Many believe that we ought to treat people as individuals and that this form of treatment is in some sense incompatible with treating people as members of groups. Yet, the relation between these two kinds of treatments is elusive. In this paper, we develop a novel account of the normative requirement to treat people as individuals. According to this account, treating people as individuals requires treating people as agents in the appropriate capacity. We call this the Agency Attunement Account. This (...) view has the surprising implication that it's not only possible to fail in treating people as individuals but also possible to fail in treating people as members of groups, on the presumption that people's agency is sometimes nested in, and exercised via, agential groups. Andrei Marmor has recently offered a narrow interpretation of the right to privacy as a right to having a reasonable amount of control over one's self‐presentation. He claims that the interest people have in preventing others from abusing their personal information to do harm is not directly protected by the right to privacy. This article rejects that claim and defends a view according to which concerns about abuse play a central role in fleshing out the appropriate scope of a general (...) right to privacy. (shrink)

Most studies on the ethics of privacy focus on what others ought to do to accommodate our interest in privacy. I focus on a related but distinct question that has attracted less attention in the literature: When, if ever, does morality require us to safeguard our own privacy? While we often have prudential reasons for safeguarding our privacy, we are also, at least sometimes, morally required to do so. I argue that we, sometimes, ought to safeguard our privacy for the (...) sake of the possible wrongdoer, in order to prevent the possible wrongdoer from committing a morally defiling act that renders them worse off. I illustrate the variety of cases in which this duty binds us and contrast my view to some other claims in the literature which also purport to show that we sometimes have a duty to safeguard our own privacy. Mainz and Uhrenfeldt have recently claimed that a violation of the right to privacy can be defined successfully under reliance on the notion of ‘Negative Control’. In this reply, I show that ‘Negative Control’ is unrelated to privacy right violations. It follows that control theorists have yet to put forth a successful normative account of privacy.

Do privacy rights restrict what is permissible to infer about others based on statistical evidence? This paper replies affirmatively by defending the following symmetry: there is not necessarily a morally relevant difference between directly appropriating people’s private information—say, by using an X-ray device on their private safes—and using predictive technologies to infer the same content, at least in cases where the evidence has a roughly similar probative value. This conclusion is of theoretical interest because a comprehensive justification of the thought (...) that statistical inferences can violate privacy rights is lacking in the current literature. According to a popular view, privacy is a function of people not knowing or rationally believing some fact about you. But intuitively it seems possible for a perpetrator to violate your right to privacy without learning any facts about you. For example, it seems plausible to say that the US National Security Agency’s PRISM program violated, or could have violated, the privacy rights of the people whose information was collected, despite the fact that the NSA, for the most part, merely (...) collected information without examining it, and thus, for the most part, did not acquire knowledge about specific people. This pair of judgements creates the challenge of aligning one of the most popular accounts of what privacy is with a suitable account of the right to privacy. Call this the alignment challenge. -/- In this paper, I criticize two recent attempts to answer the alignment challenge: one based on risk, proposed by Björn Lundgren, and one based on modal robustness, proposed by Carissa Véliz. I then offer my preferred response, which I call the inquiry account. According to this account, the right to privacy protects against certain forms of inquiry. This account explains why there is a gap between what privacy is a what the right to privacy protects people against. Moreover, it explains why it is possible to violate someone’s right to privacy without obtaining knowledge. (shrink)

By now a consensus has emerged that people, when subjected to high-stakes decisions through automated decision systems, have a moral right to have these decisions explained to them. However, furnishing such explanations can be costly. So the right to an explanation creates what we call the cost problem: providing subjects of automated decisions with appropriate explanations of the grounds of these decisions can be costly for the companies and organisations that use these automated decision systems. In this paper, we explore (...) whether large language models could prove significant in overcoming the cost problem. We provide an initial case for believing that they can but only with serious ethical costs. (shrink)

In this paper, we defend what we call the ‘Hybrid View’ of privacy. According to this view, an individual has privacy if, and only if, no one else forms an epistemically warranted belief about the individual’s personal matters, nor perceives them. We contrast the Hybrid View with what seems to be the most common view of what it means to access someone’s personal matters, namely the Belief-Based View. We offer a range of examples that demonstrate why the Hybrid View is (...) more plausible than the Belief-Based View. Finally, we show how the Hybrid View generates a more plausible fit between the concept of privacy, and the concept of a (morally objectionable) violation of privacy. (shrink)

