1. Bosanquet, who relished paradox, does not disappoint us about history. The late nineteenth century was a golden age of historical inquiry. Historians — Ernst Curtius, J.G. Droysen, Theodor Mommsen in Germany, William Stubbs, E.A. Freeman and F.W. Maitland in England, Jules Michelet and others in France — were establishing history as a credible and esteemed academic discipline. This increasing respectability of the practice of history was matched by a sophisticated theorisation of history, a theorisation which took two directions. On (...) the one hand were Marx’s brilliant and bewitching historical projections. On the other the logic and methodology of history as an autonomously valid form of knowledge and inquiry were being elaborated. This last was largely a process in which the hermeneutic inquiries of Friedrich Schleiermacher, Droysen and Wilhelm von Humboldt came to fruition in the work of such writers as Philip August Boeckh, Wilhelm Dilthey and — not to forget The Presuppositions of Critical History — our own F.H. August Boeckh, in his Encyclopedia and Methodology of the Philological Sciences provides an account of the methodology of philology (or what otherwise might be called methodological hermeneutics) that is the culmination of the development of the science of philology in the nineteenth century. Boeckh importantly defines philology in relation to philosophy and to history. Philosophy is the knowledge of the truth, gnosis, while philology is the knowledge of what has been known, anagnosis. Boeckh's hermeneutics provide the (...) background for much of the theory and practice of the twentieth and twentieth‐first centuries. Those who have looked for method in hermeneutics have looked to Boeckh. Those, like Hans‐Georg Gadamer and Paul Ricoeur, who have been critical of the methodologism and scientism in nineteenth‐century hermeneutics, have often considered Boeckh a leading example of these features which they would overcome. It is great honor to be even a virtual part of an event to celebrate the work of Leslie Zines, and especially to celebrate it in such august company. Leslie was a colleague that I greatly admired and liked. The disciplinary divide between us was not any bar to affection, though Leslie never let me forget that the constitutional-law terrain was sacred ground on which outsiders ventured at their peril. I particularly enjoyed the way that he, like our mutual, (...) recently departed friend, Paul Finn, gently mocked the pretensions of a philosopher to declaim on topics jurisprudential. I fear I’m going to tread on his ground again in this little paper and I can only beg his, and Paul’s, posthumous indulgence. My topic is the dispersion of power within the state. This ideal has a long history but has ceased to be much celebrated by those who endorse it and has come in for fierce attack among populist opponents. It’s not an exaggeration to say, in Yeats’s words, that on this subject ‘The best lack all conviction, while the worst Are full of passionate intensity’. In this short paper I would like to rehearse reasons why we should warmly endorse the dispersive ideal. And endorse it, regardless of how we dub it: whether, for example, we describe it in a mainly twentieth-century formula, as the separation of powers; in an eighteenth-century antecedent as a regime of checks and balances; in an earlier name that goes back to the Roman Republic as a mixed constitution; or in a term I myself favor as a polycentric arrangement or system. Interpreted as doctrine, nirvana is a wooden category; as a path, subtle and paradoxical, a factor celebrated in the later Mahayana texts (samsara is nirvana; nirvana is samsara). In pleading for sensitivity to context, Welbon maintains that the Buddha was not a philosopher, much less a nineteenth-century one, but a saint and a (...) "genius as a soteriological tactician": Depending on the context and in particular the needs of the individual(s) to whom he spoke, his emphasis varied. To those full of self, his message was expressed negatively. To those full of fear, the message expressed confidence. To those full of suffering, the message expressed hope. (p. 300) Nirvana's "meanings," then, are many, and include "both annihilation and bliss, negation and affirmation, nonexistence and existence" (p. 302). Yet the author's primary concern is not simply to advance one more theory of nirvana, lined up beside the rest; it is rather to elucidate the role of theory in its relation to intercultural and history of religions data. Interpretations are themselves phenomena whose intentionality, context, or history must be clarified. The differences between the scholars surveyed in this book stem not so much from varying conclusions about given data as from differences of premise and method; they are differences of questions rather than answers. Nirvana, a