Pluralism as Inability to Choose In this article I locate Justifying Contract in Europe’s most unique contribution in its rhetorical and methodological commitment to pluralism, which, although Hesselink may disagree, is also a normative and political commitment. Starting from this observation, I then discuss the normative implications of this type of pluralism for the ways in which different reasons are reconciled and reflected in the law. As I argue, it may not be necessary, desirable, or even possible to choose the (...) precise reasons why we support a certain normative answer – say consumer protection is desirable – nor to discard all concerns coming from those supporting the opposite answer – no consumer protection. This implies that ‘reconciliation’ describes better than ‘compromise’ what we need to shape contract law in Europe. In the conclusions, I reflect on what this may mean for the EU and EU Law. As I suggest, the type of pluralism the book evokes and celebrates, if not explicitly theorizes, offers a powerful rejection of accounts that see EU law as dominated by a narrow set of values and normative commitments. Annotated logics were introduced by V.S. Subrahmanian as logical foundations for computer programming. One of the difficulties of these systems from the logical point of view is that they are not structural, i.e., their consequence relations are not closed under substitutions. In this paper we give systems of annotated logics that are equivalent to those of Subrahmanian in the sense that everything provable in one type of system has a translation that is provable in the other. Moreover these new systems (...) are structural. We prove that these systems are weakly congruential, namely, they have an infinite system of congruence 1-formulas. Moreover, we prove that an annotated logic is algebraizable (i.e., it has a finite system of congruence formulas,) if and only if the lattice of annotation constants is finite. (shrink)

The discussion on ethical issues, it is said, should not be confined to experts but should be extended to patients and local communities, because of the real need to engage stakeholders and non‐stakeholders alike not only in carrying out any biomedical research project, but also in the drafting and legislation of bioethics instruments. Several local and inter‐country consultations have already been conducted in furtherance of this goal, but there is much left to be desired in them. The consultations may have (...) helped in articulating local principles, but not in making the instruments embody these principles. As such, instruments turn incompossible, i.e. the principles and actions they legitimate are not performable. In an ethnographic study conducted in the Philippines, for example, paragraphs 29 and 30 of the Declaration of Helsinki and CIOMS guidelines 8 and 15 are construed as not only contradictory to one another but also to local principles. This problem can be solved by taking deliberate steps to ensure that consultations are grounded in ethnographic data about local principles, which the instruments would embody. A steering committee can be of help in gathering ethnographic data, in conducting consultations at the local level, and in providing a venue for discourse on various bioethical issues. (shrink)

The article examines Kant's notion of conceptual extension in order to determine a conception of predication that could integrate, in a coherent fashion, basic theoretical commitments of general logic as he conceived it and the central tenets of his transcendental logic. After a brief overview of the several characterizations of thatnotion in the Kantian corpus, I distinguish three interpretative models concerning it in the literature. Such models are criticized and their prospects of integrating Kant's commitments in a fully satisfactory way (...) are rejected. Finally, I sketch an alternative account of Kant's notion of conceptual extension, which respects the criteria of adequacy that guided the examination of the former models. It points, on its turn, to a revaluation of Kant's notion of conceptual content. (shrink)

In [3], O. C. García and W. Taylor make an in depth study of the lattice of interpretability types of varieties first introduced by W. Neumann [5]. In this lattice several varieties are identified so in order to distinguish them and understand the fine structure of the lattice, we propose the study of the interpretations between them, in particular, how many there are and what these are. The purpose of this article is to analyze the citizenship proposed by Rousseau in light of certain delimitations placed by the philosopher to the exercise of this right, which configure a kind of political participation that would be appropriate to the regime described in the Social Contract. So, I intend to show that popular sovereignty has, for the Genevan writer, a key role in defending the legislation, and that it is up to the Lawgiver and to the magistrates guide citizens (...) in approving the good laws necessary for the State. This thesis is consistent with Rousseau’s republicanism, since it shows that these citizens, members of the social compact, are responsible for protecting and preserving their own freedom throughout the existence of the political body. In this paper we make an algebraic study of the variety of MV*-algebras introduced by C. C. Chang as an algebraic counterpart for a logic with positive and negative truth values.We build the algebraic theory of MV*-algebras within its own limits using a concept of ideal and of prime ideal that are very naturally related to the corresponding concepts in l-groups. The main results are a subdirect representation theorem, a completeness theorem, a study of simple and semisimple algebras, and a (...) characterization of the ideal of infinitesimals as an l-group. In the last section we develop a detailed proof a the one-dimensional theorem of McNaughton, that is, the free MV*-algebra in one generator is the algebra of McNaughton functions over [−1,1]. In contrast with the rest of the paper, this last result is based on work done for MV-algebras. (shrink)

