While National Human Rights Institutions are widely regarded as particularly promising tools in the emerging transnational regime for the regulation of business and human rights, we still know little about their potential and actual contribution to this field. This article bridges the gap between business and human rights research and NHRI scholarship, proceeding in three steps: Firstly, I analyze the structural conditions for NHRIs to tackle business-related human rights abuses effectively, focusing on the key conditions of legitimacy and competences. Secondly, (...) I examine the envisaged role and functions of NHRIs in business and human rights regulation according to the Paris Principles and the UN Guiding Principles. Thirdly, I reconstruct and critically assess NHRIs’ mandates and powers to address corporate human rights abuse, based on the analysis of surveys and reports. I argue that there is a significant mismatch between the essential structural conditions for effective NHRI engagement with business and human rights, the expected contribution of NHRIs to the prevention and remedy of corporate human rights abuses, and the limitations of their mandates and powers in practice. To overcome that misalignment and unlock NHRIs’ full potential, this article proposes a reform of the Paris Principles which would provide these institutions with a robust source of international legitimacy and increase the pressure on state governments to extend their powers. Recently, an increasing number of scholars have been showing interest in old-fashioned racism again. While recent studies on old-fashioned racism apparently increase our knowledge of this psychological theory of racism, the studies actually shed light on a different type of racism, namely offensive racism. The aim of this text is to argue that psychological theories of racism, like old-fashioned racism and modern racism, depend on societies’ social norms. I will show that questionnaires are highly sensitive to social norms, and if (...) there is change in social norms, the original measurement object alters. The theory of old-fashioned racism implicitly assumes agents that follow (or conform to) the social norm to behave prejudiced. Today, however, this social norm does not exist in Western societies. If agents express the same prejudices today, they indicate their willingness to breach the social norm to behave unprejudiced. Thereby, classic old-fashioned racism measures reflect a new kind of racism today. (shrink)

This paper presents a dynamic perspective in which the psychological contract is treated as a structured set of beliefs that are held by individual employees about the mutual obligations of the organization as employer and themselves as employees. This set of beliefs is assumed to produce a state of commitment to the organization in which the employee is willing to accept work roles and tasks offered by the organization, and to carry them out in accordance with certain standards. The dynamic (...) model that is presented can help to explain why the commitment of employees remains relatively stable over time, and why it may suddenly decrease or increase under circumstances that are perceived as critical by the employee. The model assumes that the employee's evaluation of the organization's behavior changes over time, but that the structure of the psychological contract and the associated commitment change only when certain limits are overstepped. This perspective on changes in the psychological contract transforms the concept into a powerful construct that may lead to fruitful research on the dynamics of organization-employee relationships. Can we hold agents responsible for their implicitly biased behavior? The aim of this text is to show that, from the nurturing stance, holding subjects responsible for their implicitly biased behavior is justified, even though they are not blameworthy. First, I will introduce the nurturing stance as Daphne Brandenburg originally developed it. Second, I will specify what holding somebody responsible from the nurturing stance amounts to. Third, I show how and why holding responsible can help a subject develop an impaired (...) capacity. Fourth, I analyze empirical data about holding prejudiced subjects responsible and highlight that the internal motivation to control prejudiced reactions decreases implicit attitudes’ influences. Furthermore, the data show that in order to be appropriate moral demands have to acknowledge the target's autonomy and competence. In sum, from the nurturing stance, holding implicitly biased subjects responsible is appropriate if they can adequately respond to the moral demands. (shrink)

Degree-sentences, i.e. sentences that seem to refer to things that allow of degrees, are widely used both inside and outside of philosophy, even though the metaphysics of degrees is much of an untrodden field. This paper aims to fill this lacuna by addressing the following four questions: [A] Is there some one thing, such that it is degree sensitive? [B] Are there things x, y, and z that stand in a certain relation to each other, viz. the relation that x (...) has more y than z? [C] In those cases in which degree sentences do not refer to phenomena that are degree sensitive, what is responsible for their prima facie seeming to do so? [D] If there are degree sensitive things, to which ontological categories do they belong? We answer each of these questions by arguing that there are, metaphysically speaking, different phenomena that degree sentences refer to: some refer to determinates that emanate from a certain determinable, others to tokens that are instantiations of a certain type, and yet others to what we call ‘complex, resultant properties that are constituted by stereotypical properties’. Finally, we show the relevance of our answers by applying them to the notions of freedom and belief. (shrink)

