In common law jurisdictions, legal professionals cite facts and legal principles from precedent cases to support their arguments before the court for their intended outcome in a current case. This practice stems from the doctrine of stare decisis, where cases that have similar facts should receive similar decisions with respect to the principles. It is essential for legal professionals to identify such facts and principles in precedent cases, though this is a highly time intensive task. In this paper, we present (...) studies that demonstrate that human annotators can achieve reasonable agreement on which sentences in legal judgements contain cited facts and principles. The article is devoted to the problem of the expert knowledge crisis, which consists in a decrease in public trust in scientific experts, the transformation of the role of experts in making socially significant decisions, escapism or neglect on the part of experts in relation to the society. We believe that in order to resolve the existing confrontation between society and experts, it is necessary to compare the positions of both, and then formulate common grounds that can serve for resolving (...) the conflict. We assign the role of moderator in the practice of resolving this conflict to politicians, who are forced to maneuver between the advice of experts and the opinions of voters, and also take responsibility for the consequences of implementing decisions. Reconstructing the position of experts, we rely primarily on the work of T. Nichols “The Death of Expertise”. We believe that it very clearly articulates the concerns of the scientific community about its current status, role and future fate, as well as the expert community’s understanding of the reasons for the current situation. The position of society is expressed in the works of P. Feyerabend. So, as the first task of our article, we see a comparison of these positions and identification of key points of conflict contradiction. Looking for resolving the conflict contradiction, we rely on the concept of communicative action by J. Habermas and the ideas of the actor-network theory of B. Latour. It is possible to compare all four positions thanks to the analytical approach to the history of philosophy of J. Barnes. An argumentative analysis makes it possible to clearly identify both the basic points of their contradiction and the positions common to all parties, which should form the basis for the search for consensus. Such basic positions are not the assessment of expert or profane knowledge, but the desire by all parties of communication to preserve the democratic structure of society. (shrink)

In the recent article Poetry , Language and Communication by Bernard Mayo, the author, intending to establish new distinctions between poetry and other uses of language, has overshot the mark, and arrived at a completely obscurantist view of poetry.

In Spain, the introduction of the new Diploma in Nursing in 1977 saw the role of nurses shifting from that of medical assistants with technical skills to being independent members of the healthcare team with specific responsibility for providing professional nursing care. Here, we analyse the evolution of the nursing profession in Spain following the transfer of nurse education to universities, doing so through interviews with the first generation of academic tutors. This was a qualitative study using the method of (...) analytic induction and based on the principles of grounded theory. Participants were selected by means of theoretical sampling and then underwent in‐depth interviews. Steps were taken to ensure the credibility, transferability, dependability and confirmability of data. The main conclusion of the analysis is that there is a gap between a theoretical framework borrowed from the Anglo‐American context and a nursing practice that, in Spain, has traditionally prioritised the application of technical procedures, a role akin to that of a medical assistant. It is argued that a key factor underlying the way in which nursing in Spain has evolved in recent decades is the lack of conceptual clarity regarding what the role of the professional nurse might actually entail in practice. Two hypotheses concerning the relative importance of agentic versus communal traits as predictors of selfesteem were tested. The perspective hypothesis assumed that self-esteem is dominated by agency over communion because self-perceptions are formed from the agent perspective. The culture hypothesis assumed that self-esteem is dominated by communal concerns in collectivistic cultures and by agentic concerns in individualistic cultures. Study 1 involving three samples from collectivistic countries and three from individualistic ones found that self-esteem was better predicted from self-ratings of agentic (...) than communal traits, with the exception of collectivistic women for whom the two predictors were equal. Study 2 primed the interdependent or independent self and found self-ratings of agency to be better predictors of self-esteem than self-ratings of communion, with the exception of interdependence priming,where the two predictors were equal in strength. The Platonic corpus is a collection of texts written under Plato's name. It is fairly inconvenient for us, modern readers, that it includes texts hardly authored by Plato, but we are normally able, or deem ourselves so, to tell the difference between spurious and authentic material. Yet that 'either-or' logic might be too simplistic to account for the specifics of 'school accumulation', which continued more or less till the end of the Hellenistic epoch and implied imitation rather than deception: the (...) Platonic corpus was in the making as long as the Academy existed. And so were its separate components: authorial and editorial revisions and 'updates' of dialogues are signalled both by ancient sources and by modern computational techniques. In eleven chapters provided by twelve specialists in the field, this volume explores the Platonic corpus as a living whole in its dynamic and complex development. Two major sets of questions are addressed here. The first concerns the individual components of the corpus, the institutional and philosophical context of their emergence, and questions of authorship and revision. The second question has to do with the corpus as a whole, with the progressive organization of the dialogues into a recognized body of work, including both ancient and modern editions and classifications, as well as the formation and transformations of the canon. This commentary is an attempt to give a Vygotskian perspective on Carpendale's & Lewis's (C&L's) target article. The article uses ideas that are well familiar to Vygotsky's scholars. However, it develops these ideas further and raises important empirical questions about the role of social interaction in the development of social cognition. The article provides a fresh view on the old problems and frames themes traditional for the English-speaking developmental psychology into a broader international perspective.

