This paper develops a formal framework to model a process in which the formation of individual opinions is embedded in a deliberative exchange with others. The paper opts for a low-resolution modeling approach and abstracts away from most of the details of the social-epistemic process. Taking a bird's eye view allows us to analyze the chances for the truth to be found and broadly accepted under conditions of cognitive division of labour combined with a social exchange process. Cognitive division of (...) labour means that only some individuals are active truth seekers, possibly with different capacities. Both mathematical tools and computer simulations are used to investigate the model. As an analytical result, the Funnel Theorem states that under rather weak conditions on the social process, a consensus on the truth will be reached if all individuals possess an arbitrarily small capacity to go for the truth. The Leading the pack Theorem states that under certain conditions even a single truth seeker may lead all individuals to the truth. Systematic simulations analyze how close agents can get to the truth depending upon the frequency of truth seekers, their capacities as truth seekers, the position of the truth (more to the extreme or more in the centre of an opinion space), and the willingness to take into account the opinions of others when exchanging and updating opinions. This contribution serves as an invitation to a renewed exploration of Herbert Marcuse’s critical theory. It discloses his continued relevance for critical social theory and politics in the contemporary moment and why Marcuse should not be condemned to the dustbin of history but should be appropriated and developed in our contemporary conditions in which crises are multiplying.

ZusammenfassungDie Ökonomisierung bzw. die Kommerzialisierung des Sports ist ein langfristiger Prozess, der sich bereits seit der Wende zum 20. Jahrhundert vollzog und unterschiedliche Sportarten in unterschiedlichen Entwicklungsphasen und Geschwindigkeiten erfasste. Sportartikelunternehmen wie adidas beschleunigten diese Entwicklung nach dem Zweiten Weltkrieg, indem sie anlässlich sportlicher Großereignisse wie Olympischen Spielen oder Fußball-Weltmeisterschaften intensive Kontakte und Netzwerke zu Spitzensportlern und Funktionären aufbauten. Dabei ging es zunächst um die individuelle Ausrüstung der Sportler mit Schuhen und Kleidung, seit den 1960er Jahren dann auch um Promotionverträge (...) bei denen – in West- wie in Osteuropa – Geldzahlungen eine zunehmend wichtige Rolle spielten. Eine solche Vermarktlichung – also die Gestaltung von Prozessen, die bislang über den Staat oder bürokratische Strukturen und nun zunehmend über den Markt geregelt wurden (Ahrens et al. 2015: 395f.) Ökonomisierung, Kommerzialisierung und Vermarktlichung sind verwandte Begriffe, die z.T. auch synonym benutzt werden. Siehe dazu jüngst Graf (2019)., was im Vergleich zu anderen gesellschaftlichen Subsystemen durchaus eine Art „Normalisierung“ darstellte, erreichte spätestens in den 1980er Jahren und mit der massenmedialen Verbreitung des Sports neue Dimensionen, die wiederum mit Hilfe von adidas unter Horst Dassler in Kooperation mit dem IOC und der FIFA vorangetrieben wurden und die Grundlagen einer Kommerzialisierungsspirale legten, deren Auswirkungen bis in die Gegenwart reichen. Is there an anthropological difference within the basic style by which human beings exist ‘in’ world? The central problem of Gregor Samsa’s metamorphosis and the specific status of his animality can be focused by this question. Perhaps this difference manifests itself only when the human being has become estranged from any normal relation to world: when it has been changed into a shape of subjectivity that no longer shares the common net of a world of sense, and remains only an (...) ‘animal.’ The moment is tragic in that the attempt to live an alternative style of worldly being results in the ‘animalyzed’ subject’s condemnation to death. The large swinging bell Gloriosa, cast in 1497 for Erfurt Cathedral by Gherardus de Wou, ranks as an outstanding masterpiece of Gothic bell-founding art. Its musical quality and formal aesthetics became an object of emulation for generations of succeeeding bell founders and there have been repeated attempts to discover the hidden deisgn of the bell's profile. An early drawing is based on measurements made in 1865 by Sorge and consistent or modified reproductions of it were subsequently published by several authors. (...) Since 1985, a new admeasure of the bell's profile has been available. From these data a shape-fitting reconstruction was obtained by means of computer aided design (CAD) but following the traditional principles of bell design. With the aid of the finite element method (FEM) the frequencies of the partials of a bell can be calculated from its material and its profile. They make up the inner harmony as an important part of euphony, namely the purity of sound. Calculated values for the most important partials are given in terms of deviation from ideal harmonic intervals and are compared with acoustically ascertained values and modern standards. A further part of euphony, i.e. reverberation and sonority, is related to the bell metal, makingGloriosa highly resonant. As a piece of luck with a singular coincidence of perfect profile and excellent material.Gloriosa will remain the undefeatable prototype of western bells. (shrink)

This article describes the place occupied by Edith Stein's philosophy in the early phenomenological movement, in relation to the most important philosophers of this philosophy: Edmund Husserl, Max Scheler, and Martin Heidegger.

