An official misrepresentation of the law occurs when an official, acting as an agent of the state, represents what is legal or not in an erroneous or misleading way. Should reliance on such misrepresentations excuse one from criminal responsibility? American courts presently recognize two official misrepresentation defenses: Entrapment by Estoppel and Public Authority. However, there is disagreement about what constitutes these defenses and what their limits are. Part of the confusion surrounds why these defenses are justified at all, especially given (...) the general principle ignorantia juris non excusat. We propose an answer to this justification question: these defenses are justified because official misrepresentations preclude knowledge of the illegality of the acts in question. It is not simply that someone on the receiving end did not know; they could not know. We develop this account, linking it to due process and fairness, and then use it to clarify Entrapment by Estoppel and Public Authority and argue both should be subject to important restrictions. Abstract: This article examines the uses of official apologies for massive human rights abuses in the context of democratic transitions. It sketches a normative model of apologies, highlighting how they serve to provide some moral and practical redress for past wrongs. It discusses a number of contributions apologies can make, including publicly confirming the status of victims as moral agents, fostering public reexamination and deliberation about social norms, and promoting critical understandings of history that undermine apologist historical accounts. The article (...) then presents certain normative criteria that any official apology must satisfy, and concludes with a discussion of several theoretical and practical challenges that apologies face in transitional contexts. It draws on Chilean President Patricio Aylwin's apology for his predecessor's crimes as an illustration of some of the promises and challenges that apologies face. (shrink)

In his collection of essays, Law as a Leap of Faith, John Gardner lucidly develops a powerful account of legal positivism, primarily via a careful interrogation of H. L. A. Hart’s work, with a particular focus on Hart’s most important text, The Concept of Law. In this essay, I raise a question regarding the significance of legal subjects’ understanding of themselves as legal subjects. I claim that as Gardner fills out the picture of what it takes to have an ideal (...) legal system, we will find that there is no requirement that subjects have any understanding of themselves as legal subjects, much less an understanding either of what the law requires of them or of the legal status with respect to officials that the law gives them. In particular, I argue that Gardner’s account of the law is too focused on the perspective of officials, and leaves out the perspective of legal subjects. This manifests what I call a unidirectional legal optic: the view of the law is the view from a single perspective, namely the perspective of the official. This is not an accurate picture of the law and so should not be presented as the paradigmatic account of law. (shrink)

This paper aims to measure the quality of all Romanian cities’ websites in 2019 and 2022, before and after the disruptive event of COVID-19. Since the official websites are the core instrument of e-governance, the changes in the quality of Romanian cities’ websites reflect the changes in the development of urban e-governance in Romania. The COVID-19 lockdowns and contact restrictions and the moving of most activities into the online environment had the potential to impact the performance of Romanian cities’ websites (...) significantly and catalyze the progress of local e-governance. The quality of Romanian cities’ official websites was measured using an adapted survey instrument proposed by Holzer and Kim and Manoharan, Melitski, and Holzer. The tool covers five critical criteria of website quality or performance: personal data security, usability, content, services, and citizen participation. The research results may seem contrary to expectations: the improvements of websites have been incremental rather than transformational. Although our research provides only a case study, we may assert that the reform of traditional administration remains a step-by-step process. Our study’s main contribution consists in showing that the progress of e-governance is an incremental process even in a situation of emergency that requires the moving of most activities into the online environment. This book constitutes a supplement to the 1926 account of Alfred Marshall's Official Papers edited by John Maynard Keynes. The book presents material which Keynes did not include, editorial notes and introductions to the various pieces. It focuses on the advice that Marshall, a founding father of modern economics, offered to the British government in the late nineteenth century. The topics covered include education, the role of women, trade unions, unemployment, public enterprise, the quantity theory of money, inflation and trade, (...) benefits of free trade and dangers of protection. The material offers valuable insights into policy thinking at the time, much of which has a surprising degree of relevance to pressing policy issues during our own time. The essays which Bentham collected together for publication in 1830 under the title of Official Aptitude Maximized; Expense Minimized, written at various times between 1810 and 1830, deal with the means of achieving efficient and economical government. In considering a wide