The purpose of this paper is to analyze the virtue of temperance as a moral competence in professional performance. The analysis relies on three different streams of literature: virtue ethics, positive psychology and competency-based management. The paper analyzes how temperance is defined in each of these perspectives. The paper proposes an integrative definition of temperance as “moral competence” and summarizes behaviors in business environments in which temperance plays a role.

This paper focuses on the extension of AGM that allows change for a belief base by a set of sentences instead of a single sentence. In [FH94], Fuhrmann and Hansson presented an axiomatic for Multiple Contraction and a construction based on the AGM Partial Meet Contraction. We propose for their model another way to construct functions: Multiple Kernel Contraction, that is a modification of Kernel Contraction, proposed by Hansson [Han94] to construct classical AGM contractions and belief base contractions. Content-based authorship identification is an emerging research problem in online social media networks, due to a wide collection of issues ranging from security to privacy preservation, from radicalization to defamation detection, and so forth. Indeed, this research has attracted a relevant amount of attention from the research community during the past years. The general problem becomes harder when we consider the additional constraint of identifying the same false profile over different social media networks, under obvious considerations. Este trabajo analiza los aspectos más destacados de la polémica entre Juan Carlos Bayón y Eugenio Bulygin acerca de las lagunas jurídicas, el principio de prohibición y el alcance de la discreción judicial. En esta disputa, Bulygin defiende cuatro tesis centrales, enunciadas en Normative Systems : una cuidadosa distinción entre normas y proposiciones normativas es esencial para resolver el problema de las lagunas jurídicas, la versión débil del principio de prohibición no sirve para mostrar que no existen lagunas, la (...) versión fuerte del principio de prohibición es verdadera solo cuando el sistema es completo, y en casos de lagunas jurídicas, los jueces tienen discreción para resolver estas situaciones. Sin embargo, Bayón señala que el problema no es la falta de distinción entre normas y proposiciones normativas sino el desacuerdo acerca de cuándo una solución jurídica es concluyente. La diferencia entre soluciones prima facie y concluyente es esencial porque en ciertas situaciones, el derecho no da una respuesta pero tampoco deja espacio para la discrecionalidad judicial. Según Bayón, en estos casos el principio de prohibición "todo lo que no está prohibido está permitido" juega un papel fundamental. Este trabajo muestra que los argumentos de Bayón son insuficientes para rechazar las tesis clásicas defendidas por Bulygin. In this paper I analyze the most relevant aspects of the controversy between Juan Carlos Bayón and Eugenio Bulygin about the existence of legal gaps, the so called "principle of prohibition" and the scope of judicial discretion. In this debate, Bulygin defends four classical theses advanced in his wellknown book, Normative Systems : a careful distinction between norms and norm propositions is actually needed in order to solve the problem of legal gaps, the analytical truth of the weak version of the principle of prohibition cannot guarantee the completeness of legal systems, the strong version of the principle of prohibition is true only if legal systems are complete, and judges have discretion in cases of legal gaps. However, Bayón claims that the problem is not the lack of distinction between norms and norm proposition but rather the identification of conclusive legal solutions. Conclusive legal solutions must be distinguished from the prima facie solutions provided by explicitly enacted norms. According to Bayón, the difference between conclusive and prima facie solutions is essential in legally irrelevant cases; in such cases the principle of prohibition plays an essential role because it entails the rejection of judicial discretion. In this paper I claim that the arguments advanced by Bayón fail to provide a sound ground for discarding the classical theses defended by Bulygin. (shrink)

ABSTRACT This précis offers a summary of key claims in my book Human Dignity and Human Rights.

