Ex aequo et bono compensations refer to tribunal’s compensations that cannot be determined exactly according to the rule of law, in which case the judge relies on an estimate that seems fair for the case at hand. Such cases are prone to legal uncertainty, given the subjectivity that is inherent to the concept of fairness. We show how basic principles from statistics and machine learning may be used to reduce legal uncertainty in ex aequo et bono judicial decisions. For a (...) given type of ex aequo et bono dispute, we consider two general stages in estimating the compensation. First, the stage where there is significant disagreement among judges as to which compensation is fair. In that case, we let judges rule on such disputes, while a machine tracks a certain measure of the relative differences of the granted compensations. In the second stage that measure, which expresses the degree of legal uncertainty, has dropped below a predefined threshold. From then on legal decisions on the quantity of the ex aequo et bono compensation for the considered type of dispute may be replaced by the average of previous compensations. The main consequence is that this type of dispute is, from this stage on, free of legal uncertainty. (shrink)

When I examine contextualism there is much that I can doubt. I can doubt whether it is a cogent theory that I examining, and not a cleverly stated piece of whacks. I can doubt whether there is any real theory there at all. Perhaps what I took to be a theory was really some reflections; perhaps I am even the victim of some cognitive hallucination. Although contemporary powers metaphysics largely understands itself as a metaphysical realist undertaking, recently powers have come to the surface also within an idealist context. This paper aims to characterize and motivate an absolute idealist conception of powers. I compare realist and idealist powers metaphysics in their respective responses to Humean scepticism concerning powers, thereby motivating the claim that the very idea of a power is actually best understood as an idealist idea. I continue to characterize the absolute idealist’s understanding of (...) power, for which it is necessary to see that the content of her power notion is inseparable from the way in which she arrives at that notion. I close with a brief reflection on the absolute idealist’s understanding of the power of thought, which is where idealist and realist powers metaphysics diverge most radically. (shrink)

The purpose of this article is twofold. First, it explores and shows ways in which one important view of racism parallels the Christian doctrine of original sin. Second, it argues that this comparison helps to close the gap between the two main strands of Christian thinking about original sin. Philosophers and theologians are often asked to decide between Augustinian or Irenaean theories of original sin. An epistemology of ignorance, especially as applied in discussions of racism, helps us to see how (...) this dichotomy may be short‐sighted. For virtually no one, in an epistemology of ignorance, matures into being a racist. Nevertheless, as Charles W. Mills famously argues, the epistemology of ignorance he terms the Racial Contract has a historical inception, namely, the period around the beginning of the Transatlantic Slave Trade. I close the article by discussing whether a model of original sin similar to an epistemology of racist ignorance might satisfy the dogmatic constraints of the Catholic tradition. (shrink)

In this paper I argue that racism’s subtle and insidious reach should lead us to prefer an account of religious experience that is capable of reckoning with that reach, an account that, I shall argue, appears in the work of St. John of the Cross. The paper begins with an analysis of race and racism and the way in which the latter can have existential and even spiritual effects. The argument is then applied particularly to white people and the deleterious (...) effects racism has on their intellects, wills, and even memories, not merely inwardly but also as a result of what Charles Mills famously calls an epistemology of ignorance. Notably, intellect, will, and memory are the key sites for union in St. John’s discussion. In the last main section, I discuss how progress in the mystical life can be hindered by racism’s effects even while it is possible for there to be “touches of union” on the way. Another result of this inquiry is that it shows how a widely-used schema, such as St. John’s, will require spiritual aspirants to deal with racism, both in themselves and in the world. (shrink)

It is increasingly clear that children's excessive consumption of products high in added (or extrinsic) sugar causes obesity and obesity‐related health problems like type 2 diabetes, cardiovascular disease, and metabolic syndrome. Less clear is how best to address this problem through public health policy. In contrast to policies that might conflict with adult's right to self‐determination — for example sugar taxes and soda bans — this article proposes that children's access to products high in added sugars should be restricted in (...) the same way that children's access to tobacco products is restricted. The article first considers how the recommended policy will protect a child's right to an open future while not violating parental rights. The article then explores how the implementation of the recommended policy can help transform the social meaning of sugar and thereby curb the parental supply of added sugar to children — a central cause of obesity. What is the best question reductionists would have to answer but cannot, and why exactly is there no reductionist answer to that question? To answer this question, we need to identify the relevant question.

