Institutional review boards, tasked with facilitating ethical research, are often pulled in competing directions. In what we call the protection-inclusion dilemma, we acknowledge the tensions IRBs face in aiming to both protect potential research participants from harm and include under-represented populations in research. In this manuscript, we examine the history of protectionism that has dominated research ethics oversight in the United States, as well as two responses to such protectionism: inclusion initiatives and critiques of the term vulnerability. We look at (...) what we know about IRB decision-making in relation to protecting and including “vulnerable” groups in research and examine the lack of regulatory guidance related to this dilemma, which encourages protection over inclusion within IRB practice. Finally, we offer recommendations related to how IRBs might strike a better balance between inclusion and protection in research ethics oversight. (shrink)

We set out an account of how self-domestication plays a crucial role in the evolution of language. In doing so, we focus on the growing body of work that treats language structure as emerging from the process of cultural transmission. We argue that a full recognition of the importance of cultural transmission fundamentally changes the kind of questions we should be asking regarding the biological basis of language structure. If we think of language structure as reflecting an accumulated set of (...) changes in our genome, then we might ask something like, “What are the genetic bases of language structure and why were they selected?” However, if cultural evolution can account for language structure, then this question no longer applies. Instead, we face the task of accounting for the origin of the traits that enabled that process of structure-creating cultural evolution to get started in the first place. In light of work on cultural evolution, then, the new question for biological evolution becomes, “How did those precursor traits evolve?” We identify two key precursor traits: the transmission of the communication system through learning; and the ability to infer the communicative intent associated with a signal or action. We then describe two comparative case studies—the Bengalese finch and the domestic dog—in which parallel traits can be seen emerging following domestication. Finally, we turn to the role of domestication in human evolution. We argue that the cultural evolution of language structure has its origin in an earlier process of self-domestication. (shrink)

The use of genome-wide association studies in medical research and the increased ability to share data give a new twist to some of the perennial ethical issues associated with genomic research. GWAS create particular challenges because they produce fine, detailed, genotype information at high resolution, and the results of more focused studies can potentially be used to determine genetic variation for a wide range of conditions and traits. The information from a GWA scan is derived from DNA that is a (...) powerful personal identifier, and can provide information not just on the individual, but also on the individual's relatives, related groups, and populations. Furthermore, it creates large amounts of individual-specific digital information that is easy to share across international borders. This paper provides an overview of some of the key ethical issues around GWAS: consent, feedback of results, privacy, and the governance of research. Many of the questions that lie ahead of us in terms of the next generation sequencing methods will have been foreshadowed by GWAS and the debates around ethical and policy issues that these have created. La integración de la tecnología en el ámbito del derecho penal plantea desafíos significativos debido a la falta de regulación de la inteligencia artificial (IA), lo que podría comprometer los derechos fundamentales. Este estudio se centra en abordar estos desafíos y proponer soluciones mediante un análisis exhaustivo de la situación actual y las posibles implicaciones de la IA en el sistema jurídico penal. El objetivo principal de esta investigación es analizar los problemas, desafíos y oportunidades que surgen con la implementación (...) de la inteligencia artificial en el ámbito penal. Se busca identificar la necesidad de una regulación específica para la IA en el derecho penal, con el fin de proteger los derechos fundamentales de las personas y garantizar un sistema jurídico justo y equitativo. Para abordar esta problemática, se adoptó un enfoque metodológico cualitativo. Se llevó a cabo una revisión bibliográfica detallada para examinar los antecedentes, problemas y desafíos asociados con la IA en los sistemas jurídicos, especialmente en el ámbito penal. Además, se realizaron análisis de criterios y opiniones de expertos en derecho para obtener una comprensión más profunda de la situación y las posibles soluciones. Los resultados de este estudio revelan la necesidad urgente de establecer una normativa específica para regular la aplicación de la inteligencia artificial en el ámbito penal. Se destaca que la falta de regulación representa un riesgo significativo para los derechos fundamentales, especialmente en lo que respecta a la configuración de delitos con el apoyo de la IA. Además, se identifican diferentes dimensiones que deben abordarse en la regulación, incluyendo principios y reglas básicas del derecho, supervisión humana de los sistemas de IA y la promoción de la innovación responsable en este campo. Este artículo subraya la importancia de establecer una regulación efectiva para la inteligencia artificial en el ámbito penal. Esta regulación no solo protegerá los derechos fundamentales de las personas, sino que también promoverá un uso responsable y progresivo de la IA como una herramienta valiosa para los profesionales del derecho. Forgiveness is clearly an important aspect of our moral lives, yet surprisingly Kant, one of the most important authors in the history of Western ethics, seems to have very little to say about it. Some authors explain this omission by noting that forgiveness sits uncomfortably in Kant’s moral thought: forgiveness seems to have an ineluctably ‘elective’ aspect which makes it to a certain extent arbitrary; thus it stands in tension with Kant’s claim that agents are autonomous beings, capable of determining (...) their own moral status through rational reflection and choice. Other authors recognise that forgiveness plays a role in Kant’s philosophy but fail to appreciate the nature of this duty and misrepresent the Kantian argument in support of it. This paper argues that there is space in Kant’s philosophy for a genuine theory of forgiveness and hopes to lay the grounds for a correct interpretation of this theory. I argue that from a Kantian perspective, forgiveness is not ‘elective’ but, at least in some cases, morally required. I claim that, for Kant, we have an imperfect duty of virtue to forgive repentant wrongdoers that have embarked on a project of self-reflection and self-reform. I develop a novel argument in support of this duty by drawing on Kant’s theory of rational agency, the thesis of radical evil, Kant’s theory of moral development, and the formula of humanity. However, it must be noted that this is a conditional duty and Kant’s position also entails that absence of repentance on the part of the wrongdoer should be taken as evidence of a lack of commitment to a project of self-reflection and self-reform. In such cases, Kant claims, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. I argue that this duty should be understood as one of the duties of self-esteem, which involves the duty to respect and recognise our own dignity as rational beings. (shrink)