With steadily accumulating knowledge and increasing differentiation of access to knowledge democracies face the troublesome problem of technocracy. A solution was sought in widened participation without giving up the claim that ‚rationality’ would have a better chance of being realized. New ‚constructivist’ theories renounce this claim on the basis of equally valid ‚rationalities’. This paper tries to refute this view by specifying the concept of rationality and by analysing discourse mechanisms furthering rationality. This is clone by reconstructing some lines of (...) argumentation of a technology assessment of transgenic herbicide-resistant crops. Conclusions arise which are difficult to reject because there is a binding form of rationality at work. But rational argumentation does not guarantee consensus in politicized debates. (shrink)

Over the past 15 years, Rainer Forst has developed a fundamental research programme within the tradition of Frankfurt School Critical Theory. The core of this programme is a moral account of the basic right of justification that humans owe to one another as rational beings. This account is put to work by Forst in articulating - both historically and philosophically - the contexts and form of justice and of toleration. The result is a powerful theoretical framework within which to (...) address issues such as transnational justice and multicultural toleration. In this volume, Forst sets out his ideas in an extended essay, which is responded to be influential interlocutors including: Andrea Sangiovanni, Amy Allen, Kevin Olson, Anthony Laden, Eva Erman and Simon Caney. _Contexts of Justice,_ highly acclaimed when it was published in Germany, provides a significant new intervention into the important debate between communitarianism and liberalism. Rainer Forst argues for a theory of "contexts of justice" that leads beyond the narrow confines of this debate as it has been understood until now and posits the possibility of a new conception of social and political justice. This book brings refreshing clarity to a complex topic as it provides a synthesis of traditions and (...) theories that leads to a truly original approach. Forst makes a four-part distinction to decipher the debate between communitarianism and liberalism. These four parts concern the constitution of the self, the neutrality of law, the ethos of democracy, and the opposition between universalism and contextualism. He shows that a comprehensive theory of justice needs to take these different contexts adequately into account. He discusses recent debates about discursive democracy and feminist critiques of liberalism, and addresses such topics as multiculturalism and civil society. (shrink)

Based on the belief that computational modeling (thinking in terms of representation and computations) can help to clarify controversial issues in emotion theory, this article examines emotional experience from the perspective of the Computational Belief–Desire Theory of Emotion (CBDTE), a computational explication of the belief–desire theory of emotion. It is argued that CBDTE provides plausible answers to central explanatory challenges posed by emotional experience, including: the phenomenal quality,intensity and object-directedness of emotional experience, the function of emotional experience and its relation (...) to cognition and motivation, and the relation between emotional experience and emotion. In addition, CBDTE avoids most objections that have been raised against cognitive theories of emotion. A remaining objection, that beliefs are not necessary for the emotions covered by CBDTE, is rejected as empirically unsupported. (shrink)

The existence of predatory animals is a problem in animal ethics that is often not taken as seriously as it should be. We show that it reveals a weakness in Tom Regan's theory of animal rights that also becomes apparent in his treatment of innocent human threats. We show that there are cases in which Regan's justice-prevails-approach to morality implies a duty not to assist the jeopardized, contrary to his own moral beliefs. While a modified account of animal rights that (...) recognizes the moral patient as a kind of entity that can violate moral rights avoids this counterintuitive conclusion, it makes non-human predation a rights issue that morally ought to be subjected to human regulation. Jennifer Everett, Lori Gruen and other animal advocates base their treatment of predation in part on Regan's theory and run into similar problems, demonstrating the need to radically rethink the foundations of the animal rights movement. We suggest to those who, like us, find it less plausible to introduce morality to the wild than to reject the concept of rights that makes this move necessary to read our criticism either as a modus tollens argument and reject non-human animal rights altogether or as motivating a libertarian-ish theory of animal rights. Mental-threshold egalitarianism, well-known examples of which include Jeff McMahan’s two-tiered account of the wrongness of killing and Tom Regan’s theory of animal rights, divides morally considerable beings into equals and unequals on the basis of their individual mental capacities. In this paper, I argue that the line that separates equals from unequals is unavoidably arbitrary and implausibly associates an insignificant difference in empirical reality with a momentous difference in moral status. In response to these objections, McMahan has proposed the introduction (...) of an intermediate moral status. I argue that this move ultimately fails to address the problem. I conclude that, if we are not prepared to give up moral equality, our full and equal moral status must be grounded in a binary property that is not a threshold property. I tentatively suggest that the capacity for phenomenal consciousness is such a property, and a plausible candidate. (shrink)

