Hospital health committees in Turkey review medical reports from clinical practitioners and decide whether or not they are justified. As a rule, each HHC member is expected to observe and examine each patient and then evaluate the report. If the report from the patient's doctor is approved, then the Social Security Administration, a state organisation, will meet all of the patient's expenses covering treatment, medication and operations. Justification of health expenditure is crucial for the state because health resources have to (...) be carefully allocated. Conflicts of obligation also generate ethical issues which have to be resolved as well. However, HHCs are not designed to make ethical decisions. In our lives, we aim to achieve welfare for ourselves, that is, to live good lives. But we also have another, more impartial perspective, where we aim to balance our concern for our own welfare against a concern for the welfare of others. This is a perspective of justice. Nils Holtug examines these two perspectives and the relations between them.

The aim of this study was to explore ethically problematic situations in the long-term nursing care of elderly people. It was assumed that greater awareness of ethical problems in caring for elderly people helps to ensure ethically high standards of nursing care. To obtain a broad perspective on the current situation, the data for this study were collected among elderly patients, their relatives and nurses in one long-term care institution in Finland. The patients (n=10) were interviewed, while the relatives (n=17) (...) and nurses (n=9) wrote an essay. Interpretation of the data was based on qualitative content analysis. Problematic experiences were divided into three categories concerning patients’ psychological, physical and social integrity. In the case of psychological integrity, the problems were seen as being related to treatment, self-determination and obtaining information; for physical integrity, they were related to physical abuse and lack of individualized care; and for social integrity, to loneliness and social isolation. This study provided no information on the prevalence of ethical problems. However, it is clear from the results that patient integrity warrants more attention in the nursing care of elderly patients. Roughly, according to conditional egalitarianism, equality is non-instrumentally valuable, but only if it benefits at least one individual. Some political theorists have argued that conditional egalitarianism has the important virtue that it allows egalitarians to avoid the so-called objection. However, in the present article I argue that conditional egalitarianism does not offer the egalitarian a plausible escape route from this objection. First, I explain the levelling down objection and suggest some particular concerns from which it derives its force. Then I (...) provide a more precise definition of conditional egalitarianism. Finally, I give two arguments against this principle. According to the first, it violates the transitivity of the betterness relation (or more specifically, ). This study aimed to describe and compare the views of nurses and older patients' relatives on factors restricting the maintenance of patient integrity in long-term care. The purposive sample comprised 222 nurses and 213 relatives of older patients in four Finnish long-term care institutions. The data were collected using a self-developed questionnaire addressing five sets of factors relating to patients, relatives, nurses, the organization and society. The maintenance of patient integrity was restricted by: (1) social factors, including lack of respect (...) for long-term geriatric care and lack of adequate resources; (2) patient factors relating to forgetfulness; and (3) factors relating to nurses and relatives in maintaining patient integrity. Better maintenance of patient integrity requires that more consideration is paid to issues of social respect and to the availability of adequate resources. Closer attention must be given to patients who are forgetful and unable to take part in decision making. (shrink)

According to the Harm Principle, roughly, the state may coerce a person only if it can thereby prevent harm to others. Clearly, this principle depends crucially on what we understand by harm. Thus, if any sort of negative effect on a person may count as a harm, the Harm Principle will fail to sufficiently protect individual liberty. Therefore, a more subtle concept of harm is needed. I consider various possible conceptions and argue that none gives rise to a plausible version (...) of the Harm Principle. Whether we focus on welfare, quantities of welfare or qualities of welfare, we do not arrive at a plausible version of this principle. Instead, the concept of harm may be moralized. I consider various ways this may be done as well as possible rationales for the resulting versions of the Harm Principle. Again, no plausible version of the principle turns up. I also consider the prospect of including the Harm Principle in a decision-procedure rather than in a criterion of rightness. Finally, in light of my negative appraisal, I briefly discuss why this principle has seemed so appealing to liberals. (shrink)

