This book presents G. A. Cohen's Gifford Lectures, delivered at the University of Edinburgh in 1996. Focusing on Marxism and Rawlsian liberalism, Cohen draws a connection between these thought systems and the choices that shape a person's life. In the case of Marxism, the relevant life is his own: a communist upbringing in the 1940s in Montreal, which induced a belief in a strongly socialist egalitarian doctrine. The narrative of Cohen's reckoning with that inheritance develops through a (...) series of sophisticated engagements with the central questions of social and political philosophy. In the case of Rawlsian doctrine, Cohen looks to people's lives in general. He argues that egalitarian justice is not only, as Rawlsian liberalism teaches, a matter of rules that define the structure of society, but also a matter of personal attitude and choice. Personal attitude and choice are, moreover, the stuff of which social structure itself is made. Those truths have not informed political philosophy as much as they should, and Cohen's focus on them brings political philosophy closer to moral philosophy, and to the Judeo-Christian ethical tradition, than it has recently been. In a study published in late April in Nature Communications, the authors were able to sustain 105- to 115-day-old premature lamb fetuses—whose level of development was comparable to that of a twenty-three-week-old human fetus—for four weeks in an artificial womb, enabling the lambs to develop in a way that paralleled age-matched controls. The oldest lamb of the set, more than a year old at the time the paper came out, appeared completely normal. This kind of research brings us one step (...) closer to providing excellent quality of life for premature newborns, but it also portends major legal and ethical questions, especially for abortion rights in America. I take a close look at Bernard Williams’s paper "Moral Luck," which put this notion on the philosophical agenda. Williams’s focal example is the painter Paul Gauguin. According to Williams, Gauguin’s morally dubious decision to desert his family so as to pursue an artistic career can be redeemed only by his partially fortuitous success as a painter. This is shown by the consideration that a successful Gauguin would not be able to regret his decision, whereas failure would have prompted regret. (...) I suggest that the best way to understand this claim is to see Gauguin’s decision to become an artist as a constitutive decision, which launches what for him proved to be a defining project. One cannot coherently regret the realization of such a project or the decision that gave rise to it because that would amount to wishing to be someone else: conditions of personal identity set the limits on the counterfactuals about ourselves that we can intelligibly entertain. However, not being able to regret the constitutive elements of one’s life is not the same as approving of these elements. So I disagree with Williams’s ultimate conclusion that the inability to regret a decision signals some justification for it, no matter how attenuated. (shrink)

Joseph Heath defends competitive markets and conceptualizes business ethics with reference to Pareto efficiency, which he takes to be the “implicit morality of the market.” His justification for markets is that they generate Pareto efficient outcomes, meaning that markets optimally satisfy consumer preferences. And, for Heath, business ethics is the set of normative constraints—regulation and beyond-compliance norms—needed to preserve that outcome. The present paper accepts Heath’s claim that the economic justification for markets is ethical, in that satisfying consumer preferences is (...) a good. But, contra Heath, the ethical consideration at work is a consequentialist one; and acknowledging this consequentialism exposes limitations of Heath’s “market failures” approach to business ethics. We suggest two limitations, and we expect many will accept our argument that Heath’s conception of business ethics is too narrow. The present paper outlines two broader implications. First, acknowledging that the justification for markets is ethical eliminates the apparent—and false—conflict between purportedly amoral economic activity on one hand and ethical considerations on the other; instead, business ethics is a matter of weighing the consequentialist ethical benefit of economic activity and markets against other moral arguments/other ethical considerations. Second, Heath restricts business ethics to the constraints needed to protect the market’s ability to efficiently satisfy consumer preferences, constraints he calls “efficiency imperatives”; this restriction supports the widespread tendency to think that all social problems are economic; and, a business ethics so-conceived diminishes the perceived importance of noneconomic values—this attitude is dangerous. Virtue argumentation theory provides the best framework for accommodating the notion of an argument that is “fully satisfying” in a robust and integrated sense. The process of explicating the notion of fully satisfying arguments requires expanding the concept of arguers to include all of an argument’s participants, including judges, juries, and interested spectators. And that, in turn, requires expanding the concept of an argument itself to include its entire context.

