Intuitively, a speaker who uses slurs to refer to people is doing something morally objectionable even if no one is measurably affected by their speech. Perhaps they are only talking to themselves, or they are speaking with bigots who are already as vicious as they can be. This paper distinguishes between slurring as an expressive act and slurring as the act of causing a psychological effect. It then develops an expression-focused ethical account in order to explain the intuition that slurring (...) involves an effect-independent moral wrong. The core idea is that the act of expressing a morally defective attitude is itselfpro tantomorally objectionable. Unlike theories that focus only on problematic effects, this view is able to shift the moral burden of proof away from victims of slurring acts and onto speakers. It also offers moral guidance with respect to metalinguistic and pedagogical utterances of slurs. (shrink)

In this paper, I explore how to accommodate non-consequentialist constraints with a broadly value-based conception of reasons for action. It turns out that there are two grades of non-consequentialist constraints. The first grade involves attaching ethical importance to such distinctions as the doing/allowing distinction, and the distinction between intended and unintended consequences that is central to the Doctrine of Double Effect. However, at least within the value-based framework, this first grade is insufficient to explain rights, which ground weighty reasons against (...) infringing those rights that need not be outweighed even when infringing those rights is necessary for preventing a larger number of people from having their rights infringed in the same way. Such rights form a second grade of non-consequentialist constraints: within the value-based framework, this second grade is best explained in terms of the intrinsically relational values and disvalues of interpersonal interactions and relationships. This paper argues, first, that the legal construction of transsexualism is a matter of interest, not only to members of the trans community, but to all students of gender, including feminists. The paper then proceeds to explain and analyse, using feminist perspectives, key aspects of the Gender Recognition Act 2004 in the light of the recent caselaw concerning the rights of trans persons. The 2004 Act, it is argued, is a conservative move, which attempts to deny the threat transsexualism poses (...) to the binary system of gender, by instigating a system to formally ‘recognise’ only men and or women. However, the way in which the Act constructs the public/private divide and the mind/body relation carries potential for legal recognition of subject positions which may in a variety of ways be ‘beyond’ the binary system that is currently orthodox. The paper can as such be read as a case study in the legal (re)construction of gender, the gender/sex relation, and the widespread tendency to construct gender conservatively. (shrink)

According a widely held view in the philosophy of mind, property dualism is a respectable theory whereas substance dualism need not be taken seriously. This paper argues that property dualism, as it is usually understood, is incoherent. The commitments that are meant to lead to property dualism actually lead to substance dualism. The argument presented here adds weight to David Chalmers’ suggestion that the serious nonphysicalist options are in fact various kinds of panpsychism and substance dualism. Along the way I (...) offer an account of the substance/property distinction, argue against the existence of substrata as distinct from substances and properties, and describe a new position which I call ‘transcendent panpsychism’. Inicio indicando as influências e desdobramentos sobre a elaboração desta teoria, seguido dos principais conceitos que os autores usarão para tratar o conteúdo semânticodas sentenças. O ponto de partida são operações conjunto-teoréticas, inicialmente através das funções In e Cont. Mas a dificuldade com a adição os leva a especificar o conceito de informatividade semântica por (...) meio das funções cont e m, que avaliam o espaço lógico-probabilístico sentencial. Sendo inversamente definíveis, onde a altaprobabilidade de verdade de uma sentença implica em seu escasso conteúdo informacional. Com isto, os autores introduzem a função inf como a contribuição de uma sentença na identificação de qual descrição-de-estado possível é o caso. Proceeding from the observation by Ryle that I cannot prepare myself for the next thought that I am going to think, I argue that conscious acts cannot control my bodily motions or thoughts. This position is not compatible with indeterminism. I also argue that consciousness represents the irreducible and multi-modal output of the behavioral control system sensors necessary for the control of human behavior demonstrated by Marken . My analysis supports one experimental result obtained by Libet, Gleason, Wright, and Pearl (...) , namely, that the initiation of a "voluntary act" is an unconscious cerebral process. I conclude that the following are not realizable: "mental intentions" acting on the supplementary motor area as postulated by Eccles and Robinson , and "veto," a conscious abort of a motor act after subjects reported "wanting to act" . These two items would seem to be amenable to test by studies similar to or refinements of Libet's. (shrink)