range of themes in the fields of constitutional law, public finance, and legal reform, Bentham places the problem of official corruption at the centre of his analysis. He contrasts his own recommendations for good administration, which he had fully developed (...) in his magisterial Constitutional Code, with the severe deficiencies he saw in English practice. The core of the volume consists of four major essays directed against the principles and policies of four leading statesmen: Edmund Burke, George Rose, Robert Peel, and Lord Chancellor Eldon. Of particular concern to Bentham were the abuses sanctioned by the judges and their officials in the Westminster Hall courts, which, he argues, resulted in the denial of justice to the majority of the population. In early 2011, Cow Heavy Books published The Official Catalog of the Library of Potential Literature , a compendium of catalog 'blurbs' for non-existent desired or ideal texts. Along with Erinrose Mager, I edited the project, in a process that was more like curation as it mainly entailed asking a range of contemporary writers, theorists, and text-makers to send us an entry. What resulted was a creative/critical hybrid anthology, a small book in which each page opens (...) to a new iteration of textual desire. These texts explore the material possibilities of the book. Somewhat parallel to the call of N. Katherine Hayles who, in her book Writing Machines , urges literary theorists to take up the practice of Medium Specific Analysis (to account for the way the medium in which it is presented conditions or at least bears on a literary text). I see in the imagined works of The Official Catalog a call for the innovative writers of today to become Medium-Responsive. This would mean thinking through the specific (materially constrained) possibilities offered by the media in which texts are presented, and in thinking of the literary text as a kind of art in the greater context of other arts and the book as a medium situated within the context of many other media. In doing so, the contemporary writer refutes the chorus of critics who lament the death of the book by consistently reinvigorating literary innovation. The following are selections from The Official Catalog of the Library of Potential Literature that show possible paths for (thinking about) new writing that engages with its medium. —Ben Segal, Editor THE CUBE Even the most radical non-linear texts have tended to exploit or subvert only the sequential possibilities of print—from the continuous loop of Joyce's Finnegans Wake to the shuffled cards of Marc Saporta's Composition No. 1 —but The Cube takes such multiplicities to an entirely new level. Set in a grid, the book's words can be read conventionally, across the page, as well as down each column—with either route making complete grammatical sense. But they can also be read as stacked strata and mined like lexical core samples through the layered pages of the book. This is the rare book that continues to stir, whirl, and pop on every new reading. Sean Higgins blogs at BOMBlog where he is responsible for the column Volumes and Territories, as well as Ghost Island , a fledgling collaborative intellectual collective. THE SLOW BOOK The Slow Book , written by an anonymous author at the dawn of literacy, on a minor planet (otherwise notable only as the source of that exceptionally hardy, not very tasty grain called “shef” sowed on hostile planets as an early step to colonization), and encoded into a series of punctures on a strip of copper coiled inside a clever device, something between a player piano and an old-fashioned film projector, is being released into print, as was the author’s intention, at a rate of one word per century (local time). Each word is, across the Forty Galaxies, agreed to be uncannily apt for the century in which it appears—even “of,” in a century during which the highest value was attached to fidelity, whether to ideals, worlds, or romantic love; even “the,” which governed two centuries, one extraordinarily materialistic, during which advances in propulsion and navigation accelerated the exchange of exceptional objects between the remotest planets of the Forty, and one in which the central concern, both of philosophers and the common man, was whether, in an age of rapidly proliferating hypothetical worlds, anyone or anything concretely existed at all. Even those words published long before interstellar contact can be seen in retrospect to have transgalactic pertinence. As a result, attempts to abstract the machine from its publishers, Hobson & Hui, in order to “predict the future” for insight or gain by “fast- forwarding” the copper strip have been many and ingenious. While, in centuries of skepticism (“maybe”), or of unrest (“go”) the book has been nearly forgotten, in others it seems to haunt every thought, every deed, despite the fact that the subject of The Slow Book is still unclear. So far only a few sentences exist in print; everyone knows them, can quote them, offer the standard exegeses and assorted heresies; yet certainties are the stuff of adolescence; mature readers are forced to acknowledge that these sentences are probably only a preamble to the main argument. They contain no proper nouns, nor can we identify any definite theme. There is even disagreement about their tone, whether coolly ironic, as some insist, or ardent. The appearance of an unusual grammatical case, sometimes called the future pluperfect continuous, used to describe events that at some future point will have always been true (but are not yet)—hitherto known to appear only in the synthetic