ABSTRACTEvaluative aesthetic discourse communicates that the speaker has had first-hand experience of what is talked about. If you call a book bewitching, it will be assumed that you have read the book. If you say that a building is beautiful, it will be assumed that you have had some visual experience with it. According to an influential view, this is because knowledge is a norm for assertion, and aesthetic knowledge requires first-hand experience. This paper criticizes this view and argues for (...) an alternative view, according to which aesthetic discourse expresses affective states of mind, analogously to how assertions express beliefs. It is because these affective states require first-hand experience that aesthetic discourse communicates that such acquaintance is at hand. The paper furthermore argues that the lack of an experience requirement for aesthetic belief ascriptions constitutes a problem for the kind of expressivist who claims that evaluative belief states are covert non-cognitive states. In our lives, we aim to achieve welfare for ourselves, that is, to live good lives. But we also have another, more impartial perspective, where we aim to balance our concern for our own welfare against a concern for the welfare of others. This is a perspective of justice. Nils Holtug examines these two perspectives and the relations between them.

This paper presents rules of inference for a binary quantifier I for the formalisation of sentences containing definite descriptions within intuitionist positive free logic. I binds one variable and forms a formula from two formulas. Ix[F,G] means ‘The F is G’. The system is shown to have desirable proof-theoretic properties: it is proved that deductions in it can be brought into normal form. The discussion is rounded up by comparisons between the approach to the formalisation of definite descriptions recommended here (...) and the more usual approach that uses a term-forming operator ι, where ιxF means ‘the F’. Some habits are vital to who we are in that they shape both our self-perception and how we are seen by others. This is so, I argue, because there is a constitutive link between what I shall call ‘identity-shaping habits’ and narrative agency. Identity-shaping habits are paradigmatically acquired and performed by persons. The ontology of personhood involves both synchronic and diachronic dimensions which are structurally analogous to the synchronic acquisition and the diachronic performance of habits, and makes persons distinctly suitable (...) to being shaped by habits. Since habits differ vastly in their scope, I develop a conceptualization that carves out defining features of identity-shaping habits. Such habits, I venture, fundamentally alter a person’s embodiment such that the alterations to their psychological and physiological make-up vitally inform their persistence—if not metaphysically, then at least practically by crucially shaping one’s narrative agency. This contribution traces the parallel development of two distinct approaches to peasant agroecological education: the peasant-to-peasant horizontal method that disseminated across Mesoamerica and the Caribbean beginning in the 1970s, and the political-agroecological training schools of combined consciousness-building and skill-formation that have been at the heart of the educational processes of member organizations of La Via Campesina since the 1990s. Applying a theoretical framework that incorporates territorial struggle, agroecology and popular education, we examine spatial and organizational aspects of each of these (...) models for peasant education and movement-building. Recognizing that the models, their respective contexts, and the dialectical relationships therein have been in constant evolution, we share findings on the movement-place as a territorial system with socio-historical subjectivity, that is, peasant movements as territorially-embedded, collective historical actors. This leads to some conclusions in moving past educational theory that has centered upon individual subjects, and approaching a conception of territory as a subject of learning processes. (shrink)

Ian Rumfitt has proposed systems of bilateral logic for primitive speech acts of assertion and denial, with the purpose of ‘exploring the possibility of specifying the classically intended senses for the connectives in terms of their deductive use’ : 810f). Rumfitt formalises two systems of bilateral logic and gives two arguments for their classical nature. I assess both arguments and conclude that only one system satisfies the meaning-theoretical requirements Rumfitt imposes in his arguments. I then formalise an intuitionist system of (...) bilateral logic which also meets those requirements. Thus Rumfitt cannot claim that only classical bilateral rules of inference succeed in imparting a coherent sense onto the connectives. My system can be extended to classical logic by adding the intuitionistically unacceptable half of a structural rule Rumfitt uses to codify the relation between assertion and denial. Thus there is a clear sense in which, in the bilateral framework, the difference between classicism and intuitionism is not one of the rules of inference governing negation, but rather one of the relation between assertion and denial. The case in favor of gene therapy is quite simple. Gene therapy is likely to improve the health and well-being of some people that are among the worst off in society, namely patients with painful and life-threatening diseases. However, two types of objection have been raised.

