Childhood obesity is in important respects a result of legal policies that influence both dietary intake and physical activity. The law must shift focus away from individual risk factors alone and seek instead to promote situational and environmental influences that create an atmosphere conducive to health. To attain this goal, advocates should embrace a population-wide model of public health, and policymakers must critically examine the fashionable rhetoric of consumer choice.

PREFACE This volume is a sequel to yet independent of our Paranoia: A Study in Diagnosis, Reidel, Dordrecht and Boston, 1976. Whereas our first book centered on diagnosis, this centers on treatment. In our first volume, all discussions of nosology (theory of illness) and of treatment was ancillary to our discussion of diagnosis; similarly all discussion of this volume dealing with nosology - there is very little on diagnosis here - is ancillary to our discussion of psychotherapy. It is still (...) our profoundest conviction that to speak of treatment without diagnosis is meaningless, if not irresponsible, since otherwise one does not know what one is talking about. Hence, our present study, though it centers on theories of treatment, links psychotherapy with psychopathology. It is the rationale of psychotherapy which is of importance, and the rationale dwells in this link. We wish our present study to be self-contained and understood by readers who are not familiar with our first book - or with any specific literature. Our discussion of medicine in general, meaning the rationale of therapy in general, helps the uninitiated reader, as well as the initiated, we hope: it certainly has helped us. We did not see how else can we study a branch of medicine; we felt the need for some idea of how medicine is supposed to work. (shrink)

My dissertation is an exploration of two theories of political judgment that are inspired by Kant's Critique of Judgment. Both Hannah Arendt and Jean Francois Lyotard appropriate different versions of Kantian reflective judgment as a model for making political decisions because it allows for differences in thought and action, and does not reduce politics to a fabrication guided by a universal conception. This dissertation examines the viability of both theories of judgment, and assesses the relation between political judgment, politics, and (...) history. ;I begin by briefly summarizing the Critique of Judgment, and examining the factors of Kant's universal moral philosophy that are rejected by Arendt and Lyotard, in order to better understand the aspects that they appropriate for political judgment. I then explore Arendt's theory of political judgment based upon judgments of beauty. Through her theory of judgment, Arendt seeks to maintain the balance between valuing plurality, but at the same time, allowing the spectators to come to a political judgment based upon the good of the whole community. The relation between her theory of judgment and the philosophy of history is also discussed in light of her criticisms of instrumental reasoning. Next, I investigate Lyotard's theory of judgment that is based upon Kant's judgments of the sublime. Lyotard focuses upon the incommensurability of phrase genres that are manifested in his analysis of the differend . The differend concerns a wrong that cannot currently be expressed and is signaled by the feeling of the sublime. The link between the feeling of the sublime and history is explored, as well as the implications of Lyotard's theory of judgment upon his politics. Finally, I conclude with a discussion of five major differences between Arendt's and Lyotard's theories of judgment, focusing upon the temporality of judgment, the influence of the holocaust on their respective political theories, the difference between the beautiful and the sublime governing judgment, Lyotard's interpretation of Arendt's thought, and the connection between their theories of judgment and political action. Although their political strategies are important, the success of both of their theories of judgment are provisional because neither can settle the issues surrounding political agency and action that have arisen in the debate between modern and postmodern theories of politics. The deadly sin of Greed goes by many names, appears in many guises, and wreaks havoc on individuals and nations alike. In this lively and generous book, Phyllis A. Tickle argues that Greed is "the Matriarch of the Deadly Clan," the ultimate source of Pride, Envy, Sloth, Gluttony, Lust, and Anger. She shows that the major faiths, from Hinduism and Taoism to Buddhism and Christianity regard Greed (...) as the greatest calamity humans can indulge in, engendering further sins and eviscerating all virtues. Tickle takes a long view of Greed, from St. Paul to the present, focusing particularly on changing imaginative representations of Greed in Western literature and art. Looking at such works as the Psychomachia, or "Soul Battle" of the fifth-century poet Aurelius Clemens Prudentius, the paintings of Peter Bruegel and Hieronymous Bosch, the 1987 film Wall Street, and the contemporary Italian artist Mario Donizetti, Tickle shows how our perceptions have evolved from the medieval understanding of Greed as a spiritual enemy to a nineteenth-century sociological construct to an early twentieth-century psychological deficiency, and finally to a new view, powerfully articulated in Donizetti's mystical paintings, of Greed as both tragic and beautiful. Engaging, witty, brilliantly insightful, Greed explores the full range of this deadly sin's subtle, chameleon-like qualities, and the enormous destructive power it wields, evidenced all too clearly in the world today. After a decade of intense debate about mechanisms, there is still no consensus characterization. In this paper we argue for a characterization that applies widely to mechanisms across the sciences. We examine and defend our disagreements with the major current contenders for characterizations of mechanisms. Ultimately, we indicate that the major contenders can all sign up to our characterization.

