Çalışma, Muhammed b. Mustafa el-Alâî’ye (ö. 1234/1818) nispet edilen Şerḥ-i İrâde-i cüzʾiyye risâlesinin ona aidiyeti üzerine yoğunlaşacaktır. Muhammed b. Mustafa el-Alâî’nin kendisine ait olduğunu söylediği ve ona nispet edilen Şerḥ-i İrâde-i cüzʾiyye risâlesi aslında Dâvûd-i Karsî’nin (ö. 1169/1756) Risâle fi’l-iḫtiyârâti’l-cüzʾiyye ve’l-irâdâti’l-ḳalbiyye adlı risâlesinin kısmen değiştirilmiş bir versiyonudur. Alâî, Karsî’nin risâlesinden ihtiyaç duymadığı bazı bağlam ve konuları çıkararak ve gerekli gördüğü bazı başlıkları da Ebû Saîd el-Hâdimî’nin (ö. 1176/1762) el-Berîḳatu’l-maḥmûdiyye eserinden eklemeler yaparak oluşturduğu Şerḥ-i İrâde-i cüzʾiyye risâlesi, içerik açısından (...) dikkate alındığında intihalin en bariz görüldüğü bir eser niteliğindedir. Osmanlı ilim düşüncesi dikkate alındığında irade ve insan fiilleri konusunda büyük bir literatürün ortaya konulduğu ve bu metinlerin konu hakkında belli bir fikrin yerleşmesinde etkisi olduğu bilinmektedir. Belli bir dönemde telif edilen risâlelerin muhteva olarak sonraki risâle ve eserlerin muhtevasını etkilemiş olması ve bu nedenle kısmî tedâhüllerin olması sıkça karşılaşılan bir durumdur. Fakat başkasına ait bir telif üzerinde tikel bir değişiklik yaparak eseri kendisine nispet etmek ilmî olarak kabul edilemez bir durumdur. Araştırmanın konusu olan Alâî’nin risâlesi de ikinci türden bir risâle hüviyetindedir. Risâlenin tamamına yakın bir bölümü Karsî’nin konu hakkındaki risâlesi kısmen değiştirilerek oluşturulmuş ve Dâvûd-i Karsî’ye herhangi bir atıfta bulunulmamıştır. Bu çalışmada amaçlanan ise Alâî’nin kendisine nispet ettiği bu risâlenin aslında Karsî’ye ait olduğunu karşılaştırmalı tablolar üzerinden ortaya koymaktır. Bu bağlamda hem Karsî hem de Alâî’ye ait her iki metin tablolar üzerinden baştan sona kadar karşılaştırılmış; ortak ve farklı noktalar tespit edilerek gösterilmeye çalışılmıştır. Karşılaştırmalar neticesinde risâlenin Karsî’ye aidiyeti kesin şekilde tespit edildiğinden bahsi geçen intihal olgusunun bizzat Alâî tarafından mı, yoksa başka birisi tarafından mı yapıldığı sorusuna dikkat çekilmiştir. Ayrıca Alâî’nin Ebû Saîd el-Hâdimî’den kaynak göstermeden alıntı yaptığı yerler de tespit edilerek metin üzerinde farklı bir renkle gösterilmiştir. Son olarak bütünsel bir bakış imkânı sunması için Alâî’ye ait risâlenin tahkiki de yapılmıştır. Metnin tahkikinde Karsî’nin metninde mevcut olup Alâî’nin metninde olmayan ve anlamı tamamlayan kelimeler ile cümleler köşeli parantez içinde gösterilmiştir. Ayrıca Karsî’nin metninde metin-şerh ayrımı olduğundan Alâî’nin risâlesindeki bu ayrım da tespit edilmiş böylece metin bold ve parantez içinde gösterilirken şerh ise normal yazı stiliyle gösterilmiştir. Çünkü bu metin-şerh ayrımının gösterilmesi, metnin anlaşılması ve bütünlüğü açısından elzem bir durum arz etmektedir. (shrink)

In the vast expanse of classical Arabic literature, the works of Abū Dhu’ayb al-Hudhalī stand out, particularly his elegies, which provide a pro-found glimpse into the sociocultural dynamics of his era. The research presented in this article delves deep into the life and artistry of Abū Dhu’ayb, meticulously examining how his personal experiences and surroundings shaped his poetic expressions. Elegies, often characterized by their mournful tone and reflective nature, become especially significant in Abū Dhu’ayb’s repertoire as they offer poetic lamentations (...) and provide insight into the world in which he lived. The subject of this research focuses on Abū Dhu’ayb’s elegies, providing an in-depth literary analysis, and aiming to discern the intricate interplay between his life’s events and his poetic manifestations. By situating Abū Dhu’ayb’s elegies within the broader canvas of classical Arabic poetry, this research seeks to shed light on their distinct characteristics, thematic concerns, and stylistic nuances. Within the scope of this article, special attention is given to his deeply moving elegy dedicated to his sons. Drawing from a wide spectrum of his poems, we ensure a comprehensive understanding of Abū Dhu’ayb’s unique approach to the art of elegy. The rationale for this inquiry becomes particularly salient when we position Abū Dhu’ayb within the milieu of his literary peers. Although numerous poets of his era ventured into the domain of