It is widely held within contemporary metaethics that there is a lack of linguistic support for evaluative expressivism. On the contrary, it seems that the predictions that expressivists make about evaluative discourse are not borne out. An instance of this is the so-called problem of missing Moorean infelicity. Expressivists maintain that evaluative statements express non-cognitive states of mind in a similar manner to how ordinary descriptive language expresses beliefs. Conjoining an ordinary assertion that p with the denial of being in (...) the corresponding belief state famously gives rise to Moorean infelicity:?? It’s raining but I don’t believe that it’s raining. If expressivists are right, then conjoining evaluative statements with the denial of being in the relevant non-cognitive state of mind should give rise to similar infelicity. However, as several theorists have pointed out, this does not seem to be the case. Statements like the following are not infelicitous: Murder is wrong but I don’t disapprove of it. In this paper, I argue that evaluative statements express the kind of states that are attributed by ‘find’-constructions in English and that these states are non-cognitive in nature. This addresses the problem of missing Moorean infelicity and, more generally, goes to show that there are linguistic facts which support expressivism about evaluative discourse. (shrink)

What is aesthetic appreciation? What values is it concerned with? This dissertation consists of three distinct papers tackling problems related to these questions. Chapter One According to what I call the Merit Principle, roughly, works of art that attempt to elicit unmerited responses fail on their own terms and are thereby aesthetically flawed. In the first chapter, I show how the principle leads to paradox when applied to an undertheorized class of artworks I call “seductive artworks”, which invite an unmerited (...) first-order response in order to invite a repudiation of that response. I consider a number of unsuccessful solutions to the paradox, before rejecting the Merit Principle as it stands. I conclude by briefly discussing what is challenging about seductive artworks and by proposing a revision to the Merit Principle. Chapter Two Generally, we cooperate imaginatively with literary fictions, however bizarre, and the things authors write into their stories become true in the fiction. But for some claims, such as moral falsehoods, this seems not to be straightforwardly the case, which raises the question: Why not? The puzzles such cases raise are sometimes grouped under the heading “imaginative resistance”. In this paper, I argue against what I take to be the best attempts to dismiss the puzzles and solve them. I also tease out subtleties not sufficiently addressed in the existing literature and end by defending a unified solution of my own. The solution’s novelty lies in its giving a normative rather than psychological or alethic explanation for the puzzling phenomena. Chapter Three The third chapter looks at the tenability of understanding our engagement with sport along the lines of our engagement with works of fiction. Specifically, it addresses an incongruity in our attitudes towards the outcomes of competitive games and asks why these outcomes frequently prompt intense reactions, while often also seeming utterly trivial. I show why the temptation to understand our engagement with sport as akin to our engagement with works of fiction—as involving games of make-believe—faces serious theoretical obstacles. I end by exploring two alternative possibilities to the proposal. (shrink)

Mobile health devices pose novel questions at the intersection of philosophy and technology. Many such applications not only collect sensitive data, but also aim at persuading users to change their lifestyle for the better. A major concern is that persuasion is paternalistic as it intentionally aims at changing the agent’s actions, chipping away at their autonomy. This worry roots in the philosophical conviction that perhaps the most salient feature of living autonomous lives is displayed via agency as opposed to patiency—our (...) lives go well in virtue of what we do, rather than what happens to us. Being persuaded by a device telling us how to conduct our lives seemingly renders the agent passive, an inert recipient of technological commands. This agential bias, however, has led to a marginalization of patiential characteristics that are just as much part of our lives as are agential characteristics. To appreciate the inherent interlocking of acting and being acted upon, it is vital to acknowledge that agency and patiency are correlates, not mutually exclusive opposites. Furthermore, it is unclear whether an action can only count as agential so long as its causes are internal. Drawing on the extended mind and extended will framework, I argue that mHealth applications merely serve as volitional aids to the agent’s internal cognition. Autonomously set goals can be achieved more effectively via technology. To be persuaded by an mHealth device does not mainly—let alone exclusively—emphasize patiency; on the contrary, it can be an effective tool for technologically enhancing agency. (shrink)

Molnar argues that the problem of truthmakers for negative truths arises because we tend to accept four metaphysical principles that entail that all negative truths have positive truthmakers. This conclusion, however, already follows from only three of Molnar´s metaphysical principles. One purpose of this note is to set the record straight. I provide an alternative reading of two of Molnar´s principles on which they are all needed to derive the desired conclusion. Furthermore, according to Molnar, the four principles may be (...) inconsistent. By themselves, however, they are not. The other purpose of this note is to propose some plausible further principles that, when added to the four metaphysical theses, entail a contradiction. (shrink)