Applications of sexual selection theory to humans lead us to expect that because of mammalian sex differences in obligate parental investment there will be gender differences in fitness variances, and males will benefit more than females from multiple mates. Recent theoretical work in behavioral ecology suggests reality is more complex. In this paper, focused on humans, predictions are derived from conventional parental investment theory regarding expected outcomes associated with serial monogamy and are tested with new data from a postreproductive cohort (...) of men and women in a primarily horticultural population in western Tanzania (Pimbwe). Several predictions derived from the view that serial monogamy is a reproductive strategy from which males benefit are not supported. Furthermore, Pimbwe women are the primary beneficiaries of multiple marriages. The implications for applications of sexual selection theory to humans are discussed, in particular the fact that in some populations women lead sexual and reproductive lives that are very different from those derived from a simple Bateman-Trivers model. Recent research emphasizes the complexity of providing useful explanations of computer-generated output. In developing an explanation-generating tool, the computer scientist should take a user-centered perspective, while taking into account the user’s susceptibility to certain biases. The purpose of this paper is to expand the research results on explainability from the social sciences, and to indicate how these results are relevant to the field of XAI. This is done through the presentation of two surveys to university students. The analysis of the (...) results leads to some interesting hypotheses, for example that the presented order of historical facts might be more influential on the interpretation or appreciation of an event than the actual temporal order of these facts. The computer scientist should, therefore, pay particular emphasis to the format of the produced output of any explainable artificial intelligence system. The main message of the paper is that results from the social sciences must be regarded as a crucial foundation of any explainable artificial intelligence system. (shrink)

There have been and continue to be disagreements about how to consider the traditional square of opposition and the traditional inferences of obversion, conversion, contraposition and inversion from the perspective of contemporary quantificational logic. Philosophers have made many different attempts to save traditional inferences that are invalid when they involve empty classes. I survey some of these attempts and argue that the only satisfactory way of saving all the traditional inferences is to make the existential assumption that both the subject (...) and predicate classes and their complement classes are non-empty for all the propositions we admit. I briefly indicate the room for continued controversy over how properly to interpret Aristotle's statements regarding these inferences, but find some plausibility in the views of Manley Thompson and A.N.Prior that Aristotle had in mind a particular arrangement of existential import unfamiliar to most contemporary logicians. Frege taught us how to understand one form of predication: an atemporal one. There is also a different, temporal form of predication, which I briefly introduce. Accordingly, there are two fundamentally different approaches to time: a reductive one, aiming to account for time in terms of Frege’s atemporal predication, and a non-reductive one, insisting that the temporal form of predication is sui generis, and that time is to be understood in its terms. I do not directly argue for or against (...) reductionism in this paper. Rather, by evaluating the debates on endurantism–perdurantism, A-theory–B-theory, and presentism–eternalism, I argue that these debates, although aiming to be fundamental, largely boil down to mere quarrels between alternative reductive approaches. We should take notice of this fact and reorient ourselves within the debate on time accordingly: the real issue is whether we should reduce or not. I briefly sketch in what sense endurantism, A-theory, and presentism may be developed on a properly anti-reductionist basis. (shrink)

What bothers people about reliabilism as a theory of justified belief? It has yet to be formulated adequately, but most philosophical theories have that problem. People seem to be bothered by the very idea of reliabilism, with its apparent disregard for believers’ rationality and responsibility. Yet its supporters can’t seem to understand its opponents complaints. I believe that the conflict can be clarified, if not resolved, by drawing certain important distinctions.

