Following the 1980 US Supreme Court decision to allow a patent on a living organism, debate has continued on the moral issues involved in biotechnology patents of many kinds and remains a contentious issue for those opposed to the use of biotechnology in industry and agriculture. Attitudes to patenting in the life sciences, including those of the research scientists themselves, are analysed. The relevance of morality to patent law is discussed here in an international context with particular reference to the (...) law of the European Patent Convention administered by the European Patent Office (EPO). The EPO has been the principal forum for opposition to such patents and the few cases under dispute in the EPO are reviewed, including patents for the onco-mouse, human relaxin gene, and the PGS herbicidally resistant plant (gmo). Morality provisions in the European Parliament and Council Directive 98/44/EC are also summarised. (shrink)

Society must make important choices in health and medicine, the environment, energy sources, the courts and in risk and safety. These issues and many other problems facing us require knowledge of science for their solution. Polls show that nearly half of the US population believes the myths, superstition and paranormal delivered by TV and the press. The influence of direct-to-consumer advertising and physician promotions are examined in this study. We further examine some of the ethical issues which may arise when physicians accept promotional products from pharmaceutical companies. The data revealed that direct-to-consumer advertising is likely to increase the request rates of both the drug category and the drug brand choices, as well as the likelihood that those drugs will be prescribed by physicians. The data further revealed that the majority of responding physicians were either neutral (...) or did not feel that accepting some types of gifts from pharmaceutical companies affected their ethical behaviors. In the course of his interesting paper ‘The Morality of Killing’ , Mr. T. Goodrich apparently seeks to prove that decisions about population control cannot be based on the utilitarian principle. More exactly, I think, he wishes to show that such decisions cannot be based on this principle by making appeal either to the interests of those persons who would be brought into existence as a result of a decision to add to the population or to the interests, at times (...) subsequent to carrying out the decision, of those persons who would cease to exist as a result of a decision to subtract from the population. I believe that the arguments he uses to support this thesis are not good ones, and I will try to show that they are not. (shrink)

Over the last two decades, the ethical implications of patents for biological materials and processes have been the subject of spirited public debate between the many individuals and groups on which the patent system impacts. Whereas copyright, trade marks, and other species of Intellectual Property Rights (IPR) are widely acceptable, the patent system evokes criticism from many quarters, especially in relation to the legal protection of inventions in the Life Sciences. This essay deals with property rights in body parts that can be exchanged in a market. The inquiry arises in the following context. With some exceptions, the laws of many countries permit only the donation, not the sale, of body parts. Yet for some years there has existed a shortage of body parts for transplantation and other medical uses. It might then appear that if more sales were legally permitted, the supply of body parts would increase, because people would have (...) more incentive to sell than they currently have to donate. To allow sales is to recognize property rights in body parts. To allow sales, however, makes body parts into “commodities”—that is, things that can be bought and sold in a market. And some view it as morally objectionable to treat body parts as commodities. (shrink)

He concludes that there can be no correct, positive philosophical theory or linguistic or mental representation and, accordingly advocates the deflationary "no-theory theory of meaning and content." Scientific peer reviewers play an integral role in the grant selection process, yet very little has been reported on the levels of participation or the motivations of scientists to take part in peer review. The American Institute of Biological Sciences developed a comprehensive peer review survey that examined the motivations and levels of participation of grant reviewers. The survey was disseminated to 13,091 scientists in AIBS’s proprietary database. Of the 874 respondents, 76% indicated they had reviewed grant applications in the (...) last 3 years; however, the number of reviews was unevenly distributed across this sample. Higher review loads were associated with respondents who had submitted more grant proposals over this time period, some of whom were likely to be study section members for large funding agencies. The most prevalent reason to participate in a review was to give back to the scientific community and the most common reason to decline an invitation to review was lack of time. Interestingly, few suggested that expectation from the funding agency was a motivation to review. Most felt that review participation positively influenced their careers through improving grantsmanship and exposure to new scientific ideas. Of those who reviewed, respondents reported dedicating 2–5% of their total annual work time to grant review and, based on their self-reported maximum review loads, it is estimated they are participating at 56–87% of their capacity, which may have important implications regarding the sustainability of the system. Overall, it is clear that participation in peer review is uneven and in some cases near capacity, and more needs to be done to create new motivations and incentives to increase the future pool of reviewers. Given the complexity of teams involved in creating AI-based systems, how can we understand who should be held accountable when they fail? This paper reports findings about accountable AI from 26 interviews conducted with stakeholders in AI drawn from the fields of AI research, law, and policy. Participants described the challenges presented by the distributed nature of how AI systems are designed, developed, deployed, and regulated. This distribution of agency, alongside existing mechanisms of accountability, responsibility, and liability, creates barriers for (...) effective accountable design. As agency is distributed across the socio-technical landscape of an AI system, users without deep knowledge of the operation of these systems become disempowered, unable to challenge or contest when it impacts their lives. In this context, accountability becomes a matter of building systems that can be challenged, interrogated, and, most importantly, adjusted in use to accommodate counter-intuitive results and unpredictable impacts. Thus, accountable system design can work to reconfigure socio-technical landscapes to protect the users of AI and to prevent unjust apportionment of risk. (shrink)

