Individual questions of the institutional reforms of the representative-democratic parliamentary system, such as issues of electoral law, party law, and parliamentary law, are frequently discussed. But all these reflections - and this is the principal thesis of this article - must eventually remain without success, if they do not address the preceding basic problem concerning the democratically indispensable conditions of the mental constitution of the active citizen, the „civis“. There, a key role, consciously experienced like a paradox, falls upon the (...) renunciation of the claim to absolute truth of one’s own political convictions with regard to equally „relative-absolute“ claims for validity of others. On this base the psychological presuppositions of a modern pluralistic democracy are discussed, which thereupon are to be institutionalized: e. g. the capacity to compromise, the obligation of state neutrality in religious matters, the renunciation of hate speech, the rejection of „denial of reality“, and of allegedly „finalizing“ ideologies of history. Wedelstaedt überzeugend, warum Zustimmung zwar „die Bedingung für die Legitimation von Sex“ ist (2020, 127), dass die moralische Güte von Sex aber nur dann einzuschätzen ist, wenn wir darauf achten, ob die Beteiligten der Handlung sich auf Augenhöhe begegnen. Die Idee ist: Es gibt legitime sexuelle Handlungen, die moralisch gut sind, und es gibt legitime sexuelle Handlungen, die moralisch besser sind. Hier möchte ich die Idee des besseren Sexes genauer ausloten. Während (...) v. Wedelstaedt von moralisch gelungenem Sex spricht und somit auf der Ebene der moralischen Bewertung von Sex bleibt, möchte ich die Frage danach stellen, was Sex qualitativ gut macht. Tatsächlich wird in der Zustimmungsdebatte meist davon ausgegangen, dass diese zwei Fragen wenig gemeinsam haben; ob eine sexuelle Handlung legitim ist, hat zunächst nichts damit zu tun, ob diese auch gut ist. Ich werde drei Argumente liefern, warum wir legitimen Sex und qualitativ guten Sex zusammen betrachten sollten – und es wird sich zeigen, dass die gegenwärtige philosophische und rechtstheoretische Debatte Zustimmung verkürzt diskutiert und daher alleingenommen wenig hilfreich ist, stattdessen benötigt die Zustimmungsdebatte auch eine Untersuchung von qualitativ gutem Sex. This paper takes the view that compensated donation and altruism are not incompatible. In particular, it holds that the arguments against giving compensation stand on weak rational grounds: the charge that compensation fosters “commodification” has neither been specific enough to account for different types of monetary transactions nor sufficiently grounded in reality to be rationally convincing; although altruism is commendable, organ donors should not be compelled to act purely on the basis of altruistic motivations, especially if there are good (...) reasons to believe that significantly more lives can be saved and enhanced if incentives are put in place, and offering compensation for organs does not necessarily lead to exploitation—on the contrary, it may be regarded as a necessity in efforts to minimise the level of exploitation that already exists in current organ procurement systems. In prosecuting the war on terror, the Bush Administration asserts that the protections inherent in state sovereignty do not apply to state sponsors of terrorism. I examine three elements of normative arguments to assess the administration's policies. The administration sought to delegitmize terrorism by underscoring the uncivilized nature of terrorist acts. It sought to link the war on terror to efforts to prohibit the spread of weapons of mass destruction (WMD), and to frame the invasion of Iraq as central (...) to this war. Finally, the administration proposed new international standards of behavior by arguing that state sponsors of terrorism should be held accountable for terrorist acts planned on their territory, and by seeking to link the protections against intervention inherent in the sovereignty norm to this behavior. Despite initial support for delegitmizing terrorism, the US attempt to frame the war on terror as linked to WMD and Iraq met with skepticism, and it faced fierce competition from alternate frames with regard to Iraq. Finally, the invasion of Iraq stimulated resistance to US policy on normative grounds, with particular concern about the consequences for the sovereignty norm. (shrink)