This article traces a debate on Martin Buber and Franz Rosenzweig’s Germanization of the Bible. The trigger of the debate was Siegfried Kracauer’s infamous critique entitled “Die Bibel auf Deutsch”, published in April 1926 in the Frankfurter Zeitung. In his harsh review of the first volume of the translation, Kracauer regards the use of the German language by Buber and Rosenzweig as an archaization. Relying in part on unpublished letters, this paper presents and explores the different perceptions of the translation, (...) which embody the depths these fault lines penetrated both in general public discourse and, more specifically, in German-Jewish circles. This article also points towards the change of the German language in the 19th century that is embedded in the historical semantics of the Buber-Rosenzweig Bible. (shrink)

The traditional puzzles about belief reports puzzles rest on a certain seemingly innocuous assumption, that 'that'-clauses specify belief contents. The main theories of belief reports also rest on this "Specification Assumption", that for a belief report of the form 'A believes that p' to be true,' the proposition that p must be among the things A believes. I use Kripke's Paderewski case to call the Specification Assumption into question. Giving up that assumption offers prospects for an intuitively more plausible approach (...) to the semantics of belief reports. But this approach must confront a puzzle of its own: it turns out that every case is a Paderewski case, at least potentially. (shrink)

Words mean things, speakers mean things in using words, and these need not be the same. For example, if you say to someone who has just finished eating a super giant burrito at the Taqueria Guadalajara, “You are what you eat,” you probably do not mean that the person is a super giant burrito. So we need to distinguish the meaning of a linguistic expression – a word, phrase, or sentence – from what a person means in using it. MARGA REIMER has forcefully challenged David Kaplan's recent claim ([3], pp. 582-4) that demonstrative gestures, in connnection with uses of demonstrative expressions, are without semantic significance and function merely as 'aids to communication', and that speaker intentions are what determine the demonstratum. Against this Reimer argues that demonstrations can and do play an essential semantic role and that the role of intentions is marginal at best. That is, together with the linguistic meaning of the demonstrative phrase being used, an act (...) of demonstration determines what is said. I will argue that Kaplan's view is borne out if we consider the referential intentions specific to communication. Reimer may be correct about such intentions as she considers, but she overlooks specifically referential ones. When these are taken into account, we find that aalthough demonstrations contribute in a way to what is said, this does not make them semantically significant. (shrink)

Group slurs are applied to a whole category of people. Whereas slurs like jerk, creep, and hag are generally directed at individuals because of the personal traits (behavior, personality, looks, etc.), group slurs, like spic, commie, and infidel, are applied across the board to members of a category. Even when directed at a particular individual, ethnic, religious, and political slurs are applied on the basis of group membership rather than anything about the person in particular. There is a simple view of motivation on which desires are like pain-killers; they come in different strengths, and their strength determines their efficacy. That is, the stronger a desire the greater its motivational force and, when two desires conflict, the stronger one “wins out” over the weaker. This view makes it puzzling how anyone could ever exhibit “strength of will” and act on the weaker desire, even when it is a desire for something more highly valued than what is (...) more strongly desired. When the will, as the agent of reason, enters the fray, an explanation of what a person is motivated enough to do must reckon not only with competing desires and their motivational forces, but also with the will’s capacity to be affected by different ones in ways not proportional to their force. However, this complication sheds little light, for if the will must bestow its stamp of approval on a desire before the desire leads to action, then, it would seem, motivational force should be measured by strength of effect on the will. And if that’s the way to measure motivational force, then, since by that measure one always acts on the desire that affects one’s will most, there is no problem of strength of will after all. The brain adapts to changes that take place in the body. Deprivation of input results in size reduction of cortical representations, whereas an increase in input results in an increase of representational space. Amputation forms one of the most dramatic disturbances of the integrity of the body. The brain adapts in many ways to this breakdown of the afferent–efferent equilibrium. However, almost all studies focus on the sensorimotor consequences. It is not known whether adaptation takes place also at other “levels” (...) in the system. The present study addresses the question whether amputees dream about their intact body, as before the amputation, or about the body after the amputation and whether the dream content was a function of time since the amputation and type of amputation. The results show that the majority of the dreamers reported dreams about their intact body although the mean time that elapsed since the amputation was twelve years. There is no clear relation with the type of amputation. The results give modest evidence for the existence of a basic neural representation of the body that is, at least, partly genetically determined and by this relatively insensitive for changes in the sensory input. Job crafting has been established as a bottom-up work design instrument for promoting health and well-being in the workplace. In recent years, the concepts of job crafting have been applied to the university student context, proving to be positively related to student well-being. Building on person-centered analyses from the employment context, we assessed approach study crafting strategy combinations and the relationships to students’ exhaustion, study engagement, and general well-being. Data from 2,882 German university students were examined, collected online during the (...) summer term in 2020. Using latent profile analysis, we found five distinct crafting groups, which showed discriminate validity with regard to emotional exhaustion, engagement, and well-being. The results underscore the positive role of study crafting for students’ health and well-being. They further indicate a less important role of increasing social resources for emotional exhaustion when combined with a moderate increase in structural resources and a moderate increase in challenging demands. Our findings imply that interventions to promote study crafting should be considered to promote student health and well-being. (shrink)

