Objective: Symptom improvement is often examined as an indicator of a good outcome of accessing mental health services. However, there is little evidence of whether symptom improvement is associated with other indicators of a good outcome, such as a mutual agreement to end treatment. The aim of this study was to examine whether young people accessing mental health services who meaningfully improved were more likely to mutually agree to end treatment.Methods: Multilevel multinomial regression analysis controlling for age, gender, ethnicity, and (...) referral source was conducted on N = 8,995 episodes of care [Female = 5,469, 61%; meanAge = 13.66 years] using anonymised administrative data from young people's mental health services.Results: Compared to young people with no change in mental health difficulties, those showing positive meaningful changes in mental health difficulties were less likely to have case closure due to non-mutual agreement. Similarly, they were less likely to transfer or end treatment for other reasons than by case closure due to mutual agreement.Conclusion: The findings suggest that young people accessing mental health services whose symptoms meaningfully improve are more likely to mutually agree to end treatment, adding to the evidence that symptom improvement may be appropriate to examine as an indicator of a good outcome of accessing mental health services. I. Introduction Two kinds of remedies have traditionally been employed for breach of contract: legal relief and equitable relief. Legal relief normally takes the form of money damages. Equitable relief normally consists either of specific performance or an injunction – that is, the party in breach may be ordered to perform an act or to refrain from performing an act. In this article I will use a “consent theory of contract” to assess the choice between money damages and specific performance. (...) According to such a theory, contractual obligation is dependent on more fundamental entitlements of the parties and arises as a result of the parties' consent to transfer alienable rights. My thesis will be that the normal rule favoring money damages should be replaced with one that presumptively favors specific performance unless the parties have consented to money damages instead. The principal obstacle to such an approach is the reluctance of courts to specifically enforce contracts for personal services. The philosophical distinction between alienable and inalienable rights bolsters this historical reticence, since a right to personal services may be seen as inalienable. I will then explain why, if the subject matter of a contract for personal services is properly confined to an alienable right to money damages for failure to perform, specific enforcement of such contracts is no longer problematic. Finally, I shall consider whether the subject matter of contracts for corporate services is properly confined to money damages like contracts for personal services, or whether performance of corporate services can be made the subject of a valid rights transfer and judicially compelled in the same manner as contracts for external resources. A caged animal in the heart of the city, thousands of miles from its natural habitat, neurotically pacing in its confinement . . . Zoos offer a convenient way to indulge a cultural appetite for novelty and diversion, and to teach us, albeit superficially, about animals. Yet what, conversely, do they tell us about the people who create, maintain, and patronize them, and about animal captivity in general? Rather than foster an appreciation for the lives and attributes of animals, zoos, (...) in Randy Malamud's view, reinforce the idea that we are, by nature, an imperial species: that our power and ingenuity entitles us to violate the natural order by tearing animals from the fabric of their ecosystems and displaying them in an "order" of our own making. In so doing, he argues, zoos not only contribute to the rapid disintegration of our ecosystems, but also deaden our very sensibilities to constraint, spatial disruption, and physical pain. BackgroundThis paper discusses the contentious issue of reuse of stored biological samples and data obtained from research participants in past clinical research to answer future ethical and scientifically valid research questions. Many countries have regulations and guidelines that guide the use and exportation of stored biological samples and data. However, there are variations in regulations and guidelines governing the reuse of stored biological samples and data in Sub-Saharan Africa including Malawi.DiscussionThe current research ethics regulations and guidelines in Malawi do not (...) allow indefinite storage and reuse of biological samples and data for future unspecified research. This comes even though the country has managed to answer pertinent research questions using stored biological samples and data. We acknowledge the limited technical expertise and equipment unavailable in Malawi that necessitates exportation of biological samples and data and the genuine concern raised by the regulatory authorities about the possible exploitation of biological samples and data by researchers. We also acknowledge that Malawi does not have bio-banks for storing biological samples and data for future research purposes. This creates room for possible exploitation of biological samples and data collected from research participants in primary research projects in Malawi. However, research ethics committees require completion and approval of material transfer agreements and data transfer agreements for biological samples and data collected for research purposes respectively and this requirement may partly address the concern raised by the regulatory authorities. Our concern though is that there is no such requirement for biological samples and data collected from patients for clinical or diagnostic purposes.SummaryIn conclusion, we propose developing a medical data and material transfer agreement for biological samples and data collected from patients for clinical or diagnostic purposes in both public and private health facilities that may end up in research centers outside Malawi. We also propose revision of the current research ethics regulations and guidelines in Malawi in order to allow secondary use of biological samples and data collected from primary research projects as a way of maximizing the use of collected samples and data. Finally, we call for consultation of all stakeholders within the Malawi research community when regulatory authorities are developing policies that govern research in Malawi. (shrink)