A group of philosophers suggests that a sense of mineness intrinsically contained in the phenomenal structure of all conscious experiences is a necessary condition for a subject to become aware of himself as the subject of his experiences i.e. self-awareness. On this view, consciousness necessarily entails phenomenal self-awareness. This paper argues that cases of delusions of thought insertion undermine this claim and that such a phenomenal feature plays little role in accounting for the most minimal type of self-awareness entailed by (...) phenomenal consciousness. First, I clarify the main view endorsing this claim i.e. the Self-Presentational View of Consciousness and formulate the challenge from thought insertion. After, I offer a systematic evaluation of all the strategies used by the advocates of this view to deal with this challenge. Finally, I conclude that most of these strategies are unsatisfactory for they rest in unwarranted premises, imprecisions about the agentive nature of cognitive experiences, and especially, lack of distinction between the different ways in which subjects can become aware of their own thoughts. This article provides a survey of the emerging debate on the political representation of nonhuman animals. In Section 1, I identify some of the reasons why the interests of animals are often disregarded in policy-making, and present two arguments why these interests should be considered. In Section 2, I introduce four institutional proposals that have been discussed in the relevant literature. Section 3 attempts to make explicit the underlying logic of each proposal (i.e. which specific problems it wants to tackle). (...) Samuel Scheffler has recently argued that some relationships are non-instrumentally valuable; that such relationships give rise to “underived” special responsibilities; that there is a genuine tension between cosmopolitan egalitarianism and special responsibilities; and that we must consequently strike a balance between the two. We argue that there is no such tension and propose an alternative approach to the relation between cosmopolitan egalitarianism and special responsibilities. First, while some relationships are non-instrumentally valuable, no relationship is unconditionally valuable. Second, whether such relationships (...) give rise to special responsibilities is conditional on those relationships not violating certain moral constraints. Third, these moral constraints arise from within cosmopolitan egalitarianism itself. Thus the value of relationships and the special responsibilities to which they give rise arise within the parameters of cosmopolitan egalitarianism itself. The real tension is not between cosmopolitan equality and special responsibilities, but between special responsibilities and the various general duties that arise from the recognition, demanded by cosmopolitan egalitarianism, of a multiplicity of other basic goods. Indeed, even the recognition of special relationships itself gives rise to general duties that may condition and/or weigh against putative special responsibilities. (shrink)

The aim of the present paper is to reinforce some of the affirmations made by Vera Lucia Raposo in a recent paper published by the Journal of Bioethical Inquiry. According to her, germline gene editing does not violate human dignity at all. This article offers some complementary ideas supporting her statement. In particular, four main arguments are stressed. Firstly, not only is the idea of human dignity unclear, but the idea of the human genome suffers from a general lack of (...) concreteness, which has dramatic consequences for the debate. Secondly, it is highlighted that if we believe that the immutability of the human genome underpins human dignity, then it should be our duty to use the tools of genetic modification to reverse any accidental changes that occur in nature. Thirdly, it is showed that if the alteration of germline constitutes an attack on human dignity, then we should also refrain from performing medical practices such as chemotherapy, which cause precisely this effect. Finally, we argue that modification of germline is not contrary to human dignity but an excellent expression of our autonomy. (shrink)

Patients who have an oncological disease and are in palliative care belong to a group that is often characterized as highly vulnerable, and their participation in clinical trials poses a number of ethical problems. This study is cross-sectional and analytic. In all, 82% of those who took part consider it ethical to conduct research with patients in palliative care, either to help other patients in the future, in the hope of gaining some improvement or due to confidence in the physician-researcher. (...) The wide acceptance to participate in these research studies shows the potential benefits appear to exceed the merely therapeutic ones. Altruism, hoping to improve or the perception of continuing to "fight" the disease are aspects to bear in mind when evaluating respect for the autonomy of the persons involved. (shrink)

A large body of experience and expertise on the implementation of sustainable public school food procurement policies has developed in recent years. However, there has been little investigation of the values and motivations of the public officials implementing the policies. To address this gap, we examine how the city of Avignon took a step toward transition to local fresh food procurement for public schools, under French government calls for sustainable food products in public canteens. Our analysis combines the Multi-Level Perspective (...) on sustainable transitions with the Public Service Motivation construct. Unlike other studies addressing the MLP at a macro level, we focus on individual motivations behind public action. We demonstrate that staff motivations have a major impact on how policies supporting transition to local fresh food procurement for public schools are implemented. These public officials’ approach to food shows concern for the public interest regardless of financial return. It is not the rational choice that primarily drives the implementation of urban food policies, but normative conformity and affective bonding. Interestingly, we conclude that the success of Avignon’s politically-driven school food procurement policy is essentially due to the catering and procurement staff who overcame the barriers to its implementation. Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