Anscombe’s 1971 inaugural lecture at Cambridge, entitled ‘Causality and Determination’, has had a lasting influence on a remarkably broad range of philosophers and philosophical debates, touching on fundamental topics in philosophy of science, action theory, the free will debate, epistemology, philosophy of mind, and metaphysics. Especially where anti-reductionist or pluralist strands of philosophical thought are being seriously considered, one should not be surprised to find references to Anscombe’s lecture. Moreover, there appears to be a growing interest in Anscombe’s comprehensive philosophical (...) outlook, as attested by the recent publication of a weighty collection of essays spanning that outlook in its full breadth in the prestigious Routledge Philosophical Minds series. Against this background it is apt that now, 50 years after the original lecture, a Topical Collection sees the light, circling around the most central themes from Anscombe’s lecture, with a particular emphasis on the question how these hang together, how they form part of the larger philosophical project that Anscombe obviously intended the lecture to highlight. This Introduction motivates the Topical Collection, and introduces the various contributions against that background. (shrink)

Presenting a novel account of singular thought, a systematic application of recent work in the theory of speech acts, and a partial revival of Russell's analysis of singular terms, this book takes an original approach to the perennial problems of reference and singular terms by separating the underlying issues into different levels of analysis.

This chapter inquires into an initially rather startling claim Sebastian Rödl makes in his Self-Consciousness and Objectivity (SC&O): that the power of judgment is not a power among other powers, but rather “the power” (p. 60). It traces Rödl’s sophisticated understanding of powers, as presented in SC&O, in terms of a distinction between “simple powers”, such as a pear tree’s power to blossom, on the one hand, and “self-conscious powers”, such as the power of judgment, on the other. Reflection on (...) related distinctions that SC&O makes between forms of explanation and forms of necessity yields the insight that these two kinds of power cannot be kept apart. The chapter discusses various attempts to bring them together in a satisfactory way and concludes with a proposal in which the idea of givenness plays a central role, in such a way that the initially startling claim can be seen to make sense. Mele views self-deception as belief sustained by motivationally biased treatment of evidence. This view overlooks something essential, for it does not reckon with the fact that in self-deception the truth is dangerously close at hand and must be repeatedly suppressed. Self-deception is not so much a matter of what one positively believes as what one manages not to think.

Prolonging working hours and presenteeism have been conceptualized as self-endangering coping behaviors in employees, which are related to health impairment. Drawing upon the self-regulation of behavior model, the goal achievement process, and Warr's vitamin model, we examined the antecedents and moderation effects regarding quantitative demands, autonomy, emotion regulation, and self-motivation competence of university students' self-endangering coping behaviors. Results from a cross-sectional survey of 3,546 German university students indicate that quantitative demands are positively related and autonomy has a u-shape connection with (...) self-endangering coping. Emotion regulation was shown to be a protective factor for prolonging working hours. Moreover, self-motivation moderated the relationship between quantitative demands and prolonging of working hours, but not in the assumed direction. Self-motivation showed a systematic positive relationship with prolonging of working hours, but no relationship with presenteeism. Autonomy moderated the relationship of quantitative demands with both self-endangering behaviors. We found no moderating effects for emotion regulation of quantitative demands or autonomy and self-endangering behaviors. Besides further practical implications, the results suggest that lecturers should design their courses accordingly with less time pressure and university students should be trained in the use of autonomy.
