The article is devoted to topical issues of the culture of professional speech of representatives of the field of law, the level of which is an indicator of professionalism and general culture of the specialist in today's conditions. The purpose of the article is a comprehensive review of speech culture in the professional activities of lawyers at the present stage of development of Ukraine. In the research process, a descriptive method was used, as well as linguistic observation. The content of (...) the concepts of “culture of speech”, “culture of speech”, “culture of professional speech”, “culture of professional speech of a jurist” is highlighted and delimited, and it is also determined that they are in a logical mutual dependence and interdependence. It is revealed that the main standards in the speech activity of a lawyer are correctness, accuracy, logic, clarity, purity, conciseness and expediency, where normativity plays a key role. The studied material demonstrates typical mistakes of irregularity of language norms in professional speech. The causes of these mistakes are identified and ways to eliminate them are named. After analyzing the importance of language literacy and noting the importance of increasing its level for perfect mastery of the Ukrainian language standards and application in practice, it is emphasized that the culture of professional literacy today is the key to the success of a professional personality of a lawyer. This article presents an interpretation of Merleau-Ponty's notion of pre-reflective intentionality, explicating the similarities and differences between his and Husserl's understandings of intentionality. The main difference is located in Merleau-Ponty's critique of Husserl's noesis-noema structure. Merleau-Ponty seems to claim that there can be intentional acts which are not of or about anything specific. He defines intentionality by its ``directedness'', which is described as a bodily, concrete spatial motility. Merleau-Ponty's understanding of intentionality is part of his attempt to rewrite the relation (...) between the universal and the particular. He claims that meaning is intrinsic to the phenomenal field and impossible to analyse by a distinction between form and matter. Still, Merleau-Ponty's notion of meaning and philosophy is strictly opposed to any naturalized philosophy. This becomes explicated at the end of the article, where his attempt to embody intentionality is compared to Daniel Dennett's corresponding approach. (shrink)

Визначення онтологічного статусу «емпатії» – це сьогодні важлива частина проблематики, що стосується відповідей на питання про природу ментальної реальності як такої. У межах класичного поділу світу на «тіло та розум» («психофізичний дуалізм») такі об’єкти, як емпатія, мали цілком визначене пояснення. Вони тлумачилися як частина «нетілесної», «душевної» реальності. Однак зміна наукових і світоглядних парадигм заклала умови для формування нового розуміння онтологічного та епістемологічного статусу подібних об’єктів. Ключові питання, що ставиться у статті: чи належать акти емпатії до ментальної реальності? і чи є (...) ментальні акти частиною «ментального світу»? Однак після середини минулого століття світ «ментального» зазнав трансформації. Дана стаття – це спроба підважити твердження, що акти емпатії є різновидом ментальних актів (у традиційному розумінні). Джерельну базу дослідження становлять переважно праці Вілфреда Селарса та Гілберта Райла. Визначено, які зміни відбулися у розумінні свідомості після зауваг Райла та яким чином це впливає на приписування онтологічного статусу феноменам, які у минулому беззаперечно належали до ментальних об’єктів. In recent publications, Keith Lehrer developed the intriguing idea of a special mental process– exemplarization – and applied it in a sophisticated manner to different phenomena such as intentionality, representation of the self, the knowledge of ineffable content (of art works) and the problem of (phenomenal) consciousness. In this paper I am primarily concerned with the latter issue. The target of this paper is to analyze whether exemplarization, besides explaining epistemic phenomena such as immediate and ineffable knowledge of experiences, can (...) also solve the ontological problem of consciousness. In particular, Lehrer suggests that if we consider exemplarization, zombies cannot provide an argument for anti-physicalism. I argue that exemplarization offers neither a physicalist explanation of the conceivability of zombies nor a physicalist account of their impossibility. Therefore, exemplarization cannot offer a physicalist solution to the “hard problem” of consciousness. (shrink)

In the article the review of modern methodological approaches is carried out to forming of the reputation rating of legal companies and their features are considered. Except practice of western rating legal directories that successfully work at the market of legal services, methodology of the Russian and home rating directories is considered. Semantic interpretation is conducted and the matrix of criteria of the reputation rating of legal firms of basic rating directories is formed: Chambers, Legal 500, FLR Who's, Вest Lawyers, (...) Who Legal, Pravo.Ru, GVardia of legal companies. The row of conclusions that touch possibilities and expediency of application of rating technologies in the estimation of regional market of legal services is formed. Development of the regional rating of legal firms will allow really to estimate the contribution of large operators to regional market of legal services development, will provide possibility to the small regional companies to go out on the new level of business activity. Also it will be the catalyst of introduction of the new service technologies of service oriented to the client, will assist to development of competition on regional to the market. (shrink)

