Most work on reflexivity has focused on individuals exercising their reflexivity through discourse. However, agents have three major aspects (intentionality, causal efficacy and embodiment) and they are fundamentally social. This article examines the possibility of collective reflexivity conducted not just by saying, but also by doing—that is, through their embodiment. By expanding the concept of ‘performatives’ to encompass not just speech acts but also acts that speak (i.e. embodied activities as socially meaningful) and applying the work of Charles S. (...) Peirce in order to develop an ontology of embodied reflexivity, it becomes possible to determine several criteria defining embodied collective reflexivity. Assessing possibilities such as legislative debate, political demonstrations, religious ritual and dramatic performance reveals that a certain set of practices does in fact meet those criteria and discloses additional aspects of what constitutes embodied collective reflexivity. This article aims to connect Austin's seminal notion of a speech act with developments in philosophy of language over the last forty odd years. It starts by considering how speech acts might be conceived in Austin's general theory. Then it turns to the illocutionary acts with which much philosophical writing on speech acts has been concerned, and finally to the performatives which Austin's own treatment of speech as action took off from.

Decisions are performatives - or at least, they share important features with performative utterances that can elucidate our theory of what type of thought they are, and what they do. Namely, decisions have an analogous force to that of performatives, where the force of a propositional attitude or utterance is constituted by (i) its point, or purpose, which is mainly a matter of its direction-of-fit, and (ii) its felicity conditions. The force of both decisions (...) and performatives is to bring into being the states of affairs represented in their intentional contents, merely in virtue of the decision or performative’s occurrence and the satisfaction of the felicity conditions they presuppose. The aim of this contribution is to propose a natural implementation of the reflexive-referential theory advanced by Perry 2001 that aims at accounting for the reflexive character of explicit performative utterances. This is accomplished by introducing a reflexive-performative constraint on explicit performatives.

In order to maximize human performance, defence forces continue to explore, develop, and apply human performance enhancement (HPE) methods, ranging from pharmaceuticals to (bio)technological enhancement. This raises ethical, legal, and societal concerns and requires organizing a careful reflection and deliberation process, with relevant stakeholders. We discuss a range of ethical, legal, and societal aspects (ELSA), which people involved in the development and deployment of HPE can use for such reflection and deliberation. A realistic military scenario with proposed HPE application can (...) serve as a starting point for such an iterative and participatory process. Stakeholders can discuss this application, modify its features, and design appropriate processes around it – for instance, procedures for informed consent. We propose that organizing aspects into these three categories – ethical, legal, and societal – can help involve appropriate interlocutors at different moments: legal aspects with people in strategy or management roles, from the start of a project; ethical aspects with people in operations and medical roles, during development; and societal aspects with people in communication and personnel roles, during deployment. This paper contains an analysis of performatives with special attention to performatives in the law. It deals with the possibility to recognise performativity by means of a grammatical-syntactic criterion, the self-verifying and norm-promulgating character of legal performatives, an analysis of the effects of performatives by means of causal logic, the different forms of performativity and a theory of promise-performatives.

Professor J. W. N. Watkins argues in his Hobbes' System of Ideas that Hobbes' theory of moral predicates must be interpreted in terms of Austinian performatives. In this paper I shall argue two points. First, that Watkins' thesis is false. Second, that Hobbes' own doctrine, which asserts that things are made good or just by being declared to be so by the sovereign, is inconsistent. Watkins begins with brief exposition of Hobbes' theory of moral language as stated in the (...) Leviathan . But whatsoever is the object of any mans Appetite or Desire; that is if, which he for his part calleth Good : And the object of his Hate, and Aversion, Evill ; And of his Contempt, Vile and Inconsiderable . The late John Austin's William James Lectures 1 might well have borne the subtitle ‘In Pursuit of a Vanishing Distinction’. Although the chase is remorseless, glimpses of the quarry become increasingly equivocal and the hunter is left empty-handed at last. It is hard to know what has gone awry. Has the wrong game been pursued—and in the wrong direction?