This note examines the decision of the Court of Appeal in Tabernacle v Secretary of State for Defence (2009). The court held that byelaws prohibiting camping on Ministry of Defence land adjacent to the Atomic Weapons Establishment at Aldermaston, Berkshire violated the human rights of women peace protestors under Articles 10 and 11 European Convention on Human Rights. The note argues that this decision calls into question arguments recently made, that the association of women with peace should be abandoned. It (...) also reveals the potential of law to facilitate the performative and transformative production of subject positions, as ‘woman’, which do not depend on or connect with debilitating patriarchal constructions of women as weak or vulnerable. In a number of membrane-bound viruses, ion channels are formed by integral membrane proteins. These channel proteins include M2 from influenza A, NB from influenza B, and, possibly, Vpu from HIV-1. M2 is important in facilitating uncoating of the influenza A viral genome and is the target of amantadine, an anti-influenza drug. The biological roles of NB and Vpu are less certain. In all cases, the protein contains a single transmembrane α-helix close to its N-terminus. Channels can be formed by (...) homo-oligomerization of these proteins, yielding bundles of transmembrane helices that span the membrane and surround a central ion-permeable pore. Molecular modeling may be used to integrate and interpret available experimental data concerning the structure of such transmembrane pores. This has proved successful for the M2 channel domain, where two independently derived models are in agreement with one another, and with solid-state nuclear magnetic resonance (NMR) data. Section I is an account of the origins of what Johnson calls the “Informal Logic Initiative.” Section II discusses how the Informal Logic Initiative connected with the Critical Thinking Movement at the Sonoma State University Conferences starting in 1981. Section III discusses the relationship between logic and critical thinking. Section IV describes “The Network Problem,” which (...) emerged for Johnson in the mid-1980s – largely as a result of his experiences at critical thinking conferences, especially the Sonoma State conference. In his Sermons, Joseph Butler argued for a series of extraordinarily subtle and perceptive claims about the relations between virtue and self-interest. Unfortunately, there has been a great deal of controversy among Butler's interpreters about what exactly these claims amount to, and about what role these claims play in the overall project of his Sermons. Commentators generally agree that the first method is the rationalist method, which Butler almost certainly associated with the work of Samuel Clarke and William Wollaston. The (...) characteristic feature of this rationalist method is that it seeks to discover necessary truths by means of a priori reflection. By contrast, the second method starts out from contingent facts that are known on the basis of empirical observation. So Butler is claiming that the arguments of his Sermons are largely based on the contingent facts of empirical observation. One good way to understand what Butler means is to look at the earlier works of moral philosophy that are clearly influencing him. (shrink)

It is widely assumed that our “evidence” is at least one source of the “justification” that we have for believing things—where this notion of “justification” seems to be a normative notion. More precisely, it seems to be an agential normative notion, evaluating the different possible attitudes that are available to an agent at a time, on the basis of facts that are just “given”—that is, facts that it is not available to the agent to change through the way in which (...) she exercises her reasoning capacities at that time. However, given the meaning that the term “evidence” has in everyday English, what is in this sense “given” to you cannot be identified with your current “evidence”. First, some propositions count as part of the “evidence” that you now have precisely in virtue of the fact that you now believe those propositions; but these beliefs are not part of what is now “given” to you—they are themselves among the attitudes whose justification is in question. Secondly, what is now “given” to you arguably includes facts about what you believed in the past—but such facts cannot naturally be called part of your current “evidence” unless you now know or believe these facts. In fact, it seems, the concept “evidence” does not really belong to individualistic epistemology, but to social epistemology: the function of “evidence” is that it is what we can use to show that something is true to the contextually relevant audience.