The At Home/Chez Soi project is a pragmatic trial that is intended to test the effectiveness of providing persons who are homeless and mentally ill with housing and support for their mental illnesses. Research undertaken in academic journals and the gray literature about the ethics of conducting pragmatic housing studies with persons who are mentally ill revealed the lack of published knowledge in this area of research ethics. Thus, the At Home/Chez Soi project had to tailor traditional research ethics thinking (...) and tools to best protect its stakeholders. In this article, we outline two of the modifications we made. First, we evaluate the ethical challenges present when participants want to withdraw from a housing study. And second, we describe how adverse events are addressed in our pragmatic trial, and how a specially convened safety committee protects participants and stakeholders. (shrink)

Tentaremos analisar o riso burlesco, erótico e satírico da obra de Petrônio, característico da sátira menipéia e do conto milesiano, como nos atesta Enylton Sá Rego na obra O calundu e a panacéia:Machado de Assis, a sátira Menipéia e a tradição luciânica ( 1989) e, também, Ettore Paratore no livro História da literatura latina (1987). A incursão do riso no Satiricon segue um caminho erótico e libertino e, para embasar teoricamente essa questão, buscamos o estudo do filósofo francês Michel Foucalt (...) com sua História da Sexualidade3: o cuidado de si ( 1988) e de do historiador Paul Veyne em seu artigo o Império Romano Nosso objetivo é confrontar passagens significativas de Brás Cubas com passagens semelhantes do Satiricon, sob a perspectiva, ou seja, através da visão do narrador-personagem. Por meio do sério-cômico e do distanciamento do estilo sátira menipéia, mostraremos que mesmo destituídas de intenções moralizantes de forma direta, ambas as obras fazem uma crítica ao comportamento da sociedade. Por fim, ao tratar o riso de Petrônio e Machado como uma forma de crítica social velada, tentarei mostrar que a obra inserida na categoria de sátira menipeia não precisa satisfazer necessariamente um caráter prosimétrico, ou seja, ser uma mistura de prosa e verso - já que, dessa forma, Memórias Póstumas estaria totalmente fora do estilo - mas, sim, estar dentro de um viés cômico-crítico em relação a sociedade de sua época. How do cognitive biases and mechanisms from learning and use interact when a system of language conventions emerges? We investigate this question by focusing on how transitive events are conveyed in silent gesture production and interaction. Silent gesture experiments have been used to investigate cognitive biases that shape utterances produced in the absence of a conventional language system. In this mode of communication, participants do not follow the dominant order of their native language, and instead condition the structure on the (...) semantic properties of the events they are conveying. An important source of variability in structure in silent gesture is the property of reversibility. Reversible events typically have two animate participants whose roles can be reversed. Without a syntactic/conventional means of conveying who does what to whom, there is inherent unclarity about the agent and patient roles in the event. In experiment 1 we test a novel, fine-grained analysis of reversibility. Presenting a silent gesture production experiment, we show that the variability in word order depends on two factors that together determine how reversible an event is. We relate our experimental results to principles from information theory, showing that our data support the “noisy channel” account of constituent order. In experiment 2, we focus on the influence of interaction on word order variability for reversible and non-reversible events. We show that when participants use silent gesture for communicative interaction, they become more consistent in their usage of word order over time, however, this pattern less pronounced for events that are classified as strongly non-reversible. We conclude that full consistency in word order is theoretically a good strategy, but word order use in practice is a more complex phenomenon. (shrink)