The method of phenomenal contrast aims to shed light on the phenomenal character of perceptual and cognitive experiences. Within the debate about cognitive phenomenology, phenomenal contrast arguments can be divided into two kinds. First, arguments based on actual cases that aim to provide the reader with a first-person experience of phenomenal contrast. Second, arguments that involve hypothetical cases and focus on the conceivability of contrast scenarios. Notably, in the light of these contrast cases, proponents and skeptics of cognitive phenomenology remain (...) steadfast in their views. I provide an explanation of the method’s dialectical ineffectiveness by focusing on first-person performances of phenomenal contrast tasks. In particular, I argue that introspective judgments about phenomenology are regimented by the view initially held. The paper analyzes the content of Soviet propaganda and agitation used in working with the Red Army personnel in the European theater of military operations at the final stage of World War II. The author identifies the interdependence between the ideological work among the Soviet troops and political relations of the USSR with the European countries which the Red Army planned to enter and with guideline documents on organization and carrying out of outreach activities. It is demonstrated that the communications (...) work ensured an appropriate moral and psychological state of Red Army soldiers and officers, contributed to establishment of adequate interrelations with local communities of foreign countries, allies in arms of other nationalities and military units of European countries. For the sake of objectivity in treating this issue, however, it should be pointed out that there were some cases of pillage, moral and physical humiliation of inhabitants of the 'liberated' countries. Their repercussions adversely affected the postwar image of the Soviet Union and dwell within the hearts of contemporaries. It is concluded that during the work of Soviet propagandists on the eve of the Red Army entering the territory of European countries the genetic patriotism inherent in any person in circumstances which threaten his or her life, existence of his or her family and Motherland was developing into the patriotism with notes of political understanding of the goals of the Soviet Union in the European theater of military operations. The article explores the way gamification transforms the informal learning space of the higher education institutions inspired by information technologies and the all-consuming digitalization of human society. An overview is presented of the existing ideas about gamification in the context of the digital transformation of higher education. It is established that the effective use of gamification as a learning technique in the context of digital transformation of higher education contributes to the implementation of its core principles. We have attempted to (...) analyze the factors that gave rise to gamification as well as to examine the ways to introduce gamification to the informal learning experience. The components of this technology are singled out along with the principles of its functioning. In the process, we reveal the role of gamification and opportunities that open up for the organization of educational activities in the informal space of higher education. The given work identifies peculiarities and advantages of this digital form of education as well as risks associated with its introduction in the informal learning space of higher education. The authors elaborate on the specifics of the development of informal learning space in the context of global gamification, as well as the technological and semantic modernization of higher education. It is established that the main purpose of gamification is to boost the internal motivation of higher education students to study and to reveal their creative and professional abilities. (shrink)

The article deals with the problems of inconsistency of Ukrainian translation education with the trends of the postmodern state of society and the advisability of introducing the achievements of the American system of training translators is substantiated. The article describes the organization of training masters in technical translation in the United States on the basis of a systematic analysis, in particular, the structure and content, forms and methods of teaching and learning masters in technical translation. Postmodern tendencies and peculiarities of (...) master's education in the USA are revealed and substantiated. The principles of permanent improvement of translation competence, profile and general cultural orientation are described; ensuring the full formation of the readiness of graduates of master's programs in technical translation for highly qualified, productive and creative professional activities; learning in a multicultural environment; application of the latest means of automated translation during training; certification of technical translators. For the reform of translation education in Ukraine, these trends are identified as key. The results of the study were obtained by applying a comparative typological and systems analysis, the method of extrapolating educational trends in the United States and Ukraine in relation to the postmodern context of society and its practical requirements for translation education. The practical significance of the article lies in borrowing the American experience of postmodern aspects of translation education, which can be useful to the countries of the former socialist camp and post-Soviet society. In this paper, I argue that the debate on Composition as Identity—the thesis that any composite object is identical to its parts—is deadlocked because both the defenders and the detractors of the claim have so far failed to take its philosophical core at face value and have, as a result, defended and criticized respectively something that is not Composition as Identity. After establishing how Composition as Identity should properly be understood and proposing for it a new interpretation centered around the (...) novel notion of metaphysical information, I set forth a strategy to defend it that crucially rests on the indefinite extensibility of the domain of quantification. I eventually suggest that “Composition as Analysis” is a name that better reflects the content and theoretical proposal of the thesis that Composition as Identity is supposed to be. (shrink)

