The article is an extended review of the The Deacon Reader. The fourteen papers in this volume address historical, theological, pastoral and spiritual aspects of the modern Roman Catholic diaconate as developed in the United States. These papers are of mixed quality, and also illustrate the difficulties which supporters of the diaconate experience in developing a coherent theology and praxis of the diaconate. In contrast with several recent major Anglican and Lutheran approaches to the diaconate, these North American reflections (...) have yet to come to terms with the implications for the diaconate of the new linguistic profile of diakonia provided by the reviewer’s 1990 study Diakonia: Re-interpreting the Ancient Sources. The Confessio Belgica and the three offices: Article 30 inflexible? The Confessio Belgica or Dutch Confession of Faith from 1561, one of the Three Formulas of Unity in the Dutch Reformed tradition, confesses in article 30 that the government of the church, as an institution of the Christian faith, should be spiritual and conducted by chosen consistories. These consistories should consist of ministers, elders and deacons. The norm or constant of three offices was excepted by churches in this tradition, but (...) more recently it’s necessity and efficiency became questioned in some of these circles. Historically the three offices served the Reformed churches well. The acceptance of the three offices is based on the Confessio Belgica as a confession, but also on the biblical principle that Christ is the head of the church and its highest Prophet, eternal King and only Priest. The church grows spiritually out of Christ and his Spirit as their head. In this process, the church also uses the offices of minister, elder and deacon as instruments. These offices correspond with the offices of Christ as their Prophet, King and Priest. A study of the Confessio Belgica article 30 leads to the belief that it does not exclude changes in the task of the three offices nor opposes the addition of extra offices or the help of additional functionaries. Contribution: This article contributes theologically to the debate in the Dutch [ Netherlands ] Reformed churches on the offices in church. It tries to clarify all the thinking regarding the impact of the reformed Three Formulas of Unity, and especially the Dutch Confession of Faith article 30 on the work or service of the church and norms or principles to achieve an acceptable functioning of the offices in church. Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

This article contains observations on the first Dutch ecumenical introduction to a special sector of practical theology: the service of the church to the poor. The book targets students of what is known as ‘Diakonie’ in German and ‘diaconie’ in Dutch, as well as those already engaged in social work in ecclesial contexts. In German and Dutch church circles ‘Diakonie/diaconie’ designates the churches’ social work. Originally the usage was Protestant but is now increasingly Roman Catholic. Papers in the first part (...) present perspectives on social services provided by the churches. The papers cover the seven classical works of mercy – plus a new one . Then the book presents accounts of the different visions on social work in the different Dutch churches. A special chapter reports on social engagements among other religions like Judaism, Islam and Hinduism. Papers in the second part are more technical, covering such topics as the biblical roots of social work and relationships between‘diaconie’and central ecclesial activities like liturgy and catechesis. The editors of this book recognize the need for much further reflection among both contributors and readers. Although the book is presented as an ecumenical enterprise, Protestant views of the church’s social engagement predominate over Roman Catholic. An telling illustration of this is their treatment of deacons in church history and contemporary Catholic thought. In the early Church and in contemporary Catholic thinking there is a dynamic relationship between the social role of deacons and their role in liturgy and ministry of the word. Although often presented in German circles as lowly servants, deacons in early Christianity were something different. An important book by the Australian scholar J. N. Collins shows that the meaning of the Greek word diakoniachanges according to context – the term can be called a ‘floater’. Worth stressing is that according to Collins – and I think rightly – the ancient diakonianever expresses the notion of loving and caring service. If this proves to be correct – and scholarly opinion is moving in this direction – the editors will need to give some thought to revising their concept of diaconie. (shrink)

Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience. The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology further (...) and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. I argue that legitimacy discourses serve a gatekeeping function. They give practitioners telic standards for riding herd on social practices, ensuring that minimally acceptable versions of the practice are implemented. Such a function is a necessary part of implementing formalized social practices, especially including law. This gatekeeping account shows that political philosophers have misunderstood legitimacy; it is not secondary to justice and only necessary because we cannot agree about justice. Institutions undertake a huge variety of constitutive purposes. One of the roles of legitimacy is to protect and promote an institution’s pursuit of its purpose; state legitimacy is generally understood as the right to rule, for example. When considering legitimacy beyond the state, we have to take account of how differences in purposes change legitimacy. I focus in particular on how differences in purpose matter for the stringency of the standards that an institution must meet in order to be legitimate. (...) An important characteristic of an institution’s purpose is its deontic status, i.e. whether it is morally impermissible, merely permissible, or mandatory. Although this matters, it does so in some non-obvious ways; the mere fact of a morally impermissible purpose is not necessarily delegitimating, for example. I also consider the problem of conflicting, multiple, and contested institutional purposes, and the different theoretical roles for institutional purpose. Understanding how differences in purpose matter for an institution’s legitimacy is one part of the broader project of theorizing institutional legitimacy in the many contexts beyond the traditional context of the state. Courts and jurors sometimes refuse to assign liability to defendants on the basis of statistics alone, despite their apparent reliability. I argue that this refusal is best understood as a recognition of defendants’ right to security. Understood as a robust good in Philip Pettit’s sense, security requires that someone risking harm to others’ protected interests adopt a disposition of concern that controls against wrongfully harming them. Since trials risk harm, the state must adopt such a disposition. Statistics leave open the (...) possibility of innocence and so wrongful harm in a way that the state cannot ignore; if it does use such statistics, it makes defendants wrongfully insecure. This explanation of the problem of bare statistical evidence is especially apt because security grounds the right to a fair trial and judicial procedural rights more generally. (shrink)

