Die Erforschung Kants ist langst zu einem weltumspannenden Unternehmen geworden. Welch reiche Frucht der Wissenschaft dadurch zufallt, zeigen die Beitrage dieser Festschrift, die dem Nestor der deutschen Kantforschung, Norbert Hinske, gewidmet ist. Bekannte Vertreter der italienischen, japanischen, russischen und deutschen Kantforschung kommen zu Wort. Von besonderer Bedeutung fur die - in diesem Punkt ganzlich neu zu schreibende - Lebens- und Entwicklungsgeschichte Kants ist ein neu entdeckter, erstmals im Faksimile abgedruckter Brief von J. E. Biester an J. N. Tetens, der (...) belegt, dass der preussische Kultusminister v. Zedlitz zunachst nicht etwa Kant, sondern Tetens nach Halle berufen hat. Hinskes vollstandige Bibliographie rundet den Band ab - und zeigt eindrucksvoll, wie viel die Kantforschung weltweit gerade ihm zu verdanken hat. The study of Kant has long been a global undertaking. The articles in this Festschrift for the leading German expert on Kant, Norbert Hinske, show how richly productive this has been for scholars. Leading Italian, Japanese, Russian and German representatives of research on Kant have provided contributions to it. What is particular significant for the history of Kant's life and development, which has to be completely rewritten in this regard, is a newly discovered letter, reprinted in facsimile for the first time, from J. E. Biester to J. N. Tetens, which proves that Prussian Minister of Culture v. Zedlitz initially did not appoint Kant but rather Tetens to the position in Halle. Hinske's complete bibliography is included in the volume and is impressive evidence of how much Kant research worldwide owes to him. (shrink)

Elias wrote in both English and German, and in all his work runs to 14 books and around 90 other essays, along with poems and numerous interviews. The 18 volumes of the collected works contain many writings not previously published in English, and a small number never published before. All of the texts have thoroughly checked and revised, by editors who have a deep knowledge of Elia's thinking; they have inserted many clarifications, cross-references and explanatory notes.

The purpose of the presented paper is to showcase the links between Hans-Hermann Hoppe’s libertarian argumentation ethics and Karl-Otto Apel’s transcendental pragmatics with a special reference to the consensus theory of truth proposed by the latter thinker. More specifically, the author contends that Hoppe’s theory is logically contingent on Apel’s views on truth in that some crucial gaps in Hoppe’s grounding of the so-called “a priori of communication and argumentation” are filled by Apel’s original arguments. Additionally, the paper provides a (...) case for interpreting Hoppe's ethics as a theory of rational conflict-freedom, which seems to cohere best with the transcendental-pragmatist approach. Finally, the author offers a few remarks on how the most common objections against Hoppe's theory can be overcome on the basis of the transcendental pragmatics and the conflict-freedom principle. Carey's book on conceptual change and the accompanying argument that children's biology initially is organized in terms of naïve psychology has sparked a great detail of research and debate. This body of research on children's biology has, however, been almost exclusively been based on urban, majority culture children in the US or in other industrialized nations. The development of folkbiological knowledge may depend on cultural and experiential background. If this is the case, then urban majority culture children may prove to (...) be the exception rather than the rule, because plants and animals do not play a significant role in their everyday life. Urban majority culture children, rural majority culture children, and rural Native American children were given a property projection task based on Carey's original paradigm. Each group produced a unique profile of development. Only urban children showed evidence for early anthropocentrism, suggesting that the co-mingling of psychology and biology may be a product of an impoverished experience with nature. In comparison to urban majority culture children even the youngest rural children generalized in terms of biological affinity. In addition, all ages of Native American children and the older rural majority culture children gave clear evidence of ecological reasoning. These results show that both culture and expertise play a role in the development of folkbiological thought. (shrink)

A historical account of Hegel’s reception in Japan would have to deal with the European impact on the Japanese Enlightenment of the years that preceeded and prepared the Meiji era, then with the switch over from British and French to German trends marked by the Imperial Constitution, and would finally have to center on the efforts of the Nishida school to combine eastern, especially Zen, wisdom with German Idealism. That cannot here be attempted. Such a task would require a Japanese (...) scholar or, at least, somebody with an intimate knowledge of Japanese history and the history of its philosophy, not to mention, of course, the Japanese language. The author of these remarks cannot pretend to such a knowledge; all he can offer is what the subtitle specifies: impressions of a recent visit, augmented, perhaps, by some subsequent reflections; both, no doubt, highly subjective. This article presents a sequent calculus for a negative free logic with identity, called N . The main theorem (in part 1) is the admissibility of the Cut-rule. The second part of this essay is devoted to proofs of soundness, compactness and completeness of N relative to a standard semantics for negative free logic.