Ethical questions have traditionally been approached through conceptual analysis. Inspired by the rapid advance of modern brain imaging techniques, however, some ethical questions appear in a new light. For example, hotly debated trolley dilemmas have recently been studied by psychologists and neuroscientists alike, arguing that their findings can support or debunk moral intuitions that underlie those dilemmas. Resulting from the wedding of philosophy and neuroscience, neuroethics has emerged as a novel interdisciplinary field that aims at drawing conclusive relationships between neuroscientific (...) observations and normative ethics. A major goal of neuroethics is to derive normative ethical conclusions from the investigation of neural and psychological mechanisms underlying ethical theories, as well as moral judgments and intuitions. The focus of this article is to shed light on the structure and functioning of neuroethical arguments of this sort, and to reveal particular methodological challenges that lie concealed therein. We discuss the methodological problem of how one can—or, as the case may be, cannot—validly infer normative conclusions from neuroscientific observations. Moreover, we raise the issue of how preexisting normative ethical convictions threaten to invalidate the interpretation of neuroscientific data, and thus arrive at question-begging conclusions. Nonetheless, this is not to deny that current neuroethics rightly presumes that moral considerations about actual human lives demand empirically substantiated answers. Therefore, in conclusion, we offer some preliminary reflections on how the discussed methodological challenges can be met. (shrink)

Psychiatry as a discipline oscillates between the language of emotions and that of biology; ranging from the immersion into the subjective experience of another person to the objective approach of biomedical science. The tension between these different approaches may seem irreconcilable and confusing to some. This was not the case for Karl Jaspers who pioneered a systematic reflection on the concepts underlying psychiatric theory and practice. In this essay, we engage with Jaspers' thinking and create a dialogue with contemporary psychiatric (...) research and philosophy of mind. Jaspers' conception of erklären and verstehen and his position on research in the neuroscience of mental disorders is brought together with the thought of Thomas Nagel and John Searle. We argue for the compatibility of Jaspers' ideas with Nagel's and Searle's views on the mind/body problem. Furthermore, we look at current trends in biological research in psychiatry through the lens of Jaspers' General Psychopathology, from there we derive suggestions and insights for psychiatric theory and practice. Stakeholder theory has become an influential framework for addressing organizational challenges, including those related to sustainability. Yet, the inclusion of nonhuman stakeholders in stakeholder theory is complicated by ontological and epistemological obstacles. To overcome these, we turn to art and posthumanist practice theory and examine artist-led practices by focusing on the projects of two pioneering eco-artists, Helen Mayer Harrison and Newton Harrison. In this way we identify the ontological and epistemological challenges that impede the inclusion of nonhumans into stakeholder theory, (...) showing that artist-led practices allow for the inclusion of nonhuman stakeholders in two ways: (1) by specifying the temporal, spatial, and outcome distinctions that ontologically hinder their inclusion; and (2) by explicating the reframing of knowing and the emotional and imaginative dimensions of knowing that epistemologically enable their inclusion. We expand on the theorizing of nonhuman stakeholder inclusion by understanding the inclusion of nonhumans, first, not as a fixed state that is to be achieved but rather as one that materializes and gains meaning through specific practices of knowing; and, second, not as merely the absence of exclusion but rather as a dynamic interplay, where inclusion and exclusion mutually constitute one another. By advancing stakeholder theory’s theorizing and understandings of inclusion and exclusion, we also respond to urgent and contemporary environmental challenges. (shrink)

Early modern medicine was much more dependent on the senses than its contemporary counterpart. Although a comprehensive medical theory existed that assigned great value to taste and odor of medicaments, historical descriptions of taste and odor appears imprecise and inconsistent to modern eyes. How did historical actors move from subjective experience of taste and odor to culturally stable agreements that facilitated communication about the sensory properties of medicaments? This paper addresses this question, not by investigating texts, but by going straight (...) to the sensory impression, which certain substances convey. The aim is not to overwrite or rectify historical descriptions but to investigate whether modern methodologies for sensory assessment can be enlisted to understand the past. We draw on history of science for framing and research questions, pharmaceutical science for knowledge of pharmaceuticals and preparations, and food and meal science for assaying procedures and protocols. We show that sensory evaluation can yield precise descriptions that would not have been alien to early modern medicine makers. However, there are problems with translating descriptions of taste between different historical contexts. By comparing contemporary descriptions of sensations with eighteenth‐century ones, the article discusses how sensory descriptions are highly dependent on context, and subject to historical change. I am very grateful to Simon Beck for his thoughtful response to my paper “Transplanting Brains?” (2016). Needless to say, he raises more issues than I can hope to answer in a brief response. While Beck seemingly feels that the deck has been stacked against him, I think that the majority of his criticisms result from misconceptions and misunderstandings that I intend to straighten out in what follows. Before proceeding, I would like to draw attention to a worry that is (...) lurking in the shadows. Perhaps Beck and I talk at cross purposes. While Beck is concerned with a metaphysical theory of personal identity that supposedly holds across all possible worlds—and as such places heavy importance on counterfactuals and intuitions—I am concerned only with the natural world with the aim of generating empirically substantiated hypotheses about how things really are when it comes to persons persisting through time. Now, here is a disclaimer: If the natural world does not exhaust reality, then my discussion is only partial. It goes without saying that most contemporary philosophers given a choice between going with science and going with intuitions, go with science. (shrink)

