Fish stocks, as common pool resources, are more and more managed by giving fishermen exclusive access rights as Individual Transferable Quotas (ITQ). These have been widely discussed, with focus on social, economic and ecological issues. While equity aspects have been of great concern, there is very limited analysis about how to assess issues of equity and fair distribution when introducing ITQs. This paper applies an existing framework for assessing equity in resource use systems to tradable quota systems in fisheries. The (...) framework defines the perspectives of distributive fairness, the stakeholders who are bound by fair practice rules, and instruments of fairness, and identifies metrics to assess equity in practice. Homology is the similarity between organisms due to common ancestry. Introduced by Richard Owen in 1843 in a paper entitled “Lectures on comparative anatomy and physiology of the invertebrate animals”, the concept of homology predates Darwin's “Origin of Species” and has been very influential throughout the history of evolutionary biology. Although homology is the central concept of all comparative biology and provides a logical basis for it, the definition of the term and the criteria of its application remain controversial. Here, (...) I will discuss homology in the context of the hierarchy of biological organization. I will provide insights gained from an exemplary case study in evolutionary developmental biology that indicates the uncoupling of homology at different levels of biological organization. Es wird der Vorschlag gemacht, das Konzept des psychoanalytischen Arbeitsmodells (Sandler, Tuckett) auf die Erfahrungen der Lehranalyse zu übertragen. Der Autor vergleicht das von Hermann Beland 2020 [2004] beschriebene Modell mit dem eigenen und postuliert eine Besonderheit der Lehranalyse, die er als Dichotomie von »therapeutischer Dimension« und »didaktischer Dimension« formuliert. In der Beschreibung ihrer Verstrickungen wird auf einige ethische Aspekte hingewiesen, die das Ziel der Lehranalyse gefährden können.

Erythropoietin (EPO), long appreciated as the chief endocrine regulator of red blood cell formation, is now recognized to exert many additional functions outside the bone marrow. Thus, the quest is on to define the full range of EPO functions in the physiology and pathology of non‐hematopoietic tissues. Two recent studies in man and mice have highlighted the importance of the mammalian skin as one peripheral tissue with a previously unsuspected role in EPO biology; both, as a target and as a (...) source of EPO. In addition, the skin has been proposed to function as an oxygen sensor. The present hypothesis essay critically reviews the currently available evidence for this and provides a unifying theoretical scenario for intracutaneous EPO functions and for a potential role of the skin in the control of EPO production. Mainly, we propose that the skin itself directly contributes to the up‐regulation of EPO plasma levels in response to hypoxia. (shrink)

Resemblance Nominalism About Perfect Naturalness is the view that perfect naturalness of classes is best defined by a conceptual primitive of resemblance between particulars. The adequacy of RNPN is defended by outlining nominalism as the strictly anti-constitutive view that the particulars’ being the fundamental ways they are is not constituted by anything further, supplying a doubly plural contrastive and graded resemblance predicate that allows for a definition of perfect naturalness on an actualist basis, and proving a representation and a uniqueness (...) theorem on the basis of a formal constraint on resemblance called “the Principle”, thereby revealing that bodies of nominalist resemblance facts are guaranteed to behave as if they were grounded in patterns of universals distributed over particulars. Strong dispositional monism, the position that all fundamental physical properties consist in dispositional relations to other properties, is naturally construed as property structuralism. J. Lowe’s circularity/regress objection constitutes a serious challenge to SDM that questions the possibility of a purely relational determination of all property essences. The supervenience thesis of A. Bird’s graph-theoretic asymmetry reply to CRO can be rigorously proved. Yet the reply fails metaphysically, because it reveals neither a metaphysical determination of identities on a purely relational basis nor (...) a determination specifically of identities in the sense of essences. Asymmetry is thus not by itself sufficient for a solution to CRO. But it cannot even help to answer CRO when a model for the determination of essences is taken as a basis. Nor is asymmetry necessary for a reply, as property structures may well be symmetric. A metaphysics of dispositional properties as grounded in a purely relational structure faces serious obstacles, and the properties would not be fundamental. Since essence and grounding are notions of metaphysical priority, there can be no essentially dispositional metaphysically fundamental properties, and the prospects of a “coherentist” metaphysics of basic properties are dim. A modal retreat that refrains from a post-modal conception of essence and simply claims that fundamental properties play dispositional roles by metaphysical necessity is unsatisfactory. (shrink)

This chapter provides an account of the Kantian theory of value, showing how a plurality of incommensurable values, namely the fundamentally heterogeneous values of morality and prudence, can be integrated into a complete ordering by appealing to the conditionality of the value of happiness, which allows us to explain how the claims of prudence can be silenced by the claims of morality, thereby solving the Sidgwickian problem of the dualism of practical reason. Moreover, it establishes that the Kantian understanding of (...) silencing is the only way of rendering dualism coherent, given that the question as to what one ought to do, considering all the normative demands to which one is subject, requires either that these demands be commensurable, which presupposes monism, or that these demands never conflict, which can only be ensured in principle by means of conditional value structures. Inductive Metaphysics combines an anti-aprioristic emphasis on an empirical and scientific basis for metaphysics with an insistence on a specifically philosophical abductive theory-building. Since the latter specifically philosophical work is not empirical itself, it may in a liberal sense be called apriori. This paper highlights this apriori dimension within IM by a case study on Structuralism, the view that fundamental reality consists of a network of relations, which a number of philosophers consider to be suggested by modern physics. Focussing on (...) Dasgupta’s algebraic Generalism, the author argues that Structuralism suffers from a severe entailment problem, because the relations-spanning apparatus must stand for metaphysically fundamental forms. Schaffer’s contention that there are no entailment problems is rejected. Advocates of IM are well advised to take seriously their own insistence on metaphysical abduction and not to one-sidedly emphasise the empirical input: the elaboration of exact metaphysical theories and the apriori evaluation of their inherent tenability is a constituent of IM no less important than the consideration of scientific input. More traditional ways of metaphysical reasoning inevitably survive as an essential dimension within IM. (shrink)