It is hypothesized that human faces judged to be attractive by people possess two features—averageness and symmetry—that promoted adaptive mate selection in human evolutionary history by way of production of offspring with parasite resistance. Facial composites made by combining individual faces are judged to be attractive, and more attractive than the majority of individual faces. The composites possess both symmetry and averageness of features. Facial averageness may reflect high individual protein heterozygosity and thus an array of proteins to which parasites (...) must adapt. Heterozygosity may be an important defense of long-lived hosts against parasites when it occurs in portions of the genome that do not code for the essential features of complex adaptations. In this case heterozygosity can create a hostile microenvironment for parasites without disrupting adaptation. Facial bilateral symmetry is hypothesized to affect positive beauty judgments because symmetry is a certification of overall phenotypic quality and developmental health, which may be importantly influenced by parasites. Certain secondary sexual traits are influenced by testosterone, a hormone that reduces immunocompetence. Symmetry and size of the secondary sexual traits of the face (e.g., cheek bones) are expected to correlate positively and advertise immunocompetence honestly and therefore to affect positive beauty judgments. Facial attractiveness is predicted to correlate with attractive, nonfacial secondary sexual traits; other predictions from the view that parasite-driven selection led to the evolution of psychological adaptations of human beauty perception are discussed. The view that human physical attractiveness and judgments about human physical attractiveness evolved in the context of parasite-driven selection leads to the hypothesis that both adults and children have a species-typical adaptation to the problem of identifying and favoring healthy individuals and avoiding parasite-susceptible individuals. It is proposed that this adaptation guides human decisions about nepotism and reciprocity in relation to physical attractiveness. (shrink)

This book calls scholars to avoid the temptation to reduce philosophy into a normative discipline. The author argues that philosophy's main responsibility does not reside in changing the world, but in safeguarding sense and intelligibility against unfounded forms of skepticism.

This article seeks to refine understandings of the governmental logics that comprise and shape urban governance. Drawing on research using ethnographic methods that explore the business improvement district (BID) and the condominium corporation (condo) it is argued that exclusive focus on urban neo-liberalism neglects an urban ”police.” This latter logic is most famously remarked upon in Michel Foucault’s writings as targeting “little things” in urban spaces. Both “police” and the ”free rider problem” it confronts predate and are irreducible to neo-liberalism. (...) Ethnography helps discern this “police” as well as how neo-liberalism relates to it in private urban realms typically hidden from view. Examining BIDs and condos in this way shows that neo-liberalism and “police” co-exist and combine in the governance of urban residential and commercial life. This matters because it reveals a more complex picture of urban governance than is sometimes assumed when neo-liberalism is exclusively invoked and one that is necessarily considered when conceiving of alternative governing arrangements. This is not another "law-and-econ" bashing symposium. Nor is the symposium's title intended to denigrate Chicago School law and economics any more than the term "Post-Keynesian economics" was intended to denigrate the work of John Maynard Keynes. Instead, this symposium marks the fact that many practitioners of law and economics have moved well beyond the stereotypes familiar to most legal academics. Rather than designating an entirely new school of thought, the term "Post-Chicago law and economics" refers to a new era (...) in which a variety of new questions about law and lawmaking is being asked and a variety of promising economic techniques is being used to answer them. Yet most legal academics who, like me, are not part of the law and economics movement are generally unaware of these changes. The purpose of this "Symposium on Post-Chicago Law and Economics" is to bring some of these new methods and questions to the attention of mainstream legal academics and others. The hope is that those who have shunned the economic analysis of law in the past may wish to reconsider their stance in light of what Post-Chicago law and economics has to offer. To facilitate this, the author uses this Foreword to summarize the new directions suggested by each of the symposium contributors, most of whom are practitioners of law and economics. (shrink)

In their important work on locus equations, Sussman and his colleagues have helped to simplify the theoretical problem of how human listeners identify place of articulation contrasts among consonants, but much work remains before this problem is solved.

