Given the rapid growth and emerging trend of e-commerce have changed consumer preferences to buy online, this study analyzes the current Indian legal framework that protects online consumers’ interests. A thorough analysis of the two newly enacted laws, i.e., the Consumer Protection Act, 2019 and Consumer Protection Rules, 2020 and literature review support analysis of 290 online consumers answering the research questions and achieving research objectives. The significant findings are that a secure and reliable system is essential for e-business firms (...) to work successfully; cash on delivery is the priority option for online shopping; website information and effective customer care services build a customer's trust. The new regulations are arguably strong enough to protect and safeguard online consumers' rights and boost India’s e-commerce growth. Besides factors such as security, privacy, warranty, customer service, and website information, laws governing consumer rights protection in e-commerce influence customers’ trust. Growing e-commerce looks promising with a robust legal framework and consumer protection measures. The findings contribute to the body of knowledge on e-commerce and consumer rights protection by elucidating the key factors that affect customer trust and loyalty and offering an informative perspective on e-consumer protection in the Indian context with broader implications. How do we acquire moral obligations to others? The most straightforward cases are those where we acquire obligations as the result of particular actions which we voluntarily perform. If I promise you that I will trim your hedge, I face a moral Obligation to uphold my promise, and in the absence of some morally significant countervailing reason, I should indeed cut your hedge. Moral obligations which arise as a result of wrongdoing, as a function of corrective justice, are typically thought (...) to be of a similar nature. (shrink)

The issue of ‘mandatory publications’ has generated serious flak about its usefulness among the various stakeholders. A lot of debate centers around the question of ‘lack of will’ or ‘lack of skill’ as a reason for the diminishing research interests among the medical faculty in India. In our view, it is the lack of will to publish good quality research which is to be blamed rather than the lack of skill to do good quality research.

The idea to produce the current volume was conceived by Jiirgen Mittelstrass and Robert E. Butts in 1978. Idealist philosophers are wrong about one thing: the temporal gap separating idea and reality can be very long indeed - even ten or so years! Problems of timing were joined by personal problems and by the pressure of other professional commitments. Fortunately, James Brown agreed to cooperate in the editing of the volume; the infusion of his usual energy, good judgement and good-natured (...) promptness saved the volume and made its produc tion possible. Despite the delays, the messages of the papers included in the book have not gone stale. An extremely worthwhile exercise in international philosophical cooperation has come to fruition; the German constructivist philosophical position is here represented in papers in English that will make its contemporary importance available to a larger audience. The editors owe thanks to many persons. All involved in the project owe much to the interest and support of Nicholas Rescher, a friend of the undertaking from the time of its inception. My review of the translations was helped immensely by Andrea Purvis' careful copy editing of the typescript. In two earlier volumes, entitled The Logico-Algebraic Approach to Quan tum Mechanics, I have presented collections of research papers which trace out the historical development and contem porary flowering of a particular approach to physical theory. One might characterise this approach as the extraction of an abstract logico-algebraic skeleton from each physical theory and the reconstruction of the physical theory as construction of mathematical and interpretive 'flesh' on this skeleton. The idea is to show how the specific features of a (...) theory that are easily seen in application arise out of the character of its core abstract structure. In this fashion both the deeper nature of a theory and the deeper differences between theories are penetratingly illuminated. What I would describe as the 'mainstream' logico-algebraic tradition is captured in these two collections of papers. The abstract, structural approach to the characterisation of physical theory has been the basis of a striking transformation, in this century, in the understanding of theories in mathematical physics. There has emerged clearly the idea that physical theories are most significantly characterised by their abstract structural components. (shrink)