As this book reveals, his vision was much more complex and interesting. He hoped that machines would release people from relentless and repetitive drudgery in order to achieve more creative pursuits.

Unlike other post-war sociologists, Norbert Elias has always held the concept of historical development among his central concerns; his dynamic theories of the evolution of modern man have remedied the historical and epistemological shortcomings of structualism and ethno-methodology. What is Sociology? refines the arguments (...) that were first found in Elias' massive work on the civilizing process, in which he formulated his major assertions about the interdependence of the making of modern man and modern society. It is Elias' contention that changes in personality structure--embodied in phenomena ranging from table manners and hygiene habits to rites of punishment and courtly love--inevitably reflect and mould patterns of control generated by new political and social instututions. Elias' rejection of a dichotomy between individual and society, and his use of psychoanalysis, political theory, and social history, help restore a fullness of resource to sociology. (shrink)

The moral psychologist Joshua Greene has proposed a number of arguments for the normative significance of empirical research and for the unreliability of deontological intuitions. For these arguments, much hinges on the combination of various components of Greene's research – namely the dual-process theory of moral judgement, ‘personalness’ as a factor in moral decision-making, and his functional understanding of deontology and consequentialism. Incorporating these components, I reconstruct three distinct arguments and show that the Personalness Argument for the claim that empirical (...) research can advance normative ethics and the Combined Argument against deontology are both sound and interesting in themselves. They do not, however, cast doubt on traditional deontology or reserve a specific role for neuroscience. The Indirect Route argument overcomes some of the other arguments’ limitations. It is, however, invalid. I conclude by pointing out the broader philosophical relevance of Greene's arguments as shedding light on second-order morality. (shrink)

Over 90% of the organs transplanted in China before 2010 were procured from prisoners. Although Chinese officials announced in December 2014 that the country would completely cease using organs harvested from prisoners, no regulatory adjustments or changes in China’s organ donation laws followed. As a result, the use of prisoner organs remains legal in China if consent is obtained. We have collected and analysed available evidence on human rights violations in the organ procurement practice in China. We demonstrate that the (...) practice not only violates international ethics standards, it is also associated with a large scale neglect of fundamental human rights. This includes organ procurement without consent from prisoners or their families as well as procurement of organs from incompletely executed, still-living prisoners. The human rights critique of these practices will also address the specific situatedness of prisoners, often conditioned and traumatized by a cascade of human rights abuses in judicial structures. To end the unethical practice and the abuse associated with it, we suggest to inextricably bind the use of human organs procured in the Chinese transplant system to enacting Chinese legislation prohibiting the use of organs from executed prisoners and making explicit rules for law enforcement. Other than that, the international community must cease to abet the continuation of the present system by demanding an authoritative ban on the use of organs from executed Chinese prisoners. Many contemporary ethicists use case-based reasoning to reach consistent beliefs about ethical matters. The idea is that particular cases elicit moral intuitions, which provide defeasible reasons to believe in their content. However, most proponents of case-based moral reasoning are not very explicit about how they resolve inconsistencies and how they abstract principles from judgments about particular cases. The aim of this article is to outline a methodology—called Consistency Reasoning Casuistry—for case-based reasoning in ethics. This methodology draws on Richmond Campbell and (...) Victor Kumar’s naturalistic model for the resolution of inconsistencies between the content of intuitions about particular cases. I argue that reasons similar to those that motivate their model also support a more abstract form of moral reasoning that goes beyond mere resolutions of inconsistencies between case judgments and demands the formulation of more abstract moral norms. Consistency Reasoning Casuistry, it is argued, is a good candidate for a methodology for case-based moral reasoning that is in harmony with paradigms of contemporary moral psychology and that can accommodate the methodology implicit in the work of many contemporary ethicists. Reflective equilibrium has been criticized for various reasons ever since the publication of Rawls’ A Theory of Justice. Recent empirical research into moral decision-making poses new challenges to RE because it questions the reliability of moral intuitions. This research might discredit moral intuitionism in general and RE in particular insofar as it ascribes epistemic value to moral intuitions. These findings suggest, for instance, that moral intuitions vary with cultural background, gender or framing. If it could be shown that all or (...) certain kinds of moral intuitions are unreliable, this would diminish the plausibility of the claim that they provide good reasons to believe in the truth of their content, especially given the growing evidence that professional philosophers are just as biased and susceptible to distorting factors as lay people. In this paper I critically discuss three recent defenses of RE against this unreliable intuitions objection. Two of these defenses argue that the UIO misses its target, because RE does not depend on intuitions, or because the relevant considered judgments in RE are not intuitions. The third defense grants that RE depends on intuitions and that some Rawlsian considered judgments are intuitions. But it argues that the notion of considered judgments can be revised, and that wide reflective equilibrium has the means to adopt the criticism because it can use information about unreliable intuitions and exclude those from further consideration. I argue that the first two defenses do not succeed. The third defense is the most promising one. However, I argue that this defense also fails. In this defense, RE is not a distinctive moral epistemic theory: different versions of RE would be conceivable, all of which are deeply problematic. I conclude with a discussion of the broader philosophical implications of the UIO, specifically whether or not accepting the UIO would warrant skepticism regarding moral knowledge. (shrink)