Ethicism is the most comprehensively defended answer to the question regarding whether ethical properties determine aesthetic properties in artworks. According to ethicism, aesthetically relevant ethical flaws in artworks count as aesthetic flaws and aesthetically relevant ethical merits count as aesthetic merits. In this paper, I argue that ethicism’s most significant argument, the Merited Response Argument suffers from an ambiguity that makes it either unsound or uninteresting. Specifically, the notion of an artwork’s ‘prescribing’ a response, central to MRA, is ambiguous between (...) merely attempting to elicit a response from appreciators as appropriate to a work, and endorsing a response as appropriate to relevant parts of the actual world. While the first sense of ‘prescribe’ does the aesthetic work, the second does the ethical. (shrink)

Neuroconstructivism, Vol. 1: How the Brain Constructs Cognition implies that brain functioning depends on biofeedback and ecological trajectories. Using the building blocks of Boolean algebra known as logic gates and models of distributed control systems, I suggest that levels of regulatory states are responsible for optimal, pathological, and developmental processes. I include the impact of regulatory and nonregulatory functions on structural development.

In this article, I offer a politico-philosophical perspective to reassess the much-contested role of truth in politics to put forth a principle of political action that will make sense of a “right to unmanipulated factual information,” which Hannah Arendt understands as crucial for establishing freedom of opinion. In developing a principle of epistemic responsibility, I will show that “factual truth” plays a key role in Arendt’s account of political action and provides a normative order that can extricate her account from (...) charges of immoralism. The article will be divided into three sections: section 1 deals with the distinction between rational truths and factual truths, and the question of their validity, section 2 deals with what a principle of political action is, and lastly, section 3 proposes a principle of “epistemic responsibility” that becomes action-guiding in the political sphere, in order to shed new light on the 2013 Gezi Park protest, one of the recent democratic uprisings of our century. The strength of a slippery slope argument is a matter of some dispute. Some see it as a reasonable argument pointing out what probably or inevitably follows from adopting some practice, others see it as essentially a fallacious argument. However, there seems to be a tendency emerging to say that in many cases, the argument is not actually fallacious, although it may be unsubstantiated. I shall not try to settle this general discussion, but merely seek to assess the strength of (...) the slippery slope argument applied to human gene therapy. The structure of my argument will be the following. First, I shall distinguish between three different versions of the slippery slope argument; two logical versions and an empirical one. Next, I will address human gene therapy in terms of each of the three versions, partly relying on slippery slope arguments against this practice that have already surfaced in the literature. I shall argue that neither version pulls through. The logical versions fail primarily because relevant distinctions can be made between different uses of gene therapy, contrary to what the proponents of the arguments claim. The empirical version fails because there seems to be no evidence supporting the claim that we shall in fact slide down the slope if we engage in gene therapy, and because if we accepted the conclusion that we should not allow gene therapy on the basis of the empirical argument, we should have to make very far-reaching and undesirable modifications in health care in general, in order to be consistent. The Ethical Question asks whether ethical values in artworks determine their aesthetic value and, if so, how. I argue that the question is ambiguous between a direct and an indirect reading. I show how the indirect reading is philosophically uninteresting because it has an obvious answer: a view called ‘immoralism’. I also show how most of the significant figures in the relevant literature address the indirect form of the question anyway—needlessly, if I am right. Finally, I consider whether some version (...) of the indirect question is more philosophically interesting, connecting it to the so-called ‘qua problem’. Mobile health devices pose novel questions at the intersection of philosophy and technology. Many such applications not only collect sensitive data, but also aim at persuading users to change their lifestyle for the better. A major concern is that persuasion is paternalistic as it intentionally aims at changing the agent’s actions, chipping away at their autonomy. This worry roots in the philosophical conviction that perhaps the most salient feature of living autonomous lives is displayed via agency as opposed to patiency—our (...) lives go well in virtue of what we do, rather than what happens to us. Being persuaded by a device telling us how to conduct our lives seemingly renders the agent passive, an inert recipient of technological commands. This agential bias, however, has led to a marginalization of patiential characteristics that are just as much part of our lives as are agential characteristics. To appreciate the inherent interlocking of acting and being acted upon, it is vital to acknowledge that agency and patiency are correlates, not mutually exclusive opposites. Furthermore, it is unclear whether an action can only count as agential so long as its causes are internal. Drawing on the extended mind and extended will framework, I argue that mHealth applications merely serve as volitional aids to the agent’s internal cognition. Autonomously set goals can be achieved more effectively via technology. To be persuaded by an mHealth device does not mainly—let alone exclusively—emphasize patiency; on the contrary, it can be an effective tool for technologically enhancing agency. (shrink)