dogmas of the Thanatographical Society, and in certain highly circumscribed religious contexts—has suggested to some scholars that the Slow Book was originally intended for ritual use, but the proximity of the usage to a term designating a small hand plow that, as Pott and Mielcke have convincingly shown, would have borne a distinctly obscene double meaning in its culture of origin in the author’s time, argues otherwise. It is likewise unclear whether the situation that seems to be—with teasing incompleteness—sketched out in these few lines is intended as an illustration of general principles, a case study, a dramatic scene, or an extended metaphor. In short, we have no idea what The Slow Book is about. In our own time, we believe that it is almost certainly a work of fiction, but that may be because we live in the century of “if”. In each age, perhaps, we see the book we most need to read. Some have dared to suggest that the metal strip is blank until, with millennial fanfare, it advances into its new position, that no ur-text exists, that the book itself is brought into being—written—by our need. But that is exactly the sort of thing we would believe, in 7645. THE BOOK OF SOUNDS The Book of Sounds is just that: a book of sounds made when letters are construed in new ways to bring forth out of the alphabet new forms of speech. A book meant to be read out loud, The Book of Sounds is not unlike Laurie Anderson's O Superman or Brian Eno's Music for Airports in its attempt to make music out of the most primary and simplest of methods. It breaks language down to its barest bones and makes out of the page a drum that has never before been beaten upon. PARADISE OF THE BLIND by Celan Solen Although the reclusive Celan Solen published his first and only book in 1963—paying out-of-pocket for a limited edition of the slim collection No One May Have the Same Knowledge Again —he remained in American obscurity for almost three decades. In 1992 a micro-press in Istanbul brought out No One in Turkish. A German translation followed in 1995. Soon it became clear in literary circles Solen was a world-class (if highly unclassifiable) artist—lyrical, dense, enigmatic—who could undo the conventional short story in 397 words by inventing impossible worlds housed in impossible whirls (in “Small Sadnesses,” a single chartreuse tree frog in Borneo unknowingly holds time together by its very presence in the universe, while each letter of its tale refers, not to itself, but to the one preceding it in the alphabet). By his disappearance last year, Solen was considered master by a generation of writers and critics (except, alas, for those gentlemen in the Swedish Academy). Imagine, then, that generation’s delight at the discovery, locked away in the author’s safe-deposit box, of his second and final composition. Had Lynch’s Lost Highway been book instead of film, and had it been penned by Beckett at his least certain, revised by Barthelme at his most formally deranged, and typeset by Derrida at his most semiotically catastrophic, the result might have been something like Paradise of the Blind : interlacing narratives of a man composed of borrowed organs (whose most cheerless and difficult to locate, god, could only have been invented by an empty heart), a nonexistent medieval painting blamed for the ruin of future hope, and the spread of a philosophy that holds earth a mistake constantly recurring in the dream of a fish lying on the floor of the Atlantic (if the fish wakes, our world winks off)—all contained in a text packed with typed-over passages, torn postcards, poems that can be deciphered only when held up to a mirror, pages ornamented with trompe-l'œil paperclips and coffee stains and buzzing houseflies, some busy with illegible runes that dissolve when exposed to light, three that smell like roses or lemons (depending on whether a man or woman is reading), two that stain with the bloody fingerprints of the those who handle them, one that ignites when brushed with breath, thirteen sewn from baby skin, one that moans when touched, and one that screams—yet all without mass, unimaginable, and invisible. The aim of this work of reference is to provide a full year-by-year list of officials from archaic and classical Athens, along with, where appropriate, a short notice of their activities, including all the evidence pertaining to an individual's office in a particular year. It also contains all state decrees datable to any year or which contain relevant information. It offers a basic reference, of a kind that has been lacking up to now, for the study of Athenian magistracies (...) and official life. The introduction gives essential details of the positions included, and the indexes give an alphabetic listing of individuals with their offices, a listing by geographical provenance (demes), and an indication of documents of disputed date. As far as possible the use of Greek and Latin has been avoided in order that the book should be accessible to a wide readership. It should prove a fundamental tool for future research. (shrink)