elegy, Abū Dhu’ayb’s compositions stand apart, characterized by their intimate resonance and the intricate threads of narrative woven seamlessly into his poetic tapestry. Engaging with overarching themes of fate, destiny, honor, and the human condition, his works do more than just lament the loss of loved ones or ponder the transient nature of life. Through this research, we aim to elevate the understanding of Abū Dhu’ayb’s contribution to Arabic literature and underscore the importance of his elegies as both literary mas-terpieces and historical documents. The primary purpose of this study is twofold. Firstly, it seeks to explore the artistic depth and breadth of Abū Dhu’ayb’s elegies, understanding their thematic richness and linguistic excellence. Secondly, the study aims to draw connections between the poet’s life—a life replete with its share of joys, sorrows, triumphs, and tribulations—and the elegies he crafted. By doing so, the research offers a holistic view of the poet, not just as a literary figure but also as a person deeply affected by the world around him. The methodological framework employed in this research is rooted in both literary analysis and historical contextualization. By closely reading Abū Dhu’ayb’s elegies, the research deciphers their symbolic and metaphorical elements, laying bare the poet’s craft. Concurrently, by positioning these elegies within their historical context, the study provides a broader understanding of the socio-political and cultural milieu of Abū Dhu’ayb’s era. This dual approach ensures a well-rounded exploration, enabling readers to appreciate the elegies both as individual pieces of art and as part of a larger poetic tradition. This study will examine how Dāvūd al-Qarṣī, an 18th-century Ottoman scholar, resolved the paradox between human freewill and God being the creator of everything in his work Risālâh fi’l-ikhtiyārāt al-juzʾiyyah wa’l-irādāt al-qalbiyyah. In addition, in this study, the critical edition and translation of the risālah will also be provided. The treatise which is the subject of the present study is a link in the series of works written under the title of human acts in the Islamic thought tradition regarding al-irādah (...) al-juzʾiyyah, afʿāl al-ʿibād, khalq al-aʿmāl, qaḍā, and qadar. This risālah is one of the rare examples prepared with the method of “mamzūj annotation (sharḥ)”, which is a method in which “text” and “annotation” are intertwined. Qarṣī examines in detail a total of seven views, four of which are famous (mashhūr) and three of which are non-famous, about voluntary acts. Qarṣī interprets the approaches and views of the non-famous sects and includes them in the famous sects and allocates approximately 4/3 of the work to these sects. In the final stage of the work, the author states that the view of Māturīdīs is parallel with the predecessor’s (Salaf) view of “Neither jabr nor tafwīḍ; rather, it is merely a situation between these two approaches.” Qarṣī, who was inspired by Athīrī Maḥmad Afandī (d. 1092/1681), says that voluntary acts come about by the sum of “two powers (qudrat)”, “two wishes (mashīʾat)” and “one taqwīn”. Also, according to this, the first four of them are proximate causes, while the attribute taqwīn is the influencing factor. Qarṣī acts from the meanings of the term action (fiʿl) and the “theory of state (ḥāl)” in order to prove that human beings are true agents (fāʿil) on the one hand and to protect God’s attribute of creation on the other. In fact, the concept of “state (ḥāl)”, used in understanding divine attributes and some ontological issues, was applied to acts by the Māturīdī mutakallim Ṣadr al-Sharīʿa al-Thānī (d. 747/1346). Thus, a doctrine of action was developed, and this doctrine was accepted and used by the later period Māturīdī mutakallims. With reference to Ṣadr al-Sharīʿa, Qarṣī tries to justify the issue based on the meanings of the the term action and the modes of existence of these meanings. He says that action has two implications; one of them is the “infinitive meaning” (al-maʿnā al-maṣdarī) and the other is “the thing that comes with this infinitive meaning (al-ḥāṣıl bi-maṣdar)”. The infinitive meaning of the act constitutes the “non-thing aspect” of the action, and the meaning of the action that is created with