Assuming the existence of God and divine commands, it makes sense to ask to what end God issues commands. This question has been raised in recent philosophical literature in the context of whether there can be a divine command to believe in, or to worship, God. In this article, I argue that the answers proposed to this question fail to appreciate the wide range of possible purposes of divine commanding. The problem of theorizing privacy moves on two levels, the first consisting of an inadequate conceptual vocabulary and the second consisting of an inadequate institutional grammar. Privacy rights are supposed to protect individual subjects, and so conventional ways of understanding privacy are subject-centered, but subject-centered approaches to theorizing privacy also wrestle with deeply embedded contradictions. And privacy’s most enduring institutional failure modes flow from its insistence on placing the individual and individualized control at the center. Strategies for rescuing privacy from (...) irrelevance involve inverting both established ways of talking about privacy rights and established conventions for designing institutions to protect them. In terms of theory, turning privacy inside out entails focusing on the conditions that are needed to produce sufficiently private and privacy-valuing subjects. Institutionally, turning privacy inside out entails focusing on the design, production, and operational practices most likely to instantiate and preserve those conditions. (shrink)

This paper argues that Rawls’ principles of justice provide a normative foundation for stakeholder theory. The principles articulate (at an abstract level) citizens’ rights; these rights create interests across all aspects of society, including in the space of economic activity; and therefore, stakeholders – as citizens – have legitimate interests in the space of economic activity. This approach to stakeholder theory suggests a political interpretation of Boatright’s Moral Market approach, one that emphasizes the rights/place of citizens. And this approach to (...) stakeholder theory – in terms of citizens – raises a further question, what rights and obligations do economic agents have, beyond those attached to their roles as citizens? Rawls would reject additional rights and obligations of this sort for two reasons, one tied to freedom and one tied to pluralism. Rawls’ work therefore presses us to re-conceptualize the place of ethical claims in the economic context. (shrink)

In this paper I discuss the nature of halakhic facts and I frame the discussion in a broader meta-ethical context. Most of the existing literature on the philosophy of halakha has focused on the contrast between ‘Halakhic Realism’ and ‘Halakhic Nominalism’. This theoretical contrast is vague and includes a wide range of theories. Inspired by the meta-ethical literature, I propose to focus the discussion on views that can be called ‘Halakhic Naturalism’ and ‘Halakhic Non-naturalism’. I present, develop and distinguish between (...) different meanings of 'naturalism' and consider arguments for and against 'Halakhic Naturalism'. The purpose of this paper is twofold: First, to present and demonstrate the fruitful encounter between meta-ethics and the philosophy of halakha. While deductive validity provides the limiting upper bound for evaluating the strength and quality of inferences, by itself it is an inadequate tool for evaluating arguments, arguing, and argumentation. Similar remarks can be made about rhetorical success and dialectical closure. Then what would count as ideal argumentation? In this paper we introduce the concept of cognitive compathy to point in the direction of one way to answer that question. It is a feature of our argumentation rather than my argument or (...) your argument. In that respect, compathy is like the harmonies achieved by an accomplished choir, the spontaneous coordination of athletic teamwork, or the experience of improvising jazz musicians when they are all in the flow together. It is a characteristic of arguments, not a virtue that can be attributed to individual arguers. It makes argumentation more than just the sum of its individual parts. The concept of cognitive compathy is brought into focus by locating it at the confluence of two lines of thought. First, we work up to the concept of compathy by contrasting it with empathy and sympathy in the context of emotions, which is then transplanted into epistemic, cognitive, and argumentative soil. Second, the concept is analytically linked to ideal argumentation by way of authenticity in communication. In the final section, we explore the extent to which argumentative virtues are conducive to producing compathetic argumentation, but reach the unhappy conclusion that the extra value of compathetic argumentation also transcends the evaluative reach of virtue argumentation theory. In Memory of Ed PellegrinoEuthanasia in Belgium is not limited to terminally ill patients. It may be applied to patients with chronic degenerative diseases. Currently, people in Belgium wish to make it possible to euthanize incompetent patients who suffer from dementia. This article explains the Belgian law and then explores arguments for and against euthanasia of patients with dementia. It probes the dementia paradox by elucidating Dworkin’s distinction between critical and experiential interests, arguing that at the end-of-life this distinction is (...) not clearcut. It argues against euthanasia for patients with dementia, for respecting patients’ humanity and for providing them with more care, compassion, and good doctoring. (shrink)