The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an (...) expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration. Rainer Forst develops a critical theory capable of deciphering the deficits and potentials inherent in contemporary political reality. This calls for a perspective which is immanent to social and political practices and at the same time transcends them. Forst regards society as a whole as an ‘order of justification’ comprising complexes of different norms referring to institutions and corresponding practices of justification. The task of a ‘critique of relations of justification’, therefore, is to analyse such legitimations with regard to (...) their validity and genesis and to explore the social and political asymmetries leading to inequalities in the ‘justification power’ which enables persons or groups to contest given justifications and to create new ones. Starting from the concept of justification as a basic social practice, Forst develops a theory of political and social justice, human rights and democracy, as well as of power and of critique itself. In so doing, he engages in a critique of a number of contemporary approaches in political philosophy and critical theory. European citizenship is a nested membership in a multilevel polity that operates at member state and union levels. A normative theory of supranational citizenship will necessarily be informed by the EU as the only present case and will be addressed to the EU in most of its prescriptions, but should still develop a model sufficiently general to potentially apply to other regional unions as well. The Article first describes three basic characteristics of such a polity — democratic representation at the (...) supranational level, internal freedom of movement between member states, and regional limits to external geographic expansion — and argues that a multiplication of such regional unions would contribute to a more just and peaceful international order. Building on this modification of Kant’s model for a global confederation of republics, the contribution explores three alternative approaches for strengthening democratic citizenship in the European Union: a statist approach that aims at transforming the EU into a federal state, a unionist approach whose goal is to strengthen union citizenship vis-a`-vis member state nationality, and a pluralist one that specifies citizenship norms for each level and balances them with each other on the basis of the current state of federal integration. These approaches are then compared with regard to their implications for three policy questions: general status differences and inequality of rights amongst EU citizens living in their country of nationality, EU citizens residing in other member states, third-country nationals, and EU citizens residing outside the territory of the Union; voting rights in European, national, and local elections; and access to Union citizenship and to member state nationality. In this paper, I focus on Kant’s doctrine of figurative synthesis. Figurative synthesis is the result of the activity of productive transcendental imagination. This is the chief problem of the so-called “second proof step” in Kant’s deduction of the categories according to the second edition of the Critique of Pure Reason. The pure original synthetic apperception forms in the inner and outer sense - i. e. in time and space - by self-affection structures of order that make it possible to (...) cognize empirical objects. The order of space and time through figurative syntheses must be distinguished on the one hand from space and time as forms of intuition and on the other hand from the order of the manifold given in space and time. This clarifies the differences and relations between the constitutive noetic faculties of our knowledge apparatus. (shrink)

Research on cognition and emotion during the past 30 years has made reasonable progress in theory, methods and empirical research. New theories of the cognition–emotion relation have been proposed, emotion research has become more interdisciplinary, and improved methods of emotion measurement have been developed. On the empirical side, the main achievement of the past 30 years is seen to consist in the reduction of the set of serious contenders for a theory of emotions. Still, several important issues are not fully (...) resolved, including the computational implementation of appraisal processes, the nature of emotions, and the link between emotions and actions. Also, quantitative theories of the cognition–emotion relation need to be refined and tested, and improved theories of the link between emotions and bodily and facial expressions need to be developed. To counter the dangers of theoretical fragmentation and knowledge loss, more efforts should be devoted to the analysis, reconstruction, comparison and integration of important theories and hypotheses in the field of emotion, as well as to the systematization of arguments in favor and against these theories and hypotheses. We first present a reconstruction of James’s theory of emotion (JATE) and then argue for four theses: (a) Despite constructivist elements, James’s views are overall in line with basic emotions theory. (b) JATE does not exclude an influence of emotion on intentional action even in its original formulation; nevertheless, this influence is quite limited. It seems possible, however, to repair this problem of the theory. (c) Cannon’s theory of emotion is a centralized version of JATE that inherits from the latter (...) theory a potentially fatal flaw, the insufficient physiological differentiation of emotions. Byrne & Hilbert conceive of color perception as the representation of a physical property “out there.” In our view, their approach does not only have various internal problems, but is also apt to becloud both the intricate and still poorly understood role that “ color ” plays within perceptual architecture, and the complex coupling to the “external world” of the perceptual system as an entirety. We propose an alternative perspective, which avoids B&H's misleading dichotomy between a purely subjective and a (...) realist conception of “ color.”. (shrink)

This paper argues for a conception of transnational justice that provides an alternative to globalist and statist views. In light of an analysis of the transnational context of justice, a critical theory is suggested that addresses the multiple relations of injustice and domination to be found in this context. Based on a universal, individual right to reciprocal and general justification, this theory argues for justifiable social and political relations both within and between states. In both of these contexts, it distinguishes (...) between minimal and maximal justice and stresses the interdependence of domestic and transnational justice. On both levels, minimal justice calls for a discursive structure of justification, whereas maximal justice implies a fully justified basic social structure. (shrink)

This article argues that alienation should be understood as a particular form of individual and social heteronomy that can only be overcome by a dialectical combination of individual and collective autonomy, recovering a deontological sense of normative authority. If we think about alienation in Kantian terms, the main source of alienation is a denial of standing or, in the extreme, losing a sense of oneself as a rational normative authority equal to all others. I call the former kind of alienation, (...) where persons deny others equal standing as a normative authority in moral or political terms, first order noumenal alienation, as there is no proper mutual cognition and recognition of each other in such a social context. I call the latter kind of alienation, where a subject does not consider themselves an equal normative authority – or an ‘end in oneself’ – second order noumenal alienation. In this sense, alienation violates the dignity of humans as moral and political lawgivers – a dignity seen by Rousseau, Kant and Marx as inalienable: It can be denied or violated, but it cannot be lost.