Miranda Fricker’s insightful work on epistemic injustice discusses two forms of epistemic injustice—testimonial injustice and hermeneutical injustice. Hermeneutical injustice occurs when the victim lacks the interpretative resources to make sense of her experience, and this lacuna can be traced down to a structural injustice. In this paper, I provide one model of how to fill the conceptual gap in hermeneutical injustice. First, I argue that the victims possess conceptual resources to make sense of their experiences, namely phenomenal concepts. Second, I (...) show how one might work the way up in a two-step process from a subjective, phenomenal concept to a novel, public concept. Finally, I discuss the conditions that have to be met for this process to be successful. The resulting model shows a way how the victims might alleviate hermeneutical injustice by developing novel concepts, given that the dominant group does not care about their predicament. (shrink)

Whereas some of the critics of Hermann Cohen's strictly rational foundation of religious consciousness promoted a turn to subjectivism, others endorsed an ethicotheology while seeking to revise the "Religion of Reason." Among the latter was the Ukrainian-born social philosopher David Koigen (1877-1933), author of Der moralische Gott. Eine Abhandlung über die Beziehungen zwischen Kultur und Religion/The Moral God: An essay on the relations between culture and religion (Berlin: Jüdischer Verlag, 1922). To what extend is there a relevance of aesthetics for life? By postulating a non-discursive and emotional relevance of forms Cassirer, Langer and Krois open the door for this idea. -/- Inwieweit spielt die Ästhetik im Leben eine Rolle? Indem sowohl Cassirer, Langer und Krois eine nicht-diskursive und emotionale Relevanz von Formen unterstellen, öffnen sie die Türen für diese Idee.

Gender-unfair language gives rise to injustice towards both women and non-binary people. Different strategies have been proposed to overcome this injustice, but which is the “best”? In this paper, I will approach this question from a normative perspective, taking into account practical and ethical aspects. I’ll first assess the feasibility and redundancy of the various strategies. Through this lens, no strategy stands out as the best, but each is best suited for specific contexts. I thus argue for a pluralistic approach (...) relying on multiple strategies. I further propose to combine more of them in the same text. This solution is the most efficient, but not the fairest: when considering ethical aspects, most strategies turn out inadequate. Only gender-neutral paraphrases, namely what I call “conservative neutrality”, are truly fair both towards women and non-binary people. I conclude by proposing an adjustment to such a strategy to counterbalance its practical shortcomings. Whether such a proposal will be taken on board by speakers is an empirical question that goes beyond the scope of this paper: my goal here is to provide reasons that could guide speakers’ decisions rather than arguing for which strategies are more likely to spread. The paper follows the thesis, that the perception of real or virtual media shares the anthropological state of "Ausdruckswahrnehmung" or perception of expression (Ernst Cassirer). This kind of perception does not represent a distant, neutral point of view, but one that is guided by feelings or "vitality affects" (Daniel N. Stern). The prerequisites, however, for triggering these feelings/"vitality affects" are not recognizable objects or motifs, but rather their sensually evaluable “abstract representations” or their formal logical structures. In contrast to aesthetic (...) feelings, however, they affect not only our feelings of lust or unlust or our knowledge (formal aesthetics) but also our actions (semiotics). So, when I extend aesthetic experiences to semiotic effects, I will talk about vitality semiotics. This new concept is of consequence, because the thesis of the responsibility of the producer is based on these effects. This is to be carried out by analyzing and presenting the approach of the Bauhaus master Josef Albers. (shrink)

This paper is a contribution to the philosophical debate on visual blur from a relationalist perspective. At the same time, it offers a methodological reflection on the adequacy of explanations of phenomenal similarities and differences among perceptual experiences. The debate on seeing blurrily has been shaped by two implicit assumptions concerning our explanations of differences and similarities between experiences of seeing blurrily and other experiences. I call those assumptions into question, and argue that we do not need to provide a (...) unified explanation of the character of blurry experiences for our account to be adequate. The diversity of blurry experiences supports a different, pluralist approach to explanations of how things appear to subjects. (shrink)