Meaningful interactions with works of art are often absent from education. Across the country, art museums are intent on changing this situation. But to incorporate art viewing1 into an educational milieu that does not value art, art museum educators are constantly forced to justify the educational value of their programs. One common argument to substantiate the worth of art viewing is that it promotes critical thinking. In fact, several museums across the United States assert that the goal of their education (...) programs is precisely to foster critical thinking in students.2 These assertions are aligned with a growing body of research that proves that encounters with works of art can help develop skills.. Populations have different percents on different history realms regarding baths and fountains. A constant historical issue of such places is related with constant use and adore. Therefore we find ourselves in time where they where more used and ages where they where less used. On our paper we analyse from a sociological perspective the use of such spaces, mainly associated with social interaction and sociability. The aim of this paper is to show that the calculi described by Anshakov and Rychkov are algebraizable in the sense of Blok and Pigozzi. As a consequence, a proof of the strong completeness of these calculi is obtained.

Introduction. The intensity of the visual media influence in the format of films and TV series on cultural life, reaching its peak in the era of streaming television, poses the task for the humanities to study the visual type of thinking, visual consciousness, which is different from the classical visualization of verbal thinking in the plastic arts. If a researcher intends to derive from a film or TV series, a value system, a cognitive strategy that is relevant for its time, (...) the visual environment may turn out to be no less eloquent for him than the dramatic action taking place in it. The character and quality of this environment are made up of many sensory elements: light, color, movement and its choreography, sound, space, subject referents, etc. Taken together, they represent not so much an articulation of the author’s thought, but a way of specifically visually thinking through this thought. The complex structure of visual-mental environments requires extensive and systematic research work. In this article we take one of the most obvious substantive aspects of the visible: the vestimental strategy of the film. The purpose of the article is to identify patterns marked by subject (vestimentary) characteristics that are redundant in relation to the dramatic action by comparing the visual environments of films from different decades of the 20th century; using the code of cultural universals that assign the function of sociocultural and ethical regulation to the concept of “clothing” [1; 3; 5; 10; 15], to identify the meaning of these patterns in the context of the ethical thinking of the era. Methods. During the study, the authors use general scientific methods of analysis and synthesis; the method of phenomenological reduction, which makes it possible to record the sensory qualities of object-spatial screen environments; a hermeneutical method that allows, on the basis of visible sign structures, to identify the essential intentions of a visual image. In view of the task, it turned out to be necessary to involve some concepts of narratology (in particular, the concept of focalization) and methods of corpus analysis adopted in linguistics. The scientific novelty lies in the fact that we approach the visual source from a philosophical and cultural perspective, considering the visual environment of the film as a form and method of actual sociocultural or philosophical thinking, which has specific (visual) tools. This approach allows us to draw conclusions based not only on individual films, but also on large source databases. Results. During the analysis, the authors applied the tools of modern visual studies and the conceptual basis of socio-philosophical ethics to cinematic texts of the 20th century. This made it possible to discover visual patterns common to films of some decades of the 20th century, namely: the 1930s, 1950s, 1990s, and connect them with the ethical issues of time. Conclusions. Analysis of source databases that include cinematic texts can be carried out through a systematic analysis of the visual environments presented on the screen. At the same time, dominant visual patterns characteristic of a particular era can be identified and described. Such a dominant determines the emphasis in the figurative whole and reveals important aspects of philosophical and cultural thought relevant for its time, including ethical thought. (shrink)