Quais são as causas do descontentamento das pessoas com a política, pergunta-se o filósofo Renato Janine Ribeiro na abertura de O Valor Volta à Política, coletânea de artigos escritos entre 2011 e 2015, num momento de forte otimismo com um país que, após consolidar a democracia, parecia destinado a fortalecê-la e se desenvolver. O retrocesso que o atingiu - assim como a outros países - substituiu a política pelo ódio. Mais que o antipetismo, o maior triunfo desse furor foi (...) a antipolítica. Mas o que aconteceu? Será que a vida política se tronou um efeito da vida econômica? Se a cidadania, em nossos dias, realmente foi substituída pelo consumo, então é a subida ou a queda no nível de vida o principal critério para as pessoas decidirem seus votos? É recorrendo ao tempo longo que Janine vai examinar se o apelo democrático simplesmente se esgotou ou se o que estamos vivendo é uma "reação reacionária" dos ressentidos com um mundo em transformação. Observador atento e afiado, o próprio autor revisita esses anos de efervescência tecendo, em 2021 - portanto após a ascensão da extrema-direita -, comentários aos seus artigos. Dos efeitos da crise financeira de 2008 à contestação da legitimidade das eleições de 2014 - que Janine equivale à abertura de uma caixa de Pandora -, passando pelas manifestações de 2013 e pela ascensão das redes sociais, descortinam-se no fio dos anos visões da política brasileira e os possíveis devires de um passado que perdura no presente. We prove that there are two involutions defined by monadic terms that characterize Monadic Algebras. We further prove that the variety of Monadic Algebras is the smallest variety of Interior Algebras where these involutions give rise to an interpretation from the variety of Bounded Distributive Lattices into it.

This paper criticizes the predominant, representational-neurophysicalist conception of sensory perception. It introduces the notion of "experience-field" to give a tentative ontological account of the phenomenological data of experience. The general idea is that visual experience, for instance, would be ontologically something like an experience-field extending over and between the central nervous sistem of the subject of the experience and the distal object of vision. I call this position phenomenological macrorealism, in contrast to scientific microrealism. Phenomenal qualities are not subjectively inside (...) the brain, but objectively inside perceptual extraencephalic experience-fields, or, as we say, out there in the world. Some specific consequences of phenomenological macrorealism are presented.Este artigo critica a concepção predominante, representacionista-neurofisicalista sobre a percepção sensorial. Introduz a noção de "campo-experiência" na tentativa de tratamento ontológico dos dados fenomenológicos da experiência. A idéia geral é que a experiência visual, por exemplo, seria ontologicamente algo assim como um campo-experiência de intencionalidade visual, que se estende por sobre e entre o sistema nervoso central do sujeito da experiência e o objeto distai da visão. Chamo esta posição de macrorrealismo fenomenológico, em contraste com o microrrealismo científico. Qualidades da fenomenalidade não estão subjetivamente dentro do cérebro, mas objetivamente dentro de campos-experiência perceptuais extra-encefálicos, ou, como dizemos, lá fora no mundo. In The Science of Culture and the Phenomenology of Styles, Renato Barilli examines the history of artistic style in relation to scientific discovery. Applying an innovative analysis, he illustrates the subtle, yet intrinsic, connection between paradigm shifts in the sciences and in the arts. Barilli argues that there are "homologies," or equivalences, between specific discoveries or inventions and revolutionary advances in artistic techniques. An insightful reflection on the historic perspectives of cultural production, The Science of Culture and the Phenomenology of Styles sheds new light on the relationship between visual culture, art, and language. Partindo da ideia de Deleuze que filosofia é criar conceitos, este artigo tem como objetivo apresentar a filosofia afroperspectivista, criando conceitos para articular ensino de filosofia e a educação das relações etnicorraciais. O conceito de denegrir trabalha para problematizar o nascimento da filosofia na busca por uma nova coreografia do pensamento.

Nesse artigo, empreenderemos uma reflexão sobre a analítica do poder em Michel Foucault. Nossa intenção é percorrer a produção foucaultiana a partir de meados dos anos setenta até início dos anos oitenta, buscando compreender os deslocamentos ou “reviravoltas” pelos quais o conceito de poder sofreu ao longo do tempo. Procuraremos mostrar que é possível identificar três momentos na pesquisa de Foucault. Em primeiro lugar, ao tentar se afastar da tradicional compreensão jurídica-discursiva do poder, ele introduz uma análise inédita a respeito (...) da dinâmica do poder disciplinar e dos micropoderes que compõem o campo social. Pode-se considerar esse um deslocamento, de modo geral, em relação à tradição política ocidental. Com o curso Em defesa da sociedade encontramo-nos diante de uma modificação na compreensão do poder, ao identificá-lo como guerra ou luta. Por fim, com a introdução dos conceitos de biopoder/biopolítica, Foucault é levado a uma grande expansão de suas pesquisas, tematizando conceitos que não faziam parte de seu interesse até então, como, por exemplo, o conceito de Estado. É nesse contexto que o conceito de governo fará sua entrada nas reflexões de Foucault. Entendemos que o conceito de governo se configura como um refinamento e, igualmente, deixa mais ampla e complexa sua análise do poder a fim de dar conta do presente político. (shrink)

Nevertheless, the theologian's task to use new languages to reach new fields and ease the dialogue still remains. It is observed as even more complex in a plural scene as the present days. For this reason, the narrative, as a theological language, presents a reading key to Christology, used by the contemporary french theologian, Joseph Moingt. Through this key, it is supposed to give a (...) relevant and convincing answer to the question repeated all the time: who is Jesus of Nazareth and what he means for our relationship with God?