Life threatening emergencies involving infants and children are inherently dramatic, tension-filled situations. It is no wonder, then, that depictions of such events can be found in literature by and about doctors. In many ways, too, such depictions can illuminate key aspects of such events, such as the physician's own anxiety and the tensions between the various people involved, better than the medical literature. Hence it is suggested that the study of literary depictions of pediatric emergencies might be a useful adjunct (...) for those, physicians and other health care providers, who are called upon to manage them. Religion does not have the tools to help us resist this extinction since it has itself diminished humanity by positing a perfect Other Being, which controls our lives. The author argues that we need to reclaim a sense of ourselves as essentialising animals. Genealogies in philosophy can be tricky and even a little dangerous. Lines of influence and inheritance run much more linearly on paper than in reality. I am often reminded of Robert Frost's "Mending Walls" and the attention that must be paid to what is being walled in and what is being walled out. In other words, William James and Emmanuel Levinas are not natural conversation partners. I have always read James as a fellow traveler of Edmund Husserl, and placed both (...) in a line of thought that might share Franz Brentano and Wilhelm Dilthey as forebears. In this genealogy, Levinas appears with an asterisk, or after one. Maurice Natanson described Husserlian phenomenology as an elderly grandparent who comes down to dinner just a little bit too early, making everyone uncomfortable. Seating Levinas next to James brings to mind some similar scene. What basic premises or positions do James and Levinas share? Is Levinas a Jamesian pragmatist? Is he a radical empiricist? Does James offer an ethics that parallels or even complements Levinas's rigorous ethical phenomenology? (shrink)

COVID-19 pandemic has claimed thousands of lives around the world. Among the casualties are doctors, nurses, and other health care professionals. Those who defy the danger of death and continue to render their services have to deal with psychological and mental stress due to the lack of protective measures and equipment, the overwhelming number of patients, and the experience of discrimination. In fact, some left their job. In this paper, I will argue that the motivation of health care professionals and (...) the outcome of their sacrifices, as against assuring personal safety, can be explained by the principle of the common good. First, they are faithful to their oath as health care professionals since it is their commitment as part of an institution that assumes the responsibility of providing health care to people in need. Second, restoring the patients’ condition goes beyond health issues since the recovery of each COVID-19 patient diminishes the spread of the virus, which, if not for the care of HCPs, could worsen the situation with snowballing consequences to society as a whole. While it is expected for any health care professional as a frontliner in times of pandemic, their motivation to serve exemplifies the greater value for the common good. (shrink)

The man behind the New York Times Magazine ’s immensely popular column “The Ethicist”–syndicated in newspapers across the United States and Canada as “Everyday Ethics”–casts an eye on today’s manners and mores with a provocative, thematic collection of advice on how to be good in the real world. Every week in his column on ethics, Randy Cohen takes on conundrums presented in letters from perplexed people who want to do the right thing (or hope to get away with doing the (...) wrong thing), and responds with a skillful blend of moral authority and humor. Cohen’s wisdom and witticisms have now been collected in The Good, the Bad & the Difference , a collection of his columns as wise and funny as a combination of “Dear Abby,” Plato, and Mel Brooks. The columns are supplemented with second thoughts on (and sometimes complete reversals of) his original replies, follow-up notes on how his advice affected the actions of various letter writers, reactions from readers both pro and con, and observations from such “guest ethicists” as David Eggers and the author’s mom. This study examines the influence of ethical fit on employee attitudes and intentions to turnover. The results of this investigation provides support for the conjecture that ethical work climate is an important variable in the study of person-organization fit. Ethical fit was found to be significantly related to turnover intentions, continuance commitment, and affective commitment, but not to job satisfaction. Results are discussed in regard to some of the affective and cognitive distinctions among satisfaction, commitment, and behavioral intentions.

The most important contemporary development in rhetoric for the theory of argumentation is Jeanne Fahnestock's program of figural logic, the ruling insight of which is that figures epitomize arguments. Working primarily with the antimetabolic formula at the heart of Gregor Mendel's paper “Experiments in Plant Hybridization,” I investigate the figural bases of the logic anchoring this foundational essay in genetics. In addition to antimetabole, the formula also depends crucially on ploche, polyptoton, onomatopoeia, antithesis, synecdoche, reification, and metaphor.

