Many philosophers think that normative judgements do not aim to represent the world. In this paper, I argue that this view is incompatible with the thought that when two people make conflicting normative judgements, at most one of these judgements is correct. I argue that this shows that normative judgements do aim to represent the world.

This essay interrogates the relation between descriptive and prescriptive elements in Don Ihde’s philosophy of technology. I argue that while Ihde’s philosophy contributes more to normative inquiry than is often acknowledged, it may be insufficient for addressing core issues concerning cosmopolitanism, ecological catastrophe, and animal rights.

Science-policy interactions can both facilitate and hamper professional normative judgement, i.e. a value judgement about the desirability of a certain situation. Anthropogenic land subsidence, contributing to relative sea-level rise in the economically important Western peatland areas in the Netherlands is a case in point. The implementation of mitigation, adaptation and compensation measures is lagging, partly due to science-policy interaction problems potentially leading to conflicts between stakeholders, including agrarians, climate scientists and inhabitants. We find that professional normative judgement is (...) enhanced when researchers and societal stakeholders reflect more critically on their role and engage in more inclusive science-policy interactions. When doing research among vulnerable populations, researchers are obliged to protect their subjects from harm. We will argue that traditional ethical guidelines are not sufficient to do this, since they mainly focus on direct harms that can occur: for example, issues around informed consent, fair recruitment and risk/harm analysis. However, research also entails indirect harms that remain largely unnoticed by research ethical committees and the research community. Indirect harms do not occur during data collection, but in the analysis of the (...) data, and how the data is presented to the scientific and wider societal community. Highly stigmatized research subjects, like substance‐dependent parents, are especially at risk of encountering indirect harm, because the prejudice against them is so persistent. In this paper we discuss two forms of indirect harm. First, researchers have to be aware how their results will be preceived by society. Even when subjects are presented in an objective way, further, out of porportion stigmatization can occur. Researchers sometimes try to counteract this by whitewashing their results, at the risk of downplaying their respondents’ problems. The second risk researchers face is that their own normative judgements influence how they question such parents, report results and interpret statements. Researchers’ own normative judgements may influence the way they present their subjects. This article reviews a broad range of research that exhibits such indirect harms, discussing how and why indirect harms occur and formulating corresponding recommendations on how to prevent them. I examine and rebut Ridge’s two arguments for Capacity Judgment Internalism (simply qua their particular character and content, first person normative judgments are necessarily capable of motivating without the help of any independent desire). First, the rejection of the possibility of anormativism (sec. 2), second, an argument from the rational requirement to intend to do as one judges that one ought to do (sec. 3). A central source of support for expressivist accounts of normative discourse is the intimate relationship between normative judgment and motivation. Expressivists argue that normative judgments must be noncognitive, desire-like states in order to be so tightly linked with motivation. Normative statements are then construed as expressions of these noncognitive states. In this paper, I draw on dual-process models in cognitive psychology to respond to this argument. According to my proposal, normative judgments are ordinary beliefs that (...) are typically produced by two kinds of process: intuitive-affective processes and domain-general reasoning. When produced by the first kind of process, motivation and judgment tend to align. When produced by the second kind, motivation and judgment might not align. Since the first kind of process is the most common pathway of normative belief formation, normative judgments are typically accompanied by aligning motivation. This proposal enables cognitivists to explain the intimate link between normative judgment and motivation, thereby removing the major obstacle to interpreting normative statements truth-conditionally. To naturalize normative judgment is to give some account of it, in naturalistic and non-normative terms. Simon Blackburn’s Ruling Passions embraces naturalism, about ethics especially.