A major reason for the emergence of naturalism in philosophy of science in recent years is the rejection of the idea of a priori principles to which science must conform. A naturalistic attitude also underlies the new developments in sociology of science. Traditional sociologists of science believed that the cognitive content of science was beyond their rightful scope. The new sociologists challenge this premise, arguing for the legitimacy of a sociological study of scientific knowledge. They offer an alternative approach to (...) traditional epistemological issues. This has resulted in a debate between philosophers and sociologists. The purpose of this dissertation is two-fold. The first is to examine the issues underlying the debate between naturalist philosophers of science and sociologists of scientific knowledge. The second is to understand the relationship between the two disciplines. ;The second chapter critically examines Laudan's rationalist account of science. He rejects the traditionalist rationalism and the relativism of Kuhn and attempts to establish a position which can avoid the problems that beset these viewpoints. This middle position, I argue, is not viable. The third chapter is concerned with the central claims made by the Edinburgh strong programmers. I discuss and criticize the import of their relativist-symmetrical approach and also their instrumentalism. My argument is that the interest explanation is inadequate because it ignores constraints offered by the natural world. The fourth chapter is a discussion of the issues underlying the debate between naturalist philosophers and sociologists of knowledge. I examine the treatment accorded by both sides to nature, human nature and society in their accounts of science and criticize Giere's normative naturalism. The fifth chapter deals with relativist, constructivist and discourse-analytic trends in the sociology of knowledge. I criticize their anti-realist stance. The sixth chapter is a critical examination of Latour's actor-network model of science and technology which aims to go beyond the rationalist and relativist views discussed earlier. Finally, I examine the relation between philosophy and sociology of science and conclude that fundamental differences remain between them, despite efforts by some philosophers to reconcile these differences. Denis Noble has produced a succinct analysis of the ‘Illusions of the Modern Synthesis’. At the heart of the matter is the place of agency in organisms. This paper examines the nature of conscious agent action in organisms, and the role of affects in shaping agent choice. It examines the dual role these have in shaping evolution, and in the social worlds of scientists that shape evolutionary theory. Its central claim follows Noble, that agency is central to the structure of (...) organisms, and raises careful consideration for the role animal agency and affective evaluations in biology, and in biologists. Efficient prospective motor control, evident in human activity from birth, reveals an adaptive intentionality of a primary, pre-reflective, and pre-conceptual nature that we identify here as sensorimotor intentionality. We identify a structural continuity between the emergence of this earliest form of prospective movement and the structure of mental states as intentional or content-directed in more advanced forms. We base our proposal on motor control studies, from foetal observations through infancy. These studies reveal movements are guided by anticipations of future effects, (...) even from before birth. This implies that these movements, even if they are simple and discrete, are the actions of an intentional agent. We develop this notion to present a theory of the developing organisation of a core feature of cognition as embodied agent action, from early single actions with proximal prospectivity to the complex serial ordering of actions into projects to reach distal goals. We claim the prospective structural continuity from early and simple actions to later complex projects of serially-ordered actions confirms the existence of an ontogenetically primary form of content–directedness that is a driver for learning and development. Its implications for understanding autism are discussed. (shrink)

William Whewell is considered one of the most important nineteenth-century British philosophers of science and a contributor to modern philosophical thought, particularly regarding the problem of induction and the logic of discovery. In this volume, Robert E. Butts offers selections from Whewell's most important writings, and analysis of counter-claims to his philosophy.

This article addresses the claim that some contemporary states may possess obligations to pay reparations as a result of the lasting effects of a particular form of historic imperialism: colonialism. Claims about the harms and benefits caused by colonialism must make some kind of comparison between the world as it currently is, and a counterfactual state where the injustice which characterised so much of historic interaction between colonisers and the colonised did not occur. Rather than imagining a world a world (...) where there was no such interaction, this article maintains that the appropriate counterfactual is one where relations between different communities were characterized by an absence of domination and exploitation. This means that current day states may possess reparative duties which are much more extensive than is often supposed. (shrink)

