In this paper, I offer an immanent critique of John Rawls's theory of justice which seeks to show that Rawls's understanding of his theory of justice as criteriological and contractarian is ultimately incompatible with his claim that the theory is grounded on the primacy of the practical. I agree with Michael Sandel's observation that the Rawlsian theory of justice rests on substantive metaphysical and epistemological claims, in spite of Rawls's assurances to the contrary. But while Sandel argues for even more (...) substantive metaphysical and epistemological commitments, I argue in the opposite direction. Following J. G. Fichte, I argue for a normative theory of society, not based on some particular notion of the good or on some contentious account of what all reasonable persons would agree to, but based only on the radical primacy of the practical, that is, based only on the seemingly empty premise that free beings - precisely because they are free - cannot be imagined in advance as all agreeing to any particular thing at all. Evidence does not support the claim that observers universally recognize basic emotions from signals on the face. The percentage of observers who matched the face with the predicted emotion (matching score) is not universal, but varies with culture and language. Matching scores are also inflated by the commonly used methods: within-subject design; posed, exaggerated facial expressions (devoid of context); multiple examples of each type of expression; and a response format that funnels a variety of interpretations into one word specified by (...) the experimenter. Two experiments examined false recall for lists of semantically and phonologically associated words as a function of presentation duration. Veridical recall increased with long exposure durations for all lists. For semantically associated lists, false recall increased from 20–250 ms, then decreased. There was a high level of false recall with 20 ms durations for phonologically associated lists , which declined as duration increased. In Experiment 2, for lists presented at 20 and 50 ms rates, false recall given zero correct recall (...) was observed frequently, suggesting that conscious recollection of studied words was not necessary for phonological false memory. Differences between phonologically and semantically associated lists were consistent with a feature integration model based on automatic initial processing of phonetic features of words. (shrink)

This final comment provides, a theoretical framework on how to conceive the self as presented in the key-note paper ‘Meaningfulness, volunteering and being moved. The event of witnessing’. This is deemed requisite to achieve a full understanding of how depth in meaningfulness comes about.

The question of the meaning and meaningfulness of life is neglected by philosophers today. Meaning is implicitly assumed to be associated with individual choices and preferences. This article argues that meaningfulness works in another way as well, when something provokes meaningfulness. One of the consequences of this vision is that there may well be implicit "standards" for meaning. Certain benchmarks for meaning-references concerned with our "being-in-the-world"-have not been explored fully enough. Another point that as been neglected in the recent discussion (...) on meaningfulness is the very structure of being that is appealed to. However, this has not affected the quest for meaning or for an understanding of this meaning, despite an increasing societal neglect of the importance of its pursuit. This article aims to contribute to a philosophical understanding of the sense of life in the world, drawing on (...) Jean-Luc Nancy's understanding of sense as developed in his Sense of the World. To talk of “sense” rather than of “meaning” is an unconventional choice in the field, yet both differ from one another in that sense refers to an opening as the very possibility of meaningfulness generally. This paper describes the relation between the surpassing and ethics. It first describes how we re-think the surpassing. We divide it into a non-reflective and a reflective level. Next we link it to ethics. The point we want to make is that in order for something to be ethical it needs a surpassing element. Yet not all surpassing elements lead to ethics. Therefore, we will first delineate the surpassing.

This paper makes a conceptual inquiry into the notion of ‘publics’, and forwards an understanding of this notion that allows more responsible forms of decision-making with regards to technologies that have localized impacts, such as wind parks, hydrogen stations or flood barriers. The outcome of this inquiry is that the acceptability of a decision is to be assessed by a plurality of ‘publics’, including that of a local community. Even though a plurality of ‘publics’ might create competing normative demands, its (...) acknowledgment is necessary to withstand the monopolization of the process of technology appraisal. The paper presents four ways in which such an appropriation of publicness takes place. The creation of dedicated ‘local publics’, in contrast, helps to overcome these problems and allows for more responsible forms of decision-making. We describe ‘local publics’ as those in which stakeholders from the different publics that are related to the process of technology implementation are brought together, and in which concerns and issues from these publics are deliberated upon. While previous research considering the emergence of strategic alliances has typically viewed their formation through a single theoretical lens, we suggest that multiple theoretical perspectives are needed to understand their complexity. This research conceptually integrates the resource-based view and institutional theory to assess variations in firm-level motivations to form strategic alliances. Applying these ideas to the context of complex environmental problems, we propose that strategic alliances typically are either competency- or legitimacy-oriented, and that four structural dimensions characterize both types of (...) alliances—organization learning, partner diversity, governance structure, and partner relations. We present research propositions that describe how alliances differ along these dimensions, and offer an important broader perspective on alliance formation that is applicable towards understanding their strategic and social outcomes. In this paper, we discuss how phenomenology might cogently express the way painful experiences are layered with complex intersubjective meaning. In particular, we propose a critical conception of pain as an intricate multi-levelled phenomenon, deeply ingrained in the constitution of one’s sense of bodily self and emerging from a web of intercorporeal, social, cultural, and political relations. In the first section, we review and critique some conceptual accounts of pain. Then, we explore how pain is involved in complex ways with (...) modalities of pleasure and displeasure, enacted personal meaning, and contexts of empathy or shame. We aim to show why a phenomenology of pain must acknowledge the richness and diversity of peculiar painful experiences. The second section then weaves these critical insights into Husserlian phenomenology of embodiment, sensation, and localisation. We introduce the distinction between Body-Object and Lived-Body to show how pain presents intersubjectively. Furthermore, we stress that, while pain seems to take a marginal position in Husserl’s whole corpus, its role is central in the transcendental constitution of the Lived-Body, interacting with the personal, interpersonal, and intersubjective levels of experiential constitution. Taking a critical-phenomenological perspective, we then concretely explore how some people may experience structural conditions which may make their experiences more or less painful. (shrink)