In social psychology, the concept of implicit attitudes has given rise to ongoing discussions that are rather philosophical. The aim of this paper is to discuss the status of implicit prejudices from a philosophical point of view. Since implicit prejudices are a special case of implicit attitudes, the discussion will be framed by a short discussion of the most central aspects concerning implicit attitudes and indirect measures. In particular, the ontological conclusions that are implied by different conceptions of implicit attitudes (...) will be scrutinized. The main question to be discussed involves whether implicit prejudices are mental states at all, or whether they are rather dispositions to behave in a certain way. This question will be discussed against the background of principles for belief ascription, which requires ascribed mental states to fulfill some specific explanatory role. It is often assumed that trolling is an intentional action. The aim of the paper is to argue for a form of unintentional trolling. Firstly, we outline minimal conditions for intentional actions. Secondly, an unintentional trolling example is introduced. Thirdly, we will show that in some cases, an utterance can be expressive, while it is perceived as descriptive. On the basis of the justification-suppression model, we argue that the introduced trolling example is such a case. In order to bypass social (...) sanctions for expressing prejudices, agents unintentionally express their prejudices through stories that appear to be descriptive. Thereby, the characterized behavior does not fulfill the minimal conditions for intentional action. Fourthly, we give criteria that can be used to identify unintentional trolls. Finally, after unintentional trolling is analyzed, the trolls’ behavioral goals are considered. In conclusion, an analysis of unintentional trolling is given, which has explanatory benefits in contrast to the classic intentional trolling concepts. (shrink)

According to the standard view on the issue, the habit of marking questions with a particular typographical sign in Greek and Latin script does not arise prior to the eighth or ninth century. This period is generally credited with the ‘invention’ of the question mark (excepting Syriac evidence, which points to the fifth and sixth centuries). The purpose of the present article is to correct this view. It argues that the first indication for the use of a typographical sign that (...) marks questions can actually be detected no later than during the reign of Emperor Hadrian (a.d. 117–38), that is, more than half a millennium before the traditional date of the invention. The chief witness is Nicanor of Alexandria, who does not seem to have used question marks himself, but criticizes the misappropriation of another punctuation mark to that purpose. He thus indirectly testifies to the existence of question marks. Comparable traces can also be found later in the exegetical works of some Christian commentators. (shrink)

This article is a discussion of Hume's maxim Nothing we imagine is absolutely impossible. First I explain this maxim and distinguish it from the principle Whatever cannot be imagined (conceived), is impossible. Next I argue that Thomas Reid's criticism of the maxim fails and that the arguments by Tamar Szábo Gendler and John Hawthorne for the claim that “it is uncontroversial that there are cases where we are misled” by the maxim are unconvincing. Finally I state the limited but real (...) value of the maxim: it does help us, in certain cases, reliably to make up our minds. Along the way I show that Reid, his criticism of the maxim notwithstanding, actually employs it, and I furthermore argue that the principle What is inconceivable, is impossible is spurious. (shrink)

Over the last two decades foundationalism has been severely criticized. In response to this various alternatives to it have been advanced, notably coherentism. At the same time new versions of foundationalism were crafted, that were claimed to be immune to the earlier criticisms. This volume contains 12 papers in which various aspects of this dialectic are covered. A number of papers continue the trend to defend foundationalism, and foundationalism's commitment to basic beliefs and basic knowledge, against various attacks. During the Belgian legislative elections on 13 october 1985, the Centre Liégeois d'Etudes de l'Opinion, University of Liège, polled voters leaving the voting booths. The objective was to determine the characteristics of electors of the various parties according to the usual criteria of identification. The motives and wishes of the voters were also recorded. The poll consisted of a representative sample of one thousand French speaking voters in the province of Liège.Most of the article presents the results obtained by cross-tabulating (...) various identifying and motive variables with the political parties. In this way, we measure and demonstrate the relative importance of all the independent variables on the distribution of votes, except for sex which seems have little influence. (shrink)

