The paper discusses the Anglo-American philosophy of law of the 20th century, more specifically the philosophy of law of Ronald Myles Dworkin and his criticism of the legal positivism of Herbert Lionel Adolphus Hart. The author presents the history of the criticism of legal positivism in Ronald Dworkin’s philosophy of law and distinguishes historical stages. The subject of the study is the critique of legal positivism but not the Hart-Dworkin debate itself, well known in Western philosophy of law. The (...) reason is that the discussion was conducted between Dworkin and Hart’s supporters but not between Dworkin and Hart by himself. The latter responded to the criticism only after twenty seven years. The article explains why Dworkin chose for his criticism Herbert Hart’s version of legal positivism. This is due to the fact that Dworkin highly appreciated Hart’s positivist theory of law and characterized it as the “most clear.” The article presents the methodological foundations of criticism of Hart’s legal positivism in Dworkin’s philosophy of law. It reveals a methodological divergence between the two legal theories, which directly affects the understanding of the concept of law and its content. Therefore, we can assume that the legal theories of Hart and Dworkin are two competing models of law: Dworkin’s model considers law as a set of rules and principles and Hart’s model acknowledges only rules and court decisions as a source of law. The article also presents the key principles of positivism criticized by Dworkin. These principles, firstly, interpret law as a set of legal rules determined through a special legal criterion, secondly, provide the judge with an opportunity to make a decision “at his own discretion” in a situation not regulated by law, and, thirdly, recognize only legal rights and obligations enshrined in legal regulations. It is important to note that in this article the author describes criticism as an independent phenomenon of legal philosophy with a particular focus on the history and foundations of this phenomenon. The volume gathers eleven studies on the intellectual exchanges during the Middle Ages among the three cultures which existed side by side in the same geographical area, i.e. the vast space from the British Isles to the Sahara Desert, and from the Douro Valley to the Hindu Kush. These three cultures – who may not be reduced to their confession or ethnicity – are historically related to each other in many respects, both material (trade, wars, marriages) and immaterial (the interdependence (...) among their religious narratives and their philosophical speculations). The studies herein presented focus on some peculiar examples of the transcultural interactions among exponents of the Arabic, Hebrew and Latin philosophical and theological traditions. While we do not want to downplay the fundamental role of the religious contexts, our focus on the linguistic denominations of these cultures aims at drawing attention to the conceptual medium, or rather media, which underlined and shaped the interactions and interplays among these traditions – interplays that were characterized by the contact of these three languages being used by people of different religious beliefs in their quest for knowledge: Spanish Jews writing in Arabic, Jews collaborating in the translation of Arabic texts into Latin through the vernacular, Western Muslims whose writings were read mainly by Jews and Christians in Hebrew and Latin. Why are visual artworks experienced as having intrinsic significance or normative depth? Why are some works of art better able to manifest this significance than others? In this 2002 book Paul Crowther argues that we can answer these questions only if we have a full analytic definition of visual art. Crowther's approach focuses on the pictorial image, broadly construed to include abstract work and recent conceptually-based idioms. The significance of art depends, however, essentially on the transhistorical nature of the pictorial (...) image, the way in which its illuminative power is extended through historical transformation of the relevant artistic medium. Crowther argues against fashionable forms of cultural relativism, while at the same time showing why it is important that an appreciation of the history of art is integral to aesthetic judgment. We also show how Roig, in the framework of what he identifies as methodological amplification within the field of philosophy´s task, fixes a rupture when interweaving epistemological concepts with reflective exercises in which the art of philosophy explores the vital experience, builds and rebuilds its own sources and opens up to an axiological dimension. In this framework, Roig revises the "legacy", adds other voices, handles critically the axiological structure of discourses and analyzes its ways of recognition. We aim to present the theoretical and critical tools of this book, especially to discuss the conditions and possibilities of the philosophical knowledge taken as practical, social, established and as liberator; and to discuss the terms of humanisms that the philosophical knowledge presents or interpellates. McGandy's The Active Life: Miller's Metaphysics of Democracy, and the new edited collection of Miller's writings entitled The Task of Criticism, do an excellent job of revealing the contemporary significance of Miller's work. Collectively, they have convinced this skeptic that the midworld and its ontology of functioning objects are an important contribution to contemporary American philosophy.The Task of Criticism faces several challenges. First, George P. Brockway supervised the publication of five volumes of Miller's collected works, and Fell himself edited a 1990 volume on Miller's philosophy (The Philosophy of John William Miller, Lewisburg: Bucknell University Press), followed by Stephen Tyman's Decrying the Ideal (Carbondale: Southern Illinois University Press, 1993). Colapietro published Fateful Shapes of Human Freedom: John William