Graphical displays of simple moving geometrical figures have been repeatedly used to study the attribution of animacy in human observers. Yet little is known about the relevant movement characteristics responsible for this experience. The present study introduces a novel parametric research paradigm, which allows for the experimental control of specific motion parameters and a predictable influence on the attribution of animacy. Two experiments were conducted using 3D computer animations of one or two objects systematically introducing variations in the following aspects (...) of motion: directionality, discontinuity and responsiveness. Both experiments further varied temporal kinematics. Results showed that animacy experience increased with the time a moving object paused in the vicinity of a second object and with increasing complexity of interaction between the objects . The experience of animacy could be successfully modulated in a parametric fashion by the systematic variation of comparably simple differential movement characteristics. (shrink)

ABSTRACTSince its origin bioethics has been a specialized, academic discipline, focussing on moral issues, using a vast set of globalized principles and rational techniques to evaluate and guide healthcare practices. With the emergence of a plural society, the loss of faith in experts and authorities and the decline of overarching grand narratives and shared moralities, a new approach to bioethics is needed. This approach implies a shift from an external critique of practices towards embedded ethics and interactive practice improvement, and (...) from a legal defence of rights towards fostering interdependent practices of responsibility. This article describes these transitions within bioethics in relation to the broader societal and cultural dynamics within Western societies, and traces the implications for the methodologies and changing roles of the bioethicist. The bioethicist we foresee is not just a clever expert but also a relationally sensitive person who engages stakeholders in reciprocal dialogues about their practice of responsibility and helps to integrate various sorts of knowledge . In order to illustrate this new approach, we present a case study. It concerns a project focusing on an innovation in elderly care, based on the participation of various stakeholders, especially older people themselves. (shrink)

We examined whether positive and negative affect motivates verbal and spatial working memory processes, respectively, which have implications for the expenditure of mental effort. We argue that when emotion promotes cognitive tendencies that are goal incompatible with task demands, greater cognitive effort is required to perform well. We sought to investigate whether this increase in cognitive effort impairs behavioural control over a broad domain of self-control tasks. Moreover, we predicted that individuals with higher behavioural inhibition system (BIS) sensitivities would report (...) more negative affect within the goal incompatible conditions because such individuals report higher negative affect during cognitive challenge. Positive or negative affective states were induced followed by completing a verbal or spatial 2-back working memory task. All participants then completed one of three self-control tasks. Overall, we observed that conditions of emotion and working memory incompatibility (positive/spatial and negative/verbal) performed worse on the self-control tasks, and within the incompatible conditions individuals with higher BIS sensitivities reported more negative affect at the end of the study. The combination of findings suggests that emotion and working memory compatibility reduces cognitive effort and impairs behavioural control. (shrink)

Despite the propensity of species introductions to disrupt ecosystems through community disassembly, the use of species translocations is becoming more widely accepted. In this paper, we examine ethical investigations into human migration in an attempt to evaluate how translocation may be justified. Previous attempts to make the analogy between human and species migration have been prone to black and white thinking. We argue that the disagreement between nativist and cosmopolitan approaches to introduced species can be defused by extending the analogy (...) through the migration ethics literature. Additionally, by extending the discussion to the special status of refugees, we are able to develop a theoretical framework for species migrations that acknowledges the risk of species introduction while recognising that special obligations towards endangered species may necessitate the use of translocations. Patientenselbstbestimmung und Patientenverfügungen haben zunehmende Bedeutung und Beachtung erfahren. In der vorliegenden qualitativen Studie wurden 15 Patientinnen und Patienten mit amyotropher Lateralsklerose —einer unheilbaren, chronisch-degenerativen Erkrankung mit vorhersehbarer Symptomatik—interviewt, um zu erfahren, welche Werte und Kriterien sie bei prospektiven Entscheidungen am Lebensende und bei der Abfassung von PV zugrunde legen. Die Auswertung erfolgte nach der Methode der „grounded theory“. Die befragten Patientinnen und Patienten befürworteten einen Verzicht auf lebenserhaltende Behandlungen, wenn sie keine hinreichenden Lebensmöglichkeiten mehr sahen, d. h. wenn sie (...) die aktuelle Lebensqualität für unzureichend erachteten und die Chance auf Besserung als gering einschätzten. Dem Patientenwillen sprachen sie bei der Entscheidungsfindung ein Vetorecht zu. Patientenverfügungen fassten sie erst ab, als sie keine Hoffnung mehr auf Besserung ihrer Erkrankung hatten. Sie verstanden diese als Instrumente zur vorsorglichen Erklärung ihres Wunsches, auf lebensverlängernde Maßnahmen zu verzichten, wenn die LM inakzeptabel geworden sind. Damit wollten sie sich gegenüber dem Arzt absichern, den sie in der Rolle eines Anwalts des Lebens sahen und mit dem sie daher ihre Behandlungswünsche nicht besprochen haben. Trotz vorhersehbarer Symptomatik legten sie in ihren PV keine spezifischen Behandlungswünsche nieder, sondern verwendeten allgemeine Formularmuster ohne konkreten Bezug zu ihrer Erkrankung. Daher bestehen auch bei dieser Patientengruppe Zweifel, ob die PV in einer konkreten Behandlungssituation hilfreich sind. (shrink)