the infinitive indicates “the thing aspect” thereof. Thus, because the aspect of the action that is not existentand therefore not a thing is not subject to creation, the agency and responsibility of human beings are grounded. Similarly, Qarṣī maintains that the mashīʾat, which means will, qaṣd and al-irādah al-juzʾiyyah, was not created because its existence in humans is in the form of succession and it is of a state-like (ḥāl) existenceOn this account. Qarṣī manages to preserve both human freewill and the absolute creativity of God due to the non-existent and non-thing aspect of the act on the one hand, and will (irādah), mashīʾat and qaṣd not being subjected to creation on the other. Aims The study aims to test the Turkish validity and reliability of the Rushton Moral Resilience Scale (RMRS) and examine the effect of moral resilience on moral distress. Background Moral distress is a phenomenon that negatively affects health workers, health institutions, and the person receiving care. In order to eliminate or minimize the negative effects of moral distress, it is necessary to increase the moral resilience of nurses. Moral resilience involves developing systems that support a culture of ethical practice in (...) healthcare and aim to increase an individual’s capacity to cope with moral challenges. Methods A methodological and descriptive-predictive study design was adopted. Sociodemographic Information Form, Measure of Moral Distress – Healthcare Professionals (MMD-HP), and Rushton Moral Resilience Scale were used to collect data from the nurses. A total of 255 clinical nurses were recruited. Ethical considerations Hacettepe University’s non-interventional ethics committee approved the study’s protocol and informed consent was obtained from the participants. Results The original four-factor structure of the scale was tested with confirmatory factor analysis, and the index values were evaluated and found at an acceptable level. The Cronbach Alpha coefficient of the scale was found to be 0.826. Moral resilience predicted moral distress total, intensity, and frequency levels. A moderate and weak relationship was found in the negative between all sub-dimensions of moral distress and moral resilience. Conclusions The Rushton Moral Resilience Scale Turkish version showed good psychometric properties. Moral resilience has a reducing effect on moral distress. Young nurses who have less experience are at risk because they have lower moral resilience levels, while nurses working in intensive care units are at risk because of their high moral distress levels. A healthy workplace can be created by developing specific approaches to improve moral resilience in reducing the impact of moral distress in the healthcare environment. (shrink)

Every emerging technology has its pros and cons; health-conscious users pay more importance to healthy and environment-friendly technologies. Based on the UTAUT2 model, we proposed a comprehensive novel model to study the factors influencing consumers’ decision-making to adopt the technology. Compared to prior studies that focused on linear models to investigate consumers’ technology adoption intentions and use behavior. This study used a Structural Equation Modeling-fuzzy set qualitative comparative analysis approach to account for the complexity of customers’ decision-making processes in adopting (...) new technology. We collected valid responses from 830 consumers, analyzed them, and evaluated them using a deep learning SEM-fsQCA technique to capture symmetric and asymmetric relations between variables. We have extensively incorporated a health-consciousness attitude as a predictor and mediator to understand better the decision-making toward technology adoption, specifically 5G technology. All the factors tested in our model are statistically significant except the economic factors. Health-consciousness attitude and behavioral intention found significant predictors and valid mediators in the process of 5G technology adoption. FsQCA provided six configurations to achieve high 5G adoption. The findings have significant practical ramifications for telecom corporations, advertisers, government officials, and key policymakers. Additionally, the study added substantial theoretical literature to technology adoption, particularly the adoption of 5G technology. (shrink)