This chapter examines autonomism. Autonomism is roughly the view that an artwork’s ethical properties do not bear on its aesthetic or artistic value. The author sketches some of the view’s history before describing various versions of it defended over the last quarter-century. These are divided into ‘radical’, ‘robust’, and ‘moderate’ forms of autonomism. The author considers the strengths and weaknesses of each. The author also devotes some space to the ‘interactionist’ views against which contemporary autonomism is typically opposed. Some things that we take to be the case in a fictional work are never made explicit by the work itself. For instance, we assume that Sherlock Holmes does not have a third nostril, that he wears underpants and that he has never solved a case with a purple gnome, even though neither of these things is ever mentioned in the narration. This article argues that examples like these can be accounted for through the same content-enriching reasoning that we employ (...) when confronted with non-fictional discourse, with the important difference that fictional discourse essentially involves pretence. Fictional discourse works in much the same way as non-fictional discourse, and what is conveyed without being stated can accordingly be explained through familiar pragmatic mechanisms. It is argued that this account carries some distinct advantages over competing views. (shrink)

Ethicism is the most comprehensively defended answer to the question regarding whether ethical properties determine aesthetic properties in artworks. According to ethicism, aesthetically relevant ethical flaws in artworks count as aesthetic flaws and aesthetically relevant ethical merits count as aesthetic merits. In this paper, I argue that ethicism’s most significant argument, the Merited Response Argument suffers from an ambiguity that makes it either unsound or uninteresting. Specifically, the notion of an artwork’s ‘prescribing’ a response, central to MRA, is ambiguous between (...) merely attempting to elicit a response from appreciators as appropriate to a work, and endorsing a response as appropriate to relevant parts of the actual world. While the first sense of ‘prescribe’ does the aesthetic work, the second does the ethical. (shrink)

The article analyses and reconstructs a broad idea of legal responsibility which underlies and normatively links tort law with the law of unjustified enrichment. The article’s central proposition is that responsibility for damage caused and enrichment-responsibility are closely interrelated. Both aspects of obligations are equally an expression of corrective justice, and ultimately serve to protect the civil rights of citizens. It is shown that the idea of civil equality and the principle against unjustified enrichment require citizens to assume responsibility not (...) only for the consequences of their misbehaviour, but also for the consequences of lawful actions that non-reciprocally endanger the rights of others. This can be seen particularly clearly in cases of necessity like Vincent v Lake Erie. Under current law, those cases fall in between the categories of unjustified enrichment and wrongs; in most legal systems, they are therefore regarded as particularly hard cases. Nevertheless, the liability of a person lawfully causing damage in a situation of necessity exemplifies the idea of legal responsibility, and thus helps in better understanding the law of non-contractual obligations. Methodologically, the article combines historical arguments derived from the late scholastic theory of restitution with a comparative analysis of Western legal systems and contemporary private law theory. This approach is designed to overcome the conceptual boundaries of national private laws on both sides of the English Channel; it may help to address difficult legal problems more appropriately. It is characteristic of many discussions in jurisprudence that the questions group around a relatively small selection of so-called basic legal concepts. Some authors explicitly maintain that the main task of a philosophy of law should be conceptual analysis. Authors expressing this view are usually classified as exponents of “analytical jurisprudence.” Within analytical jurisprudence itself there is considerable disagreement over such questions as what “analysis” is, what kind of methods the analyst ought to employ, etc. Most writers representing this school, (...) however, have in common a marked interest in terminological problems. Their discussions typically take as a point of departure certain verbal expressions, and their primary task is to clarify the actual, or desired, meaning of these expressions, either generally or in certain connections.
