This article examines the domestic use of drones by law enforcement to gather information. Although the use of drones for surveillance will undoubtedly provide law enforcement agencies with new means of gathering intelligence, these unmanned aircrafts bring with them a host of legal and epistemic complications. Part I considers the Fourth Amendment and the different legal standards of proof that might apply to law enforcement drone use. Part II explores philosopher Wittgenstein’s notion of actional certainty as a means to interpret (...) citizens' expectations of privacy with regard to their patterns of movement over time. Part III discusses how the theory of actional certainty can apply to the epistemic challenge of determining what is a “reasonable” expectation of privacy under the law. This Part also investigates the Mosaic Theory as a possible reading of the Fourth Amendment. (shrink)

Morse has produced a work that emphasizes the extreme significance and vital discipline of legal philosophy in representing the integration of legal principles and moral precepts. The Thinkers discusses, delineates, and analyzes the integral legal philosophies of Hobbes, Wilson, Aquinas, Augustine, Descartes, Hegel, Leibnitz, Kant, Carlyle,Thoreau, and Hohfeld.

I do not by any means with to take on the philosophy or aesthetics of music as a whole. In his review of Edward Lippman’s Humanistic Philosophy of Music, Monroe Beardsley lists six areas in which an ideal philosophy of music ought to provide guidance: an ontology of music, an answer to the question What is a musical work of art? a taxonomy of music, a categorical scheme for the basic and universal aspects of music; a hermeneutics or semiotics of (...) music, an answer to the question What, if anything, can music refer to? an epistemology of music; a theory of music criticism, an answer to the question What makes one musical work better than another? the foundations of a social philosophy of music.4 My subject here is the third item. I want most particularly to separate it from the fifth item, for to arrive at an interpretation of a particular piece is not to arrive at an evaluation of it. I shall also try, particularly in my discussion of Nelson Goodman’s seminal Languages of Art, to avoid the first item.5 And I shall try throughout to avoid embroilment in the question of how the aesthetic experience can be separated from the nonaesthetic.My subject is in fact only a part of the third item above, namely, current theories of musical expression. “Expression” is not equivalent to “meaning”; I understand and shall use the word “expression” to indicate a kind of meaning that entails some kind of reference outside the internal syntax of the artwork itself. As Goodman remarks, “rather obviously, to express is to refer in some way to what is expressed.”6 How this reference is made by the artwork is interaction with the listener, and what sort of purpose it serves—these concerns will be the focus of this essay. To choose this focus is not to deny something of which I have no doubt, both from Peter Faltin’s careful arguments and from my own experience: there is a kind of musical meaning that is purely syntactic, that operates without reference outside the internal operations or procedures of musical systems themselves.7 But through this may be ontologically the most fundamental kind of musical meaning, it is not the only kind. In On Certainty, the important, but to many readers obscure, twentieth century Austrian philosopher, Ludwig Wittgenstein, provides not only a brilliant solution to a previously intractable philosophical problem, but also the elements of an entirely new way of approaching this and similar longstanding, apparently un-resolvable, problems. In these notes he re-conceives the problem of radical skepticism–the claim that we can never really be certain of anything except the contents of our own minds–as a kind of philosophical “disease” of thought. His (...) approach to the problem, which I will emphasize is similar to the treatment of disease, has two main goals: -/- (1) bring about an awareness in the philosopher that this kind of extreme skepticism is not a methodological approach to be taken seriously, and, with this awareness, -/- (2) an attempt to replace this radical skepticism with a practical, Common Sense framework. -/- Implicit in Wittgenstein’s approach are a number of strategies found in a contemporary approach to psychotherapy known as Cognitive Behavioral Therapy (CBT). These strategies, along with philosophical methods and scientific practices rooted in the Scottish School of Common Sense, seek to diagnose and treat irrational thoughts and beliefs that often emerge (and re-emerge) in the discipline of philosophy. The aim is to provide the philosopher with tools necessary to adjust and reshape these irrational, self-defeating thoughts and beliefs into something new, something healthy. (shrink)

What role did Humanism play in the emergence of English Protestantism? This question has remained a live issue for Reformation scholarship over the past four centuries. In The Ark, the Covenant, and the Poor Men's Chest, the author examines the issue in detail, utilizing categories drawn from the research of John W. O'Malley on the application of different modes of classical rhetoric to biblical interpretation during the Renaissance. Anyone interested in either the revival of classical learning during the Renaissance or (...) the religious upheaval of the English Reformation will benefit from reading this work. The book's focus on primary sources from the sixteenth century and the best insights from recent secondary scholarship yields insights that will be of great interest to specialists in the field of Renaissance and Reformation studies. The inclusion of a timeline of major events, a biographical index of major figures, and a glossary of theological terms make this work accessible and helpful for students with varying degrees of familiarity with early modern England. Comparing the exegetical writings of Erasmus and John Colet, the author illustrates the key differences between Erasmian and Italian Humanism. Erasmus' reliance upon deliberative oratory for the explication of scripture, and his preoccupation with a Platonic philosophia Christi, result in an oracular Christology, focused narrowly on the speech of Jesus. By contrast, Italian Humanism relies upon epideictic rhetoric, and yields a portrait of Christ that highlights the deeds of the Messiah and the paschal dimensions of His salvific work, as seen in the writings of John Colet. These divergent patterns of biblical interpretation are also characteristic of the writings of the two bishops of London during the Reformation, Edmund Bonner, and Nicholas Ridley. Their contrasting approaches to scriptural interpretation suggest that opting for either Italian or Erasmian Humanism may have been decisive, both for Ridley's Protestantism and Bonner's Catholicism. Exploring Certainty: Wittgenstein and Wide Fields of Thought considers how, where, and to what extent the thoughts and ideas found in Wittgenstein’s On Certainty can be applied to other areas of thought, including: ethics, aesthetics, religious belief, mathematics, cognitive science, and political theory. Robert Greenleaf Brice opens new avenues of thought for scholars and students of the Wittgensteinian tradition, while introducing original philosophies about human knowledge and cognition.

