The most important contemporary development in rhetoric for the theory of argumentation is Jeanne Fahnestock's program of figural logic, the ruling insight of which is that figures epitomize arguments. Working primarily with the antimetabolic formula at the heart of Gregor Mendel's paper “Experiments in Plant Hybridization,” I investigate the figural bases of the logic anchoring this foundational essay in genetics. In addition to antimetabole, the formula also depends crucially on ploche, polyptoton, onomatopoeia, antithesis, synecdoche, reification, and metaphor.

En examinant les discours les plus emblématiques produits par la philosophie moderne au sujet de la peine de mort, notre intention n'est nullement de "peser le pour et le contre" en vue de déterminer quelle position s'avère la plus raisonnable. Assumant d'emblée le point de vue abolitionniste, notre question est la suivante : dans quelle mesure est-il possible de fonder en raison le refus catégorique de la peine capitale? A cet égard, le détour par l'histoire de la philosophie nous montre (...) à quel point cette raison est avant tout divisée contre elle-même. En effet, au terme d'un travail visant à sonder la cohérence interne des partisans de la peine de mort (Locke, Kant, Stuart Mill) ainsi que de ses adversaires (Beccaria, Bentham), il nous est apparu impossible de conclure à un simple défaut de rationalité de la part des uns ou des autres. Ce que l'on constate au contraire, c'est que chaque démonstration se déploie à partir d'un certain nombre de principes éthiques indémontrables. Bien plus, chaque grande philosophie pénale est susceptible de donner lieu à des prises de position radicalement opposées. Mais pour peu que l'on se refuse à concevoir un abîme insurmontable entre la raison d'une part, et ce que d'aucuns nommèrent le "coeur" d'autre part, la philosophie morale peut bénéficier d'une approche dans laquelle le raisonnement et la sensibilité se complètent, au lieu de constituer une alternative. Paradoxalement, c'est dans l'oeuvre de Jean-Jacques Rousseau qu'il nous a semblé possible de repérer les éléments permettant de fonder au mieux l'abolition, tout en évitant le double écueil du rationalisme dogmatique et de l'émotivisme relativiste. The ability to consider and analyze different stakeholder interests is a skill required of today’s business students. This paper describes a 35-minute experiential exercise using Tinkertoys® or Legos® to demonstrate and reinforce the concept of stakeholder management. The exercise, the Tower Building Challenge (TBC), is targeted toward classes in business ethics, strategy, or decision-making and requires students to work in groups to build a tower with the underpinning challenge that each group member has a different interest in how the tower (...) should be built. Student feedback reflects on the difficulty of satisfying all stakeholders when making business decisions, the importance of making the interests of stakeholders transparent to enhance cooperation and the effectiveness of the decision-making process, and the need for stakeholder management when considering business decisions that impact stakeholders. Following this experiential exercise, students’ preliminary understanding presents an opportunity for a deeper discussion of stakeholder management. Specifically, students are prompted to consider stakeholder interests as joint, rather than opposed, when engaged in stakeholder management. (shrink)

This study examines the influence of ethical fit on employee attitudes and intentions to turnover. The results of this investigation provides support for the conjecture that ethical work climate is an important variable in the study of person-organization fit. Ethical fit was found to be significantly related to turnover intentions, continuance commitment, and affective commitment, but not to job satisfaction. Results are discussed in regard to some of the affective and cognitive distinctions among satisfaction, commitment, and behavioral intentions.

The purpose of this study was to determine if there is a relationship between the ethical climate of the organization and the development of person-organization fit. The relationship between an individual's stage of moral development and his/her perceived ethical work environment was examined using a sample of 86 working students. Results indicate that a match between individual preferences and present position proved most satisfying. Subjects expressing a match between their preferences for an ethical work climate and their present ethical work (...) climate indicated that they were less likely to leave their positions. (shrink)

