad definida por nuestro Código Civil, analizando los valores que la sustentan, desde un posicionamiento feminista y desde la perspectiva de los derechos de las personas menores de edad. Para este examen se efectuará un recordatorio sobre el origen de la Patria Potestad, conectándolo con el nacimiento del patriarcado moderno, diseñado a través del contrato social de Rousseau. Comprobaremos cómo las construcciones ideológicas sobre la familia (...) que cimentaron el surgimiento de la Patria Potestad y su posterior vida se mantienen en la actualidad, escondiéndose tras las resistencias de los operadores jurídicos, en la aplicación de la suspensión del ejercicio de la patria potestad al padre que ejerce violencia de género. Social and cultural contexts influence power dynamics and shape gender perceptions, roles, and decisions regarding the management of agrobiodiversity for dealing with and adapting to climate change. Based on a feminist political ecology framework and a mixed method approach, this research performs an empirical analysis of two case studies in the northern of India, one in the Himalayan Mountains and another in the Indian-Gangetic plains. It explores context-specific influence of gender roles and responsibilities on on-farm agrobiodiversity management gendered expertise and (...) knowledge related to agrobiodiversity and gendered preferences for practices and institutional arrangements for agrobiodiversity conservation linked to adaptation to climate change. In the Himalayan mountains women actively participate in crop and seed management decisions and tasks, and maintain informal institutions for seed and services exchanges in the case of crisis, which simultaneously favours high levels of agrobiodiversity and enhances women’s social status. By contrast, in the Indio-Gangetic plains, where women from better-off households are socially secluded and women from poorer households work mainly as labourer to respond to high out-migration of men, they exercise less public control over agrobiodiversity, with their role being mainly invisible at the homestead and related to post-production tasks. We finally discuss as improved understanding of the links between gendered spaces, crops, tasks, social status, and agrobiodiversity management can facilitate the design of gender-sensitive policy interventions for conservation and adaptation to climate change. We estimate that 208,000 deep brain stimulation (DBS) devices have been implanted to address neurological and neuropsychiatric disorders worldwide. DBS Think Tank presenters pooled data and determined that DBS expanded in its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. The DBS Think Tank was founded in 2012 providing a space where clinicians, engineers, researchers from industry and academia discuss current and emerging DBS technologies and logistical and ethical issues facing the field. (...) The emphasis is on cutting edge research and collaboration aimed to advance the DBS field. The Eighth Annual DBS Think Tank was held virtually on September 1 and 2, 2020 (Zoom Video Communications) due to restrictions related to the COVID-19 pandemic. The meeting focused on advances in: (1) optogenetics as a tool for comprehending neurobiology of diseases and on optogenetically-inspired DBS, (2) cutting edge of emerging DBS technologies, (3) ethical issues affecting DBS research and access to care, (4) neuromodulatory approaches for depression, (5) advancing novel hardware, software and imaging methodologies, (6) use of neurophysiological signals in adaptive neurostimulation, and (7) use of more advanced technologies to improve DBS clinical outcomes. There were 178 attendees who participated in a DBS Think Tank survey, which revealed the expansion of DBS into several indications such as obesity, post-traumatic stress disorder, addiction and Alzheimer’s disease. De entre los muchos problemas con los que se encuentra la etnia gitana a la hora de convivir en sociedad, la escuela debería ser el menor. Sin embargo, las actitudes de desconocimiento, que dan lugar a reacciones xenófobas, se repiten en este contexto. El hecho de que muchos de los integrantes de la etnia gitana no consigan el Graduado Escolar, sumado a la cantidad de prejuicios a los que están sometidos, no hace sino aumentar la brecha de exclusión social de (...) esta etnia. A las y los gitanos se les culpabiliza desde todos los ámbitos, políticos, culturales y desde la propia escuela, de su no integración, de su desinterés, etc., sin atender a las diferencias sociológicas y culturales que presenta esta etnia con respecto al grupo de población mayoritaria. The literature on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises concerns that these technologies may affect personality, mood, and behavior. We conducted semi-structured interviews with researchers (n = 23) involved in developing next-generation DBS systems, exploring their perspectives on ethics and policy topics including whether DBS/aDBS can cause such changes. The majority of researchers reported being aware of personality, mood, or behavioral (PMB) changes in recipients of DBS/aDBS. Researchers offered varying estimates of the frequency of PMB changes. A (...) smaller majority reported changes in personality specifically. Some expressed reservations about the scientific status of the term ‘personality,’ while others used it freely. Most researchers discussed negative PMB changes, but a majority said that DBS/aDBS can also result in positive changes. Several researchers viewed positive PMB changes as part of the therapeutic goal in psychiatric applications of DBS/aDBS. Finally, several discussed potential causes of PMB changes other than the device itself. (shrink)
