I argue for accepting a pluralist approach to species, while rejecting the realism about species espoused by P. Kitcher and a number of other philosophers of biology. I develop an alternative view of species concepts as divisions of organisms into groups for study which are relative to the systematic explanatory interests of biologists at a particular time. I also show how this conception resolves a number of difficult puzzles which plague the application of particular species concepts.

1. The Tractatus doctrine of saying and showing In a letter to Russell dated 19.4.1919, written shortly after he had finished the Tractatus, Wittgenstein told Russell that the main contention of the book, to which all else, including the account of logic, is subsidiary, ‘is the theory of what can be expressed (gesagt) by prop[osition]s -- i.e. by language -- (and, which comes to the same, what can be thought) and what cannot be expressed by prop[osition]s, but only shown (gezeigt); (...) which I believe is the cardinal problem of philosophy’ (CL 68). This was emphasized in both preface and conclusion of the book. The preface observes that the whole sense of the book can be summed up in the following words: ‘what can be said at all can be said clearly, and what we cannot talk about we must pass over in silence’ (TLP p.3). The conclusion of the book (TLP 7) simply repeats this. The preceding three remarks, however, are noteworthy. They make three claims. First, ‘There are, indeed, things that cannot be put into words. They make themselves manifest. They are what is mystical’ (TLP 6.522). This reiterates the leitmotif of the book, namely that there are things that cannot, by the very nature of representation, be said. But though they cannot be said, they are shown by features of the relevant system of representation. Secondly, the correct method in philosophy would really be to say nothing except what can be said, i.e. empirical propositions that have nothing to do with philosophy, and then, when someone wanted to say something metaphysical, to demonstrate to him that he had failed to give meaning to certain signs in his propositions (TLP 6.53). This method, of course, is not the method that has been followed throughout the book, which consists almost exclusively of modal assertions concerning what must, can or cannot be thus and so in reality, in language and in the relation between language and reality.. In this paper, I use a framework from computational linguistics, the Rational Speech Act framework, to model deceptive probabilistic communication. This account allows agents to discount for the biases they perceive their interlocutors to have. This way, agents can update their credences with the perceived interests of others in mind.

Among the extensive correspondence of Timothy I, Catholicos of the Church of the East, are two letters which refer to his collobaration in a translation of Aristotle's Topics into Syriac and Arabic, commissioned by the Caliph al-Mahdī. For some time now, commentators in and out of the scientific community have been expressing concern over the direction of scientific research. Cogent critics have labeled it excessively commercial, out of touch with its “pure,” public-spirited roots, and generally too much a creature of its entrepreneurial, self-interested times. In most if not all of this hand-wringing, the scientific community's growing reliance on intellectual property rights, especially patents, looms large. Ever since the constitutional revolution of the 1930s, constitutional law and theory have been dominated by questions of civil rights. The expansion of rights under the Warren Court constituted a deep-seated shift in judicial attitudes that has proved remarkably stable over time. Despite protests in some quarters that the Burger Court and the current Rehnquist Court have undermined civil rights recognized during the Warren Court era, the fact is that the changes have been surprisingly marginal. Even precedents that were widely (...) believed to be endangered species a decade ago – such as Miranda and Roe v. Wade – continue in force, although they have indeed been pruned back. Despite their importance, however, these high-profile cases do not go to the core of the Supreme Court's agenda. The core is epitomized by Brown v. Board of Education on the one hand, representing an aggressive and interventionist attitude toward government discrimination against discrete minorities, and footnote four of the Carotene Products case, on the other hand, representing an extraordinarily deference to the political process with respect to economic regulation. The Rehnquist Court's commitment to this core agenda is not dramatically different than that of its predecessors, at least not when the broad sweep of constitutional law is taken into account. In his most recent article, “The Appeals Process as a Means of Error Correction,” Steven Shavell asks a very important question: Why do we use a hierarchical court structure? The flip side of this inquiry is whether we might not be better off simply making our trial courts more efficient. Although I certainly applaud the recent efforts of Shavell and other law and economics scholars to examine issues of institutional design, this particular attempt suffers from two major flaws. The first (...) involves the asymmetric treatment of litigants before trial courts and appeals courts: Appellants can choose to either appeal cases or not, but the population of cases before the trial courts is assumed to be exogenous. This severely limits the ability to improve the efficiency of trial courts, leading to an overestimation of the value added from an appeals process. The second problem involves the behavior of judges, who are assumed to behave as automatons. Allowing judges to behave rationally dramatically changes the nature of the model's results, most fatally leading to the elimination of the separation equilibrium that Shavell wishes to achieve. The issue of the emergence of formal axiomatic logical systems due to the emergence of logical antinomies in formal axiomatic systems, specifically the issue of developing formal logical axiomatics in the calculus of considerations was investigated in the considered research. At the same time, in order to determine the characteristics of the implementation of the logical-methodological principles and provisions of the deductive reasoning obviously, conceptual-logical foundations of the calculus of considerations was studied and the main propositions of the calculus of (...) considerations and the analysis of the initial logical operations on them were given in the study. The basic laws of logic and the expression of one logical act with another one were also explained in the research work by giving the concepst of proportional form and tautology in the calculus of considerations. At the same time, main properties and the procedure of setting of the formal deductive theory in the calculus of considerations were studied in the article. In order to provide an adequate characterization of the conceptual and methodological bases of the calculus of considerations in the research work, the basic logical laws of the calculus of considerations developed by the German mathematician and thinker P. Hilbert were also given. In addition, the main principles and methodological provisions of the deductive method were investigated, and the rules of deriving new conclusions from the axioms were interpreted. At the end of the reviewed article, the main principles and methods of the formal axiomatic mathematical systems built on a deductive basis, specifically the calculus of considerations, were studied and a logical-methodological analysis of the calculus of considerations was carried out on this basis. In this framework, the syntactic and semantic analysis of formalized language in formal axiomatic logical systems was carried out separately, the constituent parts of those systems, including the construction scheme, were given. The objective of the paper is to examine the role of the two donor agencies, the IMF and the World Bank in the formulation of social welfare policies in the post-independence Sri Lanka. The ideologies of the two major parties in Sri Lanka, the United National Party (UNP) and the Sri Lanka Freedom Party (SLFP), became the determining factor in the formulation of social welfare policies before 1977. In this context, the IMF and the World Bank played two different roles (...) before 1977. Meanwhile, the ideological gap existed between the two major parties began to disappear after 1977 with the introduction of liberalized economic policies. The IMF and the World Bank played an important role during the post-1977 period. There was evidence that these funding bodies influenced in the formulation of social welfare programmes under the two major parties. The guideline recommended by these two organizations adversely affected the subsidized rice ration, one of the major welfare programmes, in the country. (shrink)

What does the law demand when it requires citizens to conform to standards of reasonableness? I propose and defend the view that the law should demand that citizens conform their behavior to some actual conduct in society. I contrast this idea against what might be called the ``empty vessel'' view of reasonableness, where the standard is understood to function like an empty vessel in the law, allowing courts to use various norms and moral judgments to determine what seems reasonable in (...) the circumstances. The empty vessel account is the more common approach for understanding reasonableness, but it leaves obscure whether and how assessments about appropriate conduct connect with facts about citizens' actual conduct. I argue for a ``binocular'' view that focuses our attention on actual practices and thereby establishes how these standards provide a stable guide to conduct and support the rule of law. (shrink)