A caged animal in the heart of the city, thousands of miles from its natural habitat, neurotically pacing in its confinement . . . Zoos offer a convenient way to indulge a cultural appetite for novelty and diversion, and to teach us, albeit superficially, about animals. Yet what, conversely, do they tell us about the people who create, maintain, and patronize them, and about animal captivity in general? Rather than foster an appreciation for the lives and attributes of animals, zoos, (...) in Randy Malamud's view, reinforce the idea that we are, by nature, an imperial species: that our power and ingenuity entitles us to violate the natural order by tearing animals from the fabric of their ecosystems and displaying them in an "order" of our own making. In so doing, he argues, zoos not only contribute to the rapid disintegration of our ecosystems, but also deaden our very sensibilities to constraint, spatial disruption, and physical pain. Invoking an array of literary depictions of animals, from Albee's Zoo Story and Virginia Woolf's diaries to the films of Harold Pinter and the poetry of Marianne Moore, Reading Zoos links culture, literature, and nature in an engaging and accessible introduction to environmental ethics, animal rights, cultural critique, and literary representation. There is a class of views about our moral relations with non-human animals that share the idea that animals do not matter directly for ethical purposes: whatever duties or obligations we have with respect to animals are indirect, connected somehow to other duties or obligations – to other human beings, for example – in which the well-being or interests of animals do not figure. Criticisms of indirect duty theories have often focused either upon denying the link that is supposed to (...) exist between how we treat animals and how or whether we discharge other obligations or upon denying that the indirect duty theorist has an adequate account of the animal-related duties we are confident that we have. I shall not pursue either of these options. Instead, I shall argue, first, that there is a tension within the indirect duty theorist’s view that makes it doubtful that anything will enable him to get what he wants from a theory, and second, that even if the necessary link between the way animals and humans are treated is assumed to be present, it will turn out that its best explanation will imply that there are direct duties to animals after all. In this special issue on Jonathan Glover and his applied ethics, I asked Jeff McMahan to review the influence of Questions of Life and Death, published forty years ago in its original version. Jeff McMahan, Glover's former student, has since developed his own ethics of killing. I wanted to know what he had learned from Glover's philosophy, which he recognized as a pioneer in applied ethics.

Several different positions are classified as contractarian. Though there are variations among them, they all include the assumption that practical or action-guiding principles, among which are principles of moral justification and of political legitimacy, somehow have their basis in consent. A contractarian may or may not believe that there are other practical principles that are based on or justified by something besides consent. If he believes there are any others, there will be delicate issues to address as to whether they (...) yield prescriptions incompatible with prescriptions arising from the appropriate kind of consent. Roughly speaking, contractarians could be ordered in terms of the weight that they attach to principles grounded in consent. If we call the appropriate kind of consent contractual, then there are several options available, ranging from the admission of nothing but contract-based principles to the admission of noncontract-based principles that can sometimes conflict with principles based on contract. The pure form of contractarianism which will be our main focus admits only contract-based principles. (shrink)

The Muslim woman wearing the veil, the female anorexic and the from-male-to-female transsexual constitute three different figures that, despite their striking differences, have a common symbolic ground. By focusing on the similarity between the veiled woman and the other two figures, the article sheds a different light on the debate about the Muslim veil in western societies. It is argued that the western notion of woman is based on a structural ambivalence of transcendence and immanence. On the one hand, woman (...) is expected to be liberated, in control and active in public life and in all ways just as free as the man, on the other she represents a deficiency compared to the man; it is expected of her that she takes up a complementary, subordinate position in relation to the man. The subordinate position, however, is seldom pronounced. Officially, the gender hierarchy is not a part of egalitarian societies, that is, the modern configuration that formally rejects a hierarchical worldview. Is this the reason why the three figures are regarded as pathological? Does their way of demonstrating extraordinary transcendence combined with extraordinary immanence make them monstrous? (shrink)

Life threatening emergencies involving infants and children are inherently dramatic, tension-filled situations. It is no wonder, then, that depictions of such events can be found in literature by and about doctors. In many ways, too, such depictions can illuminate key aspects of such events, such as the physician's own anxiety and the tensions between the various people involved, better than the medical literature. Hence it is suggested that the study of literary depictions of pediatric emergencies might be a useful adjunct (...) for those, physicians and other health care providers, who are called upon to manage them. This paper examines the collective fraudulent behaviors taking place during the residential real estate bubble in the United States from 2002 to 2006 and the influence of others’ choices on decision making leading to a herd mentality. The antecedents of collective fraud are discussed in terms of the sociological theory behind human herding and the fraudulent behaviors during the real estate bubble are examined. Using archival witness testimony as a primary basis for analysis, this paper argues that without widespread collective (...) fraud, the bubble may not have developed and the herd mentality may have dissipated without the consequences of financial disaster. The aim of an analysis of this nature is to offer a plausible explanation of some of the preconditions to the event under study. (shrink)