The stakes associated with an algorithmic decision are often said to play a role in determining whether the decision engenders a right to an explanation. More specifically, “high stakes” decisions are often said to engender such a right to explanation whereas “low stakes” or “non-high” stakes decisions do not. While the overall gist of these ideas is clear enough, the details are lacking. In this paper, we aim to provide these details through a detailed investigation of what we will call (...) the “Simple Stakes Thesis”. The Simple Stakes Thesis, as it will turn out, is too simple. For even if the stakes associated with a specific one-off decision are low—and hence does not engender a right to an explanation—such decisions may nevertheless form part of a high stakes pattern or aggregate of decisions. In such cases, we argue, even a low stakes decision may engender a right to explanation. Not only does this show that the right to explanation is more demanding than so far recognized. It also shows that the stakes thesis is significantly harder to apply in practice. (shrink)

If I decide to disclose information about myself, this act may undermine other people’s ability to conceal information about them. Such dependencies are called privacy dependencies in the literature. Some say that privacy dependencies generate moral duties to avoid sharing information about oneself. If true, we argue, then it is sometimes justified for others to impose harm on the person sharing information to prevent them from doing so. In this paper, we first show how such conclusions arise. Next, we show (...) that the existence of such a dependency between the moral significance you are inclined to attribute to privacy dependencies and judgments about permissible self-defense puts pressure on at least some ways of spelling out the idea that privacy dependencies ought to constrain our data-sharing conduct. An increasingly popular view in scholarly literature and public debate on implicit biases holds that there is progressive moral potential in the discomfort that liberals and egalitarians feel when they realize they harbor implicit biases. The strong voices among such discomfort advocates believe we have a moral and political duty to confront people with their biases even though we risk making them uncomfortable. Only a few voices have called attention to the aversive effects of discomfort. Such discomfort skeptics warn that, (...) because people often react negatively to feeling blamed or called-out, the result of confrontational approaches is often counterproductive. To deepen this critique, I distinguish between awareness discomfort and interaction discomfort, developing a contextual approach that draws on recent research on negative affect and emotions to chart a more complete picture of the moral limits of discomfort. I argue that discomfort advocates risk overrating the moral potential of discomfort if they underestimate the extent to which context shapes the interpretation of affect and simple, raw feelings. "What is the significance of our gut feelings? Can they disclose our deep selves or point to a shared human nature? The phenomenon of perpetrator disgust provides a uniquely insightful perspective by which to consider such questions. Across time and cultures, some individuals exhibit signs of distress while committing atrocities. They experience nausea, convulse, and vomit. Do such bodily responses reflect a moral judgment, a deep-seated injunction against atrocity? What conclusions can we draw about the relationship of our gut feelings (...) to human nature and moral frameworks? Drawing on a broad range of historical examples as well as the latest scholarship from the philosophical and scientific study of emotions, this book explores the relationship of cognition and emotion through the lens of perpetrator disgust. Considering a range of interpretations of this phenomenon, it becomes evident that gut feelings do not carry a straightforward and transparent intentionality in themselves, nor do they motivate any core, specific response; they are templates that can embody a broad range of values and morals. Using this core insight, the book proposes a contextual understanding of emotions, by which an agent's environment shapes their available hermeneutic equipment-concepts, categories, names-that individuals rely on to make sense of their emotions and navigate the world"--. Many seem to think that AI-induced responsibility gaps are morally bad and therefore ought to be avoided. We argue, by contrast, that there is at least a pro tanto reason to welcome responsibility gaps. The central reason is that it can be bad for people to be responsible for wrongdoing. This, we argue, gives us one reason to prefer automated decision-making over human decision-making, especially in contexts where the risks of wrongdoing are high. While we are not the first to (...) suggest that responsibility gaps should sometimes be welcomed, our argument is novel. Others have argued that responsibility gaps should sometimes be welcomed because they can reduce or eliminate the psychological burdens caused by tragic moral choice-situations. By contrast, our argument explains why responsibility gaps should sometimes be welcomed even in the absence of tragic moral choice-situations, and even in the absence of psychological burdens. According to the implicit commitment thesis, once accepting a mathematical formal system S, one is implicitly committed to additional resources not immediately available in S. Traditionally, this thesis has been understood as entailing that, in accepting S, we are bound to accept reflection principles for S and therefore claims in the language of S that are not derivable in S itself. It has recently become clear, however, that such reading of the implicit commitment thesis cannot be compatible with well-established positions (...) in the foundations of mathematics which consider a specific theory S as self-justifying and doubt the legitimacy of any principle that is not derivable in S: examples are Tait’s finitism and the role played in it by Primitive Recursive Arithmetic, Isaacson’s thesis and Peano Arithmetic, Nelson’s ultrafinitism and sub-exponential arithmetical systems. This casts doubts on the very adequacy of the implicit commitment thesis for arithmetical theories. In the paper we show that such foundational standpoints are nonetheless compatible with the implicit commitment thesis. We also show that they can even be compatible with genuine soundness extensions of S with suitable form of reflection. The analysis we propose is as follows: when accepting a system S, we are bound to accept a fixed set of principles extending S and expressing minimal soundness requirements for S, such as the fact that the non-logical axioms of S are true. We call this invariant component the semantic core of implicit commitment. But there is also a variable component of implicit commitment that crucially depends on the justification given for our acceptance of S in which, for instance, may or may not appear reflection principles for S. We claim that the proposed framework regulates in a natural and uniform way our acceptance of different arithmetical theories. (shrink)