Elephants show a rich social organization and display a number of unusual traits. In this paper, we analyse reports collected over a thirty-five year period, describing behaviour that has the potential to reveal signs of empathic understanding. These include coalition formation, the offering of protection and comfort to others, retrieving and 'babysitting' calves, aiding individuals that would otherwise have difficulty in moving, and removing foreign objects attached to others. These records demonstrate that an elephant is capable of diagnosing animacy and (...) goal directedness, and is able to understand the physical competence, emotional state and intentions of others, when they differ from its own. We argue that an empathic understanding of others is the simplest explanation of these abilities, and discuss reasons why elephants appear to show empathy more than other non-primate species. The paper addresses the question of whom to obey, the law or the prophets, and reviews the ongoing confusion between the two apparent opposing forces. Doing Ethics in a Pluralistic World is an apt title for this collection of essays in honour of Roger C. Hutchinson who, over many decades, has encouraged and participated in shaping a Canadian contextual social ethics. His abiding interest in social ethics and in religious engagement with public issues is reflected in his life’s work — seeking the consensus and self-knowledge required to achieve cooperation in the search for a just, participatory, and sustainable society. One of Roger Hutchinson’s many notable (...) accomplishments is his development of a method of dialogue for ethical clarification in situations of diversity. Some of the essays collected here apply this method to specific issues, while others discuss how religious persons and organizations can and do co-operate in a pluralistic world to achieve social and ecological well-being. All essays are of keen interest to those concerned with the role and function of ethics at the matrix of religious conviction and social transformation. For nearly three decades Roger Hutchinson has been based at Victoria University in Toronto, first in religious studies, then at Emmanuel College, where he completed his teaching career as professor of church and society while serving as principal from 1996 to 2001. This article integrates research on gendered organizations and the work-family interface to investigate an innovative workplace initiative, the Results-Only Work Environment, implemented in the corporate headquarters of Best Buy, Inc. While flexible work policies common in other organizations “accommodate” individuals, this initiative attempts a broader and deeper critique of the organizational culture. We address two research questions: How does this initiative attempt to change the masculinized ideal worker norm? And what do women’s and men’s responses reveal about the persistent ways (...) that gender structures work and family life? Data demonstrate the ideal worker norm is pervasive and powerful, even as employees begin critically examining expectations regarding work time that have historically privileged men. Employees’ responses to ROWE are also gendered. Women are more enthusiastic, while men are more cautious. Ambivalence about and resistance to change is expressed in different ways depending on gender and occupational status. (shrink)

Barbara H. Fried presents a powerful critique of the nonconsequentialist approaches that have been dominant in recent Anglophone moral and political thought. She argues that nonconsequentialist theories have disastrous consequences in the political domain and are inadequate at dealing with conflicts of individual interests in the moral domain.

Horace writes somewhere "Sit quod vis, simplex dumtaxat et unum" which can be comfortably rendered as "make anything at all, so long as it hangs together." The hanging together is the quality most writers point to as evidence of success: simply, it (...) works. What poetry does is the more complex question, since it is the understanding of its internal kinesis which allows for its definition. Essentially, it takes an object from objective reality (insofar as we can agree such exists) and creates an oxymoronic entity: a static consciousness. This is always seen in phenomenological terms, that is, it must be consciousness of something. The poet recognizes this in deference to the common consciousness and the common understanding of the everyday, by the use of metaphor, simile, and the other accouterments of the trade. Things must be as they appear, and they must be as they appear to some majority of the people, in order for the poet to argue his private vision with clarity. The analogy must have some common ground before it has meaning, before the "naming" takes place. For Martin Heidegger the activity of creating poetry, dichten, is not only an indispensable part of human life, it signals the humanness of the person. He has two principal essays on poetry which show how this activity ofdichten combines his concepts Dasein and Vorhandenheit (despite his later abandonment of Dasein for Lichtung). Heidegger's essay, "Hölderlin and the Essence of Poetry," seeks to determine what is common to poetry, that is, what constitutes its essence. 340 Phyllis Zagano341 Another ofhis essays, "What are Poets For?" begins where the first ends (with considerations of Friedrich Hölderlin's "Bread and Wine"). Each essay comments on specific poems and somewhat imperfectly attempts a poetic theory in consonance with the rest of Heidegger's work. Since "Hölderlin and the Essence of Poetry" concentrates more on poetic theory than "What are Poets For?," investigation of it will prove more helpful in understanding and appropriating Heidegger's contention that "The writing of poetry is the fundamental naming of the Gods____"· In his "Letter on Humanism," Heidegger calls language the "House of Being," while man is the "Shepherd of Being." This understanding ofthe function oflanguage and the methodweuse tocreateand recreate ourselves and our world recurs often in Heidegger's work. The essay, "Hölderlin and the Essence of Poetry," stands as a seeking after what is common to poetry and, while Heidegger recognizes that Hölderlin's work is "only one among many others" (p. 294) and therefore cannot be used as the sole criterion to determine what constitutes poetry, he says that if what we recognize as the "essence of poetry" is present in a universal concept, then it ought to be able to be extrapolated from Hölderlin's poetry as well as from that of any other poet. What constitutes the "essence" of poetry, Heidegger argues, ought to be equally valid in every poem, but it is perhaps well to remind him that what ought to be equally valid in every poem is only equally valid in every poem which "hangs together," that is, every poem which performs its function as poem. Such insistence is ofcourse mere definition of terms, but in this case, without prior argument on the metaphysics of art, it is necessary. In any event, Heidegger concludes that the essence of Hölderlin's poetry is the "essence ofpoetry" itself (p. 294), and that what is common to poetry is found in it. While some critics might argue that Heidegger makes too much of Hölderlin here, the more dangerous weakness in this method of argumentation is the possibility that an idiosyncrasy might be mistaken for an essential element or, more probably, that too much will be generalized from this particular example or set of examples. Gregory Fried outlines a new approach to ethics and politics combining skeptical idealism and what he calls polemical ethics, and goes on to apply polemical ethics to the crucial questions around fascism and racism.