‘Tympaniser’, Alan Bass tells us, is an ‘archaic verb meaning to ridicule publicly’ or to decry. In the essay fronting Margins of Philosophy called ‘Tympan’ Derrida decries the philosophy that would own its limits, absorbing ‘the margin of its own volume’. While it is Derrida’s late work on the ‘animal question’ that has brought his insistence on the nourishment of the limits between species as limitrophy to wider attention, it is also named as the general condition of the interface of (...) the limits in the much earlier text, ‘Tympan.’ There, in dislocating the tympanum, the margins of philosophy are eaten. Equally, given the rhythmic address of the tympanum, we might say that the margins of philosophy are beaten. Struggling within the strictures of a small town amateur dramatic rehearsal, Selma, the lead protagonist in Dancer in the Dark, makes a plea for more rhythm. But there is no license for tap-dancing in The Sound of Music. This chapter considers Dancer’s persistent play on rhythmic sounds as that which trip Selma’s fantasy song and dance numbers as a ‘tympanising’ of the limits, notably of the limits of the law in both juridical and symbolic senses, as they also work the edges of the film’s two styles. In a provocative analysis of this film, Cary Wolfe suggests that we might understand Selma’s vocal style as a refusal of the phallic imposition of language, and that her virtually suicidal submission to the death sentence construed as a Lacanian ‘feminine’ act, allow for a notion of a ‘posthuman feminine’. ‘Tympan Alley’ redirects Wolfe’s tantalising term ‘posthuman feminine’ through a more consistently Derridean line of thought. It draws on Derrida’s late work on the animal, in which it is polemically clear that deconstruction has never been confined to the signifier nor to the human, and sounds out the implications of his early work on b/eating the limits through Selma’s percussive ear. A two‐dimensional modal operator is utilized in analyzing non‐ performative sentences that contain principal verb which, in other contexts, have (...) performative uses. My primary goal in this paper is to defend the plausibility of Kripke’s thesis that there are contingent a priori truths, and to fill out some gaps in Kripke’s own account of these truths. But the strategy here adopted is, to the best of my knowledge, still unexplored and different from the one adopted both by Kripke himself and by his critics. I first argue that Kripke’s examples of such truths can only be legitimate if seen as introduced by performative (...) utterances sense). And, if this is so, we can apply the machinery of illocutionary act theory to these utterances to explain how one can have a priori knowledge of some contingent facts generated by the utterances themselves. I shall argue that the overall strategy can fill out two gaps in Kripke’s original account: first, we can explain the nature of the truth-makers of contingent a priori truths sense, broadly conceived) and, second, we can explain how contingent a priori knowledge can be transmitted from one speaker to another. I explore how gender can shape the pragmatics of speech. In some circumstances, when a woman deploys standard discursive conventions in order to produce a speech act with a specific performative force, her utterance can turn out, in virtue of its uptake, to have a quite different force—a less empowering force—than it would have if performed by a man. When members of a disadvantaged group face a systematic inability to produce a specific kind of speech act that they are entitled (...) to perform—and in particular when their attempts result in their actually producing a different kind of speech act that further compromises their social position and agency—then they are victims of what I call discursive injustice. I examine three examples of discursive injustice. I contrast my account with Langton and Hornsby's account of illocutionary silencing. I argue that lack of complete control over the performative force of our speech acts is universal, and not a special marker of social disadvantage. However, women and other relatively disempowered speakers are sometimes subject to a distinctive distortion of the path from speaking to uptake, which undercuts their social agency in ways that track and enhance existing social disadvantages. High-performance work systems -performance research has dominated innovative human resource management studies for two decades. However, mainstream HPWS research has paid little attention to employees’ perceptions of HPWS, or to the relationship between HPWS and corporate social performance. The influence of CSP on employee outcomes such as organizational commitment and organizational citizenship behaviour has thus been similarly neglected. This paper seeks to investigate these missing links in literature using data collected from a sample of 700 employees in China. The findings (...) demonstrate that HPWS is positively related to HPWS satisfaction and employees’ perceptions of CSP. HPWS satisfaction fully mediates the relationship between HPWS and employees’ affective commitment. There are multiple mediators between HPWS and OCB, indicating more complicated mechanisms through which HPWS leads to desired HR outcomes. Employees’ perceived CSP has a significant influence on HPWS satisfaction, AC and OCB, suggesting firms should place a premium on achieving a reputation as being socially responsible. (shrink)