As a response to the semantic and logical paradoxes, theorists often reject some principles of classical logic. However, classical logic is entangled with mathematics, and giving up mathematics is too high a price to pay, even for nonclassical theorists. The so-called recapture theorems come to the rescue. When reasoning with concepts such as truth/class membership/property instantiation, (These are examples of concepts that are taken to satisfy naive rules such as the naive truth schema and naive comprehension, and that therefore are (...) compatible with a solution to paradox cast in the logics considered below. Other notions of similar kind can be added to the list.) if one is interested in consequences of the theory that only contain mathematical vocabulary, nothing is lost by reasoning in the nonclassical framework. This article shows that this claim is highly misleading, if not simply false. Under natural assumptions, some well-established approaches to recapture are incorrect. (shrink)

Some moral philosophers argue that we hold others and ourselves morally responsible for acting on second-personal reasons. This article connects this idea with the emerging literature on the moral responsibility of groups by exploring in which sense, if any, groups can be held accountable for acting on second-personal reasons. On the developed view, groups are second-personally competent if and only if they possess capacities for sympathy, acting on that sympathy, and related self-reactive attitudes. Focusing especially on loosely structured groups without (...) unifying decision-making procedures, the article goes on to argue that the required group-level capacities can be realized through the interdependent exercise of member-level capacities. Truth-theoretic deflationism holds that truth is simple, and yet that it can fulfil many useful logico-linguistic roles. Deflationism focuses on axioms for truth: there is no reduction of the notion of truth to more fundamental ones such as sets or higher-order quantifiers. In this paper I argue that the fundamental properties of reasonable, primitive truth predicates are at odds with the core tenets of classical truth-theoretic deflationism that I call fix, express, and quantify. Truth may be regarded as a broadly (...) logical, sui generis notion. However, this has little to do with the original aims of the deflationary theory of truth. (shrink)