Contract as Promise is a study of the philosophical foundations of contract law in which Professor Fried effectively answers some of the most common assumptions about contract law and strongly proposes a moral basis for it while defending the classical theory of contract. This book provides two purposes regarding the complex legal institution of the contract. The first is the theoretical purpose to demonstrate how contract law can be traced to and is determined by a small number of basic moral (...) principles. At the theory level the author shows that contract law does have an underlying, and unifying structure. The second is a pedagogic purpose to provide for students the underlying structure of contract law. It also includes a substantial new essay entitled Contract as Promise in the Light of Subsequent Scholarship--Especially Law and Economics which serves as a retrospective of the work accomplished in the last thirty years, while responding to present and future work in the field. This book presents the concept of ‘unstaging’ war as a strategic response to the failure of the discourse and institutions of peace. This failure is explained by exploring the changing character of conflict in current and emergent global circumstances, such as asymmetrical conflicts, insurgencies, and terrorism. Fry argues that this pluralisation of war has broken the binary relation between war and peace: conflict is no longer self-evident, and consequentially the changes in the conditions, nature, systems, philosophies and technologies of war (...) must be addressed. Through a deep understanding of contemporary war, Fry explains why peace fails as both idea and process, before presenting ‘Unstaging War’ as a concept and nascent practice that acknowledges conflict as structurally present, and so is not able to be dealt with by attempts to create peace. Against a backdrop of increasingly tense relations between global power blocs, the beginnings of a new nuclear arms race, and the ever-increasing human and environmental impacts of climate change, a more viable alternative to war is urgently needed. The issues involved in deciding whether to use artificial methods of delivering hydration and nutrition are often very difficult for patients, families, and health care providers. Once private and personal matters, these decisions now frequently involve the judicial system. Five years ago, Hospice of Washington recognized the need for a written policy and wrote the one published here. Its goal is to respect individual preferences and family concerns while addressing the nutrition and hydration needs of dying patients. This paper extends Being-centered and spiritual leadership theory using non-self from the Buddhist philosophy to further our understanding of how inner life functions as the source of spiritual leadership. While spiritual leadership theory has received widespread acceptance and considerable empirical support, its developmental process and potential for being used to pursue self-centered ends remain underdeveloped. Drawing on non-self from the Buddhist emptiness theory, we identify different egoistic forms of attachment at each level of being that can lead to forms of (...) suffering in spiritual leadership. Then we show how leaders operating at lower levels of being can fall into the trap of practicing a form of pseudo-spiritual leadership that is overly focused on self-centered or instrumental purposes and economic rationality. We then introduce mechanisms to move beyond pseudo-spiritual leadership practices and discuss implications for future theory, research, and practice. (shrink)

Specific methodological limitations of traditional sex differences research are uncovered by feminist psychologists who argue for a shift toward a theoretical appropriation of gender that reveals its significance as a site of ongoing situated social regulation. I argue that such a shift has important implications for studies on gender and cognition, and that such studies have the potential to significantly expand our understanding of the contextual and situated nature of both social and "non-social" cognition.

Objective: To examine current research payment practices and to inform development of clearer guidelines for researchers and ethics committees.Design: Exploratory email based questionnaire study of current research participant reimbursement practices. A diverse sample of organisations and individuals were targeted.Setting: Australia.Participants: Contacts in 84 key research organisations and select electronic listservers across Australia. A total of 100 completed questionnaires were received with representations from a variety of research areas .Main measurements: Open-ended and fixed alternative questions about type of research agency; type (...) of research; type of population under study; whether payment is standard; amounts and mechanisms of payment; factors taken into account when deciding on payment practices; and whether payment policies exist.Results: Reimbursement practice is highly variable. Where it occurs it is largely monetary and is for time and out-of-pocket expenses. Ethics committees were reported to be often involved in decision making around reimbursement.Conclusions: Research subject payment practices vary in Australia. Researchers who do provide payments to research participants generally do so without written policy and procedures. Ethics committees have an important role in developing guidelines in this area. Specific guidelines are needed considering existing local policies and procedures; payment models and their application in diverse settings; case study examples of types and levels of reimbursement; applied definitions of incentive and inducement; and the rationale for diverse payment practices in different settings.