Philosophers of history in the past few decades have been predominantly interested in issues of explanation and narrative discourse. Consequently, they have focused consistently and almost exclusively on the historian’s output, thereby ignoring that historical scholarship is a practice of reading, thinking, discussing, and writing, in which successful performance requires active cultivation of certain skills, attitudes, and virtues. This paper, then, suggests a new agenda for philosophy of history. Inspired by a “performative turn” in the history and philosophy of science, (...) it focuses on the historian’s “doings” and proposes to analyze these performances in terms of epistemic virtue. It argues that historical scholarship is embedded in “practices” or “epistemic cultures,” in which knowledge is created and warranted by means of such virtues as honesty, carefulness, accuracy, and balance. These epistemic virtues, however, are not etched in stone: historians may highlight some of them, exchange one for another, or reinterpret their meaning. On the one hand, this suggests a rich area of research for historians of historiography. To what extent can consensus, conflict, continuity, and change in historical scholarship be explained in terms of epistemic virtue? On the other hand, the proposal outlined in this article raises a couple of philosophical questions. For example, on what grounds can historians choose among epistemic virtues? And what concept of the self comes with the notion of virtue? In addressing these questions, philosophy of history may expand its current scope so as to encompass not only “writings” but also “doings,” that is, the virtuous performances historians recognize as professional conduct. Scientific models can be performative: they can causally affect the phenomena they are intended to represent. The existing literature offers two responses. The appraisal view emphasizes that performativity can sometimes be a good-making model attribute, e.g., when predictions steer the public’s behavior in desirable ways. The mitigation view seeks to endogenize agents’ behavioral response to model-issued forecasts to get rid of performativity instead. This paper argues that neither approach is fully compelling: the appraisal view encounters severe concerns about moral values (...) illegitimately encroaching on how modelers construct and use models, while the mitigation view fails to acknowledge that endogenization is itself a choice that involves substantive value-judgments relating to the desirability of certain social outcomes. The use of certain performance-enhancing drugs (PED) is banned in sport. I discuss critically standard justifications of the ban based on arguments from two widely used criteria: fairness and harms to health. I argue that these arguments on their own are inadequate, and only make sense within a normative understanding of athletic performance and the value of sport. In the discourse over PED, the distinction between “natural” and “artificial” performance has exerted significant impact. I examine whether the distinction makes sense (...) from a moral point of view. I propose an understanding of “natural” athletic performance by combining biological knowledge of training with an interpretation of the normative structure of sport. I conclude that this understanding can serve as moral justification of the PED ban and enable critical and analytically based line drawing between acceptable and nonacceptable performance-enhancing means in sport. Recent years have witnessed an increasing growth in mutual funds that invest according to social criteria. As a consequence, the financial performance of these portfolios has attracted the interest of academics and practitioners. This paper investigates the performance of a sample of socially responsible mutual funds from seven European countries investing globally and/or in the European market. Using unconditional and conditional models, we assess the performance of these funds in comparison to conventional and socially responsible benchmark portfolios. The results show (...) that European socially responsible funds present in general neutral performance in relation to both conventional and socially responsible benchmarks. However, performance estimates seem to be slightly higher when funds are evaluated in relation to socially responsible indices. Our results also show that socially responsible funds are more exposed to conventional than to socially responsible indices. Furthermore, conventional benchmarks are better able to explain fund returns than socially responsible benchmarks. These findings are robust to both unconditional and conditional models of performance. We also observe that conditional models lead to a slight improvement of performance estimates and to the explanatory power of the models, both when conventional and socially responsible benchmarks are considered. This is consistent with most previous empirical findings on conditional performance evaluation. Our results show that investors who wish to hold European funds can add social screens to their investment choices without compromising financial performance. (shrink)