A central debate in the ethics of deception concerns the moral comparison among the three media through which deception is executed: lying, falsely implicating, or nonlinguistic deception. The two prominent views are that lying is morally worse or that the choice of medium is morally insignificant. This article refutes both and argues for a new position. The article first presents a theory on the moral significance of the medium of deception as such: it argues that the medium of communication affects (...) the reliability of beliefs formed through it, which amounts to gradations in the warrant of truth of different media. Breach of lower warrant of truth is a lesser breach of trust; it therefore deserves lighter condemnation. Consequently, the article shows that, morally speaking, lying is either worse than or equal to falsely implicating and that there is no a priori gradation between nonlinguistic deception and the two linguistic media. Full-length studies of individual books of Nietzsche have been lacking until now both because of the immaturity of the field and because Nietzsche's style itself seems to contraindicate them. Close reading, however, reveals a great deal of literary and philosophical unity. This holds good even of Human, All-Too-Human, Nietzsche's longest and most unwieldy work. The book represents Nietzsche's break with Schopenhauer and Wagner, as well as the birth of Nietzsche as we know him in the later works. The book's embrace (...) of science as conducive to culture follows the early works' vilification of science as anathema to culture. This reassessment is possible because science is now seen as a method and a discipline rather than an insatiable drive for knowledge, and culture is now a broad set of symbols and activities rather than a narrowly focussed "unity of artistic style." Both changes were motivated by Nietzsche's rejection of Wagner. Part of the help science provides culture is its release from restrictive metaphysical beliefs. Nietzsche battles metaphysics, principally that of Schopenhauer, by means of scientific arguments meant both to provide alternative explanations of phenomena and to expose the origin of countervailing metaphysical beliefs. However, even when combined in a two-pronged attack, these arguments still fall short of their goal of refuting metaphysics. The scientific world-view may nonetheless aid the development of "free spirits," whose unalloyed devotion to knowledge makes them science's paragons. The free spirits are the prototypes for the later works' strong individuals, yet here they are viewed as crucial elements in the cultural development of general society. Nietzsche seeks both to create them and to encourage their devotion to the needs of culture. Part of his effort to do this is the deployment of a terse, elliptical style which will involve the reader more thoroughly than can be done by means of argument alone. Study of the book's structure reveals that its core, Parts 1, 5, and 9, outlines the relation between science, culture, and free spirits. (shrink)

The theme of Aesthetics in Present Future concerns the new chances the arts have and the deep changes they are undergoing, due to the new media, and the digital world in which we are growingly immersed. That this world is to be understood from an aesthetic point of view, become clear if we think of how much of what we produce, and observe and study is offered through images in particular and perceptual means in general.

This is an extensive critical review of Euthanasia in International and Comparative Perspective. My Review is divided into five parts. First, I outline the book's strengths. I proceed by speaking of the need for clear and cohesive terminology. I then discuss end-of-life decision-making in some of the countries: Belgium, The Netherlands, and the State of Oregon in the United States, all allow PAS. Belgium and The Netherlands also allow euthanasia. I also discuss Israel's Dying Patient Law,13 enacted by the Knesset (...) on December 5, 2005. Finally, I make some suggestions for improvement, including a detailed proposal for PAS which I conceive to be the best policy when balancing one against the other the autonomy of the patient, on the one hand, and the safeguards against abuse when life might be considered too lightly, on the other. Indeed, the main difference between euthanasia and PAS is that in euthanasia, it is the physician who makes the final act of taking patient's life, whereas in PAS it is the patient who takes his or her life. In euthanasia, the physician has control over the process. In PAS, the physician controls the procedure up until the last act. The patient has control over the very act of suicide. (shrink)