I argue for a new conception of practical authority based on an analysis of the relationship between authority and subject. Commands entail a demand for practical deference, which establishes a relationship of hierarchy and vulnerability that involves a variety of signals and commitments. In order for these signals and commitments to be justified, the subject must be under a preexisting duty, the authority’s commands must take precedence over the subject’s judgment regarding fulfillment of that duty, the authority must accept the (...) position and responsibilities of command, and the authority must be sufficiently trustworthy relative to how vulnerable the subject makes herself by deferring. This results in an instrumentalist conception of practical authority that can be favorably compared to Joseph Raz’s famous service conception. The relational conception’s main advantage is that it focuses on the authority as much as the subject, requiring that the authority accept responsibility for the relationship and be sufficiently trustworthy. (14쪽) 『징비록』은 조선 선조 때 영의정을 지낸 서애(西厓) 류성룡이 집필한 임진왜란(壬辰倭亂)의 전란사입니다. 제목인 징비(懲毖)는 『시경(詩經)』 「소비편(小毖篇)」의 “예기징 이비후환(豫基懲 而毖後患)”, 즉 내가 경계함은 후환을 삼가기 위함이라는 구절에서 한 글자씩 따왔습니다. (…) 그는 임진왜란 당시의 참담한 상황을 기록하면서, 동시에 난이 일어나기 이전의 일도 기록해 그 원인이 어디에 있었는지를 밝히려고 했습니다. (31~32쪽) 세상의 중심에 서서 세상을 이어주는 것이 바로 인문 정신이며 시민의 지혜라고 생각합니다. 시민의 지혜로 세상을 바라볼 때, 논쟁이 화쟁적 대화로 이어질 때, 갈등과 분쟁은 더 이상 문제 상황이 아니라 더 큰 진리가 드러나는 에너지요, 기회가 될 것입니다. (97쪽) 톨스토이는 ‘어떻게 살 것인가’라는 질문에 대한 답을 작품을 통해 보여주게 되는데요, 그 답은 바로 ‘성장’입니다. 성장이란 인간이 끊임없는 성찰과 학습을 통해 자기완성에 도달하는 과정입니다. 톨스토이는 성장에 대해 “끊임없이 보다 나은 사람이 되어가는 것”이라고 이야기합니다. (99~100쪽) 개인의 사소한 사정은 더더욱 표현하기 어렵습니다. 사회적인 문제들을 표현하기 위해서는 연대도 가능하고 협력도 가능합니다. 그러나 자기 안에 있는 문제는, 실제로 모든 사람들이 똑같이 느끼고 있음에도 불구하고 연대가 불가능하고 협력도 어렵습니다. 바로 그 사이에 다리를 놓고 협력할 수 있도록 해주는 것이 문학입니다. 또한 그것들을 표현할 말을 만들어내고, 그것들을 표현하기 위해 어떤 특별한 세계를 개발하고 또 그것들을 전파할 수 있도록 약속하는 것이 문학입니다. 그리고 그 문학의 전위가 바로 시(詩)이며, 시가 바로 그 일을 합니다. (135쪽) 아내가 “삶은 상처다”라고 아주 멋진 말을 하더군요. 그리고 삶은 상처를 치유하는 과정이라고 덧붙였습니다. 일상은 늘 상처를 만들고 상처와 만나고 그 상처를 조금씩 치유해주고 가라앉혀주는 것이라고요. 진짜 삶은 누구에 의해 혹은 누구의 규범과 교훈에 종속되어 노예로 사는 것이 아니라 자기 자신으로 살아가는 것입니다. (…) 실존의 존엄성을 우주의 그 누구도 모독할 수 없습니다. (154~155쪽) 우리는 우리의 행동이 어떤 경로를 거쳐 어떤 결과를 가져올지 알아야 하고, 그 결과에 따른 책임도 져야 합니다. 그것이 오늘날 우리에게 필요한 윤리입니다. 그러려면 선한 동기만이 아니라 지식도 있어야 하고, 능력도 있어야 합니다.
