What principles explain or justify legal institutions or decisions, thereby transforming coercion to authority? Are there or could there be any such universal principles? Can any philosophical theory account for such principles? How, if at all, do philosophical theories of law and politics apply to particular issues? And finally, what, if any, do such practical applications tell us about general theories and principles? In the discussion of global ethics, philosophical ethics risks losing its distinct theoretical horizons. This predicament arises primarily from philosophy's failure to anchor its own object and to provide a rational basis for global justice from within its current confined theoretical paradigm. Against this background, this paper will first prioritize global co-existence as the primary concern of global ethics, then propose ontological co-existence justice as its foundational principle, and finally argue that the normative validity of co-existence justice is predicated on (...) the nations fulfilling the critical requirements of modern civilization, namely, the advancement of individual freedom. This chapter offers an overview of experimental legal philosophy with a special focus on questions in general jurisprudence, that part of legal philosophy that asks about the concept and nature of law. Much of the experimental general jurisprudence work has tended to follow the questions that have interested general jurisprudence scholars for decades, that is, questions about the relation between legal norms and moral norms. Wholesale criticism of experimental general jurisprudence is scant, but, given existing debates about experimental philosophy generally, (...) one can anticipate where disagreement is likely to occur. Outside of experimental general jurisprudence, there is plenty of vibrant discussion about how experimental results can enrich our understanding of various concepts that figure in everyday legal thought such as causation, intention, consent, or meaning. In the future, experimental legal philosophers should continue to consider the degree to which their project is purely descriptive or whether it is revisionary or pragmatic in its ambitions. Also, future work might consider whether to focus more attention on legal experts. (shrink)

Peter Adamson offers an accessible, humorous tour through a period of eight hundred years when some of the most influential of all schools of thought were formed: from the third century BC to the sixth century AD. He introduces us to Cynics and Skeptics, Epicureans and Stoics, emperors and slaves, and traces the development of Christian and Jewish philosophy and of ancient science. Chapters are devoted to such major figures as Epicurus, Lucretius, Cicero, Seneca, Plotinus, and Augustine. But in keeping (...) with the motto of the series, the story is told 'without any gaps, ' providing an in-depth look at less familiar topics that remains suitable for the general reader. For instance, there are chapters on the fascinating but relatively obscure Cyrenaic philosophical school, on pagan philosophical figures like Porphyry and Iamblichus, and extensive coverage of the Greek and Latin Christian Fathers who are at best peripheral in most surveys of ancient philosophy. A major theme of the book is in fact the competition between pagan and Christian philosophy in this period, and the Jewish tradition also appears in the shape of Philo of Alexandria. Ancient science is also considered, with chapters on ancient medicine and the interaction between philosophy and astronomy. Considerable attention is paid also to the wider historical context, for instance by looking at the ascetic movement in Christianity and how it drew on ideas from Hellenic philosophy. Modern philosophy of science was, initially, an epistemology of science based on the logical analysis of the language of science. It was superseded by a “sociological epistemology,” according to which the acceptance of scientific statements and theories depends on conditioningscoming from the social context and powers, and this view has fueled anti-scientific attitudes.This happened because the sociological turn still expressed an epistemology of science. Science, however, is not only a system of knowledge, but also a complex human activity. Hence, ethical, (...) political, social, religious issues appear legitimate if they concern “doing science.”Therefore, we must “rethink” philosophy of science, accepting in it also an axiology of science that could enable us to retain the cognitive value of science and at the same time to make techno-scientific activity compatible with the satisfaction of a great variety of values that inspire our societies. Dewey blurs the distinction between poetry and philosophy. This is clearest in his aesthetics where he affirms Matthew Arnold’s dictum that “poetry is criticism of life.” The maxim, though, fails to say “how poetry is a criticism.” The role of art in general is imagining and creating images of the actual beyond the possible that (from a moral perspective) ought to exist. One can derive an ought from an is if one understands the is of poetic possibility. Dewey asserts that (...) “poetry teaches us as friends and life teach, by being, and not by express intent.” He affirms that it is “by way of communication that art becomes the incomparable organ of instruction.” Blurring the distinction between poetry and philosophy requires reconsidering the character—especially the moral character—of education as cultural criticism. BERDYAEV AS A PHILOSOPHER How shall a non-Russian, above all a North American, assimilate the extraordinary assemblage of ideas which is Berdyaev's philosophy? Dr. Richardson does not exaggerate the difficulties. And he introduces us with great care (and what a formidable task it must have been) precisely to what is most strange in this writer, his fusion of historical.. eschatological-metaphysical-mystical-Christian conceptions. By some standards Berdyaev is a theologian rather than a philosopher; for he takes the truth of the Christian revelation (...) for granted and his work can readily be viewed as an elaborate apologetic for one religion against all others and against irreligion. Yet I incline to sympathize with him in his claim to be a philosopher. What an eccentric one, however! There are indeed some partial analogies in the general European tradition. Certainly this Russian is a disciple of Kant, and strong traces of Kantianism survive in him. He also moved away from Kant somewhat as did Fichte, Hegel, and, above all, Schelling in his last period. His sympathetic response to Heracleitos and Boehme recalls Hegel. The interest in Boehme and Schelling is found also in Tillich. Like the late German-American, Berdyaev rejects conceptual in favor of symbolic speech about God. Like Bergson, he stresses intuition and makes a radical distinction between scientific logical analytic thought and the mode of apprehension by which, he believes, metaphysical truth is to be appropriated. The west-centrism in approaching the knowledge systems of east has been sufficiently highlighted and problematized. This paper argues that the attempts have often been restricted to a framework of colonial gaze that prevents the Indian classical philosophy from gaining a vantage of its own. The approach to the classical traditions have been largely fragmented, catering to the pressure of proving its “relevance” either as a knowledge system or as texts with useful resources and answers to contemporary problems. This “problem solving” (...) framework at the very outset de-recognizes the capacity of an entire philosophical tradition of problem identification and formulation, unsettling terrains of knowledge by asking new questions. The article presents a case for theorizing relevance as a prerequisite to resolving some of these issues. (shrink)

Adorno's remarks on the philosophy of history are scattered throughout his works. Perhaps the most important passages are to be found in Negative Dialectics and the 1964–1965 lectures on History and Freedom, as well as in texts such as Dialectic of Enlightenment and the essays on “The Idea of Natural‐History,” “Progress,” and “The Meaning of Working through the Past.” However, these works do not constitute anything like a complete theory. Nevertheless, many themes and references recur in Adorno's writings, allowing for (...) a selectively thematic reconstruction of the most central lines of argument. The present text brings together a few concepts and problems from Adorno's readings of Kant, Hegel, and Marx, mainly, in order to provide the reader with a general picture of what is at issue. Among them are moderate mathematical fictionism, categorical foundations of the protean character of mathematics, the mathematical overdetermination of physics, and Hungarian traditions and the philosophy of non-classical logic.