Drawing on recent phenomenological discussions of collective intentionality and existential phenomenological accounts of agency, this article proposes a novel interpretation of shared action. First, I argue that we should understand action on the basis of how an environment pre-reflectively solicits agents to behave based on (a) the affordances or goals inflected by their abilities and dispositions and (b) their self-referential commitment to a project that is furthered by these affordances. Second, I show that this definition of action is sufficiently flexible (...) to account for not only individual action (in which both (a) and (b) refer only to an individual) but also several distinct subtypes of shared action. My thesis is that behaviour counts as shared action if and only if it is caused by a solicitation in which either (a) the goals, or (b) the commitments, or both (a) goals and (b) commitments are joint, i.e., depend on several individuals. We thereby get three distinct subtypes of shared actions: (i) jointly coordinated individually committed action, (ii) individually coordinated jointly committed action, and (iii) jointly coordinated jointly committed action. Apart from Aristotle it is Comte who most influenced Brentano's Psychology from an Empirical Standpoint, especially with regard to methodological questions. Brentano follows Comte not only in his attack on 'metaphysical' sciences and in his claim that sciences in their positive stage deal with phenomena; he also takes over Comte's encyclopedic law, replacing, however, sociology with psychology. In order to lay the foundations of psychology, Brentano recommends all the scientific methods suggested by Comte, but states that psychology employs as its (...) genuine method inner perception, the neglect of which had led Comte to deny the autonomous status of psychology as a science. A range of contemporary voices argue that negative affective states like distress and anxiety can be morally productive, broaden our epistemic horizons and, under certain conditions, even contribute to social progress. But the potential benefits of stress depend on an agent’s capacity to constructively interpret their affective states. An inability to do so may be detrimental to an agent’s wellbeing and mental health. The broader political, cultural, and socio-economic context shapes the kinds of stressors agents are exposed to, but it (...) also delineates the hermeneutic equipment they have available to interpret their stress. We discuss the principles for a primitive, object-linguistic notion of consequence proposed by ) that yield a version of Curry’s paradox. We propose and study several strategies to weaken these principles and overcome paradox: all these strategies are based on the intuition that the object-linguistic consequence predicate internalizes whichever meta-linguistic notion of consequence we accept in the first place. To these solutions will correspond different conceptions of consequence. In one possible reading of these principles, they give rise to a notion (...) of logical consequence: we study the corresponding theory of validity by showing that it is conservative over a wide range of base theories: this result is achieved via a well-behaved form of local reduction. The theory of logical consequence is based on a restriction of the introduction rule for the consequence predicate. To unrestrictedly maintain this principle, we develop a conception of object-linguistic consequence, which we call grounded consequence, that displays a restriction of the structural rule of reflexivity. This construction is obtained by generalizing Saul Kripke’s inductive theory of truth. Grounded validity will be shown to satisfy several desirable principles for a naïve, self-applicable notion of consequence. (shrink)

There is considerable evidence that listeners’ understanding of a spoken sentence need not always follow from a full analysis of the words and syntax of the utterance. Rather, listeners may instead conduct a superficial analysis, sampling some words and using presumed plausibility to arrive at an understanding of the sentence meaning. Because this latter strategy occurs more often for sentences with complex syntax that place a heavier processing burden on the listener than sentences with simpler syntax, shallow processing may represent (...) a resource conserving strategy reflected in reduced processing effort. This factor may be even more important for older adults who as a group are known to have more limited working memory resources. In the present experiment, 40 older adults and 20 younger adults were tested for comprehension of plausible and implausible sentences with a simpler subject-relative embedded clause structure or a more complex object-relative embedded clause structure. Dilation of the pupil of the eye was recorded as an index of processing effort. Results confirmed greater comprehension accuracy for plausible than implausible sentences, and for sentences with simpler than more complex syntax, with both effects amplified for the older adults. Analysis of peak pupil dilations for implausible sentences revealed a complex three-way interaction between age, syntactic complexity, and plausibility. Results are discussed in terms of models of sentence comprehension, and pupillometry as an index of intentional task engagement. (shrink)

Recombination maps of ancestral species can be constructed from comparative analyses of genomes from closely related species, exemplified by a recently published map of the human‐chimpanzee ancestor. Such maps resolve differences in recombination rate between species into changes along individual branches in the speciation tree, and allow identification of associated changes in the genomic sequences. We describe how coalescent hidden Markov models are able to call individual recombination events in ancestral species through inference of incomplete lineage sorting along a genomic (...) alignment. In the great apes, speciation events are sufficiently close in time that a map can be inferred for the ancestral species at each internal branch ‐ allowing evolution of recombination rate to be tracked over evolutionary time scales from speciation event to speciation event. We see this approach as a way of characterizing the evolution of recombination rate and the genomic properties that influence it. (shrink)