Miller and the Crises of Modernity (Nashville: Vanderbilt University Press) in 2003. Do we really need another volume? Second, Miller's brand of idealism is not very fashionable these days. Is there any hope that pragmatic idealism can inform contemporary social theory, and make a contribution to the very real and concrete problems faced by modern democratic institutions?I believe that the answer to both of these questions is "yes." Recognizing the importance of previous volumes devoted to Miller's philosophy, the editors present The Task of Criticism as the first comprehensive introduction to Miller's philosophy, and it attempts to cut a middle ground between a complete collection of essays and a "best of" anthology. The category of the meaning of history has long existed in European philosophy as one of its fundamental themes, which has undergone many collisions during its development. The last century has been marked by a radical revision of approaches to this theme both in the philosophy of history and in the tradition of intellectual history. In the twentieth century, Kant’s historical criticism was taken by German thought to its logical conclusion in such a way that the assertion (...) of the meaning of history has actually suffered a fiasco in the field of rationalist philosophy. The purpose of this article is to attempt to show how the Russian philosopher Nikolai Berdyaev, witnessing the spiritual and political crisis of European and Russian culture, seeks a solution to this problem within the philosophy of history, reformulating the problem of the meaning of history in a metaphysical way. To do this, he investigates theologically the foundations on which the historiosophic projects of the New Age are built, and tries to resolve the contradictions in the understanding of Christian revelation that are revealed in them. Returning the question of the meaning of history to its theological source allows Berdyaev to reconcile the contradictory hopes of philosophers of history for the realization of the personal freedom of its subjects with the existence of a universally meaningful sense in it. It is important for the materialist historian, in the most rigorous way possible, to differentiate the construction of a historical state of affairs from what one customarily calls its "reconstruction." The "reconstruction" in empathy is one- dimensional. "Construction" presupposes "destruction." Almost fourteen years after the death of Jacques Derrida, the least one can say is that his inheritance is as contested and fraught with rivalries, rejections, and appropriations as at the time of the flowering of Deconstruction in American universities in (...) the seventies and eighties. A halt was observed in 1988-89 after the posthumous revelations about Paul de Man's past in Belgium and Derrida's embattled defense of his friend. Today, in France, one often hears that "Derrida a fait l'Ecole mais n'a pas fait ecole," meaning that Derrida passed the entrance examination of the prestigious Ecole Normale Superieure where he taught for a long time, where he met Paul Celan, Louis Althusser, Michel Foucault and many other luminaries, whereas he never had a real "school" in France-no real institutional backing beyond the various Parisian places at which he taught later, or those that he founded like the College de Philosophie; his following constituted of young philosophers, only a few of whom became university professors in their turn and disseminated his teachings. However, the mechanisms of power within the French university remained closed to Derrida until the end; besides, he wanted to prevent the stereotyped reproduction currently observed from master to disciple. The philosophy of “presence” seeks to challenge current understandings of meaning and understanding. One can trace its origins back to Vico, Dilthey, and Heidegger, though its more immediate exponents include Jean-Luc Nancy, Hans Ulrich Gumbrecht, and such contemporary philosophers of history as Frank Ankersmit and Eelco Runia. The theoretical paradigm of presence conveys how the past is literally with us in the present in significant and material ways: Things we cannot touch nonetheless touch us. This makes presence a (...) post-linguistic or post-discursive theory that challenges current understandings of “meaning” and “interpretation.” Presence provides an overview of the concept and surveys both its weaknesses and its possible uses. In this book, Ethan Kleinberg and Ranjan Ghosh bring together an interdisciplinary group of contributors to explore the possibilities and limitations of presence from a variety of perspectives—history, sociology, literature, cultural theory, media studies, photography, memory, and political theory. This thesis sets out to show that a philosophical reflection on history is, in the strongest possible way, an essential feature of Hume's project of a science of human nature: a philosophical investigation of human nature, for Hume, cannot be successful independently of an understanding of the relation of human beings to their history. Hume intended to criticize traditional metaphysics by referring all knowledge to experience. But it is almost always assumed that Hume means by "experience" the result (...) of an individual's past sense perception or personal observation. Accordingly, Hume's criticism of traditional metaphysics is taken to lead to an individualistic conception of knowledge and human nature. In this thesis I claim that this picture of Hume's "empiricism" is simply wrong. He is not a philosopher who reduces "experience" to the merely private happenings within a personal psychology. On the contrary, Hume has a wider notion of experience, one that includes not only personal observation and memory, but, fundamentally, one that includes implicit knowledge of human history. Experience, so understood, brings about what I term a historical point of view, namely, the point of view of someone who seeks to extend his experience as far as it is possible