The paper has three main sections. The first is concerned with developing the idea of a democratic system of rights. The second section turns, then, to constructing an idea of economic justice suitable to such a system. The paper concludes, in its final section, with a brief reflection on and assessment of the general line of argument taken.

In the first section of this paper, I articulate Jaegwon Kim's argument against emergent down ward causation. In the second section, I canvas four responses to Kim's argument and argue that each fails. In the third section, I show that emergent downward causation does not, contra Kim, entail overdetermination. I argue that supervenience of emergent upon base properties is not sufficient for nomological causal relationsbetween emergent and base properties. What sustains Kim's argument is rather the claim that emergent properties realized (...) by base properties can have no causal powers distinct from those base properties. I argue that this is false. The essays in this 1987 volume are concerned with ideas of contrarity and other kinds of polar opposition in French literature of the eighteenth century. Originally these ideas were merely part of an impulse to undermine the establishment, but as the century progressed the desire to invert social values and question accepted norms merged with the main groundswell of the age to form part of the movement of Revolution. He also explores minor genres such as opéras comiques, theatrical parodies, and erotic or pornographic pieces; these have been largely forgotten, but in their time they imbued the creative life of the era with vitality. This article argues that secularism is not neutral. Secularization is a process, the secular state is a structure, whereas secularism is a political philosophy. Secularism takes two main forms: first, a “benevolent” secularism that endeavours to treat all religious and nonreligious belief systems even-handedly, and, second, a “hostile” kind that privileges unbelief and excludes religion from the public sphere. I analyze the European Court of Human Rights decision in Lautsi v Italy, which illustrates these types. The article concludes that secularism (...) as a political philosophy cannot be neutral, and the secular state is not neutral in its effects, standpoint, governing assumptions or treatment of religious truth claims. The underdetermination of intentional explanation by motor behavior complicates inferences drawn from preserved artifacts in the archaeological record to intentions in their production. Without knowledge of a producer's intentions, inferences drawn from those intentions to required cognitive abilities for having those intentions is also complicated.

Of course, music performance has a long “artisanal” history. After all, the training of musicians to perform has been the mainstay of academies and conservatoria for centuries. But the discipline of music performance as part of an academic musicology is a much more recent invention. We argue that it arises some time in the 1960s, when scholars could begin to write comparative histories of performance and think difference choices as to performance style. Against the now sterile authentic/non-authentic, modern/post-modern debates that (...) characterise contemporary music studies, we propose that the various approaches might be classified according to the three Lacanian registers of the Imaginary, the Symbolic and the Real. We put forward a certain “Real” at stake in performance, although it could never be the basis of any practice, musical manifesto or even properly belong to a history of music performance. (shrink)

The sentence that comprises 5.31.5 in Caesar's Bellum Gallicum has long been felt to be problematic. It was deleted entirely by H. Meusel. A. Klotz posited a lacuna after quare. Others sought smaller adjustments. Yet, the defence of the text as transmitted also drew advocates and the debate quietened. The current Teubner edition, by W. Hering in 1987, prints the transmitted text and does not acknowledge the debate in the apparatus criticus. I propose a new solution, one that reinterprets the (...) sentence in context and requires a small textual change from et to nec. I will first set the context and identify problems with the conventional understanding of 5.31.5. (shrink)

An analysis and assessment of Nietzsche's metapsychology. Nietzsche is neither a dualist nor a physical reductionist about the mind. Instead, he is best interpreted as thinking that the mind is embodied and embedded in a larger natural and social environment with which it is dynamically engaged.

This article explores the recurrent global claim by indigenous peoples for their spiritual concerns to be taken seriously and given appropriate effect in public policy. The secular liberal state's commitment to ideals of religious neutrality and equal treatment of all faiths and none is clearly tested to the degree it privileges traditional indigenous religion in the name of fostering indigenous culture. This dilemma has been acutely raised in New Zealand where Maori metaphysical concerns—the appeasement of taniwha (spiritual monsters) and the (...) evils of mingling the mauri (life-force) of human and non-human species in genetic engineering—have been subjected to judicial scrutiny. Quite apart from issues of justiciability, the legal acknowledgment of indigenous spirituality raises questions about the continued secularity of the state. This essay traverses the varying responses to indigenous spirituality, especially criticisms that such recognition constitutes government countenancing of primitive superstition, a fostering of paganism or naked religious favouritism. Wind turbine noise is annoying and has been linked to increased levels of psychological distress, stress, difficulty falling asleep, and sleep interruption. For these reasons, there is a need for competently designed noise standards to safeguard community health and well-being. The authors identify key considerations for the development of wind turbine noise standards, which emphasize a more social and humanistic approach to the assessment of new energy technologies in society.