Recently, psychologists have developed indirect measurement procedures to predict suicidal behavior. A prominent example is the Death/Suicide Implicit Association Test (DS-IAT). In this paper, I argue that there is something special about the DS-IAT which distinguishes it from different IAT measures. I argue that the DS-IAT does not measure weak or strong associations between the implicit self-concept and the abstract concept of death. In contrast, assuming a goal-system approach, I suggest that sorting death-related to self-related words takes effort because death-related (...) words trigger avoidance-impulses, which suicide ideation weakens. The DS-IAT taps into weakened automatic responses from the self-preservation system. Additionally, the suggested cognitive structure, illuminated with the selfish-goal theory, explains predictable suicidal behavior. (shrink)

Can agents overcome unconscious psychological influences without being aware of them? Some philosophers and psychologists assume that agents need to be aware of psychological influences to successfully control behavior. The aim of this text is to argue that when agents engage in a proactive control strategy, they can successfully shield their behavior from some unconscious influences. If agents actively check for conflicts between their actions and mental states, they engage in reactive control. For engaging in reactive control, agents need awareness (...) of those mental states which are in conflict with an action. In contrast, if agents are actively maintaining a goal in consciousness, they engage in proactive control. Proactive control does not consist of conflict detection or conflict resolution. I argue that proactive control explains how agents overcome unconscious psychological influences. In doing so, I claim that consciousness is important for engaging in reactive and proactive control. The theologian Hugo Rahner argued that the homo ludens is a man of ‘Ernstheiterkeit’, a person who can smile under tears but also recognizes the gravity in all earthly cheerfulness. The primary aim of this study was to test the validity of this notion: Do homines ludentes exist? Two hundred sixty-three adult subjects were measured for seriousness and cheerfulness and playfulness. Results provided unequivocal support for Rahner's thesis. Numerous subjects scored high in both seriousness and cheerfulness thus confirming the existence (...) of homines ludentes. It was further found that these subjects were among those scoring highest in playfulness. Subjects scoring high in cheerfulness but low in seriousness were, however, even more closely associated with playfulness. The scores for homines ludentes did not differ from the rest of the subjects in the creative and dynamic facets of playfulness. The importance of developing empirical research to investigate hypotheses derived from non-scientific concepts is discussed. (shrink)