According to Smell Objectivism, the smells we perceive in olfactory experience are objective and independent of perceivers, their experiences, and their perceptual systems. Variations in how things smell to different perceivers or in different contexts raise a challenge to this view. In this paper, I offer an objectivist account of non-illusory contextual variation: cases where the same thing smells different in different contexts of perception and there is no good reason to appeal to misperception. My central example is that of (...) dihydromyrcenol, a substance that can smell both woody and citrusy depending on what other odourants one has recently been exposed to. I first argue that the subjects’ apparently conflicting reports about the way dihydromyrcenol smells are best understood as comparative characterisations of a smell. Given this understanding, different reports can be correctly made in response to perceiving the very same smell. I then argue that the phenomenal difference between the experiences subjects have across contexts can be explained compatibly with Smell Objectivism. On the account proposed, subjects perceive the very same smell but different qualities, notes, or aspects of it are salient to them, depending on the context of perception. I then consider how the proposed defence of Smell Objectivism can be adapted to other cases where the same thing is reported as smelling different in different contexts. (shrink)

Over the past two decades, the epidemic of HIV/AIDS has challenged the public health community to fundamentally rethink the framework for preventing infectious diseases. While much progress has been made on the biomedical front in treatments for HIV infection, prevention still relies on behaviour change. This book documents and explains the remarkable breakthroughs in behavioural research design that have emerged to confront this new challenge: the study of partnership networks.Traditionally, public health research focused on the "knowledge, attitudes, and practices " (...) of individuals, an approach designed for understanding health-related behaviour like seat-belt wearing and cigarette smoking. For HIV and other sexually transmitted infections, however, there are at least two people involved in transmission. This may not seem like a big difference, but in fact it changes everything. First, it means that your risk depends on your partners -- and on their partners, and their partners: it depends on your position in the network of partnerships. Consider, for example, the rise of infections among monogamous women. Second, it means that individuals are not free to simply change their behaviour -- condom use, or abstinence, needs to be negotiated with a partner. both the epidemiology of risk and constraints to behaviour are therefore a function of the partnership network. And our ability to design effective prevention strategies depends on our ability to measure and summarize that network. Using the traditional research designs, you would not see this network at all -- you would only see the unconnected nodes. They key to solving this problem lies in Network Analysis, before now a relatively obscure subfield in Sociology.For empirical studies of networks to become feasible, however, many problems had to be solved. This book documents the rapid progress that has been made. It brings together eight pioneering studies that have sought to map the networks that spread infection around the world. Each chapter reviews the questions that drove the study, the changes in methodology that were needed to implement the network survey, the mistakes and successes encountered, and the central findings that the network design made possible. An introduction provides an overview of network survey design, a glossary provides a summary of network terminology, and example questionnaires from each study provide a template for further research. The ArgumentWhat kind of objects are computer programs used for simulation purposes in scientific settings? The current investigation treats a special case. It focuses on “event generators,” the program packages that particle physicists construct and use to simulate mechanisms of particle production. The paper is an attempt to bring the multiplex and unfolding character of such knowledge objects to the fore: Multiple meanings and functions are embodied in the object and can be drawn out selectively according to the requirements of (...) a work setting. The object's conceptual complexity governs its application in some contexts, while the object is considered a mere “black box,” transparent and ready-to-hand, in others. These two poles span a full spectrum of object aspects, functions, and conceptions. Event generators are ideas turned into software, testing grounds for models, just a tool to study the performance of a detector, etc. The object's multiplex nature is submitted to negotiation among different actors. In this paper, we argue that, although neglected so far, there is a strong link between generics and testimonial injustice. Testimonial injustice is a form of epistemic injustice that “occurs when prejudice causes a hearer to give a deflated level of credibility to a speaker’s word”. Generics are sentences that express generalizations about a category or about its members without specifying what proportion of the category members possess the predicated property. We argue that generics are especially suited to cause testimonial (...) injustice for three reasons. First, generics elicit an “inferential asymmetry” :1452–1482, 2010). That is, generics are accepted even if only a few individuals possess the predicated property but are, nonetheless, taken to refer to almost all the members of the category. This peculiar combination makes generics particularly apt to cause testimonial injustice. High resistance to counter-evidence is a crucial feature of prejudice, the cause of testimonial injustice, and the more highly predictive a generalization the more it will be employed in concrete situations, leading to instances of testimonial injustice. Second, generics seem to play a key role in leading people to develop essentialist beliefs : 273–301, 2010; Rhodes et al. Proc Natl Acad Sci 109: 13526–13531, 2012). Subjects holding such beliefs treat categories as warranting strong generaliations over their members. Therefore, they will be more likely to rely on prejudice while dealing with the category members. Finally, generics are outstandingly common in everyday speech. Hence, their noxious effects are amplified by their diffusion and should not be underestimated. (shrink)