A significant proportion of states grants constitutional recognition to a single religion, leaving various other religions within society constitutionally unrecognised. Many philosophers believe that this is problematic even when such recognition is (almost) wholly symbolic. The four most common and prima facie plausible objections to what I call ‘mono-recognition’ are that it alienates citizens who do not adhere to the constitutionally recognised religion; that it symbolically subordinates these individuals; that it reinforces oppressive social hierarchies; and that it violates principles of (...) justificatory neutrality. This article shows that none of these objections establish that mono-recognition is wrong within contemporary societies—or even merely pro tanto wrong. However, it goes on to propose a novel argument that does suggest that this type of religious establishment is pro tanto wrong within most societies, if not all. According to this argument, which I refer to as the ‘desire-based objection’, mono-recognition is pro tanto wrong when it fails to accommodate at least some citizens (a) who desire constitutional recognition of their unrecognised religion on morally reasonable, or simply not unreasonable, grounds or who would do so if they were to independently ponder the possibility of receiving such recognition without having to fear any social backlash that receiving it might cause and (b) whose religion is entitled to constitutional recognition based on the size of its population within society; the societal contributions of its members; and any injustices that its members have suffered at the hands of the state or the wider society. As I show, even when one particular religion has the strongest claim to constitutional recognition, this does not normally justify granting sole recognition to it given that the weaker claims of other religions could be accommodated under a system whereby state religions are rotated and recognised for different durations depending on the strength of their claims. This commentary sides with Pessoa and his colleagues in arguing that some types of perceptual filling-in are linked with a spread of cortical activity, a hypothesis that has often been rejected on philosophical grounds. Some recent data are discussed that strengthen this linking hypothesis and indicate that a spread of cortical activity may be essential for normal surface perception.

BackgroundUnder COVID-19 pandemic, many organizations developed guidelines to deal with the ethical aspects of resources allocation. This study describes the results of an argument-based review of ethical guidelines developed at the European level. It aims to increase knowledge and awareness about the moral relevance of the outbreak, especially as regards the balance of equity and dignity in clinical practice and patient’s care. MethodAccording to the argument-based review framework, we started our research from the following two questions: what are the ethical (...) principles adopted by the ethical guidelines produced at the beginning of the COVID-19 outbreak related to resource allocation? And what are the practical consequences in terms of 'priority' of access, access criteria, management of the decision-making process and patient care?ResultsTwenty-two ethical guidelines met our inclusion criteria and the results of our analysis are organized into 4 ethical concepts and related arguments: the equity principle and emerging ethical theories; triage criteria; respecting patient’s dignity, and decision making and quality of care.ConclusionFurther studies can investigate the practical consequences of the application of the guidelines described, in terms of quality of care and health care professionals’ moral distress. Image is not just matter but also form, and computer processing in AI makes it possible to grasp this form by linguistic means (logico-mathematical languages). The synthesis of animated images has made it possible to represent metamorphoses, the thought of the unexpected. Resumen Este trabajo consiste en un análisis histórico de textos que proceden de un expediente archivístico de Cartagena de Indias entre 1715 y 1717. Los autos son textos administrativos que poseen diversas funciones en las relaciones institucionales entre metrópoli y colonias, tal como la de “emitir opinión”. En la tipología textual indiana, esta función se denomina consulta o parecer, y se caracteriza por el uso de un predicado de tipo doxástico. Para el análisis hemos adoptado las perspectivas teóricas del análisis (...) histórico del discurso y de la sociopragmática histórica. El estudio se completa con un análisis cuantitativo que permite resaltar cuáles son los rasgos lingüísticos a los que se vincula la intensificación y la atenuación en el subtipo debate dentro del registro legal en el español de la Cartagena del siglo XVIII. La conclusión sugiere que los recursos lingüísticos encontrados aumenta la intención persuasiva de la argumentación característica de los autos cartagineses. (shrink)

In this paper, I argue that, despite the progress made in recent years, virtue argumentation theory still lacks a more systematic acknowledgment of other-regarding virtues. A fuller recognition of such virtues not only enriches the field of research of virtue argumentation theory in significant ways, but also allows for a richer and more intuitive view of the virtuous arguer. A fully virtuous arguer, it is argued, should care to develop both self-regarding and other-regarding virtues. The argument from design stands as one of the most intuitively compelling arguments for the existence of a divine Creator. Yet, for many scientists and philosophers, Hume's critique and Darwin's theory of natural selection have definitely undermined the idea that we can draw any analogy from design in artifacts to