I argue that imperatives express contents that are both cognitively and semantically related to, but nevertheless distinct from, modal propositions. Imperatives, on this analysis, semantically encode features of planning that are modally specified. Uttering an imperative amounts to tokening this feature in discourse, and thereby proffering it for adoption by the audience. This analysis deals smoothly with the problems afflicting Portner's Dynamic Pragmatic account and Kaufmann's Modal account. It also suggests an appealing reorientation of clause-type theorizing, in which the cognitive (...) act of updating on a typed sentence plays a central role in theorizing about both its semantics and role in discourse. This paper develops a new form of metaethical expressivism according to which the normative judgment that X should Φ consists in a decision that X Φ. When the judgment is first-personal—e.g., my judgment that I should Φ—the view is similar to Gibbard’s plan expressivism, though the state I call “decision” differs somewhat from a Gibbard-style plan. The deep difference between the views shows in the account of third-personal judgments. Gibbard construes the judgment that Mary should Φ as a de (...) se plan on the thinker’s part to Φ if she turns out to be Mary (the Subtle View). I construe the judgment as a decision for Mary that Mary Φ (the Simple View). The main argument for Simple Plan Expressivism is that it solves problems for Gibbard’s approach, resonates with a new and interesting moral psychology, and better makes sense of certain independently plausible constraints on normative judgment. In the end I argue that this account of normative judgment has implications for first-order ethics, implying in particular that rational egoism as standardly formulated is incoherent. (shrink)

This book examines some of the deepest questions in philosophy: What is involved in judging a belief, action, or feeling to be rational?

According to one interpretation of Aristotle’s famous thesis, to say that action is the conclusion of practical reasoning is to say that action is itself a judgment about what to do. A central motivation for the thesis is that it suggests a path for understanding the non-observational character of practical knowledge. If actions are judgments, then whatever explains an agent’s knowledge of the relevant judgment can explain her knowledge of the action. I call the approach to action that accepts Aristotle’s (...) thesis so understood Normativism. There are many reasons to doubt Normativism. My aim in this paper is to defend Normativism from a pair of arguments that purport to show that a normative judgment could not constitute an event in material reality and also the knowledge of such a happening. Both highlight a putative mismatch between the natures of, on the one hand, an agent’s knowledge of her normative judgment and, on the other, her knowledge of her own action. According to these objections, knowledge of action includes (a) perceptual knowledge and (b) knowledge of what one has already done. But knowledge of a normative judgment includes neither. Hence knowledge of action cannot simply be knowledge of a normative judgment. (shrink)

Are all norms cognized in the same way? I present experimental evidence suggesting that they are not. I propose a distinction between two main classes of violations—the victimful and the victimless—and show that while people tend to rate acts belonging to either category as impermissible, the justifications for their judgments refer to salient features of the act only in the former case. I further show that Feinberg's distinction between harmful and offensive acts is useful in discriminating between different types of (...) victimful violations. (shrink)

Bart Streumer believes that the following principle is true of all normative judgements: When two people make conflicting normative judgements, at most one of them is correct. Streumer argues that noncognitivists are unable to explain why is true, or our acceptance of it. I argue that his arguments are inconclusive. I also argue that our acceptance of is limited in the case of instrumental and epistemic normative judgements, and that the extent to which we (...) do accept for such judgements can be explained by an assumption of shared standards of correctness. Finally, I argue that reductivists can appeal to the same ideas to defend their view that instrumental and epistemic normative judgements describe non-normative relations. (shrink)

It is widely assumed that the normativity of conceptual judgement poses problems for naturalism. Thus John McDowell urges that 'The structure of the space of reasons stubbornly resists being appropriated within a naturalism that conceives nature as the realm of law' (1994, p 73). Similar sentiments have been expressed by many other writers, for example Robert Brandom (1994, p xiii) and Paul Boghossian (1989, p 548).

How does other people’s opinion affect judgments of norm transgressions? In our study, we used a modification of the famous Asch paradigm to examine conformity in the moral domain. The question we addressed was how peer group opinion alters normative judgments of scenarios involving violations of moral, social, and decency norms. The results indicate that even moral norms are subject to conformity, especially in situations with a high degree of social presence. In the recent epistemological literature much has been written about the nature of suspending judgement or agnosticism. There has also been a surge of recent interest in the nature of ignorance. But what is the relationship between these two epistemically significant states? Prima facie, both suspension and ignorance seem to involve the lack of a correct answer to a question. And, again prima facie, there may be some intuitive attraction to the idea that when one is ignorant whether p, one (...) ought to suspend judgement whether p. In this paper we will explore a range of different possible normative connections between ignorance and suspension of judgement. We will also discuss how both ignorance and suspension are related to having inconclusive evidence. As we will see, the issues can become quite complex due to the fact that there are different, competing views about the nature of ignorance and also about the nature of suspension. Moreover, there are importantly different kinds of epistemic norms. Our overall aim then will be to systematically chart how these different choices will impact the possible normative connections between ignorance and suspension. (shrink)

Unbelievable Errors: An Error Theory about All Normative Judgements, written by Bart Streumer.