in order to acquire the capacity to produce more nuanced and impartial judgments in any given practice. It is precisely this historical point of view that enables us to depart from the individualistic perspective that we would otherwise be bound to adopt not only in epistemology but, most significantly, in politics, in social life, in religion, etc. ;Chapter 1 presents the historical background against which Hume elaborates his views of history's role in philosophy. Chapter 2 discusses and criticizes the individualist reading of Hume by showing that he had a satisfactory account of beliefs formed via human testimony. Chapter 3 presents a view of Hume on explanation that underscores his interest in practical and informal explanations as those of history. The book is about three things. First, how Ancient thinkers perceived humans as like or unlike other animals; second about the justification for taking a humane attitude towards natural things; and third about how moral claims count as true, and how they can be discovered or acquired. Was Aristotle was right to see continuity in the psychological functions of animal and human souls? The question cannot be settled without taking a moral stance. As we can either focus on continuity or (...) on discontinuities, how should natural science draw the boundaries? Moral agents act and react in a world that they see under a certain description, and there is no value free science that can settle what is the correct description. This book asks us to think about where moral justification could come from, and suggests that the supposed ‘moral status’ of the object cannot provide the answer. For the moral status of the object is a product of our own imagination, and once we see that, we also see that there remains the question where we ought to have the will to see it. Furthermore, since the perception of moral truth involves the development of imagination and will, the means to attain it will be better served by engagement with poetry and literature than with enquiries that seek to exclude the engagement of the imagination, or any appeal to the beauty of nature or the love of one's fellow creatures. Most philosophical writing is impersonal and argumentative, but many important philosophers have nevertheless written accounts of their own lives. Filling a gap in the market for a text focusing on autobiography as philosophy, this collection discusses several such autobiographies in the light of their authors' broader work, and considers whether there are any philosophical tasks for which life accounts are particularly appropriate. Instead of the common impersonal and argumentative forms of ordinary philosophical discussion, these autobiographical texts are deeply personal (...) and largely narrative or explanatory. The contributors to this book examine the philosophical significance of philosophers’ autobiographies and whether or not there are broadly philosophical tasks for which this sort of writing is particularly suited. _Autobiography as Philosophy_ contains a general discussion about the relation between philosophical and autobiographical writing, and essays on the specific writings of Augustine, Abelard, Montaigne, Descartes, Vico, Hume, Rousseau, Newman, Mill, Nietzsche, Collingwood and Russell by specialists on the works of these individuals. In lieu of an abstract, here is a brief excerpt of the content:Journal of the History of Ideas 61.1 (2000) 59-74 [Access article in PDF] Francesco Patrizi in the "Time-Sack": History and Rhetorical Philosophy * Paul Richard Blum Contemporary theory of history is much concerned with the narrative structure of history, its nature, and its epistemic status. 1 The problem is not only that sources present events mostly wrapped in narrative language but also that temporality is (...) an inherent feature both of the events told and of storytelling. 2 Narrativity and temporality touch upon basic metaphysical and anthropological questions, as Paul Ricoeur has pointed out, if narration is to be understood as self-explanation of a human being in whom "time" occurs as "being-in-time." 3 The following paper cannot claim to contribute to the current debate but presents Francesco Patrizi (1529-97) 4 as a Renaissance philosopher who addressed several of these problems. In discussing his conceptions of history and time, however, it is the aim of this paper only to locate these within his own philosophy. [End Page 59]One of the unresolved problems in the writings of Francesco Patrizi is the difference between his earlier contributions to the humanistic canon and his late philosophical main treatise, Nova de universis Philosophia. The earlier writings conform to the usual humanist literary topics: the political program of a città felice, the treatises on honor, the poetic fury, Petrarch (1553), and then his two dialogues on history (1560) and rhetoric (1562). The two works which followed, the Discussiones peripateticae (1571) and the Poetics (1586), show a characteristic development of humanist thinking, namely, the differentiation of purely philological from essentially philosophical literature.Patrizi's Discussiones peripateticae 5 is a polemic against Aristotle, written from a Platonic viewpoint, but his own philosophy is concealed under a mass of philological material. In an attempt that seeks to be virtually definitive, he cites passages from Aristotle and the Peripatetic tradition in order to point out mistakes and contradictions. It was on this account that Giordano Bruno heaped ridicule on him, calling him "sterco di pedanti." Simply put, he tells us, Patrizi demonstrates "how like he is to an ox or an ass." One cannot say that he has understood Aristotle either well or ill, but merely that he has read him and reread him, cut him up and stitched him together, compared him with a thousand other Greek writers, friends and foes alike, and altogether gone to an immense deal of trouble, not only to no purpose whatsoever but also to our infinite disappointment. Theodor