design in nature. Here, we examine empirical studies from developmental and experimental psychology to investigate the cognitive basis of the design argument. From this it becomes clear that humans spontaneously (...) discern purpose in nature. When constructed theologically and philosophically correctly, the design argument is not presented as conclusive evidence for God's existence but rather as an abductive, probabilistic argument. We examine the cognitive basis of probabilistic judgments in relationship to natural theology. Placing emphasis on how people assess improbable events, we clarify the intuitive appeal of Paley's watch analogy. We conclude that the reason why some scientists find the design argument compelling and others do not lies not in any intrinsic differences in assessing design in nature but rather in the prior probability they place on complexity being produced by chance events or by a Creator. This difference provides atheists and theists with a rational basis for disagreement. (shrink)

Ethical arguments about caregiver responsibility and the limits of client autonomy rely on best evidence about the risks and benefits of medical interventions. But when the evidence is unclear, or when the peer-reviewed literature presents conflicting accounts of the evidence, how are clinicians and their clients to recommend or decide the best course of action? Conflicting evidence about the outcomes of home and hospital birth in the peerreviewed literature offers an opportunity to explore this question. We present the contrary (...) evidence and describe the social and cultural elements that influence the production of the science of birth, including professional, publication, and critical bias. We then consider how the science of birth has been used an misused in making ethical arguments about preferred place of birth. We conclude with a number of recommendations about the responsible use of the evidence, arguing for an “ethics of information” that can be drawn on to guide caregivers and clients in the use of evidence for clinical decision making. Situationists maintain that psychological evidence (e.g., the well-known Good Samaritan experiment) challenges a key assumption of virtue ethics, namely that virtuous people display cross-situational consistency of behavior. This situationist critique is frequently thought to pose a serious threat to virtue ethics. Virtue ethicists have so far mainly put forward conceptual rather than empirical arguments against situationism. In this paper, we examine the extent to which a plausible empirical argument can be developed against situationism, and in favor of virtue ethics. (...) We note that such an argument will naturally entail empirical simplification, and consequently concessions from both sides of the debate will be required. We argue, however, that with such concessions in place, the debate between situationists and virtue ethicists can be captured by a claim about the way that virtuous behavior may change when situations change. We report the results of an experiment (conducted twice, for replication) showing how social science methods can be introduced to the situationism debate to test such a claim empirically. Our results offer tentative support for eudaemonist and agent-based varieties (but not for target-centered) versions of virtue ethics. (shrink)

This essay aims at questioning different aspects of narrative and description by means of the model of discourse analysis presented in Roulet & al. . After showing the necessity of a unified approach to the structure of different discourse types and the problem of discourse heterogeneity, the author examines the following problems: the distinction between a relation and a narrative and the different modes of insertion of those two types of discourse in an exchange structure, the hierarchical and argumentative structure (...) of narrative, the distinction between narrative and deliberate discourses, the insertion of dialogues in narrative and the co-construction by the interlocutors of a narrative in dialogue. He then sets up a distinction between different types of descriptions and analyses the hierarchical and argumentative structure of description. What, at this historical moment "after Auschwitz," still remains of the questions traditionally asked by theology? What now is theology's minimal degree? This magisterial study, the first extended comparison of the writings of Theodor W. Adorno and Emmanuel Levinas, explores remnants and echoes of religious forms in these thinkers' critiques of secular reason, finding in the work of both a "theology in pianissimo" constituted by the trace of a transcendent other. The author analyzes, systematizes, and formalizes this idea of an (...) other of reason. In addition, he frames these thinkers' innovative projects within the arguments of such intellectual heirs as Jürgen Habermas and Jacques Derrida, defending their work against later accusations of "performative contradiction" (by Habermas) or "empiricism" (by Derrida) and in the process casting important new light on those later writers as well. Attentive to rhetorical