Drawing on tournament theory, we argue that when environmental goals are incorporated into the cadre evaluation system, compared to officials who are close to retirement (i.e., retiring officials), non-retiring officials may exert more effort to foster risky green innovation. Based on a sample of publicly traded firms from heavily polluting industries in China between 2008 and 2016, we hypothesize and find that confronted with severe environmental pollution, firms in provinces with non-retiring governors have higher green innovation performance (...) than those in provinces with retiring governors. Moreover, we find that this effect is stronger for firms in provinces whose governors have higher promotion anticipation, for local state-owned enterprises (SOEs), and for politically connected firms. Our study identifies the political incentives of government officials as an important antecedent of corporate green innovation and highlights the value of establishing a “green” cadre evaluation system to promote sustainable development. The rise of Big Data changes the context in which organisations producing official statistics operate. Big Data provides opportunities, but in order to make optimal use of Big Data, a number of challenges have to be addressed. This stimulates increased collaboration between National Statistical Institutes, Big Data holders, businesses and universities. In time, this may lead to a shift in the role of statistical institutes in the provision of high-quality and impartial statistical information to society. In this paper, the changes (...) in context, the opportunities, the challenges and the way to collaborate are addressed. The collaboration between the various stakeholders will involve each partner building on and contributing different strengths. For national statistical offices, traditional strengths include, on the one hand, the ability to collect data and combine data sources with statistical products and, on the other hand, their focus on quality, transparency and sound methodology. In the Big Data era of competing and multiplying data sources, they continue to have a unique knowledge of official statistical production methods. And their impartiality and respect for privacy as enshrined in law uniquely position them as a trusted third party. Based on this, they may advise on the quality and validity of information of various sources. By thus positioning themselves, they will be able to play their role as key information providers in a changing society. (shrink)

Is it generally rational to defer to official stories? On the affirmative view exemplified by Neil Levy, grounds for scepticism cannot outweigh the epistemic authority of the experts presumed to generate them. Yet sociological studies of how expertise is mediated into official communications reveal the epistemic potential of citizens’ collaboratives. These may include, or advocate hearing, dissident experts. Such groups’ epistemic position is arguably analogous to that of the ‘other institutions of civil society’ that Levy sees as underwriting the authority (...) of official stories. An added advantage is that they are able to adhere to deliberative methods of inquiry. By contrast, an official story presupposes that deliberations have concluded, and what remains is to promote the agreed story. This is achieved by strategic communication, which can involve extensive coordination by organisations committed primarily to persuasion rather than truth-seeking. Sometimes it includes blocking dissidents’ deliberative challenges. A case study highlights how even an organisation of indisputable epistemic authority can be politically influenced to block the testimony of its own scientific experts, while uncritical support for its official story is maintained by other institutions of civil society. Hence, an appropriate attitude towards official stories is critical receptiveness rather than automatic deference. (shrink)

In their thoughtful, nuanced and interesting discussion, Jonathan Pugh, Julian Savulescu, Rebecca Brown and Dom Wilkinson argued that officials should recognise proof of prior infection as a valid exemption from vaccination requirements.1 This commentary agrees with parts of their analysis, but argues that the case for the exemption is less clear than the authors suggest, and the better approach is to allow officials flexibility: an exemption for natural immunity may be appropriate or may not. In part, the disagreements (...) may stem from different experiences in different societies. The authors are in the UK, and their experience may differ from the USA in multiple ways, three very glaring. First, the UK broadly used the AstraZeneca vaccine, which has higher risks than the mRNA vaccines, so our assessment of vaccine risks differs. Second, the UK has universal health insurance, so some of the access to testing issues that I raise concerns about may not apply there. And third, the risk of fraud or misrepresentation may be less in the UK—and other countries—than in the USA, where real concerns about, for example, fake vaccine cards have led to multiple arrests.2 Another issue is that information about COVID-19 changes fast—what was known when the authors wrote may no longer fit the current picture. In their article, the authors argue that it is ethically imperative that COVID-19 mandates exempt those with natural immunity. The authors argue that those who have become immune through infection are ‘potentially equivalent’ to those who were vaccinated, and refusing them an exemption is ethically unjustified—they call this the ‘unnaturalistic fallacy’. The authors convincingly conclude that existing data suggest that previous infection leads to durable immunity for at least several months and protects against reinfection. The …. (shrink)

In a recent JME article, Joona Räsänen makes the case for allowing legal age change. We identify three problems with his argument and, on that basis, propose an improved version thereof. Unfortunately, even the improved argument is vulnerable to the objection that chronological age is a better proxy for justice in health than both legal and what we shall call official age.