This article challenges E.P. Thompson's definition of ‘moral economy’ as a traditional consensus of crowd rights that were swept away by market forces. Instead, it suggests that the concept has the potential of improving the understanding of modern civil society. Moral economy was a term invented in the eighteenth century to describe many things. Thompson's approach reflects only a minor part of this conceptual history. His understanding of moral economy is conditioned by a dichotomous view of history and by the (...) acceptance of a model according to which modern economy is not subject to moral concerns. It is on principle problematic to confine a term conjoining two concepts as general as ‘moral’ and ‘economy’ to a specific historical and social setting. Recent approaches that frame moral economy as an emotively defined order of morals are also misleading since they do not address economic issues in the way they are commonly understood. Anwander questions "the role that Pogge assigns to benefiting from injustice in the determination of our duties toward the victims of injustice... challenging his claim that there is a negative duty not to benefit from injustice.".

Hans-Hermann Hoppe famously argued that monarchy is superior to democracy insofar as property rights protection is concerned. The present paper calls this claim into question, with much of the heavy lifting being done by methodological ponderings. More specifically, it is demonstrated that instead of _a priori_, praxeological truths, Hoppe’s monarchy theory offers an ideal type of the politician bestowed with an inheritable title to the throne. Against this background, the ideal type in question is shown to be faulty in that (...) it treats monarchs as capitalist landowners of sorts, thereby overlooking strictly political incentives they face, which can predictably push them in directions inimical to free markets. In this book, Norbert Wiley offers a new interpretation of the nature of the self in society.