and rational features of Adorno's and Levinas's texts, his investigations of the concepts of history, subjectivity, and language in their writings provide a radical interpretation of their paradoxical modes of thought and reveal remarkable and hitherto unsuspected parallels between their philosophical methods, parallels that amount to a plausible way of overcoming certain impasses in contemporary philosophical thinking. In Adorno, this takes the form of a dialectical critique of dialectics in Levinas, that of a phenomenological critique of phenomenology, each of which sheds new light on ancient and modern questions of metaphysics, ethics, and aesthetics. On Carlos Moya's Reply to the Argument from Luck Resumen: Esta nota crítica se centra en el argumento de Carlos Moya (2017, 168-70) a favor de la conclusión de que el Argumento de la Suerte representa en realidad un problema mayor para los compatibilistas que para los libertaristas. La Sección 1 introduce brevemente el Argumento de la Suerte. La Sección 2 discute la distinción de Moya entre dos concepciones de deliberación práctica, y propone una manera alternativa a la de Moya (...) de entender la crítica al libertarismo que se basa en la condición de que cualquier decisión libre debe tener una explicación contrastiva. Finalmente, la Sección 3 resume la respuesta libertarista de Moya al Argumento de la Suerte, y sugiere un modelo alternativo de determinismo que Moya podría considerar para completar su argumento. We study original position arguments in the context of social choice under ignorance. First, we present a general formal framework for such arguments. Next, we provide an axiomatic characterization of social choice rules that can be supported by original position arguments. We illustrate this characterization in terms of various well-known social choice rules, some of which do and some of which do not satisfy the axioms in question. Depending on the perspective one takes, our results can be (...) used to argue against certain rules, against Rawlsian theories of procedural fairness, or in support of richer, multidimensional models of individual choice. Catholic ethicists faithful to the magisterium of the Church are currently divided on the permissibility of using methotrexate to treat ectopic pregnancies. This paper examines the defenses of Rev. Albert Moraczewski, OP, and Christopher Kaczor, who argue that its use is morally permissible, in an attempt to demonstrate that methotrexate constitutes a direct abortion by virtue of its object. Specifically, the paper challenges the claims that methotrexate is aimed at inhibiting pathological tissues, that the trophoblast is not an organ of (...) the embryo, and that direct removal of a nonviable fetus is not a direct abortion. It shall be examined how anti-physicalist arguments give rise to the tension between those aspects of our everyday life and the thesis of physicalism. The debate over the subjective character of consciousness, or as it is sometimes called: “the hard problem of consciousness”, is considered to be the greatest challenge to physicalism. Many philosophers posit this as a matter that cannot be solved, regardless of scientific progress, for it is beyond the scope of what science can find out about (...) the world. If they are correct, the consequence is that the idea of physicalism itself fails. The paper is divided in two parts. For the first part we will deal with Chalmers’ version of the conceivability argument as well as the semantic apparatus of the two-dimensional framework required to make the appropriate link between conceivability and possibility. At the end of this we shall take a look at Kripke’s version of the conceivability argument against physicalism. (shrink)

Gegen den Physikalismus wird der Einwand vorgebracht, dass Qualia intrinsische, nichtreduzierbare Eigenschaften seien . Doch worauf stützt sich dieser Einwand? Im vorliegenden Artikel werden die erkenntnistheoretischen Voraussetzungen des Qualia-Arguments diskutiert. Als erforderlich erweist sich zunächst die Annahme, dass Qualia wahrnehmbar sind, sei es durch Introspektion oder durch die reflexive Struktur des Bewusstseins. Eine entscheidende Rolle spielt darüber hinaus die Annahme, dass die Wahrnehmung der Qualia eine direkte ist. Diese Annahmen werden einer eingehenden Prüfung unterzogen, mit dem Ergebnis, dass sie (...) zwar nicht als völlig gesichert, aber dennoch als gerechtfertigt gelten können. Für das Qualia-Argument ergibt sich daraus, dass es nach wie vor einen schwerwiegenden Einwand gegen den Physikalismus darstellt. (shrink)

Reinhard Lauth (1919-2007) ist einer der bedeutendsten systematischen Philosophen des 20. Jahrhunderts. In der 1979 erschienenen "Theorie des philosophischen Arguments" fasste er in einer streng formalisierten Sprache die Grundlagen systematischen Philosophierens zusammen. In seinen letzten Lebensjahren hat er seinen transzendentalphilosophischen Ansatz weiter entwickelt, was in dem hier erstmals veröffentlichten zweiten Teil des Buchs ihren Niederschlag gefunden hat. Abgerundet wird das Ganze durch einige unveröffentlichte Aufsätze.