Depuis 2011-2012, les milieux de migrants russes en France se mobilisent politiquement. On peut observer, d’une part, une mobilisation liée aux mouvements de protestation en Russie à la suite des élections jugées « truquées » et, d’autre part, une mobilisation encouragée par la politique de l’État russe envers « ses » émigrés. L’histoire, le passé, jouent un rôle primordial dans ces mobilisations. Du côté des autorités russes, les concepts et moments clés de l’histoire nationale sont mobilisés pour une construction consensuelle (...) qui est par la suite « imposée » aux migrants, perçus comme les messagers de la parole des autorités russes dans les pays d’accueil. Cependant, cette reconstruction historique par l’État russe se confronte à des contradictions qui sont à la fois internes au projet de l’État russe et relatives aux temporalités subjectives des migrants. Ces dernières fournissent autant de contrepoints et de formes de contestation, explicite ou non, au récit historique unifié que s’efforcent de bâtir les autorités russes. Ces temporalités subjectives se traduisent par des identifications : avec les années 1990 qui, dans le discours politique sur l’histoire russe, sont perçues comme des « années noires » ; avec une « classe sociale » qui appartient au passé ; et enfin, avec des segments spécifiques de l’histoire et de l’espace russes, loin des conceptions totalisantes forgées par le projet extraterritorial des autorités. The article is dedicated to considering ethnic tourism in its importance to comprehend modern cultures that are Others to the traveler's experience. In this regard, ethnic tourism is presented from the Other's cognition, i.e., the way of life of a nation, its religious and ethnic values and traditions, historical past and legends, and geographical specificity of residence. Thus, the meaning of ethnic tourism is related to the human desire to discover other cultural and social spaces. Simultaneously, the article shows how (...) another culture's perception affects the awareness of a tourist's identity. The author notes that ethnic tourism aims at fixing the distinctive features and specifics of people's life. Therefore, this type of tourism is most conducive to forming images and perceptions of ethnic and cultural diversity. The author substantiates the role of ethnic tourism to establish a dialogue of cultures in the modern world. Distinctive features of globalization, particularly travelers' continuous mobility, the conversation of ethnic groups, and the value-based mutual enrichment of peoples, have been deduced. Some theoretical approaches of Russian philosophers to the study of ethnic tourism are defined. The researcher emphasizes the idea of a correlation between ethnic cultures and religions. In this regard, early Christianity's theological ideas are conditioned in terms of their impact on the subsequent formation of pilgrimages and the modern religious tourism organization. The contemporary unity of ethnic culture and religiosity is vividly manifested in the uniqueness of the Old Believers' tradition of the Kerzhak resettlers living in the Altai Mountains. The article concludes that ethnicity should be acknowledged in any tourism organization, especially religious and pilgrimage types. (shrink)

Визначення інвестиційної привабливості підприємств у вітчизняній науці традиційно вивчається з точки зору факторів економічного характеру. Досліджень, у яких представлені наукові підходи, які розкривають неекономічні чинники залучення інвестицій, в Україні практично немає. У статті досліджено можливості залучення інвестування під проекти розвитку промислових підприємств на основі рефлексивного підходу. Обґрунтовано й розроблено відповідний алгоритм залучення інвестицій, що включає блоки підготовки, розгляду та практичної реалізації фінансування обраних проектів при виборі стратегічної поведінки всіх учасників інвестування та розподілу ризиків між ними.