This essay is an analysis of a series of writings by the Australian intellectual historian Ian Hunter on the subject of 'theory'. It examines the methodological issues raised by attempting to write a history of theory. The essay particularly seeks to analyse the various aporias at stake in Hunter's project: between the empirical and the transcendental, between history and the event, and between theory and 'empirical' history.

It would make a wonderful musical study – perhaps someone has already done it – to compare the various operatic and instrumental versions of the famous myth of Orpheus and Eurydice. [...] We know all too well the anxiety question par excellence, the disquieting “ Che vuoi? ” traversing our symbolically embedded lives. So, let me indulge a bit in this uncanny zone and ask: “ Che vogliamo? ”, what is our goal with this issue? Why did we start this (...) project? Robots try to figure out the difference between facts and opinions.

This article offers a detailed response to a recent article in this Journal by Charles Robertson titled “A Thomistic Analysis of Embryo Adoption.” A careful review of important terminology that is used in both Donum vitae and Dignitas personae was undertaken, and a summary is included to help define frequently misleading and even mistaken concepts and terms that can often lead to erroneous conclusions. This article focuses on Donum vitae I.3 and n. 2275 of the Catechism of the Catholic Church, (...) which provide strong magiste­rial support for the liceity of embryo transfer and, ultimately, for the morality of embryo adoption as the only moral solution for “orphaned” embryos. The conclusion offers a faithful interpretation and resolution of the difficult passages in Donum vitae I.5 and Dignitas personae n. 19 regarding the magisterial liceity of both embryo transfer and embryo adoption. Here we review 37 modern neuroimaging studies in an attempt to address this question posed by Halstead (1947) as he and other icons of the last century endeavored to understand how brain and behavior are linked through the expression of intelligence and reason. Reviewing studies from functional (i.e., functional magnetic resonance imaging, positron emission tomography) and structural (i.e., magnetic resonance spectroscopy, diffusion tensor imaging, voxel-based morphometry) neuroimaging paradigms, we report a striking consensus suggesting that variations in a distributed network predict (...) individual differences found on intelligence and reasoning tasks. We describe this network as the Parieto-Frontal Integration Theory (P-FIT). The P-FIT model includes, by Brodmann areas (BAs): the dorsolateral prefrontal cortex (BAs 6, 9, 10, 45, 46, 47), the inferior (BAs 39, 40) and superior (BA 7) parietal lobule, the anterior cingulate (BA 32), and regions within the temporal (BAs 21, 37) and occipital (BAs 18, 19) lobes. White matter regions (i.e., arcuate fasciculus) are also implicated. The P-FIT is examined in light of findings from human lesion studies, including missile wounds, frontal lobotomy/leukotomy, temporal lobectomy, and lesions resulting in damage to the language network (e.g., aphasia), as well as findings from imaging research identifying brain regions under significant genetic control. Overall, we conclude that modern neuroimaging techniques are beginning to articulate a biology of intelligence. We propose that the P-FIT provides a parsimonious account for many of the empirical observations, to date, which relate individual differences in intelligence test scores to variations in brain structure and function. Moreover, the model provides a framework for testing new hypotheses in future experimental designs. (shrink)

An argument is developed for the conclusion that certain neurological conditions and disorders are directly relevant for understanding the self?'s embodiment and the ownership of conscious experience enjoyed by such an embodied self. Since these neurological conditions and disorders provide evidence that there can be shifts of, and compromises to, ownership, they help identify neural substrates and realizers of such ownership. However, even if recent neuroimaging and neuropsychological nominees for neural substrates of ownership unity are core realizers of ownership, they (...) are not its total realizers. Implications of the distinction between core and total realizers are discussed. (shrink)

The most compelling evidence for Epstein et al.'s central thesis that adult second language acquisition is constrained by the innate cognitive structures that constrain native language acquisition would be evidence of poverty of the stimulus. Although there are studies that point to such evidence, Epstein et al.'s primary form of argumentation, targetlike performance by second-language acquiring adults, is much less convincing.