In this paper, we analyze the origin of the links between global bioethics (which we differentiate from biomedical bioethics) and human rights. We understand that we are in a global civilizational crisis, whose roots extend to 1492 today, in which the modern-capitalist model used the discourse of human rights to justify its predatory technocracy. There are three theoretical assumptions that support our analysis: 1) The current conditions in which the technique shows its destructive power over nature (Anthropocene) indicate that none (...) of the ethical antecedents are applicable to such circumstances. In this new context, the kantian categorical imperative has been reconverted into a moral and political duty to not instrumentalize either human beings or nature. We call this new ethical consideration bioethics. 2) The current geopolitical composition of the world must be thought in terms of the global North and the global South, as two regions that are forged in the midst of important processes of globalization of the world-system, and whose main consequence lies in the absence of equity in the distribution of wealth and well-being between the two. 3) The current environmental crisis or climate change, the product of an economic model based on extractive technology, has become one of the most serious threats against human rights. Resumen Tomando como punto de partida las condiciones del contexto socio político donde se originó el brote epidémico del virus SARS-CoV-2, los autores analizan la influencia que tuvo el principio de beneficencia como una de las razones éticas que condujeron al oftalmólogo Li Wenliang a alertar a través de la red social Weibo, sobre el surgimiento de un brote epidémico distinto, por su agresividad, al del SARS. Se asume que dicho principio puede comprenderse a partir de un enfoque donde se (...) conjugan referentes occidentales -la primera formulación del imperativo categórico kantiano y el legado hipocrático- y orientales -el principio del Ren o humanidad, derivado del pensamiento confuciano-. El artículo concluye señalando que en un mundo interrelacionado donde las prácticas médicas tienen fundamentos científicos universales, es posible tomar decisiones éticas médicas válidas para diferentes contextos culturales, siempre y cuando se continúe avanzando en el terreno de un diálogo inter-civilizatorio con perspectiva horizontal.This article analyzes the influence of the principle of beneficence as one of the ethical reasons that led ophthalmologist Li Wenliang to alert, using the Weibo plaform, about the emergence of an epidemic outbreak different from SARS. Accordingly, we discuss the socio-political context of the SARS-CoV-2 epidemic in China. We assume that the principle of beneficence might be understood from an approach combining Western references - the first formulation of the Kantian categorical imperative and the Hippocratic legacy - with Oriental ones - the Ren or humanity, derived from Confucian thought. We conclude that in an interrelated world, with medical practices having universal scientific foundations, it is possible to validate medical ethical decisions from different cultural contexts, as long as progress continues in the field of an inter-civilizational dialogue with a horizontal perspective. As the result of the complexity inherent in nature, mathematical models employed in ecology are often governed by a large number of variables. For instance, in the study of population dynamics we often deal with models for structured populations in which individuals are classified regarding their age, size, activity or location, and this structuring of the population leads to high dimensional systems. In many instances, the dynamics of the system is controlled by processes whose time scales are very different from (...) each other. Aggregation techniques take advantage of this situation to build a low dimensional reduced system from which behavior we can approximate the dynamics of the complex original system.In this work we extend aggregation techniques to the case of time dependent discrete population models with two time scales where both the fast and the slow processes are allowed to change at their own characteristic time scale, generalizing the results of previous studies. We propose a non-autonomous model with two time scales, construct an aggregated model and give relationship between the variables governing the original and the reduced systems. We also explore how the properties of strong and weak ergodicity, regarding the capacity of the system to forget initial conditions, of the original system can be studied in terms of the reduced system. A juzgar por los artículos aquí publicados, es posible nombrar para el ámbito de las humanidades por lo menos tres tendencias en la reflexión contemporánea sobre la vida buena. En primer lugar, resulta manifiesta la perspectiva crítica desde la que se aborda el problema propuesto. De un lado, una serie de artículos desmitifican escenarios, prácticas y estados que tradicionalmente se han considerado propicios, cuando no paradigmáticos, para la persecución de la vida plena. De otro lado, varias contribuciones acuden al subgénero (...) crítico de los diagnósticos sociales y leen en los tiempos que corren los síntomas de un buen número de patologías, no por conocidas menos alarmantes. En este caso los autores tematizan la dominación neoliberal, el desencanto de la distopía y el retorno de la barbarie. El desenmascaramiento emprendido por estas contribuciones también se aventura en una estrategia de contragolpe que busca actualizar remedios, maniobras y recursos, entre otros. La tercera tendencia tiene que ver con la actualidad de una teoría particular de la vida buena. Nos referimos de manera específica a la pertinencia de la teoría de la resonancia de Hartmut Rosa. Los autores de tres artículos se sintieron llamados a reflexionar sistemáticamente sobre el aporte de la teoría de la resonancia en el diálogo con otros cuerpos teóricos, como el de la misma Teoría Crítica en sus desarrollos recientes (donde es posible situar a Rosa), el de la justicia epistémica y el de la recepción literaria. Resumen Este artículo analiza la crítica de Gilles Deleuze a la dualidad kantiana de la estética. El autor atribuye la no-coincidencia entre la estética trascendental como teoría de la sensibilidad y la estética como teoría del gusto a una doble presuposición que se debe abandonar, esta es, relegar la síntesis a la actividad, y la noción de condiciones de la experiencia posible en lugar de condiciones de la experiencia real. El intento deleuziano por superar la dualidad corre el riesgo de (...) recaer en dos estéticas, y se sugiere una manera diferente de realizar dicho proyecto por medio del concepto de sensación.This paper analyses the critique posed by Gilles Deleuze to the Kantian duality of aesthetics. The noncoincidence between transcendental aesthetics as theory of sensibility and aesthetics as theory of taste is, according to the French philosopher, due to a double assumption that must be left behind: firstly, the relegation of synthesis to activity, and secondly, the notion of conditions of a possible experience instead of conditions of real experience. We argue that the Deleuzean attempt of overcoming the duality risks falling back into two aesthetics and suggest a different way of achieving that project through the concept of sensation. (shrink)