The aim of this article is to shed light on women’s experience of informal trade on one of the EU external borders: Belarus–Lithuania. The article suggests looking at the informal economy beyond the notion of precarity and to pay attention to how women themselves understand their involvement in trading practices. The author argues that, although economic necessity is an important motivation for women to start trading activities, this experience rewards them not only financially but also through non-economic aspects such as (...) self-respect, solidarity and socializing. Theoretically, the article brings together the discussion of the gendered nature of informal work with the feminist theory of agency. It shows that women’s experience of informal cross-border trade is agentive. Trade provides women with a sense of pride, self-confidence and respect and enables them to recognize their self-sufficiency. However, it is also argued that agency is not synonymous with autonomy and individualism. Theoretically and empirically, the article stresses a relational understanding of agency. On the one hand, women acknowledge their financial achievements as the capability to take proper care of their children, especially in situations when the second breadwinner is absent. On the other hand, they also value their trading experience as a space of socializing with other women. The success of cross-border trade depends on the sense of solidarity and collective action to resist the system represented by customs and border control. (shrink)

The paper analyses and evaluates the linguistic policy of the Court of Justice of the European Union against the background of other multilingual courts and in the light of theories of legal interpretation. Multilingualism has a direct impact upon legal interpretation at the Court, displacing traditional approaches with a hermeneutic paradigm. It also creates challenges to the acceptance of the Court’s case-law in the Member States, which seem to have been adequately tackled by the Court’s idiosyncratic translation policy.

Since the beginning of signed language research, the linguistic units have been divided into conventional, standard and fixed signs, all of which were considered as the core of the language, and iconic and productive signs, put at the edge of language. In the present paper, we will review different models proposed by signed language researchers over the years to describe the signed lexicon, showing how to overcome the hierarchical division between standard and productive lexicon. Drawing from the semiotic insights of (...) Peirce we proposed to look at signs as a triadic construction built on symbolic, iconic, and indexical features. In our model, the different iconic, symbolic, and indexical features of signs are seen as the three sides of the same triangle, detectable in the single linguistic sign. The key aspect is that the dominance of the feature will determine the different use of the linguistic unit, as we will show with examples from different discourse types. (shrink)