The purpose of this paper is to analyse the gap between the strategic and operational levels of corporate responsibility. The strategic level of corporateresponsibility refers to the strategic plans concerning corporate responsibility which are examined by looking at the corporate responsibility documents. The operational level stands for the everyday actions of retailers which are analysed through interviews of nine retailers. The gap between the strategic plans and operational actions is described and analysed to understand why and how the gap exists (...) and what could be done to overcome the gap in the future. Climate change exposes ecological and socio-economic systems to risks. The identified disparities in knowledge about the social climate system are at the root of the difficulties in perceiving and understanding the diversity of risks related to climate change. The still huge gap between what science and technological innovation can contribute to mitigation and what is unmanageable by humans inevitably requires a continuous process of adaptation. This work is part of the research associated with the European project (under the ERA4CS) 'Citizen (...) Sensing - Urban climate resilience through participatory risk management systems', which proposes to develop a Participatory Climate Risk Management System, a two-way communication system where is part of a participatory risk management system, contributing to adaptive governance. These objectives will be achieved through the creation of a platform that will incorporate information gathered from four pilot studies: Norrköping (Sweden), Porto (Portugal), Rotterdam (The Netherlands) and Trondheim (Norway). Ultimately, the aim is to draw conclusions on how this application can contribute to improving citizens' literacy to cope with climate change adaptation and to raise awareness of this problem, as the involvement of citizens and stakeholders will only be improved if the perception of the risk of climate change is substantially increased. Awareness campaigns about the potential risks associated with extreme events are of great importance. Citizens tend to view climate change as a global phenomenon, ignoring and avoiding taking action until it is directly and seriously affected. (shrink)

Across languages, we find epistemic indefinites, i.e. existential determiners that can convey information about the speaker’s epistemic state.1 One such indefinite is Spanish alg´un, which marks ignorance on the part of the speaker. By using alg´un in (1a) the speaker signals that he is unable (or unwilling) to identify the doctor that Mar´ıa married. Hence, it would be odd for him to add a namely continuation that explicitly identifies the doctor in question, as in (1b). El dialeteísmo es la posición que afirma que hay contradicciones verdaderas. Este artículo versará sobre esa posición. En la primera sección, mencionaré los principales aportes que, en mi perspectiva, el dialeteísmo ha hecho a la lógica filosófica. En la segunda sección, analizaré el principal problema del dialeteísmo. En la tercera sección, mostraré que los argumentos a favor del dialeteísmo no llegan a establecer la verdad de esta posición. Finalmente, explicaré cuál es el tipo de paraconsistencia que considero adecuada y la (...) compararé con la posición dialeteísta. Dialetheism is the position which claims that there are true contradictions. This paper deals with this position. In the first section, I will mention the main contributions that, in my perspective, dialetheism has made to philosophical logic. In the second section, I will analyze the main problem of dialetheism. In the third section, I will show that the arguments in favor of dialetheism are not conclusive. Finally, I will explain which kind of paraconsistency I consider adequate, and I will compare it with the dialetheist position. (shrink)