This paper aims to clear two regular misunderstandings when comparing the thoughts of Gilles Deleuze and Martin Heidegger: firstly, the alleged opposition between Heideggerian negativity and Deleuzian positivity; secondly, the assumed contrariety between Deleuzian immanence and Heideggerian transcendence. In this fashion, the proposal is not so much to point at coincidences as to underline the fact that the differences are not where they are usually sought. The method used consists in taking Deleuze’s mentions to Heidegger in Difference and Repetition as (...) a common thread for tracking the Deleuzian use of Heideggerian concepts. We will attempt to show that both aspects of the Deleuzian transcendental field, the virtual and the intensive, hold a certain “negativity” and “concealment”, respectively, which runs against the picture of Deleuze as a philosopher of thorough and unconcealed manifestation. We will likewise argue that Heideggerian transcendence is not necessarily opposed to Deleuzian immanence, and that the Heideggerian concepts of Zwiefalt and Selbe are used by Deleuze in order to think of immanence. We contend that the distinction between the negative and the problematic allows Deleuze to speak of being even while accepting ontological difference. (shrink)

“Deleuze and the Inversion of Kantism”. In this paper we aim to look into French philosopher Gilles Deleuze’s work in order to see whether there is such a thing as a ‘reversal of Kantianism’, parallel to his more well-known reversal of Platonism. To this end, we will propose, firstly, to read in the key of reversal the movements made by Deleuze regarding intensity and extension, on the one hand, and the paradox of inner sense, on the other. Then, we will (...) analyze why Kant had already accomplished two great reversals, regarding the classical conception of both time and law, and consequently, we will develop the Deleuzean conception of Nietzschean eternal return as a simultaneous reversal of both aspects. Finally, we will inquire about the tropos of the aforementioned reversal, calling on the concepts of humor and irony. (shrink)