[David Papineau] This paper disputes the common assumption that the normativity of conceptual judgement poses a problem for naturalism. My overall strategy is to argue that norms of judgement derive from moral or personal values, particularly when such values are attached to the end of truth. While there are philosophical problems associated with both moral and personal values, they are not special to the realm of judgement, nor peculiar to naturalist philosophies. This approach to the normativity of judgement is made (...) possible by naturalist views of truth, that is, views which do not presuppose normativity in explaining truth. /// [Julia Tanney] This paper attempts to describe why it is not possible to account for normative phenomena in non-normative terms. It argues that Papineau's attempt to locate norms of judgement 'outside' content, grounded in an individual's desires or reasons, mislocates the normativity that is thought to resist appropriation within a 'world that conceives nature as the realm of law'. It agrees, however, that a theory of content that locates norms 'inside' content will not be forthcoming-at least if this is to require fashioning the norms that in some sense govern judgment or thought into individually necessary conditions for contentful states. Judgementalism is an interpretation of normative decision theory according to which preferences are all-things-considered judgements of relative desirability, and the only attitudes that rationally constrain choice. The defence of judgementalism we find in Richard Bradley’s Decision Theory with a Human Face relies on a kind of internalism about the requirements of rationality, according to which they supervene on an agent’s mental states, and in particular those she can reason from. I argue that even if we grant such internalism, (...) attitudes other than preferences in the judgementalist sense rationally constrain choice. I draw a connection between the question, raised by Hume and Kant, of how aesthetic judgments can claim universal agreement, and the question, raised in recent discussions of nonconceptual content, of how concepts can be acquired on the basis of experience. Developing an idea suggested by Kant's linkage of aesthetic judgment with the capacity for empirical conceptualization, I propose that both questions can be resolved by appealing to the idea of "perceptual normativity". Perceptual experience, on this proposal, involves the awareness (...) of its own appropriateness with respect to the object perceived, where this appropriateness is more primitive than truth or veridicality. This means that a subject can take herself to be perceiving an object as she (and anyone else) ought to perceive it, without first recognizing the object as falling under a corresponding concept. I motivate the proposal through a criticism of Peacocke's account of concept-acquisition, which, I argue, rests on a confusion between the notion of a way something is perceived, and that of a way it is perceived as being. Whereas Peacocke's account of concept-acquisition depends on an illicit slide between these two notions, the notion of perceptual normativity allows a legitimate transition between them: if someone's perceiving something a certain way involves her taking it that she ought to perceive it that way, then she perceives the thing as being a certain way, so that the corresponding concept is available to her in perceptual experience. Hannah Ginsborg presents fourteen essays which establish Kant's Critique of Judgment as a central contribution to the understanding of human cognition. The papers bring out the significance of Kant's philosophical notion of judgment, and use it to address interpretive issues in Kant's aesthetics, theory of knowledge, and philosophy of biology.

