This article describes the Vaccine/Injury Project Corpus, a collection of legal decisions awarding or denying compensation for health injuries allegedly due to vaccinations, together with models of the logical structure of the reasoning of the factfinders in those cases. This unique corpus provides useful data for formal and informal logic theory, for natural-language research in linguistics, and for artificial intelligence research. More importantly, the article discusses lessons learned from developing protocols for manually extracting the logical structure and generating the logic (...) models. It identifies sub-tasks in the extraction process, discusses challenges to automation, and provides insights into possible solutions for automation. In particular, the framework and strategies developed here, together with the corpus data, should allow “top–down” and contextual approaches to automation, which can supplement “bottom-up” linguistic approaches. This article describes a notion of learning as adaptive semiotic-growth. In line with the theme of this special issue, learning will be approached on a broad ecological and evolutionary continuum – most generally expressed as a form of adaptation to the environment. Viewing learning through the criterion of signification (semiosis) means that learning is continuous across the entire biological realm. Both the life process and the learning process are expressed through forms of semiotic-engagement and involve continual adaptation and meaning-making. Thus, (...) learning cannot be seen as unique to humans. Learning is more broadly ecological before it is “cultural”. From here we can imagine educational institutions as forms of exaptation, that evolved naturally to channel learning more effectively. Thinking of learning on an ecological continuum means that learning cannot be “located” or pinned down easily in educational research or practice. Rather, learning has a sporadic identity; it is emergent in the specificity of events and must be discerned within the practices that enact it. Realizing learning as something emergently enacted in the educative encounter, and not something that can be determined and implemented, allows us to resist turning learning into an accountability tool that can easily be used towards ideological ends. Epistemic instrumentalists face a puzzle. In brief, the puzzle is that if the reason there is to believe in accord with the evidence depends, as the instrumentalist says it does, on agents’ idiosyncratic interests, then there is no reason to expect that this reason is universal. Here, I identify and explain two strategies instrumentalists have used to try and solve this puzzle. I then argue that we should find these strategies wanting. A divide exists in the creativity literature as to whether relatively more or less executive processing is beneficial to creative thinking. To explore this issue, we employ an individual differences perspective informed by dual-process theories in which it is assumed that people vary in the extent to which they rely on autonomous or controlled processing . We find that those more willing and/or able to engage Type 2 processing are more likely to successfully make creative connections in tasks requiring the (...) unification of disparate elements and the novelty of generated items, but not in some other indices of creativity, namely, cognitive flexibility and fluency. Implications for the role of executive processing in creative thinking are discussed in the context of DPTs. We situate the ability to make remote connections alongside other advanced higher order thinking capabilities that are unique to humans. (shrink)

This Article aims to draw the connection between how we conceptualize legal rights over information resources and our capacity to develop technologically neutral legal norms in the information age. More specifically, it identifies and critically examines three competing approaches to the idea of technological neutrality apparent in copyright jurisprudence. Ultimately, it is argued that true technological neutrality requires not simply the seamless expansion of legal rights into new technological contexts, but the careful, contextual recalibration of rights and interests in light (...) of shifting values and changing circumstances. As a normative principle, technological neutrality in copyright law thus demands a nuanced and relational understanding of the rights at play, and the social values that they seek to foster as technologies evolve. From the very beginning German dentists and their scientific and professional organizations were involved in the disastrous developments following the Nazi assumption of power of 1933. After purging and both organisational and ideological streamlining which had been comparatively rapidly accomplished in 1933/34 a development started which was characterized by extreme professional confrontation and lust for power in close entanglement with Nazi health policy objectives and deformation of scientific dentistry. A decisive role was assigned to the Reichszahnärzteführer Ernst Stuck (1893-1974) who (...) was the highest representative of the dental profession throughout the Nazi Regime. However, up to the present his life and position has not been thoroughly researched. What is more, history of dentistry has been looking at his activities in a merely cursory and appeasing way.In fact, his function as Reichszahnärzteführer needs to be critically scrutinized and evaluated. In an article in the Journal of Philosophical Logic in 1996, "Towards a Model Theory of Venn Diagrams,", Hammer and Danner proved the full completeness of Shin's formal system for reasoning with Venn Diagrams. Their proof is eight pages long. This note gives a brief five line proof of this same result, using connections between diagrammatic and sentential representations.