The mainly medical law and health economics treatise follows the interdisciplinary theoretical approach of health services research. The focus is on managing health care in Germany through minimum numbers of cases. What effects does this concept have on the quality aspect and the needs-based approach to inpatient care. Methodologically, a selective literature search is used. In a comparative analysis between the states of Saxony-Anhalt and Schleswig-Holstein, empirical data are examined. As a result, it can be stated that the actors have (...) experienced a power shift in the health system due to the relevant legislation. In the future, it will be less the hospital planning of the federal states than the intermediary Federal Joint Committee (G-BA) and corporate structural development that will drive the centralization of the care landscape. One hundred and fifty years ago, a hopeful young researcher reported a recent discovery he had made. Working in the bowels of a medieval castle in the German city of Tübingen, he had isolated a then entirely new type of molecule. This was the birth of a field that would fundamentally change the course of biology, medicine, and beyond. His discovery: DNA. His name: Friedrich Miescher. In this article, the authors try to find answers to the question why—despite the fact (...) that virtually everyone nowadays knows DNA—hardly anyone remembers the man who discovered it. In the history of science, the discovery of DNA was a seminal moment. Why then did it not enter into public memory? Ground‐breaking discoveries can occur in a historical context that is not ready to appreciate them. But that's not all that decides who is remembered and who is forgotten. Scientific pioneers sometimes fail to publicize their findings in a way that ensures that they receive the attention they merit. As discussed here, their personalities and habits may cause discoveries to be “overwritten” by more recent researchers, resulting in distorted cultural memories no longer reflecting the initial event. This paper distinguishes bruteness from fundamentality by developing a theory of stochastic grounding that makes room for non-fundamental bruteness. Stochastic grounding relations, which only underwrite incomplete explanations, arise when the fundamental level underdetermines derivative levels. The framework is applied to fission cases, showing how one can break symmetries and mitigate bruteness whilst avoiding arbitrariness and hypersensitivity.

Recently, metaphysical coherentism has been propounded as an alternative to metaphysical foundationalism and infinitism. The view replaces the picture of reality as a hierarchy of levels with that of a network of objects or facts standing in symmetric or, more generally, cyclic relations of metaphysical dependence. This paper defends the orthodox picture of a well-founded hierarchy against the claimed superiority of coherentism. First, it will be argued that alleged theoretical advantages of coherentism do not hold up to scrutiny. Secondly, examples (...) that are claimed to support coherentism are either misdescribed as involving metaphysical interdependence, or foundationalist treatments fare at least as good and often better than coherentist interpretations. Thirdly, a similar diagnosis applies to a recently proposed coherentist interpretation of quantum entanglement. The more general diagnosis is that claims of metaphysical dependence are convincing only if there is a detailed account of how one item metaphysically explains another. While foundationalists can resort to various specific explanatory relations, coherentism seems to be incapable of providing detailed explanations. (shrink)

ABSTRACTOne prestudy based on a corpus analysis and four experiments in which participants had to invent novel names for persons or objects investigated how the valence of a face or an object affects the phonological characteristics of the respective novel name. Based on the articulatory feedback hypothesis, we predicted that /i:/ is included more frequently in fictional names for faces or objects with a positive valence than for those with a negative valence. For /o:/, the pattern should reverse. An analysis (...) of the Berlin Affective Word List – Reloaded yielded a higher number of occurrences of /o:/ in German words with negative valence than in words with positive valence; with /i:/ the situation is less clear. In Experiments 1 and 2, participants named persons showing a positive or a negative facial expression. This paper assesses the role of the Refutation of Idealism within the Critique of Pure Reason, as well as its relation to the treatment of idealism in the First Edition and to transcendental idealism more generally. It is argued that the Refutation is consistent with the Fourth Paralogism and that it can be considered as an extension of the Transcendental Deduction. While the Deduction, considered on its own, constitutes a 'regressive argument', the Refutation allows us to turn the Transcendental Analytic (...) into a 'progressive argument' that proceeds by the synthetic method. In vertebrates, members of the cysteine‐rich protein (CRP) family are characterized by the presence of two LIM domains linked to short glycine‐rich repeats. These proteins mediate protein–protein interactions and are of fundamental importance for cell differentiation, cytoskeletal remodeling, and transcriptional regulation. To date, a vast amount of information about vertebrate CRPs has become available, including their biological functions, interacting partners, and three‐dimensional structures. Compatible with a molecular adapter role, structural data reveal that the LIM domains within these proteins represent completely (...) independent folded units bridged by flexible linker regions. The physiological roles for individual CRPs was determined by targeted gene disruption analysis and by identification of common and specific binding partners by means of yeast and mammalian two‐hybrid screens. Several CRP‐like LIM domain proteins with close structural and sequence similarity were identified in arthropods, protozoas and plants, supporting the notion that this subset of LIM domain proteins has been highly conserved over the span of evolution thereby emphasizing the importance of their function.