Averroes on Intellect provides a detailed analysis of the Muslim philosopher Averroes 's notorious unicity thesis -- the view that there is only one separate and eternal intellect for all human beings. It focuses directly on Averroes' arguments, both from the text of Aristotle's De Anima and, more importantly, his own philosophical arguments in the Long Commentary on the De Anima. Stephen Ogden defends Averroes' interpretation of De Anima using a combination of Greek, Arabic, Latin, and contemporary sources. Yet, (...) Ogden also insists that Averroes is not merely a 'commentator' but an incisive philosopher in his own right. The author thus reconstructs and analyzes Averroes' two most significant independent philosophical arguments, the Determinate Particular Argument and the Unity Argument. Alternative ancient and medieval views are also considered throughout, especially from two important foils before and after Averroes, namely, Avicenna and Thomas Aquinas. Aquinas' most famous and penetrating arguments against the unicity thesis are also addressed. Finally, Ogden considers Averroes' own objections to broader metaphysical views of the soul like Avicenna's and Aquinas', which agree with him on several key points including the immateriality of the intellect and the individuation of human souls by matter, while still diverging on the number and substantial nature of the intellect. The central goal of this book is to provide readers with a single study of Averroes' most pivotal arguments on intellect, consolidating and building on recent scholarship and offering a comprehensive case for his unicity thesis in the wider context of Aristotelian epistemology and metaphysics. ONE question asked about the relationship between feelings and emotion is whether feelings are a feature necessary to constitute emotion. Answers vary from James's assertion that they are so central as to be emotion, to Bedford's and Solomon's insistence that they are irrelevant to emotion. More moderate answers, however, have emerged, views in which feelings have a place with regard to emotion--at least some of the time. Assuming that feelings do have some status with regard to emotion, a further question (...) is to be asked. The convergence of human and artificial intelligence is currently receiving considerable scholarly attention. Much debate about the resulting _Hybrid Minds_ focuses on the integration of artificial intelligence into the human brain through intelligent brain-computer interfaces as they enter clinical use. In this contribution we discuss a complementary development: the integration of a functional in vitro network of human neurons into an _in silico_ computing environment. To do so, we draw on a recent experiment reporting the creation of silico-biological intelligence as (...) a case study (Kagan et al., 2022b ). In this experiment, multielectrode arrays were plated with stem cell-derived human neurons, creating a system which the authors call _DishBrain_. By embedding the system into a virtual game-world, neural clusters were able to receive electrical input signals from the game-world and to respond appropriately with output signals from pre-assigned motor regions. Using this design, the authors demonstrate how the _DishBrain_ self-organises and successfully learns to play the computer game ‘Pong’, exhibiting ‘sentient’ and intelligent behaviour in its virtual environment. The creation of such hybrid, silico-biological intelligence raises numerous ethical challenges. Following the neuroscientific framework embraced by the authors themselves, we discuss the arising ethical challenges in the context of Karl Friston’s Free Energy Principle, focusing on the risk of creating synthetic phenomenology. Following the _DishBrain’s_ creator’s neuroscientific assumptions, we highlight how DishBrain’s design may risk bringing about artificial suffering and argue for a congruently cautious approach to such synthetic biological intelligence. Developing a care plan in a critical care context can be challenging when the therapeutic alliance between clinicians and families is compromised by anger. When these cases occur, clinicians often turn to clinical ethics consultants to assist them with repairing this alliance before further damage can occur. This paper describes five different reasons family members may feel and express anger and offers concrete strategies for clinical ethics consultants to use when working with angry families acting as surrogate decision makers for (...) critical care patients. We reviewed records of consults using thematic analysis between January 2015 and June 2016. Each case was coded to identify whether the case involved a negative encounter with an angry family. In our review, we selected 11 cases with at least one of the following concerns or reasons for anger: perceived or actual medical error, concerns about the medical team’s competence, miscommunication, perceived conflict of interest or commitment, or loss of control. To successfully implement these strategies, clinical ethics consultants, members of the medical team, and family members should share responsibility for creating a mutually respectful relationship.