religious ultimate without the conception of deity, has indeed been a classic stumbling block to Western theories. The encounter, Welbon suggests, documents not only a history of methodological shortcomings, but "the fragile and inadequate nature of our understanding of what religion itself may be" (p. 301). Pp. xv+229. $7.50) Johann Georg Hamann, Philosophy and Faith. By W. M. Alexander. (The Hague: Martinus Nijhoff, 1966. Pp. xii+212. Gld. 28.25) America continues to contribute more than a fair share to the study of Hamann ---even though the Hamann News-Letter, edited by James C. O'Flaherty, had to stop appearing in 1963. It is now the same O'Flaherty who opens wide the gates for the study of Hamann in the English-speaking world by translating the Socratic Memorabilia and providing an introduction and explanatory notes. The Memorabilia without doubt offer the best first approach to Hamann. t But so great is the obscurity of Hamann that it is by no means sure that the Memorabilia have now become an exotericum. Before reviewing O'Flaherty's book I shall therefore present the content of the Memorabilia. If only we had simple blow-by-blow accounts of all of his writings before we embark on a wholesale interpretation! a For decades they were available in Reclams Universalbibliothek (in c. 1914 at a price of about three cents) and have now (August, 1968) been republished (together with Hamann's Aesthetica in nuce) with excellent notes and a commentary by Sven-Aage Jorgensen (present price: about twenty cents). In 1959 F. Blanke published another amply annotated edition with an extensive thorough commentary. 328 HISTORY OF PHILOSOPHY The purpose of the Memorabilia is to "convert" two friends of Hamann, Kant and Berens, from Enlightenment to Christianity (the two tried to do the opposite to Hamann) and to defend himself and his Christianity from their criticisms. To do so, Hamann decides to use philosophic rather than religious language. In so doing he will present himself as another Socrates, because, as Hamann sees it, it was the mission of Socrates to lead the Athenians to the unknown God, thus prefiguring the mission of St. Paul, and because Socrates opposed the then "enlighteners," viz., the Sophists. In so doing he furthermore compares some of his own character traits (for which he was blamed by Kant and Berens) and some events in his life with Socratic ones. But as he compares (equates) Socrates with the prophets and with Jesus, he by the same token compares (equates) himself with them. 1 August 2003 Karl Popper noted that, when social scientists are members of the society they study, they may affect that society. If the individuals to whom a theory initially applies come to understand that theory, then this understanding may affect their behaviour in such a way that the theory ceases to be applicable. This may be called the problem of reflexivity. In this paper, we identify such a problem in an apparently unlikely area: in the area of Condorcet’s (...) famous jury theorem. Suppose that each individual member of some decisionmaking body has a greater than 0.5 chance of making a correct judgment, and suppose further that all individuals’ judgments are independent from each other. Then the jury theorem states that the majority will make a correct judgment with a probability approaching 1 as the number of individuals increases. We argue that, if the individuals come to understand the jury theorem, then they may cease to make independent judgments, thereby undermining one of the conditions for the application of the theorem. Specifically, we suggest that the individuals may be faced with a temptation to free-ride on the epistemic efforts of others. We first develop the problem in some detail and then ask whether there are any escape routes that can protect the jury theorem against the effect of reflexivity. (shrink)

DBS Think Tank IX was held on August 25–27, 2021 in Orlando FL with US based participants largely in person and overseas participants joining by video conferencing technology. The DBS Think Tank was founded in 2012 and provides an open platform where clinicians, engineers and researchers can freely discuss current and emerging deep brain stimulation technologies as well as the logistical and ethical issues facing the field. The consensus among the DBS Think Tank IX speakers was that DBS expanded (...) in its scope and has been applied to multiple brain disorders in an effort to modulate neural circuitry. After collectively sharing our experiences, it was estimated that globally more than 230,000 DBS devices have been implanted for neurological and neuropsychiatric disorders. As such, this year’s meeting was focused on advances in the following areas: neuromodulation in Europe, Asia and Australia; cutting-edge technologies, neuroethics, interventional psychiatry, adaptive DBS, neuromodulation for