El presente trabajo analiza los relatos de Matilde Sánchez “Amsterdam, ‘79” y “Berlín, ‘86”, crónicas de viajes iniciáticos incluidos en La canción de las ciudades. En ambos casos, la protagonista y narradora nos presenta el viaje como un experimento sobre la propia subjetividad, consistente en la inmersión y exposición del cuerpo propio y la lengua materna a una proliferación de signos urbanos extraños, habitando y habituándose a aquellas ciudades. Se propone aquí pensar dichas crónicas a partir de los conceptos deleuzianos (...) de aprendizaje, percepto y afecto, y adentrarse en la composición de la canción en cuestión como una operación que involucra una temporalidad triple. El aprendizaje perceptivo, afectivo y lingüístico de los viajes remite a un pasado de la expectativa y a un futuro de la escritura, y los signos aprendidos se constituyen en notas de la canción de las ciudades solo en la resonancia entre los tres momentos. Although the simultaneous presence of multiple ambitions is inherent in hybrid venturing, pursuing social and/or environmental missions while securing commercial viability can generate ambivalence among stakeholders. In this study, we draw on the notion of “holism” to show how venture founders both embrace tensioned ambitions and sustain hybridity during critical venture development phases. Based on 6 years of data on The People’s Supermarket in the United Kingdom, we identify three distinct practices— fantasizing, bartering, and conjuring—used by founders to harness tensions (...) productively, without compromising their venture’s multiple ambitions. These practices demonstrate the founders’ ability to maintain a venture’s hybrid nature throughout the ideation, organizational, and scale-up phases, thereby shedding light on the application of “holism” within the realm of hybrid venturing. En las investigaciones sobre fisiología cardiovascular desarrolladas por William Harvey es posible distinguir entre dos teorías que responden a preguntas diferentes. La primera de ellas, que denominamos teoría del movimiento circular de la sangre, intenta dar una respuesta al problema sobre la cantidad de sangre que se mueve dentro del sistema. La segunda pretende dar cuenta de las causas de que la sangre se mueva y la denominamos teoría de las causas del movimiento de la sangre. En este trabajo, presentamos (...) una reconstrucción estructuralista de la primera de éstas, y mostramos que posee todos los componentes considerados esenciales para cualquier teoría, de acuerdo con la concepción estructuralista de la ciencia. La expresión bíblica «Hijo del hombre» ha sido, desde el principio del cristianismo, una de las más estudiadas, utilizadas e interpretadas. Este artículo intenta estudiar, desde los textos, el origen de la expresión en el libro de Daniel y su aparición en la Septuaginta, en algunos textos de los llamados apócrifos y en el Nuevo Testamento. Los autores de los evangelios, que escriben en griego y conocen bien el libro de Daniel, relacionan de manera directa el mensaje apocalíptico y mesiánico (...) que aparece en Daniel 7,13, y el uso trivial y cotidiano en arameo de la expresión autorreferencial, dando lugar a la interpretación de «el Hijo del hombre» como título salvífico o mesiánico. BackgroundScientific literature on posttraumatic growth after terrorist attacks has primarily focused on persons who had not been directly exposed to terrorist attacks or persons who had been directly exposed to them, but who were assessed few months or years after the attacks.MethodsWe examined long-term PTG in 210 adults directly exposed to terrorist attacks in Spain a mean of 29.6 years after the attacks. The participants had been injured by a terrorist attack or were first-degree relatives of people who had been (...) killed or injured by a terrorist attack. They completed diagnostic measures of emotional disorders and measures of PTSD and depression symptomatology, optimism, and PTG.ResultsMultiple regression analyses revealed gender differences and a positive linear relationship between PTG and cumulative trauma after the terrorist attack. Some PTG dimensions were significantly associated with PTSD symptomatology, these associations being linear, not curvilinear. However, PTG was not associated with depression symptomatology, diagnosis of emotional disorders, age, elapsed time since the attack, or optimism. In comparison with survivors assessed 18 years after the 1995 Oklahoma City bombing, Spanish victims of terrorism showed higher levels of appreciation of life, but lower levels of relating to others and spiritual change.ConclusionThe findings underscore the influence of gender on PTG and provide support to the hypothesis that some emotional distress may be a necessary condition of PTG. Future studies on PTG after terrorist attacks should take into consideration the characteristics of the terrorist attack itself and the contexts of violence and threat in which it occurred. The political, social, and cultural characteristics of the community affected by it and the profile and characteristics of other traumatic events suffered after the attack should also be taken into account in further research.