This thesis is the first major study of censorship of and in English Canadian literature. While there are several reasons scholars have focused on censorship in Europe and the United States, it is the ascendancy in quality and quantity of Canadian writing leading to its further use in institutions where censorship takes place---such as schools and libraries---that necessitates a study of censorship in Canadian literature now. This rise in censorship has prompted Canadian authors increasingly to write about the subject. In (...) this thesis I study censorship issues raised both explicitly md implicitly by Timothy Findley, Margaret Atwood, Margaret Laurence, Beatrice Culleton and Marlene Nourbese Philip. All of these writers have been subjected to censorship attacks and have responded to these attacks and grappled with the philosophical implications of censorship in their fiction and non-fiction. My investigation of censorship in these texts sheds new light on the works of literature themselves, but the literary texts also suggest a new way of looking at censorship. Each of my chapters offers arguments challenging the traditional Enlightenment model of censorship as an oppressive government practice against its citizens, a definition resulting in the mistaken views that censorship has been largely eradicated in the West and that, when it does surface, it is to be condemned on principle. This view can be contrasted with a "constructivist" model of censorship as the delegitimation of expression by social forces. My findings support a definition which draws on both models wherein censorship is the exclusion of some discourse as the result of a judgment by an authoritative agent based on some ideological predisposition. The key word in this definition is "judgment" which, when recognized as the primary activity in censorship, must change the way we approach censorship controversies. For if censorship is the exercise of judgment, and judgment is enmeshed in the fabric of human endeavour, then censorship is inevitable in our society. Since censorship is inevitable, I conclude, we should stop arguing about whether censorship itself is a desirable practice and begin to find ways to make censorship practices more reasonable or more "just.". Research shows that the physician’s personal attributes and social characteristics have a strong association with their end-of-life decision making. Despite efforts to increase patient, family and surrogate input into EOL decision making, research shows the physician’s input to be dominant. Our research finds that physician’s social values, independent of religiosity, have a significant association with physician’s tendency to withhold or withdraw life sustaining, EOL treatments. It is suggested that physicians employ personal social values in their EOL medical coping, because they (...) have to cope with existential dilemmas posed by the mystery of death, and left unresolved by medical decision making mechanisms such as advanced directives and hospital ethics committees. Halakha consists of a variety of laws that determine the halakhic status of various actions. Halakhic laws, by their very nature, have a general aspect in that they apply to all similar actions under similar conditions. In this paper, I examine, from a philosophical-analytical point of view, the relationship between the general aspect of the halakhic laws and the fact that these laws apply to particular actions. After the introduction, this paper is divided into three parts. First, I distinguish between (...) two competing theses regarding the "metaphysical order" between the general aspect of halakhic law and its individual cases. The first one, I call 'Halakhic Generalism', according to which the general aspect of Halakhic law has essential precedence. The second one I refer to as 'Halakhic Particularism', according to which the general aspect of the halakhic law is nothing more than a generalization of all its individual cases. In the second part of the paper, I argue that the particularist position has the power to justify a unique and puzzling halakhic principle. According to this principle, in cases of normative over-determination where the same action is forbidden due to two different halakhic laws, then "a prohibition does not apply to a prohibition". Finally, I compare the reasoning I offer for this principle to alternative justifications of said principle. I argue that, compared to the alternatives, the particularist position provides the best explanation for the principle. (shrink)

The economic shift initiated in the 1980s, the reign of the market and the computer, often resulted in the reappearing of a “feudal legal structure... consisting of networks of allegiance.” This paradox (ultra-modernity and neo-feudalism) is rarely considered a historical tool for studying late twentieth-century philosophy. This article is a first step in that direction, using Supiot’s characterization of the period as a “shift from law to tie” to approach the work of Levinas. In Totality and Infinity and Otherwise than (...) Being, Levinas defends a revelation of or exposure to the Other directed against the “neutralization of the Other” as being, object, or phenomenon. It is meant to liberate an interpellation by the Other before and beyond any general constitution of the object by the subject. Can this shift in twentieth-century philosophy be reconsidered if we add to Levinas’s own account Supiot’s historical understanding concerning the withering-away of general normative forms in favor of personal ties of allegiance?