In this article I would like to express my personal ideas and points of view about strike action, which I think many colleagues will share. I am a qualified paediatric nurse, currently working in the central operating theatre of a university hospital in Germany. At the same time, I am also finishing my studies in health care sciences. Apart from two short protest strikes, I have not taken part in any strike, because there have not been any during my whole (...) professional career at the hospitals where I have worked. I am personally deeply convinced that strikes are important and are a good and useful tool, in particular to protest against ‘rationalizations’, which so far have led only to lower salaries and fewer jobs for nurses, and have brought no improvement in the conditions for staff or patients. To provide an introduction to this book, we explain the motivation to publish this volume, state its main goal, characterize its intended readership, and give an overview of its content. To this purpose, we briefly summarize each chapter and put it in the context of the whole volume. We also take the opportunity to stress connections between the chapters. We conclude with a brief outlook.The main motivation to publish this volume was the diagnosis that the validation of computer simulation needs (...) more attention in practice and in theory. The aim of this volume is to improve our understanding of validation. To this purpose, computer scientists, mathematicians, working scientists from various fields, as well as philosophers of science join efforts. They explain basic notions and principles of validation, embed validation in philosophical frameworks such as Bayesian epistemology, detail the steps needed during validation, provide best practice examples, reflect upon challenges to validation, and put validation in a broader perspective. As we suggest in our outlook, the validation of computer simulations will remain an important research topic that needs cross- and interdisciplinary efforts. A key issue is whether, and if so, how very rigorous approaches to validation that have proven useful in, e.g., engineering can be extended to other disciplines. (shrink)

Despite much research in the context of aging and technology, the role of Views on aging for differences in technology use and attitudes among older adults has rarely been studied so far. This study focuses on the associations between a multidimensional measure of VoA and technology use, technology skills, and attitudes toward technology in a sample of older adults. We apply the concept of Awareness of age-related change to examine the role of positive and negative self-perceptions of aging. Bivariate and (...) multivariate regression analyses were conducted. The results showed positive associations of AARC-Gains with technology skills and technology attitudes. For AARC-Losses, we identified negative associations with technology skills, technology attitudes as well as general technology use. In contrast, associations between subjective age and all technology-related measures were non-significant. The results stress the importance to consider multidimensional measures of VoA to gain a better understanding of the associations between an individuals’ experiencing of own aging processes and technology adoption. More research is needed to determine the stability of these findings in other samples and for other kinds of technology use and attitudes. (shrink)

Résumé L’Utopie de Thomas More est composée de deux livres : Le Livre Premier, vite escamoté par les rêveurs d’avenir que l’histoire ennuie, nous parle de l’Europe de 1515 à l’aube d’une révolution de tous les savoirs, dominée par un pouvoir politique qui utilise la religion, la peur et l’ ignorance afin de satisfaire un appétit hégémonique insatiable, infiniment corrompu mais parlant haut valeurs morales et familiales. Le Livre Second nous fait miroiter un avenir à l’échelle de l’humanité qui utiliserait (...) les nouvelles techniques, la raison et la bonne gestion de ses ressources pour concilier bien commun et plaisir individuel. Ce Livre est le texte fondateur de notre modernité. C’est la Bible païenne adoptée par les Lumières et que nous avons inscrite dans la charte des institutions de notre temps. Cinq cents ans plus tard et les livres se réécrivent en miroir : le grand rêve humain initié par le Livre Second de 1516 s’englue dans la réalité de 2005. Les nouvelles promesses de l’économisme du libre choix de 2005 ne sont qu’un hallucinant retour en arrière, aux postulats du Livre Premier. (shrink)

Teilhard's texts were published in two complementary publications, the more philosophical‐theological ones in the L'Oeuvres (OV), the scientific ones in the L'Oeuvre Scientifique (OS)1. His letters were published in a nonsystematic way. The publication of the Oeuvres presented thematic compilations. The papers had their own production history, creating different versions. Scientific texts were published by Teilhard in widely dispersed journals and have been collected into L'Oeuvre Scientifique. The scientific status of Teilhard is related to his positions in the scientific world (...) and the continued use of his publications. The influences causing different versions of theological and philosophical papers are analyzed. The present accessibility of the diaries and their importance for a full understanding of Teilhard is elaborated. (shrink)