Poincare's understanding of science is expressed as conventionalist because he asserts that all sciences, including mathematics, consist of conventions and definitions. In this article, Poincare's views on how scientists should evaluate the data obtained from observation and experiment in their studies and the hypotheses that describe the relationships between these data are discussed. In the article, (...) it is also thought that especially Poincare's claims about the structure of science and the nature of scientific activity are important in terms of understanding some scientific views that emerged in the second half of the twentieth century. This book is a synthesis of more than three decades of research into the concept of time and its semiotic nature. If traditional philosophy – and philosophy of time should be no exception – in the shadow of advancing biology can be said to have reached an impasse, one important reason for this, in harmony with Wittgenstein’s vision, appears to have been its lack of appropriate tools for explicating language. The present theory of time proceeds, accordingly, from the exploration of (...) temporal expressions in language as an evolutionary fact. It derives in a hypothetical, coherent feedback process of hierarchically ordered distinctions the semantics of time from its biologically dictated perceptual and cognitive-pragmatic origins. The corresponding abductive-regulative model is anchored in the assumption of biological rhythmization as the very foundation of perception and mental/physical action. Understood to originate in space and spatial perspective, time reveals itself as an instrument for temporal perspective on motion (events and situations) in a process of analysis, i.e., discontinuation of chaos made divisible and continuous by the rhythmical screen. Whereas traditional philosophy of time paid attention almost exclusively to the temporal category of tense, the biopragmatic model sees strong evidence in the perspectival nature of time for ascribing the decisive, and probably universal, role in temporal analysis to the linguistic category of aspect. Aspect may, according to the present findings, be assumed to partake already of change-of-state and cause-effect analysis without which man’s adaptation to new situations – and precondition for survival – would be inconceivable. The proposed model of space/time cognition, inspired by Hegelian dialectics, Heidegger-Gadamer’s hermeneutic circle and Peircean logic, makes Kantian a priori superfluous and liberates time from its enigmatic appearance. For the first time in temporal studies it thus appears possible to derive hypothetically linguistic expressions of time all the way from pretemporal, homogeneous continuity effected by biological rhythmization, via pretemporal metonymic (Gestalt), chunk-wise partitioning – as a general precondition for the perception and, based on primary metaphorization, the cognition of things, space and motion – to temporal analysis/discontinuation proper, primarily by aspectual perspective, and the subsequent synthesized, heterogeneous continuity of temporally ordered events. The conception of time, so disastrous for modern temporal logic, i.e., as moving object assigned extension, divisible continuity (‛linearity’) and direction, can be shown to have emerged as a result of secondary metaphorization. This paper proves normalisation theorems for intuitionist and classical negative free logic, without and with the $\invertediota$ operator for definite descriptions. Rules specific to free logic give rise to new kinds of maximal formulas additional to those familiar from standard intuitionist and classical logic. When $\invertediota$ is added it must be ensured that reduction procedures involving replacements of parameters by terms do not introduce new maximal formulas of higher degree than the ones removed. The problem is solved by a rule (...) that permits restricting these terms in the rules for $\forall$, $\exists$ and $\invertediota$ to parameters or constants. A restricted subformula property for deductions in systems without $\invertediota$ is considered. It is improved upon by an alternative formalisation of free logic building on an idea of Ja\'skowski's. In the classical system the rules for $\invertediota$ require treatment known from normalisation for classical logic with $\lor$ or $\exists$. In this paper, we consider a few actual cases of mnemonic strategies among older subjects (older than 65). The cases are taken from an ethnographic study, examining how elderly adults cope with cognitive decline. We believe that these cases illustrate that the process of remembering in many cases involve a complex distributed web of processes involving both internal or intracranial and external sources. Our cases illustrate that the nature of distributed remembering is shaped by and subordinated to the dynamic characteristics (...) of the on-going activity and to our minds suggest that research on memory and distributed cognition should focus on the process of remembering through detailed descriptions and analysis of naturally occurring situations. With a focus on hormone treatments, this article contributes to recent problematizations of the ontology of bodies, illnesses and medication. Hormone treatment is conventionally understood to comprise preparations like pills, patches or injections, and following from this understanding, the materiality of risk is perceived as potential adverse effects of pharmaceuticals within individual bodies. By discussing Finnish trans persons’ experiences of hormone treatments, and drawing from material feminisms and trans/feminist studies, this article rethinks what ‘hormone treatments’ and their risks materially entail. Stressing the importance of accounting for the relationality of risks, the article suggests that hormone treatment risks can be seen as Baradian ‘phenomena’ that materialize contextually within specific ‘treatment apparatuses’ and the power relations that saturate them. This process of materialization includes the gendering of risks and how the gender binary itself may at times constitute a risk. (shrink)