pain, network neuromodulation for epilepsy and neuromodulation for traumatic brain injury. BatsonIn late August 1546, Philip Melanchthon had some seriously strange dreams. One night, he saw a man in the Elbe struggling to keep his head above the river's powerful current. As Melanchthon approached to help, he recognized the drowning man's visage: Charles V. Despite (...) Melanchthon's attempts to save him, the river dragged the emperor under and carried him away. Another night, he dreamed that while translating Demosthenes with his friend Joachim Camerarius in the Wittenberg castle (a Melanchthon dream if there ever was one!) he looked out a window to see that the Elbe had turned to blood.1 [End Page 713]These ominous visions reflected the precarious world Melanchthon faced in late summer 1546. Martin Luther, the hero of the German Reformation, had died in February, leaving a gaping hole in the evangelical movement. Further, German Protestantism was facing the largest political crisis in its short history. The Schmalkaldic War had begun in July, only a few weeks prior, and the Reformation faced intense military pressure from Charles V. As the emperor slowly advanced, an anxious Melanchthon lived in constant tension between wild hope that Charles would be defeated and grim fear of massive bloodshed.As the war began, Melanchthon was greatly disturbed by the violence and the potential for disastrous defeat of the Protestant cause. In an August 26 letter, he wrote this to a friend: "Often now, when I look over the Elbe River gliding by me, I sigh and think that, even if I could pour forth a river of tears as great as the Elbe's flow, I would never be able to exhaust the sadness which surrounds my soul because of this civil war. If only Charles had not started it!"2 Should the Schmalkaldic League be defeated and political support for the Reformation be crushed, the true church would be in dangerous waters, just like the emperor in Melanchthon's dream.In the midst of this impending catastrophe, on September 1, 1546, Melanchthon published an unusual work: the Collatio actionum forensium Atticarum et Romanarum praecipuarum (A comparison of the principal Attic and Roman legal actions). In this study, Melanchthon organized and compared the legal actions of Athens and Rome, following the order of the Ten Commandments. In 1546, Greek law was a virtually unknown field. Contemporary legal humanists like Andrea Alciato, Ulrich Zasius, and François Baudouin had devoted their attention almost exclusively to Roman or feudal European law.3 Nearly a century before the publication of sprawling [End Page 714] tomes by the Greek legal scholars Samuel Petit, Claudius Salmasius, and Johannes Meursius, Melanchthon treated the law of ancient Athens as a worthy subject.4 Even more puzzling, Melanchthon devoted himself to this arcane work during a moment of dire political crisis. The unusual subject matter of the Collatio and the urgent circumstances surrounding its publication raise a pair of intriguing questions: Why did Melanchthon think Attic legal actions were important? And why did he think they were worth studying while a military and political disaster loomed on the horizon?Melanchthon valued the ancient pagan laws because they showed how God had revealed legal and moral principles to the gentiles. His study of Attic and Roman law demonstrated how, through natural reason, the classical pagans had attained knowledge of the natural law and implemented it in their own societies.5 As a result, the ancient laws became indispensable to Christians studying law and moral philosophy.6 This work on ancient Greek law was an essential part of Melanchthon's pedagogical project of integrating Christianity and the classical world. As he wrote in the introduction, he had decided to write on Attic legal actions "so that students may know that they are not only formulas for litigation, but also a philosophy and a doctrine of virtue."7 By reconstructing the laws of ancient Athens and comparing them with those of Rome, Melanchthon demonstrated that classical moral and legal thought was in complete agreement with the Decalogue and essential for Christian moral development. Exactitude. The Genesis of an Epistemic Virtue in the ‘Long Nineteenth Century’. The article examines the genesis of exactitude as an epistemic virtue in both scholarly and scientific contexts in the 19th century, mainly in Prussia. Starting with an influential historiographic work on ancient metrology three semantic fields of accuracy, exactitude and precision are differentiated and pursued in their etymologies as well as applications. The historic situation between 1790 and 1860 is identified as the crucial period when the exactness of (...) the exact sciences as well as the notion of accuracy in the humanities start to diverge from one another in order to develop an