In this introduction to Nehemiah Grew's seminal 17th-century publication The Anatomy of Plants (1682), we discuss the various influences on and impacts of Grew's innovative approach to studying plant life. We offer a review of the current literature on Grew and argue for the importance of his work in its contribution to fields ranging from microscopy to agriculture and from comparative anatomy to scientific illustration. The articles included in this special issue on “The Making of The Anatomy of Plants” are (...) also introduced. We make a case for Grew as a figure of great interest and relevance in our contemporary moment; as plant studies have taken hold in the humanities, historical narratives in the history of science are expanding to include more of the life sciences—a field that, as we show, Grew actively promoted and participated in throughout his tenure at the Royal Society. I. Introduction Two kinds of remedies have traditionally been employed for breach of contract: legal relief and equitable relief. Legal relief normally takes the form of money damages. Equitable relief normally consists either of specific performance or an injunction – that is, the party in breach may be ordered to perform an act or to refrain from performing an act. In this article I will use a “consent theory of contract” to assess the choice between money damages and specific performance. (...) According to such a theory, contractual obligation is dependent on more fundamental entitlements of the parties and arises as a result of the parties' consent to transfer alienable rights. My thesis will be that the normal rule favoring money damages should be replaced with one that presumptively favors specific performance unless the parties have consented to money damages instead. The principal obstacle to such an approach is the reluctance of courts to specifically enforce contracts for personal services. The philosophical distinction between alienable and inalienable rights bolsters this historical reticence, since a right to personal services may be seen as inalienable. I will then explain why, if the subject matter of a contract for personal services is properly confined to an alienable right to money damages for failure to perform, specific enforcement of such contracts is no longer problematic. Finally, I shall consider whether the subject matter of contracts for corporate services is properly confined to money damages like contracts for personal services, or whether performance of corporate services can be made the subject of a valid rights transfer and judicially compelled in the same manner as contracts for external resources. Identifying rhetorical figures with marginal to non-existent lexico-syntactic signatures poses significant challenges for computational approaches reliant upon structural definitions or descriptions. One such figure is prolepsis ([Formula: see text]ó[Formula: see text]), which this essay charts out in some detail, addressing the challenges and the benefits of rendering such figures computationally tractable through the use of argument schemes with attention to metadiscursive or macro-discursive norms offered by pragma-dialectical traditions.

The increasing corporatization of education has served to expose the university as a business—and one with a highly stratified division of labor. This article looks at two strains of urban community organizing, distinguished by philosophy and often by gender, and influenced by the historical division of American society into public and private spheres. The authors compare the well-known Alinsky model, which focuses on communities organizing for power, and what they call the women-centered model, which focuses on organizing relationships to build community. These models are rooted in somewhat distinct traditions and vary along several dimensions, including conceptions of human nature and conflict, power (...) and politics, leadership, and the organizing process. The authors conclude by examining the implications of this analysis and questions for further research and practice. (shrink)

Whether refusal is an act of civil disobedience meant to challenge the state politically as a form of protest, or an action which reflects a deep moral objection to the policies of the state, selective conscientious objection presents the state and its citizens with a number of difficult legal and moral challenges. Appeals to authority outside of the state, whether religious or secular, influence both citizenship and the behavior of the government itself. As Israel raises funds to defend IDF officers (...) from charges of human rights violations in the United Kingdom, it may find itself in need of a better defense against those citizens hesitant to be placed in harm's way, militarily and legally. At some point in the future it may find itself unable to field soldiers for whom service in the Occupied Territories is prohibited by inviolable secular or religious law. And for those who will continue to argue that they cannot abide service in an army of occupation, an expression sounded in 1968 by Yeshayahu Leibowitz, the moral crisis of an individual conscience rent between obligations to the state and obligations to self, will linger along with the pain of a conscience nurtured and then rejected by this democratic society.