Resumen: Este artículo ofrece razones iniciales para interpretar en forma dia-léctica las “pruebas de la existencia divina” que Descartes ofrece en sus Meditaciones III y V. Primero indico algunos precedentes entre los comentaristas contemporáneos y señalo cómo esa manera de abordar los problemas funda-mentales arranca en los clásicos griegos. Después muestro cómo un procedi-miento dialéctico podría resolver un conjunto de problemas que, en principio, incluye el tradicional “círculo cartesiano”. Por último, intento mostrar que no es impensable atribuirle a Descartes una (...) argumentación metafísica del tipo indicado; para ello, esgrimo un pequeño conjunto de argumentos textuales. Mi conclusión es que este tipo de interpretaciones merecen explorarse con mayor esmero.: This paper intends to sketch an initial reason for reading in a dialec-tical way the “proofs of God’s existence” in Descartes’ Meditations, III and V. I begin by indicating antecedents for this kind of interpretation among com-mentators, and show how this approach towards basic philosophical prob-lems can be traced to the Greek classics. I then try to explain how this ar-gumentative procedure can afford in principle a solution to the well-known riddle of the “Cartesian circle”, among other related issues. Finally, I discuss a small set of textual points and show that attributing a dialectical character to Descartes’ main metaphysical arguments should not be taken to be implausi-ble at all. I conclude that interpretations of this kind deserve a more careful exploration. (shrink)

La présente contribution analyse un texte célèbre de Grégoire de Rimini, extrait de son commentaire des Sentences publié à Paris en 1346, livre II, distinction 34-37, question 1, qui demande « si Dieu est la cause efficiente immédiate du péché actuel ». Ce texte porte sur les fondements de l’éthique. Grégoire de Rimini y affirme en substance que si Dieu n’existait pas, agir contre la droite raison équivaudrait tout de même à commettre un mal. Ce texte est considéré comme la (...) première formulation de l’autonomie de la morale par un théologien philosophe. On en propose ici une relecture, attentive à sa logique argumentative et au jeu des autorités tirées du De libero arbitrio d’Augustin qu’il met en œuvre. L’Ordre des Ermites de Saint Augustin est associé de multiples manières au renouveau de l’augustinisme dès la période du premier humanisme de Pétrarque (1304-1374). La façon dont Grégoire de Rimini traite la question des racines de l’agir moral illustre à quel point il figure au premier plan du renouveau scolastique et humaniste de l’érudition augustinienne au xiv e siècle. In this paper, I discuss in detail one of the first conclusions drawn by Aristotle in the ergonargument. The paper provides an in-depth approach to Nicomachean Ethics’ lines 1098a3-4, where one reads: “λείπεταιδὴπρακτικήτιςτοῦλόγονἔχοντος”. I divide the discussion into two parts. In the first part, I put under scrutiny how one should take the word “πρακτική” and argue that one should avoid taking this word as meaning “practical” in the passage. I will argue in favor of taking it as meaning “active”. (...) The exegetical inconvenience of taking “πρακτική” as meaning “practical” is the fact that it restricts the results achieved in the ergonargument by excluding the possibility of contemplation being considered a eudaimonlife. In the second part, I discuss the expression “λόγονἔχον” and provide some arguments to take it as preliminarily introducing the criterion of division of the virtues that will be spelled out in ENI.13 so that the λόγον-ἔχονpart of the soul here also makes reference to thevirtue of the non-rational part, i.e., virtue of character. I offer a deflationary view by showing that the moral psychology is developed in ENI.7 within the limits imposed by the ergonargument. (shrink)

There are numerous studies that, from different perspectives, have dealt with the debate held in the Spanish Empire during the 16th century on the slavery of the American Indians, starring –among others– by Francisco de Vitoria and his disciples from the School of Salamanca, and also –outside the academic sphere– by Fray Bartolomé de las Casas and Juan Ginés de Sepúlveda. The purpose of this work is to study whether this debate made its mark in Spanish society. For this, it (...) is analyzed three theatrical pieces from the Golden Age signed by playwrights of the stature of Tirso de Molina, Lope de Vega and Pedro Calderón de Barca, who –given their enormous popularity– had the capacity to reach the wide audience that congregated in the corrals of comedies. Were these three writers influenced by the controversy over the Indians carried out, among other authors, by Vitoria, Las Casas and Sepúlveda? Did they fully grasp in their works the subtle debate that