The most widespread and spectacular at this moment is the most recently identified, the so-called bulimia nervosa, characterized by binge eating followed by "purging," sometimes through laxatives or diuretics, more often through self-induced vomiting. Some researchers claim that, in American colleges, at least one third of the female student population (...) is involved to some degree. (Since nine out of ten sufferers are women I will use feminine pronouns in this paper but some undergraduates at Stanford tell me that the epidemic is spreading to male students.) G.M.F. Russell, the first researcher who focused on the specific aspects ofmodern bulimia, is usually presented as the discoverer of a new illness. The title ofhis 1979 publication contradicts this view: "Bulimia Nervosa: An Ominous Variant ofAnorexiaNervosa." And, indeed, all the symptoms he describes had been mentioned before in connection with anorexia (see Bruch). The insurance companies and the medical profession like only welldefined illnesses, and so does the public. We all try to distance ourselves from pathological contamination by giving it a name. Eating disorders are often discussed as ifthey were new varieties ofmeasles or oftyphoid fever. Why distrust the distinction between two illnesses with symptoms as radically opposed as those of anorexia and bulimia? Because we live in a world where eating too much and not eating enough are opposite but inseparable ways ofcoping with the slenderness imperative that dominates 2 René Girard our collective imaginations. Most of us oscillate all our lives between attenuated forms ofthese two pathologies. The man in the street understands perfectly a truth that most specialists prefer not to confront. Our eating disorders are caused by our compulsive desire to lose weight. Most books on the subject acknowledge the universal calorie phobia but somewhat absent-mindedly, as if it could not be the major cause ofa serious illness. How could a fundamentally healthy desire become the cause ofpathological behavior, even ofdeath? Many people would be healthier, no doubt, ifthey ate less. In view of this fact, it is not illogical to suppose that, in anorexia, there must be some motivation other than this healthy desire, some unconscious drive, no doubt, that generates abnormal behavior. By turning anorexia and bulimia into two separate pathologies, the classificators make it easier for us to lose sight of their common basis. The bankruptcy of modern theories The search for hidden motivations is the alpha and omega, ofcourse, of our modern culture. Our number one principle is that no human phenomenon is really what it seems to be. A satisfactory interpretation must rely on one of the hermeneutics of suspicion that have become popular in the nineteenth and twentieth century, or on several ofthese, on a cocktail of soupçon: psychoanalysis, Marxism, feminism, etc. We automatically assume that social phenomena have little if anything to do with what is obvious in them, in this case the rejection offood. In anorexia, psychoanalysts usually diagnose "a refusal of normal sexuality," due to the patient's excessive desire "to please her father," etc. These explanations are still invoked in books being written right now but the voice is growing fainter. Around this sort of thing the smell of mustiness is overpowering. Even in Lacan's own land, the old arrogance is gone. Early in my life, I had an opportunity to observe that the eating practices ofyoung women have nothing to do with a desire to please their fathers. Just before World War II, a pretty cousin of mine was dieting furiously and her father, my uncle, was storming about helplessly, trying to get her to eat more. Fathers, as a rule, are not pleased to see their daughters starve themselves. This particular father was also a physician, at a time when the medical profession had not yet caught the disease it was already trying to cure. The hexagonal structure for ‘the geometry of logical opposition’, as coming from Aristoteles–Apuleius square and Sesmat–Blanché hexagon, is presented here in connection with, on the one hand, geometrical ideas on duality on triangles (construction of ‘companion’), and on the other hand, constructions of tripartitions, emphasizing that these are exactly cases of borromean objects. Then a new case of a logical interest introduced here is the double magic tripartition determining the semi-ring ${\mathcal{B}_3}$ and this is a borromean object again, in the (...) heart of the semi-ring ${{\rm Mat}_{3}(\mathbb{B}_{\rm Alg})}$ . With this example we understand better in which sense the borromean object is a deepening of the hexagon, in a logical vein. Then, and this is our main objective here, the Post-Mal’cev full iterative algebra ${\mathbb{P}_4 = \mathbb{P}(\mathbb{F}_4)}$ of functions of all arities on ${\mathbb{F}_4}$ , is proved to be a borromean object, generated by three copies of ${\mathbb{P}_2}$ in it. This fact is induced by a hexagonal structure of the field ${\mathbb{F}_4}$ . This hexagonal structure is seen as precisely a geometrical addition to standard boolean logic, exhibiting ${\mathbb{F}_4}$ as a ‘boolean manifold’. This structure allows to analyze also ${\mathbb{P}_4}$ as generated by adding to a boolean set of logical functions a very special modality, namely the Frobenius squaring map in ${\mathbb{F}_4}$ . It is related to the splitting of paradoxes, to modified logic, to specular logic. This essay examines the ambiguous role of imagination in Kierkegaard's work, arguing that the concept of imagination is fundamental to his existential transformation of the question of reality.

In social psychology, explicit and implicit attitudes play an important role for behavior prediction and explanation. Edouard Machery claims that attitudes are not mental states but dispositional character traits. The goal of this article is to show that this conceptualization of attitudes comes with two weaknesses: first, the author will show that if attitudes are traits, they are unmeasurable, or if we assume that a part of the trait is measurable, then we do not need the trait-picture, because then the (...) classic attitude-picture is sufficient.