Recently, the mechanistic framework of active inference has been put forward as a principled foundation to develop an overarching theory of consciousness which would help address conceptual disparities in the field (Wiese 2018 ; Hohwy and Seth 2020 ). For that promise to bear out, we argue that current proposals resting on the active inference scheme need refinement to become a process theory of consciousness. One way of improving a theory in mechanistic terms is to use formalisms such as computational (...) models that implement, attune and validate the conceptual notions put forward. Here, we examine how computational modelling approaches have been used to refine the theoretical proposals linking active inference and consciousness, with a focus on the extent and success to which they have been developed to accommodate different facets of consciousness and experimental paradigms, as well as how simulations and empirical data have been used to test and improve these computational models. While current attempts using this approach have shown promising results, we argue they remain preliminary in nature. To refine their predictive and structural validity, testing those models against empirical data is needed i.e., new and unobserved neural data. A remaining challenge for active inference to become a theory of consciousness is to generalize the model to accommodate the broad range of consciousness explananda; and in particular to account for the phenomenological aspects of experience. ABSTRACT This article examines Olympe de Gouges’ demands for the rights of woman in her famous but still understudied work Les droits de la femme. A La Reine [1791]. Particular emphasis is put on analysing how she combines her demand for equality with her conception of sexual difference. The article consists of three parts. The first part gives a brief overview of the demands for the equality of the sexes as they were presented in seventeenth-century France and critically reacted upon (...) in eighteenth-century France, not least by Jean-Jacques Rousseau in his defence of sexual difference. The second and third parts focus on Gouges’ argumentation. First, by analysing how she argues for women’s active citizenship by criticising the exclusion of women from the public sphere, but without questioning sexual difference as such; and second, by discussing how she redefines the famous slogan of the French Revolution; liberty, equality, fraternity. The conclusion argues that rather than being caught in a paradox of equality and difference, as has been claimed by Joan W. Scott, Gouges did successfully combine the two concepts, even if her interpretation of their relation was excluded from the canon of political theory. (shrink)

This article engages with the production and government of migrant multiplicities in border zones of Europe, arguing that the specificity of migrant multiplicities consists in their temporary and divisible character. It is argued that there are three different forms of migrant multiplicities: (1) the multiplicity produced due to migrants’ spatial proximity; (2) the virtual multiplicity generated through data; and (3) the visualized and narrated multiplicity that emerges from media portraits of the ‘spectacle’ of the arrivals of migrants. It is claimed (...) that multiplicities are made to divide and partition the migrants and thus prevent the formation of a collective political subject. In the concluding section, the article deals with the ambivalent character of the term ‘the mob’, addressing the twofold dimension of migrant multiplicities: these are in fact generated by techniques of power, at the same time exceeding them and representing potential emerging political subjects. The rediscovery of the thought of Giambattista Vico (1668-1774) - especially his New science - is a post-Revolutionary phenomenon. Stressing the elements that keep society together by promoting a sense of belonging, Vico's philosophy helped shape a new Italian identity and intellectual class. Poet and philosopher Giacomo Leopardi (1798-1837) responded perceptively to the spreading and manipulation of Vico's ideas, but to what extent can he be considered Vico's heir? Through examining the reasons behind the success of the New science in (...) early nineteenth-century Italy, Martina Piperno uncovers the cultural trends, debates, and obsessions fostered by Vico's work. She reconstructs the penetration of Vico-related discourses in circles and environments frequented by Leopardi, and establishes and analyses a latent Vico-Leopardi relationship. Her highly original reading sees Leopardi reacting to the tensions of his time, receiving Vico's message indirectly without a need to draw directly from the source.