Purpose– This paper aims to demonstrate that computing social issues courses are often being taught by articulating the social impacts of different computer technologies and then applying moral theories to those impacts. It then argues that that approach has a number of serious drawbacks.Design/methodology/approach– A bibliometric analysis of ETHICOMP papers is carried out. Papers from early in the history of ETHICOMP are compared to recent years, so as to determine if papers are more or less focused on social scientific examinations (...) of issues or on ethical evaluations of impacts of technology. The literature is examined to argue the drawbacks of the impact approach.Findings– Over time, ETHICOMP papers have moved away from social scientific examinations of computing to more philosophic and ethical evaluations of perceived impacts of computing. The impact approach has a number of drawbacks. First, it is based on a technological deterministic style of social explanation that has been in disrepute in the academic social sciences for decades. Second, it uses an algorithmic approach to ethics that simplifies the social complexity and uncertainty that is the reality of socio-technological change.Research limitations/implications– The methodology used in this paper is limited in several ways. The bibliometric analysis only examined five years of ETHICOMP papers, while the literature review focused on published computing education research. It is possible that neither of these forms of evidence reflects actual common teaching practice.Practical implications– It is hoped that the arguments in this paper will convince teaching practitioners to modify the way they are teaching computing social issues courses: that is, the authors hope to convince educators to add more focus on the social context of computing.Originality/value– The use of bibliometric analysis in this area is unique. The paper’s argument is perhaps unusual as well. (shrink)

Identifying rhetorical figures with marginal to non-existent lexico-syntactic signatures poses significant challenges for computational approaches reliant upon structural definitions or descriptions. One such figure is prolepsis ([Formula: see text]ó[Formula: see text]), which this essay charts out in some detail, addressing the challenges and the benefits of rendering such figures computationally tractable through the use of argument schemes with attention to metadiscursive or macro-discursive norms offered by pragma-dialectical traditions.

In a time when ethical scandals are commonplace in the media, one begins to wonder just what organizations are doing wrong. This article analyzes the Fall 2006 boardroom spying scandal at Hewlett–Packard to determine whether the workplace deviance observed can be linked to a retaliatory response to organizational power. A summary of the events leading up to, during, and the fall-out of the scandal is reported.

Emotions change over time. A comprehensive understanding of emotions will require that their temporal nature be observed and analysed. By observing emotion over time, one can disentangle and simultaneously analyse temporal variability within individuals and between-individual variability using a two-step process approach. First, within-person temporal patterns (e.g., covariation, lead–lag relation, periodicity, etc.) are assessed for each subject. Second, between-person analyses are conducted on the within-person patterns. These two steps can be done simultaneously with hierarchical linear models (HLM) or in two (...) actual steps with the process approach. HLM is limited to the intra-individual analysis of linear patterns (e.g., slope, intercept), whereas the process approach can be used to examine non-linear aspects of intra-individual change, such as multivariate patterns, within-subject skew, or phase relations between oscillating processes. In this paper we provide a description of the process approach and present several examples of, as well as suggestions for, intra-individual analysis applied to emotion and individual differences. Since the very week of September 11, 2001, commentators have remarked on the apparent clairvoyance evidenced in the novelsof the American writer Don DeLillo. DeLillo’s novels have always represented the Twin Towers as gargantuan symbols of latent catastrophe. The towers have been significant to DeLillo as a particularly gargantuan representation of the manner in which modern mass-consciousness expresses itself in the form of material technologies. Throughout his career, DeLillo has described the World Trade Center not only as a physical structure, (...) but as a kind of schematic of the future of the culture that created it. In the lines and angles of the towers, DeLillo seems to discern the “lines of intentionality” inherent in the culture of advanced technology itself, and traces them out to the conclusions toward which they seem to lead. In this paper, I will examine the manner in which DeLillo has “read” the World Trade Center as an architectural confession of a distinctly American wish to negate the human scale, to make the world over as an artificial environment, and to look forward to the surpassing of bodily and social existence. In four novels written before 9/11, DeLillo crafts an image of the World Trade Center as a sculptural representation of America’s own will to self-destruction and in his most recent novel, Falling Man, DeLillo illustrates the kind of existence that lies on the other side of this self-destruction. The most recent work toward compiling a comprehensive database of adenosine‐to‐inosine RNA editing events suggests that the potential for RNA editing is much more pervasive than previously thought; indeed, it is manifest in more than 100 million potential editing events located primarily within Alu repeat elements of the human transcriptome. Pairs of inverted Alu repeats are found in a substantial number of human genes, and when transcribed, they form long double‐stranded RNA structures that serve as optimal substrates for RNA editing (...) enzymes. A small subset of edited Alu elements has been shown to exhibit diverse functional roles in the regulation of alternative splicing, miRNA repression, and cis‐regulation of distant RNA editing sites. The low level of editing for the remaining majority may be non‐functional, yet their persistence in the primate genome provides enhanced genomic flexibility that may be required for adaptive evolution. The purpose of this study was to determine if there is a relationship between the ethical climate of the organization and the development of person-organization fit. The relationship between an individual's stage of moral development and his/her perceived ethical work environment was examined using a sample of 86 working students. Results indicate that a match between individual preferences and present position proved most satisfying. Subjects expressing a match between their preferences for an ethical work climate and their present ethical work (...) climate indicated that they were less likely to leave their positions. (shrink)