Vitoria, Las Casas and Sepúlveda maintained when they interpreted Aristotelian arguments on slavery and the consequences that derived from them in terms of the possibility of enslaving or not the Indians? Dans la première partie de L'unique fondement possible d'une démonstration de l'existence de Dieu (1763), Kant propose un argument de type ontologique qu'il avait déjà formulé dans ses écrits de 1755. La présente contribution voudrait examiner continuité et changements dans les différentes formulations. Contrairement à ce que soutiennent d'autres chercheurs, j'entends montrer que l'argument de Kant se présente, dès le départ, comme une alternative à celui des auteurs de la tradition wolffienne. Tout en confirmant la conviction que l'argument ontologique de la tradition wolffienne n'est pas démonstratif, Kant estime ne pas disposer d’un argument alternatif complet, mais seulement de son fondement. Even if the philosophical consequences of Einstein's argument turned out to be highly controversial, the protagonists of such a debate seem to agree on considering Einstein's argument as an expression of 'Leibniz equivalence', a modern version of Leibniz's celebrated indiscernibility arguments against Newton's absolute space. The (...) paper attempts to show that the reference to Leibniz, however plausible at first sight, is actually in many respects misleading. In particular it is claimed that the Logical Empiricists offer a significant historical example of an attempt to interpret the point-coincidence argument as an indiscernibility argument in the sense of Leibniz, similar to those used in 19th century by Helmholtz, Hausdorff or Poincaré. However the logical empiricist account of General Relativity clearly failed to grasp the philosophical novelty of Einstein's theory. Thus, if Einstein's point coincidence/ hole argument can be regarded as an indiscernibility argument, it cannot be an indiscernibility argument in the sense of Leibniz. Einstein rather introduced a new form of indiscernibility argument, which might be better described as an expression of 'Einstein-equivalence'. Developing some ideas of Weyl it is argued that, whereas Leibniz's arguments introduced the notion of 'symmetry' in the history of science, Einstein's argument seems to anticipate what we now call 'gauge freedom'. If in the first case indiscernibility arises from a lack of mathematical structure, in the second case it is a consequence of a surplus of mathematical structure. _German_ Die Entdeckung, dass Einsteins berühmtes Punkt-Koinzidenz- Argument zur allgemeinen Kovarianz tatsächlich eine Reaktion auf die Lochbetrachtung war, hat in den vergangenen 30 Jahren zu einer intensiven philosophischen Debatte geführt. Auch wenn die philosophischen Konsequenzen äußerst kontrovers gesehen werden, stimmen die Protogonisten doch darin überein, das Argument als Ausdruck von Leibniz-Äquivalenz, mithin als eine moderne Version von Leibniz berühmten Ununterscheidbarkeitsargumenten gegen Newtons absoluten Raum aufzufassen. Ziel des Aufsatzes ist es zu zeigen, dass der Bezug zu Leibniz, wenn auch auf den ersten Blick plausibel, tatsächlich in vielerlei Hinsicht irreführend ist. Insbesondere wird dahingehend argumentiert, dass die Logischen Empiristen ein signifikantes historisches Beispiel für einen Versuch darstellen, das Punkt-Koinzidenz Argument als ein Ununterscheidbarkeitsargument im Sinne von Leibniz, ähnlich denen im 19. Jahrhundert von Helmholtz, Hausdorff und Poincaré vorgebrachten, zu deuten. Dieser Deutung der Allgemeinen Relativitätstheorie gelingt es aber nicht, das eigentlich philosophisch Neue von Einsteins Theorie plausibel zu interpretieren. Wenn Einsteins Punkt-Koinzidenz/Lochargument als ein Ununterscheidbarkeitsargument angesehen werden soll, kann dies kein Argument à la Leibniz sein. Vielmehr hat Einstein ein neuartiges Ununterscheidbarkeitsargument eingeführt, das vielleicht besser als,Einstein-Äquivalenz' charakterisiert werden sollte. Durch Aufnahme und Weiterentwicklung einiger Ideen von Weyl wird gezeigt, dass Leibniz' Argumente zwar das Konzept der,Symmetrie' in die Wissenschaftsgeschichte eingebracht haben, Einsteins Argument aber etwas antizipiert hat, was heute gewöhnlich,Eichfreiheit' genannt wird. Wird im ersten Fall die Ununterscheidbarkeit durch ein zu wenig an mathematischer Struktur erzeugt, so ist sie im zweiten Fall gerade die Folge eines Überschusses an mathematischer Struktur. In a recent paper, Kristin Mickelson argues that Alfred Mele’s Zygote Argument, a popular argument for the claim that the truth of determinism would preclude free action or moral responsibility, is not valid. This sort of objection is meant to generalize to various manipulation arguments. According to Mickelson, the only way to make such arguments valid is to supplement them with an argument that is