Both corruption and subjective wellbeing are of concern to academics and governments. Although some evidence suggests that corruption deteriorates subjective wellbeing, the relationship between perception of official corruption and subjective wellbeing is still unknown. This study aims to examine the link between perceived official corruption and subjective wellbeing in the context of China and whether satisfaction with government performance has a mediating effect in the process. Based on data from China General Social Survey, a structural equation model was used to (...) test the hypotheses. The results of 3,033 Chinese respondents suggest that perception of official corruption is negatively related to subjective wellbeing, and satisfaction with government performance plays a mediating role in the relationship between perception of official corruption and subjective wellbeing. The article presents an analysis of the activities of formal and informal art associations in the space of contemporary art in Russia and China. The two countries actively cooperate in the field of art, including at the institutional level, which actualizes the appeal to the work of existing creative unions. The object of attention in the framework of the study is the modern art associations of the two countries, and the subject is the relationship between the structure and activities of (...) official and informal art associations of China and Russia. The aim is to analyze the features of the activity of art associations in the conditions of the modern art space of their countries. The analysis of the state and directions of development of both official structures and informal art groups is carried out. The former in both Russia and China, as a rule, are the continuers of the traditions of the former structures, but the original function of the guide of the political course of the leadership of the countries in them remained at different levels, mostly decreasing. The latter are communities of artists who unite by creative interests or around a common exhibition space for them, in particular galleries. Moreover, both forms successfully exist in both states, reflecting the trends of artistic life and at the same time influencing it. (shrink)

This article aims to provide a comprehensive and systematic understanding of the awareness of both officials and the public regarding the government's people's mobilization work (PMW) in Dong Nai province today. People's mobilization efforts have garnered significant attention from multiple sectors, yet it is crucial to examine the perspectives of both government officials and ordinary citizens. The research focuses on identifying the levels of awareness, understanding, and engagement of these groups in relation to the government's PMW policies and (...) strategies. By doing so, the study will delve into how effectively these efforts have been communicated, understood, and applied by both officials who implement policies and the public who are the target of these efforts. In addition, the article explores the challenges and successes of PMW in the province, aiming to pinpoint areas where improvements are needed to enhance collaboration between the government and the people. By offering a multidimensional perspective, the study contributes to the academic discourse on PMW while addressing practical issues surrounding the implementation of these strategies. The findings are expected to not only shed light on the current state of public awareness but also to provide policymakers with insights to refine their approach, thereby strengthening the relationship between government efforts and public participation in Dong Nai province. In 1974, David Best rightly contrasted purposive sports (exemplified by most sports) with aesthetic sports; and recently I was careful to exempt the issues for aesthetic sports from my critique of the prospects for an all-embracing philosophy of officiating. While discretion plays a part in umpiring or refereeing in both kinds of sports, it is especially important for aesthetic sports (such as gymnastic vaulting, ice-skating or diving), where the manner of execution determines victory. Here, it is urged that the issue (...) of objectivity for judgements in aesthetic sports is not the most crucial aspect: we have reason to expect correct accounts from knowledgeable, sensitive and experienced judges or umpires. Impartiality remains a concern, of course, not least between the training for judges or umpires might tend to favour particular styles of performing key movements. So that many past rule-changes are explained as attempts to improve fairness, with competitors getting their ‘just deserts’. In doing so, they have implicitly contributed to what is then valued in the manner of execution in aesthetic sports. The term ‘aesthetic’ is generally applied in its positive valence, although one must recognize the negative valence also. But, for aesthetic sports, the rules provide guidance as to what will or will not be regarded positively in the context of competition. And rule-changes here will sometimes be best explained as attempting to modify what is rewarded in such sports, the manner of performance. Such changes might be expected to bear on the character of the sport (here exemplified through men’s ice-skating). (shrink)