Norms are apt for reasoning because they have propositional structure and content; they are practical because they aim to guide action, rather than to describe aspects of the world. These two features hold equally of norms construed sociologically as the norms of specific social groups, and of norms conceived abstractly as principles of action. On either view, norms are indeterminate while acts are particular and determinate. Consequently norms cannot fully specify which particular act is to be done. Are they then (...) not genuinely action-guiding unless supplemented by practical judgment? Yet accounts of practical judgement are often thin, sometimes seeing it as blind, unreasoned `picking' of one rather than another enactment of a norm. However, on another view practical judgement carries the substantive task of seeking ways of acting that satisfy a plurality of norms, which can be both reasoned and practical. Knowledge aims to fit the world, and action to change it. In this collection of essays, Onora O'Neill explores the relationship between these concepts and shows that principles are not enough for ethical thought or action: we also need to understand how practical judgement identifies ways of enacting them and of changing the way things are. Both ethical and technical judgement are supported, she contends, by bringing to bear multiple considerations, ranging from ethical principles to real-world constraints, and while we (...) will never find practical algorithms - let alone ethical algorithms - that resolve moral and political issues, good practical judgement can bring abstract principles to bear in situations that call for action. Her essays thus challenge claims that all inquiry must use either the empirical methods of scientific inquiry or the interpretive methods of the humanities. There is a large tradition of work in moral psychology that explores the capacity for moral judgment by focusing on the basic capacity to distinguish moral violations (e.g. hitting another person) from conventional violations (e.g. playing with your food). However, only recently have there been attempts to characterize the cognitive mechanisms underlying moral judgment (e.g. Cognition 57 (1995) 1; Ethics 103 (1993) 337). Recent evidence indicates that affect plays a crucial role in mediating the capacity to draw the moral/conventional distinction. (...) However, the prevailing account of the role of affect in moral judgment is problematic. This paper argues that the capacity to draw the moral/conventional distinction depends on both a body of information about which actions are prohibited (a Normative Theory) and an affective mechanism. This account leads to the prediction that other normative prohibitions that are connected to an affective mechanism might be treated as non-conventional. An experiment is presented that indicates that “disgust” violations (e.g. spitting at the table), are distinguished from conventional violations along the same dimensions as moral violations. One of the fundamental questions in post-Fregean philosophy is how to account for the normativity involved in assertoric claims once the traditional subject-object view of thinking is rejected. One of the more productive lines of inquiry in the contemporary literature attributes normativity to second nature, which is presented as a sui generis space of reason giving and receiving distinct from the space of nature studied by the natural sciences. In this paper I suggest an alternative account by drawing from Castoriadis’s (...) philosophical interpretation of autopoiesis. For Castoriadis, the idea of second nature protects the modern conception of nature from undergoing the radical critique it requires, for it restricts normativity to the anthropic sphere. In contrast, he proposes an autopoietic account of the subject that grounds the capacity to know that one knows in the activity of the living being. Castoriadis demonstrates that the normativity of assertoric claims is not a vertical break from nature but rather a horizontal transformation of the biological capacity for self-referentiality. A review of Bart Streumer's "Unbelievable Errors.".

David Papineau [1999. “Normativity and Judgement.” Proceedings of the Aristotelian Society 73 : 16–43.] argues that norms of judgement pose no special problem for naturalism, because all such norms of judgement are derived from moral or personal values. Papineau claims that this account of the normativity of judgement presupposes an account of content that places normativity outside the analysis of content, because in his view any accounts of content that place normativity inside the analysis of content cannot explain the normativity (...) of judgement in the derivative way he proposes. Furthermore, he argues that normative accounts of content along those lines are independently problematic. In this paper I aim to respond to both objections, by arguing that normative accounts of content can be seen as naturalist accounts, even if they place normativity inside the analysis of content; and that normative accounts of content are compatible with a derivative account of norms of judgement of the sort Papi... The paper pores over the recent conceptions of normative judgement developed against the background of advances in psychology and neuroscience. It begins by analyzing what normative claim of morality and law consists of before presenting and criticizing the Social Intuitionist Model of normative judgement developed by Jonathan Haidt. The model poses serious challenges for well-established normative concepts, and the concept of normativity as objective reason for action in particular. A question is asked of what the relationship (...) between philosophical conceptions and the findings of neuroscience should be. The Strong Normative Constitutivity reading of logical laws in Frege argues that although he regards logical laws as purely descriptive, he in fact accepts that they are normatively constitutive of the act of judgement. There are passages in which Frege seems to commit himself to such an idea. However, we can understand what Frege argues in those passages based only on his conception of logical laws as the most general descriptive laws and his objectivism about truth. If my suggested (...) interpretation is correct, there is a reason to think that logical laws are merely descriptive for Frege. Further, my interpretation shows that the central issue between Frege and psychological logicians is the nature of truth. (shrink)