an inference to the best explanation. In this paper, I argue that there are (...) two other ways in which the proponent of such manipulation arguments can modify their argument, neither of which requires an inference to the best explanation. ObjectiveTo present (1) the ethical concepts related to the debate on resuscitation of extremely premature infants (EPIs) as they are described in the ethical literature; and (2) the ethical arguments based on these concepts.DesignWe conducted a systematic review of the ethical literature. We selected articles based on the following predefined inclusion/exclusion criteria: (1) English language articles (2) presenting fully elaborated ethical arguments (3) on resuscitation (4) of EPIs, that is, infants born before 28 weeks of gestation.AnalysisAfter repeated reading (...) of articles, we developed individual summaries, conceptual schemes and an overall conceptual scheme. Ethical arguments and concepts were identified and analysed.ResultsForty articles were included out of 4709 screened. Personhood, best interest, autonomy and justice were concepts grounding the various arguments. Regarding these concepts, included authors agreed that the best interest principle should guide resuscitation decisions, whereas justice seemed the least important concept. The arguments addressed two questions: Should we resuscitate EPIs? Who should decide? Included authors agreed that not all EPIs should be resuscitated but disagreed on what criteria should ground this decision. Overall, included authors agreed that both parents and physicians should contribute to the decision.ConclusionsThe included publications suggest that while the best interest is the main concept guiding resuscitation decisions, justice is the least important. The included authors also agree that both parents and physicians should be actively involved in resuscitation decisions for EPIs. However, our results suggest that parents’ decision should be over-ridden when in contrast with the EPI’s best interest. (shrink)

Supervaluationism is one of the most discussed approaches to the semantics of future tense sentences in a branching time. In this paper, we consider the criticism advanced by Malpass against Supervaluationism. This criticism relies on the fact that supervaluationists must accept as supertrue disjunctions whose disjuncts are not only supertrue—which supervaluationists are ready to acknowledge—but also not satisfiable. In order to show this, Malpass proposes a formula, F F 1, which shows the existence of a satisfiable disjunction with unsatisfiable disjuncts (...) in supervaluationist models. In reply, we show that formula F F 1 cannot be expressed within a model (whether Ockhamist or supervaluationist) because it quantifies on models. It can be correctly characterised only within a meta-model that has the resources to quantify on various models. However, once that is done, F F 1 is, for the advocates of Supervaluationism, no more demanding than other disjunctions because it just generalises at the meta-theoretical level what supervaluationists already acknowledge at the theoretical level. Livestock production has been confronted with several epidemics over the last decades. The morality of common animal disease strategies—stamping out and vaccination—is being debated and provokes controversies among farmers, authorities and the broader public. Given the complexity and controversy of choosing an appropriate control strategy, this article explores the potential of nano-enabled diagnostics in future livestock production. At first glance, these applications offer promising opportunities for better animal disease surveillance. By significantly shortening the reaction time from diagnosis to appropriate control, (...) they could complement the current disease management strategies. Although nano-enabled diagnostics will not make livestock disease eradication strategies redundant or completely free of the culling of infected animals, these diagnostics could significantly reduce the number of culled animals and animal suffering. This article aims to demonstrate that the ethical assessment of advanced diagnostics can build on the experiences with decision making in biomedical ethics where nonmaleficence, beneficence, autonomy and justice serve as important benchmarks. Nano-enabled diagnostics may be an ethically sound solution if it can resolve the dilemma between stamping out and vaccination in favor of the latter and if it can balance the autonomy–paternalism dilemma between farmers and authorities. The technology should allow to be switched on and off by farmers, whilst simultaneously allowing for a weak paternalism on behalf of authorities in order to benefit the farmer and broader society and to protect them from harm. Over the past decade, countries such as