Resumen: Cuando se habla del renacimiento del budismo a finales de la dinastía Ming, los estudiosos echan en falta el estudio de ricos registros locales, regiones específicas y casos típicos. El templo de Jingshan, en Hangzhou, proporciona una muestra de este tipo. Una manifestación destacada del templo de Jingshan a finales de la dinastía Ming es la emergencia de todo un conjunto de anales. Diferentes grupos, como los monjes, los magistrados y la alta burguesía, participaron en la redacción de la (...) historia de Jingshan de forma diacrónica en el mismo espacio. Las diferentes versiones de los Anales de Jingshan revelan el entrelazamiento de los acontecimientos históricos, las tendencias de la época y los deseos de varios grupos en distintas regiones, lo que arroja luz sobre el desarrollo que los registros históricos budistas empezaron a tener con otros clásicos ajenos al budismo en lugar de centrarse únicamente en los sutras budistas. Este proceso pone de manifiesto que el renacimiento del budismo a finales de la dinastía Ming es también un estado activo diacrónico alcanzado por las actividades de personas con diferentes propósitos en un área específica. A legitimate expectation in a liberal democracy is that public officials enforce the law regardless of its content; when they don’t do so, their actions tend to be publicly condemned. This expectation puts street-level bureaucrats in a moral dilemma when they consider that a certain law is unjust: either they don’t enforce the law and violate their duties to the citizenry, or they enforce it and become complicit in injustices. This paper argues for the legal permission of public (...) class='Hi'>officials to disregard legal mandates for moral reasons. Call it official disobedience. Contrary to common intuitions, I show that official disobedience would foster the principles of and improve governance in liberal democracies: it accommodates public officials’ personal autonomy and yields three main democratic benefits. First, information about the outcomes of the law would become available for lawmakers; second, in the aggregate, it would protect citizens from injustices; third, it would improve the moral character of bureaucrats. The problem of dirty hands is, roughly speaking, concerned with situations in which an agent is faced with a choice between two evils so that, no matter what they do, they will have to violate something of important moral value. Theorists have been primarily concerned with dirty hands choices arising in politics because they are thought to be particularly frequent and pressing in this sphere. Much of the subsequent discussion in the literature has focused on the impact that such choices (...) have on a well-functioning democracy and how, if at all, we can ensure that a politician dirtying their hands does not undermine core democratic values and processes. A particular concern has been whether dirty-handed politicians ought to publicly reveal their actions after the fact and whether they should be held accountable through some form of punishment. The first aim of this paper is to point out that the focus on what is required in the wake of a dirty-handed decision, based on the need to protect the democratic system ought to be balanced with a genuine concern for reparative justice and what is owed to the victims of dirty hands. In the second part of this paper, I then examine the suitability of one common way in which perpetrators partly repair the damage they have done to victims, namely apologizing, in the dirty hands context. Online interactions have become major channels for people to obtain and disseminate information during the new normal of COVID-19, which can also be a primary platform for rumor propagation. There are many complex psychological reasons for spreading rumors, but previous studies have not fully analyzed this problem from the perspective of the interaction between official institutions and influential users. The purpose of this study is to determine optimal strategies for official institutions considering the impact of two different influential user types (...) by designing two game-theoretic models, namely “Rumor Clarification and Interaction Model” and “Rumor Verification and Interaction Model,” which can, respectively decide whether to clarify and when to clarify. The results of this article show that clarification strategies can be decided according to the characteristics of rumors and the influential user’s reactions. Meanwhile, publishing verified information prevents trolls’ “loophole advantages” and prevents reputed personalities from spreading false information due to the vague authenticity of rumors. The political environment has a significant impact on the sustainable development of enterprises. This manuscript aims to investigate the effect of policy uncertainty and official social capital on enterprises’ effective tax rate due to the change of officials. Based on the panel data from the Chinese Industrial Enterprise Database from 1998 to 2009, it is shown that the policy uncertainty caused by the change of local government officials significantly increases the ETR of enterprises. Meanwhile, municipal officials who (...) have social ties with provincial officials in their province also tend to raise the ETR of industrial enterprises, and this tendency is more evident when the officials take office. Further research shows that the effects vary in many aspects for policy uncertainty and social capital on the ETR of enterprises. The findings of this manuscript provide support for a deeper understanding of the change in local government fiscal policies and give suggestions to strengthen political environmental governance for the sustainable development of enterprises. The aim of this article is to analyse the opinions of journalists and citizens regarding the interdependence of public media and the official sources of political power in Spain. Little research of this kind has been done in the Spanish context. Journalists and citizens representing four Spanish regions?Catalonia, Madrid, the Basque Country, and Andalusia?were questioned about their opinions regarding this interdependency. The methodology used in this research is based on quantitative techniques (surveys) and qualitative techniques (in-depth interviews and focus groups). (...) The results prove that the opinions of journalists differ from those of citizens for the majority of questions asked. Citizens are more inclined to follow directions from official sources than are journalists. The geographical background of the respondents proved to be a significant factor in terms of variation in answers. Journalists from Catalonia and the Basque country are much more reluctant to follow government directives on issues of counter terrorism or in cases of national emergency. (shrink)