This book honours David Miller's remarkable contribution to political philosophy. Over the last fifty years, Miller has published an extraordinary range of work that has shaped the discipline in many different areas, including social justice, democracy, citizenship, nationality, global justice, and the history of political thought. His work is characterised by its commitment to a kind of theorising that makes sense to the people who have to put its principles into practice. This entails paying close attention to empirical evidence from (...) the social sciences, but also results in a willingness to take the everyday beliefs of lay people seriously in its theorising. The aim is the construction of a political philosophy that can be radically reformative, but that nonetheless is justifiable and realisable here and now. This book brings together a range of papers from leading political theorists concerning many different aspects of Miller's work, on topics including national responsibility and global justice, self-determination, collective responsibility, human rights, immigration, market socialism, national identity, citizenship, multiculturalism, public goods, the political thought of David Hume, and the methodology of political philosophy. It includes a chapter by Miller himself, which develops his own distinctive approach to political theorising. The volume concludes with a complete bibliography of David Miller's published work. Although the birth and early life of an infant is similar throughout the world, meanings ascribed to infants differ according to cultural values and beliefs. This essay describes how scholars and healers have come to see the infant as distinct from other types of people, and what implications this distinction carries for how health care is practiced. The first portion of this essay explores how understanding of the infant, particularly the well-accepted notion of “normal” infant growth and development, came to (...) prominence. Drawing from the history of medicine, philosophical thought and colonial practice, this essay demonstrates that the roots of thinking about the infant in terms of his growth are deep and well-defined in North American and European ideologies. The second portion of this essay describes the practical applications and political implications of beliefs about the “normal” infant. In the arena of applied health, policy makers measure infant growth in light of assumptions about the “normal.” A case study of indigenous populations in Irian Jaya, Indonesia, shows that these measurements are highly political. Here government health officials create and manipulate statistics to ensure that indigenous infant health is represented as being below “normal.” The “normal” infant can thus be understood as a subtle and effective construct which, in Irian Jaya, at the least, is used to assimilate indigenous people into the nation-state. Earl Conee and Richard Feldman claim that mentalism identifies the core of internalist epistemology. This is what I call identifying ur-internalism. Their version of ur-internalism differs from the traditional one ? viz., accessibilism ? by not imposing requirements stipulating that subjects must have reflective access to facts which justify their beliefs for these beliefs to be justified. Instead, justification simply supervenes on the mental lives of subjects. I argue that mentalism fails to establish itself as ur-internalism by demonstrating that the (...) strong supervenience claim used by Conee and Feldman is consistent with cognitive externalism (often called ?the extended mind hypothesis?). Briefly, cognitive externalism claims that the mental states themselves (rather than their contents) constitutively depend on factors outside the bodily individual. Given this possibility, I claim Conee and Feldman's supervenience principle no longer suits the purposes to which they put it. (shrink)

Understanding People provides an overview and critique of current psychological assumptions about people and what differentiates them, and replaces them with a set of ideas taken from social constructionism. It begins with an examination of contemporary theories, then explores the critique of the social constructionists, before laying out the basis of an understanding of human action and behavior, drawing on phenomenology and personal construct theory. Using everyday experience to illustrate the issues in personality theory (Is behavior situation-specific? Why do we (...) have a sense of self? Is there an unconscious?), this book will breathe life into an area of psychology that is so often arid, and, in the eyes of students, divorced from their world. (shrink)

A typical view of Leibniz’ extraordinary metaphysical and methodological views is to regard them as having appeared by certain “applications” of his mathematical and physical discoveries. If we believe Couturat and Russell the monadology is largely only the expression of certain logically formal relationships: it is the logic of Leibniz that is basic to his mature metaphysics. Even more typical is the view that Leibniz’ work in mathematics, especially his work on the calculus, is the source of the key ideas (...) in his metaphysics. J. M. Child, the translator of the early mathematical manuscripts, says it straight out: “ … the main ideas of [Leibniz’] philosophy are to be attributed to his mathematical work, and not vice versa.” In a philosophically much more interesting way Paul Schrecker argues that what he calls Leibniz’ “infinitesimal method,” a method obviously derived from his mathematical work, pervades all of the important basic contributions of both his metaphysics and methodology. This article explores the ethical architecture of the ‘beneficiary pays’ principle, which holds that agents can come to possess remedial obligations of corrective justice to others through the involuntary receipt of benefits stemming from injustice. Advocates of the principle face challenges of both persuasion and limitation in seeking to convince those unmoved of its normative force, and to explain in which cases of benefiting from injustice it does and does not give rise to rectificatory obligations. The article considers ways in (...) which advocates of the principle might seek to win over those sceptical of its merits by employing a modified principle which sidesteps the issue of enforceability, before considering the question of whether the argument can be expanded from cases of benefiting from wrongdoing specifically to other sorts of situation where one agent involuntarily benefits from another's loss. Jaswal & Akhtar's outstanding target article identifies the necessary social nature of the human mind, even in autism. We agree with the authors and present significant contributory origins of this autistic isolation in disruption of purposeful movement made social from infancy. Timing differences in expression can be misunderstood in embodied engagement, and social intention misread. Sensitive relations can repair this.