There is a driving need computationally to interrogate large bodies of text for a range of non-denotative meaning (e.g., to plot chains of reasoning, detect sentiment, diagnose genre, and so forth). But such meaning has always proven computationally allusive. It is often implicit, ‘hidden’ meaning, evoked by linguistic cues, stylistic arrangement, or conceptual structure – features that have hitherto been difficult for Natural Language Processing systems to recognize and use. Non-denotative textual effects are the historical concern of rhetorical studies, and (...) we have turned to rhetoric in order to find new ways to advance NLP, especially for sophisticated tasks like Argument Mining. This paper highlights certain rhetorical devices that encode levels of meaning that have been overlooked in Computational Linguistics generally and Argument Mining particularly, and yet lend themselves to automated detection. These devices are the linguistic configurations known as Rhetorical Figures. We argue for the importance of these devices for Argument Mining, especially in collocations, and we present an XML annotation scheme for Rhetorical Figures to make figuration more tractable for computational approaches, particularly with an eye on the improvements they offer Argument Mining. We also discuss the intellectual and technical challenges involved in figure annotation and the implications for Machine Learning. (shrink)

The generalised, automated reconstruction of the reasoning structures underlying persuasive communication is an enormously challenging task. While this work in argument mining is increasingly informed by the rich tradition of argumentation studies outside the computational field, the rhetorical perspective on argumentation is thus far largely ignored. To explore the application of rhetorical insights in argument mining, we conduct a pilot study on the connection between rhetorical figures and argumentation structure. Rhetorical figures are linguistic devices that perform a variety of functions (...) in argumentative discourse. The textual form of some of these figures is easy to identify automatically, such that an established connection between the figure and a preponderance of argumentative content would improve the performance of argument mining techniques. Furthermore, the automated mining of rhetorical figures could be used as an empirical, corpus-based testing ground for the claims made about these figures in the rhetorical literature. In the pilot study, we explore the connection between eight rhetorical figures the forms of which we expect to be relatively easy to identify computationally, and argumentation structure (concretely, we consider the six schemes ‘anadiplosis’, ‘epanaphora’, ‘epistrophe’, ‘epizeuxis’, ‘eutrepismus’, and ‘polyptoton’, and the two tropes ‘antithesis’ and ‘dirimens copulatio’, and relate their occurrences to relations of inference and conflict). The data of the study is collected in the MM2012c corpus of 39,694 words of argumentatively annotated transcripts from the BBC Radio 4’s Moral Maze discussion program. We show that some of the figures indeed correspond to passages of high argumentative density, relative to the text as a whole. (shrink)

Suddendorf & Corballis (S&C) propose that the capacity to flexibly forsee the future was a critical step in human evolution and is accomplished by a set of component processes that can be likened to a theater production. Understanding the brain-bases of these functions may help to clarify the hypothesized component processes, inform us of how and when they are used adaptively, and also provide empirical ways of exploring to what degree these abilities exist and are implemented similarly (or differently) across (...) species. The problem of pursuing and achieving justice in a free society involves three different areas of analysis. First, the types of acts that are to be proscribed must be specified. Part of this analysis is methodological, requiring us to settle on the way in which such questions are to be decided. Second, once an offense has been defined, the remedy for its commission must be determined in a manner that is consistent with the theory of justice that defined the criminal (...) act.