We argue that the pratyabhijñā system of Kaśmir Śaivism holds an inconsistent position. On the one hand, the Pratyabhijñā regards Śiva as an impersonal mechanism and the universe, including persons, as not having agency; call this the Impersonal Component. On the other hand, it considers Śiva himself as a person, and individual persons as having agency sufficient to respond to Śiva; call this the Personal Component. We maintain that the Personal Component should be affirmed and the Impersonal Component rejected. The (...) Impersonal Component’s claim that Śiva is unaware of and unaffected by his manifestation should be rejected, and the doctrine of satkāryavāda should be modified. The universe is Śiva’s manifestation, in the first instance, but it also has a relative autonomy from him. Moreover, humans have agency and freedom. Their actions effect Śiva. In recent years, many Small Island Developing State governments have worked to increase openness and transparency of their transactions as a means to enhance efficiency and reduce corruption in their economies. In order to achieve a cost-effective and efficient strategy to implement a transparent government, Information Communication Technologies offer an opportunity of virtualization by deploying e-government services to promote transparency, accountability and consistency in the public sector and to minimize corruption. This paper explores the potential impact of government virtualization by (...) SIDS and against corruption by comparing the corruption perception index rates of 15 SIDS countries. The CPI relates to the degree by which corruption is perceived to exist among public officials and politicians by business people and country analysts. In order to reveal the long-term impact of virtual deployment and its consequences on corruption, an in-depth case analysis based on the CPI index rates was conducted on the deployment of the e-government system in Cyprus. This essay is based on a double perspective provided by literary reading and philosophy for approaching the problem of evil through a critical analysis of certain texts and characters constructed and represented in them, particularly Kant’s theodicy essay and its most important pre-text, the Book of Job. This methodology yields a novel approach to the familiar issue of theodicy vs. anti-theodicy. Adaptation and stress are two main concepts useful for better understanding the phases of illness and health-related human behavior. The two faces of adaptation, adaptation as a process and adaptation as a product, have raised the question of how long the adaptation process will take in cancer trajectories. The care setting transition from clinical-based into home-based cancer care has stressed the role of family caregivers (FCG) in cancer management. This study examines how types of demanded healthcare information affect the FCG’s (...) role in catalyzing the adaptation of female cancer patients. The mindsponge theory was used in conceptual development and results interpretation. Bayesian Mindsponge Framework (BMF) analytics was used for statistical analysis on a dataset of 48 spouses (husbands) and 12 other family members in five congested communities of Surabaya, Indonesia. Results showed that among the six types of demanded healthcare information, FCGs with a higher tendency to demand cancer-specific information are more likely to need support in catalyzing the adaptation of female cancer patients. Meanwhile, FCGs with a higher demand for information on alternative therapies are less likely to need support in catalyzing cancer adaptation. Other types of healthcare information have ambiguous effects on the need for support in cancer adaptation assistance. This study reveals that the demanded cancer-specific information, e.g., cancer’s prognosis or likely outcome, must be prioritized to assist FCG’s role in catalyzing adaptation among female cancer patients. Cancer prognosis and outcomes reflect the future of cancer care results. (shrink)