This article addresses the issue of how team identity is constructed between two people during a series of regular meetings of a work group in Serbia. Using conversation analysis to investigate social actions, this study looks at the recurrent construction of an implicit team identity by focusing on management of speaking rights and co-construction of units, and displays of knowledge and accountability. With its longitudinal perspective, the article contributes to the existing body of research on teams in interaction in general, (...) as it builds upon previous research on interactional parties and conjoined participation. The results are especially relevant for the investigations of teams in meetings, as they provide evidence of how formal features of interaction are recurrently employed to display institutionally relevant epistemics and accountability. Introduction. The authors clarify and expand the concepts of heterogeneity properties of regional socio-economic and digital spaces. Heterogeneity of space is associated with the regional uneven development and results in their socio-economic and digital differentiation, which, in turn, determines unequal conditions for ensuring the population’s life quality. In the context of the study, heterogeneity of the regional space is defined as a property of uneven spatial development of the Russian Federation’s constituent entities according to the territorial, sectoral, and temporary characteristics (...) that determine and affect the level and quality of life of the population. The citizens’ life quality throughout the country is an absolute priority of economic development at the federal and regional levels. Indeed, only then should we speak of a positive assessment of economic growth when it does not follow the path of the previous inefficient development, but is aimed at achieving a real improvement in people’s wellbeing [3; 4; 17]. Taking into consideration the particular importance of social priorities and their implementation throughout the country, the authors think it necessary to study the properties of the economic space, to determine their impact on the population’s life quality. The aim of the study is to analyze the effect of heterogeneity of the regional socio-economic and digital spaces on the population’s life quality in the Russian Federation’s constituent entities. Methods. To conduct the study, the authors make use of statistical analysis based on the data of the Russian Statistics Agency, Moscow School of Management Skolkovo, Russian Information Agency Rating; content analysis, methods of comparative analysis and positioning of regions. The scientific novelty of the study consists in expanding ideas about heterogeneity of the regional space from the standpoint of the regional socioeconomic situation and the level of their digitalization, which result in differentiating the Russian Federation’s subjects and unequal conditions for the people’s life, to a different extent affecting the population’s life quality throughout the country. In methodological terms, the study is supplemented by a pairwise comparison of the regional space characteristics and the multivariate positioning of regions in the coordinates: socio-economic space - quality of life; digitalization is a quality of life. Results. The authors study the impact of integrated indicators of the socio-economic situation of the regions, their digitalization level on the population’s life quality in the Russian Federation’s constituent entities. At the same time, the authors apply a comparison of various integral nature of the regional space indicators used, as a rule, autonomously, for multi-characteristic typologies (groups of regions I—IV and groups of regions A—D), by means of which a group of the most powerful regions was identified where the life quality is associated with the best socio-economic situation and active digitalization of these regions. Conclusions. It was found that uneven economic and digital territory development leads to interregional differentiation of the population’s life quality, as a result of which the leading regions and the outsider regions are distinguished, characterized by unequal conditions for the citizens’ life. The typology made it possible to identify groups of regions for which selective measures are needed to increase the level and quality of the population’s life. For some regions, the priority is to use their economic potential and new digital technologies, for others, active interregional interaction; the third (the weakest) cannot provide a decent standard of living without profound government support. Algunos autores interesados en este tema hacen referencia a los daños que ello podría ocasionar a otros. Pero entonces, ¿la mejora moral podría funcionar como un contraejemplo a la idea de que la mejora biomédica es siempre moralmente impermisible? Puede que (...) lejos de estar ante algo meramente permisible, la mejora de nuestro carácter moral sea algo a lo que debamos aspirar. ¿Sería entonces obligatorio seleccionar los embriones con un nivel más alto de moralidad? Aujourd’hui, tout un courant de pensée a remis au goût du jour – et à juste titre – les écrits de Wilhelm von Humboldt sur les langues en tant que « visions du monde » singulières . C’est parce que chaque langue découpe l’univers à sa manière que l’intraduisibilité serait la caractéristique fondamentale de toute traduction, aucun mot ne correspondant exactement à aucun autre dans une autre langue. Une telle analyse n’est pas, en soi, fausse, mais elle demande à être (...) sans doute relativisée. L’intraduisibilité trouve également sa source ailleurs : autrement, on ne s’expliquerait pas pourquoi, au sein de la même langue, un mot est susceptible de changer de sens selon l’époque où l’on se situe. Enfin, les structures linguistiques ne sauraient être rigides : elles sont, au contraire, d’une extrême malléabilité. C’est ce que montre l’analyse du champ sémantique de la liberté en russe.A whole current of thought has recently - and rightly - returned to the writings of Wilhelm von Humboldt on languages as unique “visions of the world” . It is because each language divides up the universe in its own way that the untranslatable may well be the fundamental characteristic of any translation, since no word corresponds exactly to any other word in another language. This idea, although not inherently wrong, needs to be completed. There are other ways of accounting for untranslatability; otherwise there would be no reason why, in the same language, a word can change its meaning with the times in which it is used. Finally, linguistic structures are not rigid: they are, on the contrary, extremely malleable. This is what we show from our analysis of the semantic field of the word “freedom” in Russian. (shrink)