W. Adorno’s writings are often categorized as either political, aesthetic or critical. While all of these characteristics are legitimate, it is problematic to view Adorno from only one of these angles. In fact, many literary critics consider his thoughts about literature to be simple cultural criticism, i.e., something that leaves the realm of pure scholarship by defiling the argumentation with philosophy or politics. Political theorists and philosophers, on the other hand, often view his literary concerns as superfluous. It (...) is my thesis that Adorno’s way of thinking can only be adequately understood when these categories are not seen as mutually exclusive. In this paper I discuss a prehistory of the recent metaphilosophical research and provide an overview of its most important areas. I review the ways of understanding of philosophy by the authors of the Early Modernity and contemporary continental philosophers and outline a trajectory of metaphilosophical discussions in analytic philosophy of 20th century. I try to show that the recent surge of metaphilosophy research in it could be explained by a search for a new identity of analytic philosophy after (...) wide disappointment in the “linguistic turn,” as well as after criticism of Quine and his followers of various aspects of the common method of conceptual analysis, and expansion of the field of inquiry. I argue that contemporary analytic philosophy is much closer to the classical and modern tradition than to the early analytic philosophy. And the most important question for contemporary metaphilosophers seems to be a question about possible substitutes of an old-fashioned conceptual analysis. Some authors propose to get rid of armchair methods at all and follow experimental line of research. This, however, could be destructive to the philosophy as a separate discipline. That’s why it is important to pay utmost attention to those philosophers who try to save armchair philosophy. As Timothy Williamson is one of the most interesting authors working in this vein, I asses his role in the recent metaphilosophical research. I give a brief review of his book “Doing Philosophy” (2018) and draw attention to the fact that its main ideas are briefly expressed in his paper “Armchair Philosophy”, published in this issue of the journal. I claim that the importance of Timothy Williamson’s work is best explained by its role in realizing that philosophers now have to make a hard choice between dissolving philosophical methodology in methods of experimental sciences and trying to find way of justification of armchair philosophy. Prompted by Hasok Chang’s conception of the history and philosophy of science (HPS) as the continuation of science by other means, I examine the possibility of obtaining scientific knowledge through philosophical criticism and reflection, in the light of four historical cases, concerning (i) the role of absolute space in Newtonian dynamics, (ii) the purported contraction of rods and retardation of clocks in Special Relativity, (iii) the reality of the electromagnetic ether, and (iv) the so-called problem of time’s arrow. In (...) all four cases it is clear that a better understanding of such matters can be achieved —and has been achieved— through conceptual analysis. On the other hand, however, it would seem that this kind of advance has more to do with philosophical questions in science than with narrowly scientific questions. This article shows that the question of “Historical Thinking and the Human” demands expanding the field of the philosophy of history. What I propose is to investigate the issue from two perspectives: firstly, by positioning it in the broader philosophical context, one that increasingly transcends the boundaries of the humanities to enter the realm of the life sciences; and secondly, by drawing on a wider range of analytical material than has usually been the case in classic works in the (...) philosophy of history. I will critically reflect upon history’s anthropocentric biases, highlighting the need to develop an alternative to history. My thinking is aligned, on the one hand, with notions of the agency of images that have emerged from art criticism and visual culture studies, and, on the other hand, with the idea of theriomorphism, which I explore in terms of new animism, new totemism and philosophical ethology. In my analysis of works by the South African artist Nandipha Mntambo, I argue that a future-oriented redefinition of the human should transcend the limited categories that have emerged within the framework of history understood as a Eurocentric approach to the past rooted in Greco-Judaic-Christian tradition. Shost'in and the French Orthodox priest Fr. Vladimir Gette on the theory of dogmatic development in the church. In (...) the context of this controversy, the arguments for the “defense” of Solovyov's position, cited in the magazine “Orthodox Review” by a theologian and Konstantin Leontyev's follower Ivan Kristi are also analyzed. The reception of Solovyov's theocratic ideas and reaction to his ecclesiastical views in both the Catholic and Orthodox circles of Russian and Western society is shown. Especially it concerns the criticism of Solovyov’s ideas in the pages of the French magazines “L’Univers”, “L'Union Chrétienne”, “Revue d’Eglise greque-unie”, etc. The evolution of Solovyov's views on the problem of the union of Eastern and Western churches, the renewal of church communication between Orthodoxy and Catholicism, the main result of which was his fundamental but unfinished work “The History and Future of the Theocracy” was demonstrated. Facticity itself is interpretive in that it sees what something is through question and answer. Heidegger is stepping back into the factors that precondition our understanding, the "forestructure" of understanding. This forehaving, he says, belongs to the very nature of knowing and understanding. We see something "as "something, and we see it in a specific historical situation.