This is an in-depth study of two exceptional seals impressed on tablets from late Sukkalmah-early Kidinuid Susa and Haft Tepe. Both seals have exceptionally long inscriptions in Akkadian, mentioning Išme-karāb and Inšušinak, respectively, followed by penalty and curse clauses resembling those used in the economic and legal texts and royal charters of Sukkalmah Susa. Analysis of the inscriptions implies that both seals must have been official seals, used by legal bodies during appeals to the supreme court. The Išme-karāb sealing, which (...) mentions the deities Išme-karāb, escort of the dead to the underworld, and Inšušinak, judge of the dead, evokes divine judgement. The Inšušinak seal has a more secular and “national” character, invoking in the curse formula four important Elamite rulers, including the illustrious Šilhaha. (shrink)

This work is unique in bringing concepts and methods from cognitive anthropology to bear on psychiatric classification. At first blush, it might seem questionable to treat clinicians’ beliefs about psychiatric disorders as folk taxonomies, no different in kind from classifications of birds produced by (...) members of a forest-dwelling tribe. Unlike birds and other natural objects of folk taxonomies, mental disorders are not concrete entities and they cannot be distinguished on perceptual grounds. Unlike tribespeople, clinicians are not simply “folk” whose naïve classifications can be compared with those of scientific authorities. They are, in fact, heavily exposed to the reigning official taxonomy during their professional training, and their thinking can hardly remain unaffected by it. It is a testament to Flanagan and Blashfield’s work that despite these apparent disanalogies, their folk-taxonomic approach manages to illuminate how clinicians carve up the psychiatric domain.This paper reports some careful, creative, and labor-intensive studies to make a few fundamental claims about how clinicians classify. First, the authors argue that clinicians hold simplified taxonomies compared with the official DSM-IV taxonomy: They encompass fewer disorders and classify them in a shallower hierarchy. Second, they claim that clinicians substantially agree in how they classify disorders, and that a consensus classification can therefore be extracted from their individual taxonomies. Third, they argue that clinicians’ taxonomies show only a modest consistency with DSM-IV, and that the discrepancies may be systematic and important. Notably, for example, clinicians did not preserve the fundamental divide between the DSM’s Axes I and II. My comments address the second and third claims.Is There a “Consensus” among the Clinicians?One of the main achievements of Flanagan and Blashfield’s paper is to develop a “consensual taxonomy,” which is laid out in their Table 2a. This taxonomy clearly distils how their clinicians tended to judge the relations among diagnoses. However, it is an exaggeration to present it as a consensus. If, by Romney, Weller, and Batchelder’s (1986) third criterion, “cultural consensus” requires that the primary factor in a principal components analysis accounts for “most” of the variance in clinicians’ judgments, then Flanagan and Blashfield’s analysis [End Page 281] fails to show consensus. Their first factor accounts for only twenty-five percent of the variance, well short of the required majority. This finding implies that there is three times as much inconsistency or variability among clinicians’ taxonomic judgments than there is consistency and commonality. The observed factor-analytic findings are compatible with the average correlation between pairs of clinicians being only about 0.2, a very weak level of agreement.This is not to say that there is no consistency among the clinicians, or that there is no value in summarizing that consistency, but it does indicate that there is a great deal of diversity as well. Clinicians’ folk taxonomies seem to be highly idiosyncratic, more a Babel of distinctive classifications than a chorus of agreement. It is therefore risky to draw strong generalizations about how clinicians classify, and to imply that there is a single consensual taxonomy.Several things are very interesting about this diversity of classifications. First, Flanagan and Blashfield show that it cannot be explained by the clinicians’ differing levels of experience or by the different methodologies used to elicit their taxonomies. The variability among clinicians must therefore have some other basis, which awaits further investigation. Second, the level of agreement (“consensus”) obtained here is significantly lower than what has been found in more orthodox studies of folk taxonomy. By implication, the classification of psychiatric disorders is a slipperier enterprise than the classification of animals and plants. People who have extensive professional experience and training in the field of psychopathology—vocational training that includes the standardizing forces of accrediting bodies and a dominant psychiatric nosology—nevertheless tend not to agree substantially about how to map that territory. In this cross-sectional observational study, we wanted to assess the viewpoints of residents and medical students about applicability of official professionalism recommendations in the emergency department. We asked 72 participants to fill a questionnaire, which was designed based on “the directory of professional ethics for physicians” written by Tehran University of Medical Sciences. The questionnaire consisted of 74 statements divided into 6 different categories: altruism, honor and integrity, justice, respect, duty and responsibility, and excellence.