The law serves functions that are not often taken seriously enough by ethicists, namely feasibility and practicability. A consequence of feasibility is that most laws do not meet the demands of ideal ethical theory. A consequence of practicability is that law requires elaborated and explicit methodologies that determine how to do things with norms. These two consequences form the core idea behind this book, which employs methods from legal theory to inform and examine debates on methodology in applied ethics, particularly (...) bioethics. It is argued that almost all legal methods have counterparts in applied ethics, which indicates that much can be gained from comparative study of the two. The author first outlines methods as used in legal, focusing on deductive reasoning with statutes as well as analogical reasoning with precedent cases. He then examines three representative kinds of contemporary ethical theories, Beauchamp and Childress’s principlism, Jonsen and Toulmin’s casuistry, and two versions of consequentialism—Singer’s preference utilitarianism and Hooker’s rule-consequentialism—with regards to their methods. Die Philosophie ist eine merkwürdige Disziplin. Sie hat keinen klar bestimmten Gegenstandsbereich und keine einheitliche Methodik. Es gibt aber eine philosophische Methode, die in fast allen Epochen und in fast allen Bereichen der Philosophie intensiv genutzt wurde und weiter genutzt wird: das Gedankenexperiment. Was genau Gedankenexperimente sind, wie sie funktionieren und welchen wissenschaftlichen Wert sie haben, wird in der Philosophie seit den 1990er Jahren intensiv diskutiert. Diese Diskussion ist jedoch stark auf Gedankenexperimente in den Naturwissenschaften und in der theoretischen Philosophie (...) fokussiert, obwohl sie auch in der praktischen Philosophie allgegenwärtig sind. Diesem Phänomen ist der Schwerpunkt „Gedankenexperimente in der praktischen Philosophie“ gewidmet. In 2021, Germany passed the first law worldwide that regulates dilemma situations with autonomous cars. Against this background, this article investigates the permissibility of trade-offs between human lives in the context of self-driving cars. It does so by drawing on the debate about the traditional trolley problem. In contrast to most authors in the relevant literature, it argues that the debate about the trolley problem is both directly and indirectly relevant for the ethics of crashes with self-driving cars. Drawing on (...) its direct normative relevance, the article shows that trade-offs are permissible in situations with self-driving cars that are similar to paradigmatic trolley cases. In scenarios that are unlike paradigmatic trolley cases, the debate about the trolley problem can have indirect normative relevance because it provides reasons against the use of moral theories and principles that cannot account for the trolley problem. Research on learning, the structure of attained knowledge, and the use of this competence in performance has repeatedly returned to longstanding proposals about how to better understand proficient use of knowledge and how humans acquire it. The following article takes up an exchange between Chiappe & Gardner and Barrett & Kurzban on the concept of modularity, one of these proposals. Despite the disagreements expressed, a careful reading of the contributions shows that they also left us with lines of discussion that (...) will eventually sort out the relevant hypotheses and integrate findings for future research. These lines of work will contribute to a clearer understanding of an updated version of the modularity hypothesis that is also compatible with evolutionary science perspectives on learning. How might the categories of domain-specific and domain-general correspond to the distinction between competence and performance and to that of narrow faculty and broad faculty? (shrink)

This article elaborates on the relation between ethical casuistry and common law reasoning. Despite the frequent talk of casuistry as common law morality, remarks on this issue largely remain at the purely metaphorical level. The article outlines and scrutinizes Albert Jonsen and Stephen Toulmin’s version of casuistry and its basic elements. Drawing lessons for casuistry from common law reasoning, it is argued that one generally has to be faithful to ethical paradigms. There are, however, limitations for the binding force of (...) paradigms. The most important limitations—the possibilities of overruling and distinguishing paradigm norms—are similar in common law and in casuistry, or so it is argued. These limitations explain why casuistry is not necessarily overly conservative and conventional, which is one line of criticism to which casuists can now better respond. Another line of criticism has it that the very reasoning from case to case is extremely unclear in casuistry. I suggest a certain model of analogical reasoning to address this critique. All my suggestions to understand and to enhance casuistry make use of common law reasoning whilst remaining faithful to Jonsen and Toulmin’s main ideas and commitments. Further developed along these lines, casuistry can appropriately be called “common law morality.”. (shrink)

The controversy over moral bioenhancement has fallen into a stalemate between advocates and critics. We wish to overcome this stalemate by addressing some of the key challenges any moral enhancement project has to meet. In particular, we shall argue that current proposals are unpersuasive as they, first, fail to diagnose the often complex causes of contemporary moral maladies and, second, are premised on methodological individualism. Focusing on brains and minds neglects social and environmental factors. Solving the mega-problems of today very (...) likely requires more than transforming individual brains, it requires structural and higher-level changes. By itself, moral bioenhancement is thus insufficient for solving these problems. Moreover, we outline some of the yet unresolved problems of legitimacy a mandatory state-run bioenhancement project faces and show why they cannot be defused through analogies with moral education. Finally, normatively less worrisome means of enhancing morality, such as psychotherapies affording self-exploration, are already available. Moral bioenhancement may thus not even be necessary for solving today’s mega problems. The overemphasis on speculative future technological fixes may cloud the view on possibilities to tackle pressing problems instantly. (shrink)