Este artículo tiene un doble objetivo: describir y analizar los aprendizajes de las cuestiones socialmente vivas con medios digitales y recursos multimediales; y caracterizar las potencialidades de estos medios en las clases de Ciencias Sociales a partir de la educación remota de emergencia. Estas transformaciones trajeron mutaciones en el oficio de ser estudiante. Desde la perspectiva instrumental identificamos aprendizajes vinculados con: la administración del tiempo personal, la organización de los recursos multimediales y las nuevas demandas de aprendizaje. Por su parte, (...) desde la perspectiva social los/as estudiantes de formación docente reconocen aprendizajes referidos a estas nuevas formas de participación en los medios digitales, vinculadas con: el uso de las redes sociales para las tareas de aprendizaje, la búsqueda, selección y lectura colaborativa de fuentes y documentos y el cuidado en internet. Y desde la perspectiva psíquica, se identifica un malestar asociado a la incertidumbre vinculada con los nuevos regímenes de cursada y acreditación. Estos resultados son de gran valor para pensar la enseñanza de las ciencias sociales en la etapa post pandemia. (shrink)

En este artículo se presenta un abordaje general de la teoría de la justicia social de John Rawls. Revisamos algunas críticas desde diversos frentes teóricos. Consideramos que la justicia social permite enjuiciar las consecuencias regresivas para la humanidad del capitalismo en su fase neoliberal y comenzar a imaginar otros mundos posibles.

A PROTEÇÃO DOS DIREITOS HUMANOS NO CONTINENTE EUROPEU: BREVES APONTAMENTOS.

Neste trabalho são apresentados dados e reflexões sobre a proposta pedagógica de Ensino Médio Politécnico, implantada desde 2012 nas escolas públicas estaduais do Rio Grande do Sul, Brasil. Tendo como pano de fundo as concepções do Educar pela Pesquisa e da Interdisciplinaridade - eixos norteadores da parte diversificada denominada Seminário Integrado -, a investigação teve cunho qualitativo, apresentando inferências sobre as compreensões acerca do conceito de pesquisa alcançadas pelos estudantes. As intervenções pedagógicas da investigação foram desenvolvidas em quatro turmas de (...) uma escola em Porto Alegre, capital do Rio Grande do Sul, encaminhadas no início do ano letivo de 2015. Por meio da análise qualitativa das falas dos alunos, da identificação da ampliação da complexidade dos seus respectivos mapas conceituais, confeccionados no software CmapTools, assim como da avaliação quanto à profundidade dos projetos encaminhados, pôde-se evidenciar ampla evolução nas compreensões dos alunos quanto ao conceito de pesquisa, percebendo-se assim que a metodologia aplicada nessa investigação foi profícua. Philosophical theories of memory rarely distinguish between importantly different sorts of memory: procedural, semantic and episodic. I argue for a temporal representation theory to explain the unique characteristic of episodic memory as the only form of conscious memory. A careful distinction between implicit and explicit representation shows how the past figures in memory. In procedural and semantic memory, the influence of the past is implicit by which I mean that the past experience is used but not represented in the skill (...) or knowledge. Episodic memory, in contrast, depends on representing a past experience as past. On a temporal representation theory of consciousness, a conscious state represents the present moment, and in the case of episodic memory, it includes a representation of past experience. The embedded account of the ‘feeling of pastness’ takes past experience to be part of the explicit content of a conscious state. An episodic memory is a representation of the present that includes a representation of the past. Whereas a higher-order theory of consciousness can give no reason why only episodic memories are conscious, a temporal theory explains why episodic memories are both higher-order and conscious. Finally, I consider the essential role of episodic memory in the formation of a temporally extended self. The demands of a social environment motivate development of an ability to track the mental states of others and oneself over time. By incorporating past experience (and future experience) into the present, episodic memory extends experience in time to form the sense of self. Through a careful examination of the function of temporal representation, we can see why the past is not consciously represented in procedural and semantic memory and the value of consciously representing the past in episodic memory. The idea that teachers love children is often taken for granted in education. Rarely is the idea of love itself examined. Bringing together the work of educators, curriculum theorists and clinical psychoanalysts, and drawing upon autobiographical and narrative case studies, this groundbreaking collection examines the collision of love and learning, including the ways in which such intersections are provoked, repressed and denied. Contributors turn to psychoanalysis to explore questions of love in all of its varying permutations - ambivalence, sexuality, hatred, (...) desire, projection, and loss - in order to demonstrate how the social ramifications of such work is critical to the ways teachers are currently being prepared for life in the classroom. Opaque value chains as well as environmental, ethical and health issues and food scandals are decreasing consumer trust in conventional agriculture and the dominant food system. As a result, critical consumers are increasingly turning to community-supported agriculture (CSA) to reconnect with producers and food. CSA is often perceived as a more sustainable, localized mode of food production, providing transparent production or social interaction between consumers and producers. This enables consumers to observe where their food is coming from, which means CSA (...) is considered suitable for building trust in food (production). However, it remains unclear how exactly members’ trust in ‘their’ farmers is built. To determine the factors that predict members’ trust in CSA and its farmers, and the importance of these factors when compared to each other, we conducted a quantitative study among CSA members in Germany and applied a multiple regression model (n = 790). The analysis revealed that trust in CSA and its farmers is influenced by “reputation”, “supply of information”, “direct social interaction” and the “duration of CSA membership”. Other factors such as the “certification status of the CSA farm” and “attitudes toward organic certification” did not significantly predict trust. We conclude that producers’ willingness to be transparent already signals trustworthiness to CSA members and is more important to members than formal signals. Other actors within the food system could learn from CSA principles and foster a transition toward a more regionalized value-based food system to help restore agriculture’s integrity. (shrink)