France, Belgium, Denmark, Austria, Latvia, and Bulgaria have banned face-coverings from public spaces. These bans are popularly known as ‘burqa bans’ as they seem to have been drafted with the aim of preventing people from wearing burqas and niqabs specifically. The scholarly response to these bans has been overwhelmingly negative, with several lawyers and philosophers arguing that they violate the human right to freedom of religion. While this article shares some of the concerns (...) that have been raised, it argues that banning face-coverings in public is morally justified under certain conditions with the exception of facemasks that are necessary for the containment of infectious diseases, such as COVID-19. The reason for this is that those who publicly cover their face make it very difficult for other members of society to socially interact with them, especially for those who are deaf or hard-of-hearing, which is problematic in an age where many people are chronically lonely or at risk of becoming chronically lonely. As such, this article can be understood as a more elaborate, and arguably more sophisticated, defence of the justification that France offered for its face-covering ban before the European Court of Human Rights, namely that covering one’s face undermines the conditions for ‘living together’. The question of 'the end of metaphysics' is generally considered as a central issue concerning the nature and significance of philosophy as such, and, accordingly, as belonging to the realm of 'pure' or 'fundamental' philosophy. By contrast, this book investigates to what extent the end of metaphysics might be related to specific influences from outside philosophy. Focusing on the period between 1830 and 1848, it argues that metaphysics was not so much challenged by internal philosophical argument, but rather by a (...) transformation of Western culture in its entirety. Metaphysics was overtaken by the modern spirit of the age. In consequence, this book approaches 'the end of metaphysics' as a problem of the philosophy of culture. Three historians of culture provide an overview and analysis of the 'Age of Revolution' by focusing upon the political revolution in France, the industrial revolution in England and the intellectual revolution in Germany respectively. The proclamations of the end of metaphysics by Auguste Comte, Friedrich Engels and Otto Friedrich Gruppe are shown to mirror this threefold cultural transformation. Against this backdrop, the idea of the end of metaphysics is brought into relief as a historical reality during the years 1830 to 1848. Este artículo analiza y critica los argumentos de Carl Schmitt contra la democracia liberal, y pone en cuestión su aprovechamiento por parte del pensamiento progresista contemporáneo. Primero se examina la conexión conceptual de la concepción schmittiana de lo político con la transformación del Estado liberal en el Estado totalitario. Luego se cuestiona el supuesto filosófico que subyace en la crítica de Schmitt al liberalismo: la tesis de la imposibilidad de alcanzar soluciones racionales y pacíficas a los conflictos políticos. Se analizan (...) en este contexto los dos recursos deliberativos más importantes de que dispone el liberalismo para abordar los conflictos políticos: los acuerdos y los compromisos de intereses. Por último, el artículo concluye con algunas reflexiones sobre el significado político del "neoschmittianismo" contemporáneo. This article analyses Carl Schmitt's arguments against liberal democracy, and questions the potential of these arguments for contemporary progressive political thought. The article shows the conceptual connection of the schmittian concept of the political with the transformation of the liberal State into a totalitarian State. Subsequently it tries to show that the main premise of Schmitt's critique of liberalism is false, namely the belief that it is impossible to reach a dialogical and peaceful solution to political conflicts, either by agreement or by compromise. Finally the article includes some reflections on the political significance of contemporary "neo-schmittianism". (shrink)

This paper examines the cognitive foundations of natural theology: the intuitions that provide the raw materials for religious arguments, and the social context in which they are defended or challenged. We show that the premises on which natural theological arguments are based rely on intuitions that emerge early in development, and that underlie our expectations for everyday situations, e.g., about how causation works, or how design is recognized. In spite of the universality of these intuitions, the cogency of (...) natural theological arguments remains a matter of continued debate. To understand why they are controversial, we draw on social theories of reasoning and argumentation. (shrink)