In his article, “Wittgenstein and Basic Moral Certainty,” Nigel Pleasants argues that killing an innocent, non-threatening person is wrong. It is, he argues, “a basic moral certainty.” He believes our basic moral certainties play the “same kind of foundational role as [our] basic empirical certaint[ies] do.” I believe this is mistaken. There is not “simply one kind of foundational role” that certainty plays. While I think Pleasants is right to affiliate his proposition with a Wittgensteinian form of certainty, he exposes (...) himself to a tension that exists in On Certainty regarding how we acquire it: is certainty natural, is it social? In this paper, I present two ways in which we come to possess certainty: a bottom-up approach, where certainty is part of our instinctual predisposition, and a top-down approach, where certainty is acquired through positive reinforcement by family and culture. Thelen et al. criticize “spatial coding” approaches to the A-not-B error. However, newer thinking about spatial coding provides more precise analytic categories and recognizes that different spatial coding systems normally coexist. Theorizing about spatial coding is largely compatible with dynamic-systems theory, augmenting it with an analysis of what one means when discussing “location at A” (or B).

We evaluate three of Geary's claims, finding that there is little evidence for sex differences in object- vs. person-orientation; sex differences in competition, even if biologically caused, lead to sex differences in mathematics only given a certain style of teaching; and sex differences in mental rotation, though real, are not well explained in a sociobiological framework or by the proximate biological variables assumed by Geary.

In this reproduction of his original publication of 1649, Rene Descartes discusses how seekers of knowledge can best attain true insight of the world around them. Often referred to as simply the Discourse on the Method, this work is frequently cited as one of the most important to appear during the Enlightenment era. It discusses the ideal means through which those in search of knowledge can approach the world, and the practice of science, as a means of attaining true and (...) definitive insight. The Discourse on Method is influential chiefly for its role in establishing the scientific method; a technique which scientists have used to make valid discoveries over the centuries. Descartes instructs the reader to doubt everything, and to use this universal doubt as a starting point from which to approach a problem. In addition to matters of science, Descartes reflects upon his own personal, religious beliefs. In addition to his Method, Descartes also explains certain social and personal notions such as obeying the laws and statutes of his country and prioritizing self-advancement over the achievement of material wealth or fortune. Famous for including the much-quoted phrase "Je pense, donc je suis" - "I think, therefore I am" - the Discourse on Method today stands as a crucial cornerstone of countless educational courses on philosophy. There is more to legal knowledge representation than knowledge-bases. It is valuable to look at legal knowledge representation and its implementation across the entire domain of computerisation of law, rather than focussing on sub-domains such as legal expert systems. The DataLex WorkStation software and applications developed using it are used to provide examples. Effective integration of inferencing, hypertext and text retrieval can overcome some of the limitations of these current paradigms of legal computerisation which are apparent when they are used (...) on a stand-alone basis. Effective integration of inferencing systems is facilitated by use of a (quasi) natural language knowledge representation, and the benefits of isomorphism are enhanced. These advantages of integration apply to all forms of inferencing, including document generation and casebased inferencing. Some principles for development of integrated legal decision support systems are proposed. (shrink)

Bringing the views of Grayling, Moyal-Sharrock and Stroll together, I argue that in On Certainty, Wittgenstein explores the possibility of a new kind of foundationalism. Distinguishing propositional language-games from non-propositional, actional certainty, Wittgenstein investigates a foundationalism sui generis . Although he does not forthrightly state, defend, or endorse what I am characterizing as a "new kind of foundationalism," we must bear in mind that On Certainty was a collection of first draft notes written at the end of Wittgenstein's life. The (...) work was unprogrammatic, sometimes cryptic. Yet, his exploration into areas of knowledge, certitude and doubt suggest an identifiable direction to his thoughts. (shrink)

The philosophies of Ludwig Wittgenstein and Maurice Merleau-Ponty may seem at first glance to be mutually exclusive. On further examination, however, they can be seen to share some fundamental points of view. For instance, they both share a common rejection of a modern mechanistic explanation of nature, and both endorse what we might call a pre-linguistic level of meaning. In this paper, we show that these thinkers not only share some fundamental philosophical views, but also had, for many years, contemplated (...) what cognitive scientists today call “embodied cognition.”.