Weak determiners have both a presuppositional and a non presuppositional reading. Two ways of accounting for this fact have been proposed. The Ambiguity Approach (Partee 1989, Diesing 1992, de Hoop 1992) posits that weak determiners are ambiguous. The Pragmatic Approach (Büring 1996) claims that we do not need to postulate an ambiguity in the semantics: the presuppositional reading arises as a result of presuppositions triggered by topic/focus marking. In this paper we explore the possibility that both theories are needed. We (...) present as evidence the behavior of two Spanish weak determiners, unos and algunos. Algunos can get a presuppositional reading independently of topic/focus marking, as predicted by the Ambiguity Approach. Unos, on the other hand, exhibits the behavior predicted by the Pragmatic Approach: it is presuppositional only when marked either as contrastive topic or as focus. (shrink)

When we bring together certain plausible and compatible principles guiding the use of vague predicates the inclination to accept that vague predicates are tolerant is significantly weakened. As the principle of tolerance is a troublesome, paradox inducing principle, a theory giving a satisfactory account of the nature of vague predicates and accounting for the appeal of the sorites paradox, without recourse to the principle of tolerance is a worthy addition to the vagueness debate. The theory offered, Contextual Intolerance, draws considerably (...) on Sainsbury's (1996) thesis of the boundarylessness of vague concepts and on the contextualist theories of vagueness offered by Stewart Shapiro (2003, 2006) and Diana Raffman (1994). This article presents a review of the literature on science and religion in Nordic countries. Seventy-seven articles, books, and chapters on the topic were collected from five major scholarly databases between 1997 and 2018. We scrutinized how research in this data set was engaged with social scientific research. Most of the research was not social scientific. It was primarily philosophical, theological, and historical research; very little presented empirical and theoretical social scientific research. The studies reflected societal discussions, bringing out some (...) cultural dimensions and social issues, but not specifically in the Nordic context. Some societal aspects were highlighted, such as ethics and climate change, but these were not necessarily tied to the Nordic societies. We propose that in the Nordic context there seems to be a need for social scientific research on science and religion. This research could use theoretical perspectives from, for instance, sociology, science and technology studies, higher education studies, and anthropological research. (shrink)

Over recent years, lawyer misconduct and regulation of the profession have been topics of considerable interest. Yet, when the topic of legal ethics is raised, the focus tends to be on lawyer conduct external to the firm: lawyer conduct in court; lawyer conduct vis-a-vis client; or lawyer conduct vis-a-vis opposing counsel or the judiciary. The recent National Attrition and Re-engagement Study, however, raises a different aspect of legal professional ethics. This Report found a widespread incidence of bullying, intimidation, discrimination and (...) harassment within law firms, primarily affecting though not confined to, female lawyers. Of course, bullying and associated behaviours are not confined to the legal profession. But these behaviours are at odds with a profession that purports to be deeply concerned with the ethical conduct of its members. Arguing that ‘ethics begins at home’, this paper suggests NARS raises uncomfortable questions about legal professional ethics: if law firms cannot treat their own staff members ethically, what does that say about the firm’s approach to ethical conduct more generally? And if this culture is as widespread as the report suggests, what does this say about the ethics of the legal profession as a whole? (shrink)