Consciousness directs the actions of the agent for its own purposive gains. It re-organises a stimulus-response linear causality to deliver generative, creative agent action that evaluates the subsequent experience prospectively. This inversion of causality affords special properties of control that are not accounted for in integrated information theory, which is predicated on a linear, deterministic cause-effect model. IIT remains an incomplete, abstract, and disembodied theory without explanation of the psychobiology of consciousness that serves the vital agency the organism.

Alasia Nuti’s recent book Injustice and the Reproduction of History: Structural Inequalities, Gender and Redress puts forward a compelling vision of contemporary duties to redress past wrongdoing, grounded in the idea of “historical-structural-injustice”, constituted by the “structural reproduction of an unjust history over time and through changes”. Such an approach promises to transcend the familiar scholarly divide between “backward-looking” and “forward-looking” models, and allow for a reparative approach that focuses specifically on those past wrongs that impact the present, while retaining (...) a significant focus on the historical. While Nuti’s work is perhaps the most sophisticated treatment of structural injustice to date, this paper argues that an exclusive concentration on historical-structural-injustices neglects some aspects and some acts of wrongdoing that call out for present-day redress. What is needed, therefore, is a pluralist theory that can accept the pressing force in the present of historical-structural-injustices, whilst also making room for past-regarding duties that either do not fit, or are not best conceptualized in terms of, this approach, without being overwhelmed by the sheer scale of historic injustice. The aftermath of war is always messy and complicated. When should objects or resources that were unjustly taken in wartime be returned to the victims of misappropriation, or their heirs? This article advances two arguments that are intended to buttress claims for the restitution of property in general, and particularly claims advanced by the heirs of the original victims of misappropriation.

The history of international relations is characterized by widespread injustice. What implications does this have for those living in the present? Should contemporary states pay reparations to the descendants of the victims of historic wrongdoing? Many writers have dismissed the moral urgency of rectificatory justice in a domestic context, as a result of their forward-looking accounts of distributive justice. Rectifying International Injustice argues that historical international injustice raises a series of distinct theoretical problems, as a result of the popularity of (...) backward-looking accounts of distributive justice in an international context. It lays out three morally relevant forms of connection with the past, based in ideas of benefit, entitlement and responsibility. Those living in the present may have obligations to pay compensation insofar as they are benefiting, and others are suffering, as a result of the effects of historic injustice. They may be in possession of property which does not rightly belong to them, but to which others have inherited entitlements. Finally, they may be members of political communities which bear collective responsibility for an ongoing failure to rectify historic injustice. Rectifying International Injustice considers each of these three linkages with the past in detail. It examines the complicated relationship between rectificatory justice and distributive justice, assesses the appropriateness of judging the past by contemporary moral standards, and argues that many of those who resist cosmopolitan demands for the global redistribution of resources have failed to appreciate the extent to which past wrongdoing undermines the legitimacy of contemporary resource holdings. Today a failure of the physical sciences accompanies a failure of the social sciences; and the failure of both consists in part in this: in the lack of a fully-developed and implemented sense of social responsibility. Both have denied guilt for their shortcomings in this respect: advancing rationalizations to the effect that social reform is not the task of science; that objectivity suffers if such motivations are allowed to become involved; and that science makes its most valuable contributions to social (...) welfare rather by maintaining a strict laboratory manner of impartiality. Implied often, as well, is the conclusion that not science itself but the misuse of science; not the patience and care of science itself but the impatience and carelessness of non-scientists is responsible for the miscarriage of its contributions.