We investigated the influence of personality and culture on effects of mortality salience over cultural worldview defense. We hypothesized that CWVD reactions to MS differ between Germany and Poland because of the higher conservatism of the latter country, and that they are moderated by action vs. state orientation. In this study German and Polish, participants were exposed either to MS or to a control condition. Punishment ratings to trivial offences and serious social transgressions were measures of CWVD. Results showed that (...) social transgressions in both conditions were more strongly punished in Poland than in Germany. Additionally, compared to the control condition, under MS action oriented punished serious transgressions more strongly in Germany whereas state oriented punished serious transgressions more strongly in Poland. That is, the effects of MS on CWVD are moderated by personality and culture. We interpret the opposite pattern of punishment to serious social transgressions given by action and state orientedin in Germany and Poland, respectively, according to the higher emotional autonomy of action-oriented persons in either culture. Članak razmatra pojam demokracije Johna Deweya u odnosu na ranije i suvremene radikalno ljevičarske ideje. Ističu se slična epistemološka, antropološka i politička stajališta u ovim teorijama. Vrlo je važno odbacivanje ili podcjenjivanje političke demokracije i naglasak na demokratskom životu s ciljem stvaranja novog društva, posve drukčijeg od postojećih društava. Članak je podijeljen u tri dijela. Prvi dio istražuje razumijevanje demokracije kao nepolitičkog fenomena i kao sinonima za novi oblik ljudske egzistencije u mladog Marxa te kasnijim stavovima Marxa i Lenjina o (...) demokraciji kao »hipokriziji«. Drugi dio analizira Deweyev pojam demokracije kao »načina povezanog življenja« i skreće pozornost na neke značajne podudarnosti i, također, razlike spram Marxovih ranih ideja. Treći dio razmatra razumijevanje demokratskog društva kao identičnog s globalnim društvom u kojem komunikacija među ljudima nije ograničena političkim granicama. I argue that the Nineteenth Century phenomenon of Russian nihilism, rather than belonging to the spiritual crisis that threatened Europe, was an independent and historically specific attitude of the Russian intelligentsia in their wholesale and utopian rejection of the prevailing values of their parents’ generation. Turgenev’s novel, Fathers and Sons, exemplifies this revolt in the literary character Bazarov, who embodies an archetypical account of the conflict between generations, social values, and traditions in Russian—but not just Russian—culture.

This study considers the origins and characteristics of Karl Jaspers’ biographical approach. Specifically, we analyse how this approach manifests itself in Jaspers’ work, namely, in his understanding of psychology, his psychology of worldviews, his views on the history of philosophy and his philosophical method. The biographical approach was a central strategy in Jaspers’ work as an appeal to life and was closely linked with how Jaspers understood both philosophy and his thought. This essay explores the return of the subject in the computational context, which I address as a digital subject. This digital subject encompasses a digital identifier, correlations in data or a data profile, moving between biological characteristics and symbolic expression. I focus on the processes through which digital subjects are constructed by matching, correlating, modelling, as well as how they become enactive. The ways of pulling data together into a digital subject is often presented as a logic of fact, where (...) data is equated with documentary evidence. Instead, I propose the notion of the distance in which digital subjects are produced. Indexicality comes from outside of data, whereas the regard for the thick distance becomes a mark of the form of knowledge. I conclude by arguing for a posthumanities approach that establishes the distance while allowing for different subjects to be called upon. (shrink)

The writer’s sketch Anglo-Indian Society and his collection of short stories Plain Tales from the Hills depict the characteristic features of Anglo-Indians’ worldview and lifestyle, which are revealed and analyzed by the author of the article. Special attention is paid to biographical factors (...) influencing the author’s choice of Anglo-Indian topic at the beginning of his writing career. The researcher concludes that Kipling presents in his works an outline of Anglo-Indian society which emerged from the writer’s observations of Anglo-Indians’ lives during his work as a reporter. Striving for credibility in consideration of advantages and shortcomings of Anglo-Indian worldview and lifestyle, the author tries to occupy the position of the unconcerned observer, being capable of assessing the situation with fresh mind. Kipling disguises himself under the image of the hero-narrator, being either a tourist traveler from abroad, or a reporter, accustomed to collecting factual material for the local paper, in such a way receiving an opportunity to speak ironically and sometimes even sarcastically about certain models of behavior, accepted by Anglo-Indians. ]]>.