epistemic virtue each on its own. Do citizens have an obligation to obey the law? This book differs from standard approaches by shifting from the language of obedience to that of deference. The popular view that law claims authority but does not have it is here reversed on both counts: law does not claim authority but has it. Though the focus is on political obligation, the author approaches that issue indirectly by first developing a more general account of when deference is due to the view of (...) others. Two standard practices that political theorists often consider in exploring the question of political obligation - fair-play and promise-keeping - can themselves be seen as examples of a duty of deference. In this respect the book defends a more general theory of ethics whose scope extends beyond the question of political obligation to questions of duty in the case of law, promises, fair play and friendship. Phenomenal consciousness and social cognition are interlocking capacities, but the relations between them have yet to be systematically investigated. In this paper, I begin to develop a theoretical and empirical framework for such an investigation. I begin by describing the phenomenon known as social pain: the affect associated with the perception of actual or potential damage to one’s interpersonal relations. I then adduce a related phenomenon known as affective contagion: the tendency for emotions, moods, and other affective states to spread (...) from person to person in social contexts. Experimental studies of these two phenomena suggest that affective consciousness depends on perception of the social world in much the same way that it depends on perception of the body – in short, that consciousness is ‘socially embodied’. In the second part of the paper I argue that the distinctive sociality of our species, especially its moral dimension, rests heavily on our ability to represent the conscious states of others. In closing, I put these ideas together and show how they point to a circular causal-mechanistic nexus between consciousness and social mindedness. (shrink)

Employing a thematic approach and drawing on disciplines ranging from neurobiology to philosophy, Film and Morality examines how morality is presented in films and how films serve as a source of moral values. While the role of censorship in upholding moral standards has been considered comprehensively, the presence of moral dilemmas in films has not attracted the same level of interest. Film-makers may address moral concerns explicitly, but moral dilemmas can serve as plot devices, creating dramatic tension by providing pivotal (...) moments when characters are called upon to make life-changing decisions. Drawing on a range of well-known and neglected films mainly from Britain and America, this book provides numerous examples of how film-makers make use of morality and how audiences are invited to explore moral issues by following characters who live with the consequences of their choices. Film and Morality introduces philosophical debates on such topics as free will, conscience and the place of moral codes in everyday life, showing the relevance of film to these issues. We develop and defend a distinction between two types of self-censorship: public and private. First, we suggest that public self-censorship refers to a range of individual reactions to a public censorship regime. Second, private self-censorship is the suppression by an agent of his or her own attitudes where a public censor is either absent or irrelevant. The distinction is derived from a descriptive approach to self-censorship that asks: who is the censor, who is the censee, and how do they interact? (...) We label situations in which censor and censee are different agents as public self-censorship, and situations in which they are the same agents as private self-censorship. We demonstrate the salience of this distinction by analysing the case of publication of Mohammed cartoons by the Danish newspaper Jyllands-Posten. Our analysis reveals the presence and interaction of a number of different instances of private and public self-censorship. While our article is primarily concerned with establishing this novel descriptive distinction between public and private self-censorship, our analysis has important evaluative implications. We explain for instance how Jyllands-Posten was laudable as a public self-censor but not so as a private self-censor. In general, our analysis reveals that the agents and processes involved in public and private self-censorship are substantively different, as are the agents to whom normative principles regarding censorship should be applied. In particular, principles of free speech do not apply to the case of private self-censorship, because while an instance of censorship, the absence of an external censor makes the censorship non-coercive.