This paper addresses and proposes to resolve a longstanding problem in the philosophy of physics: whether and in what sense Albert Einstein’s Chasing the Light thought experiment was significant in the development of the theory of special relativity. Although Einstein granted this thought experiment pride of place in his 1949 Autobiographical Notes, philosophers and physicists continue to debate about what, if anything, the experiment establishes. I claim that we ought to think of Chasing the Light as Einstein’s first attempt to (...) problematize the very idea of the electromagnetic ether frame, and that it thereby contributed to his eventual adoption of one of special relativity’s two foundational axioms: the “light postulate”. This interpretation requires the assumption that Einstein had presupposed special relativity’s other axiom, the “principle of relativity”, when initially considering Chasing the Light. This argument is novel insofar as it provides evidence that such a presupposition by Einstein is both conceptually and historically plausible. Moreover, this paper directly challenges John D. Norton’s compelling claim that Chasing the Light is best understood as a refutation of emission theories of light propagation; while both interpretations of the experiment are conceptually coherent, I argue that the interpretation found in this paper is supported more straightforwardly by historical evidence. Georges-Éugene Haussmann, Emperor Napoléon III’s Prefect of the Seine, had in 1853 been tasked with modernizing the city. This essay combines deconstruction (chiefly the later work of Jacques Derrida) and systems theory (both social and biological systems theory) to rethink the question of ecological poetics in the work of Wallace Stevens, and in particular some of his most important poems that focus on birds and bird song. Ecocriticism has typically approached literature in general and poetry in particular in terms of its representation of nature. This essay argues for a non-representationalist ecopoetics that derives from replacing the concept of (...) “nature” with the systems theory concept of “environment” (a term that applies equally to human and non-human forms of life). This theoretical shift allows us, in turn, to better understand the relationship of poetry and poetics to the “worlds” in which humans and non-humans live (to borrow the term that stretches from Jakob von Uexküll to Heidegger and then to Derrida). A number of philosophers have claimed that non-evidential considerations cannot play a role in doxastic deliberation as motivating reasons to believe a proposition. This claim, interesting in its own right, naturally lends itself to use in a range of arguments for a wide array of substantive philosophical theses. I argue, by way of a counterexample, that the claim to which all these arguments appeal is false. I then consider, and reply to, seven objections to my counterexample. This paper traces the development of enactive concepts of value and normativity from their roots in the canonical work of Varela et al. through more recent works of Ezequiel Di Paolo and others. It aims to show the central importance of these concepts for enactive theory while exposing a potentially troublesome ambiguity in their definition. Most definitions of enactive normativity are purely proscriptive, but it seems that enactive theories of cognitive agency and experience demand something more. The question of what makes a ‘law’ distinct from other kinds of rules and social norms – often called the project of ‘conceptual jurisprudence’ – gives rise to a classic debate in modern legal theory. The debate has historically centred on the competing Western views of (i) natural law theory and (ii) legal positivism. Meanwhile, the ancient Chinese school of thought known as ‘Legalism’ (法家) has remained an under-explored branch of Eastern philosophy, despite its many insights into the nature of (...) government and legal systems. This paper argues that Legalism, when interpreted as a system of conceptual jurisprudence, offers a genuine alternative to both of the dominant Western theories. It achieves this by invoking normative reasoning to conceptually distinguish ‘laws’ from other sorts of rules at the most fundamental level of analysis, but also by doing so without any necessary reference to notions of morality. This unique characteristic of Legalism is introduced in this paper as ‘form prudentialism’. (shrink)

This book has two main tasks: (1) to call attention to the special challenges presented by our experience of affect—all varieties of pleasure and pain—and (2) to show how these challenges can be overcome by an “enrichment approach” that understands affect as the enrichment or deterioration of conscious activity as a whole. This “enrichment approach” draws from Alfred North Whitehead as well as the pragmatists John Dewey and William James, all of whom thought of affect as a fundamental aspect of (...) experience rather than a special class of feelings. It also draws from recent scientific research that suggests that the dynamic repertoire of consciousness can change, effectively expanding and contracting our capacity to feel. Weaving these perspectives together, the book develops a theory that accounts for the peculiar phenomenology of affect and sheds new light on a diverse range of experiences, from everyday pleasures and pains to the special satisfactions of the arts and religious festivity. This article shows Sigonius' emendation to be fatally flawed, however, and popular election to be a legal requirement for senatorial enrollment – and not just a social desideratum. This prerequisite is shown to originate in the fourth-century lex Ovinia, with ramifications for models of aristocratic rule at Rome, mid-Republican (...) political developments, and the curia itself. Although the work of Henri Lefebvre has become better known in the English speaking world since the 1991 English translation of his 1974 masterpiece, The Production of Space, his influence on the actual production of space, of architecture and the city, has been less pronounced. Even if he is now widely read in schools of architecture, planning and urban design, Lefebvre's message for practice remains elusive; inevitably so because the entry of his work into the consciousness of the Anglosphere has (...) come with repression of the two most challenging aspects of his thinking: romanticism and utopia, which simultaneously confront modernity while being progressive. Arguably, contemporary discomfort with romanticism and utopia obstructs movement of Lefebvre's thinking from being an object of theoretical interest to actually influencing practice. Utopia is the lynchpin of Lefebvre's enterprise. Understanding and acting upon architecture and the city with Lefebvre but without utopia impoverishes his theoretical construct. His ideas on practice and the methods he elaborated are fundamentally utopian. Although utopia may seem to have no place in the present, Lefebvre reveals this as little more than a self-serving affirmation that 'there is no alternative' to social and political detachment. Demanding the impossible may end in failure but doing so is the first step towards other possibilities. To think about Lefebvre is to think about utopia, and thinking about utopia when thinking with Lefebvre is to make contact with what is most enduring about his project for the city and its inhabitants, and with what is most radical about it as well. Lefebvre for Architects offers a concise account of the relevance of Henri Lefebvre's writing for the theory and practice of architecture, planning and urban design. Assassins are often regarded as ahistorical figures of evil. In this article, I contest this view by analysing the assassination of President William McKinley by Leon Czolgosz in 1901. There are two purposes to this article. The first is to situate McKinley’s assassination within the history and development of the social sciences, principally sociology, rather than assume that the assassin is a trans-historical representation of willful irresponsibility. On January 18, 2006, the United States Supreme Court unanimously held that the constitutional challenge to New Hampshire's Parental Notification Prior to Abortion Act would be remanded to the United States Court of Appeals for the First Circuit, to determine whether the Court of Appeals could, consistent with New Hampshire's legislative intent, formulate a narrower remedy than a permanent injunction against enforcement of the parental notification law in its entirety.In 2003, New Hampshire enacted the Parental Notification Prior to Abortion Act.