Despite some promising steps in the right direction, organizational analysis has yet to exploit fully the theoretical and empirical possibilities inherent in the writings of Pierre Bourdieu. While certain concepts associated with his thought, such as field and capital, are already widely known in the organizational literature, the specific ways in which these terms are being used provide ample evidence that the full significance of his relational mode of thought has yet to be sufficiently apprehended. Moreover, the almost complete inattention (...) to habitus, the third of Bourdieu’s major concepts, without which the concepts of field and capital (at least as he deployed them) make no sense, further attests to the misappropriation of his ideas and to the lack of appreciation of their potential usefulness. It is our aim in this paper, by contrast, to set forth a more informed and comprehensive account of what a relational – and, in particular, a Bourdieu-inspired – agenda for organizational research might look like. Accordingly, we examine the implications of his theoretical framework for interorganizational relations, as well as for organizations themselves analyzed as fields. The primary advantage of such an approach, we argue, is the central place accorded therein to the social conditions under which inter- and intraorganizational power relations are produced, reproduced, and contested. Miracles are extraordinary events that occur in the hands of those who claim to be prophets and which cannot be repeated by others. By these miracles, the prophets prove to society that the truths they convey are of divine origin. The miracles bestowed upon prophets vary according to the scope of the message they deliver and the interests and relevance of the societies with which they deal. Accordingly, Islamic scholars have classified miracles into three groups. The miraculous events that appeal (...) to people’s senses and lead them to the truths they convey by captivating their astonishment are called emotional miracles. Such miracles are events that occur without cause by overcoming the laws of nature, which are in the realm of causes, through the direct intervention of Allāh. On the other hand, spiritual miracles are truths that arouse the interlocutor’s interest in moral conduct and rational conclusions rather than in his sensory perceptions. Since these truths are attained through contemplation, they are not confined to a particular time and place, as in the case of emotional miracles. Some Kalām scholars have also considered the Prophets’ revelational knowledge about events that have occurred in the past or will occur in the future as miracles. They have studied these events that a person could not bear in the past or could not predict for the future under the title of "The news miracle" Among these three types of miracles, scholars have considered spiritual miracles superior to the others both in terms of the breadth of their influence and their continuity. That Prophet Muhammad (PBUH) is the last of the prophets, and that the teachings he received through revelation remain valid until the Day of Judgment necessitates that some of the miracles bestowed upon him must be of a quality that attracts the attention of all people. For this reason, Islamic scholars have placed the permanent miracle of Prophet Muhammad in the category of spiritual miracles. Scholars agree that his greatest miracle that has astonished all humankind is the Qurʾān. The clearest proof of this are the verses in the Qurʾān that challenge the opponents to bring a similar one. Allāh commands the disbelievers first to bring a similitude of the Qurʾān (al-Isrāʾ 17:88), then the equivalent of ten surahs (Hūd 11:13), and finally any surah of the Qurʾān (al-Baqara 2:23). Thus, the deniers are made aware of their inability to meet this challenge under gradually mitigating circumstances. Although scholars agree on the Qurʾānic miracle’s reality, they have expressed different views on its nature and essence. Thus, some scholars have argued that the miracle of the Qurʾān does not arise from some properties special to it but from the direct intervention of Allāh in human who have the ability to bring something like it. Most Islamic scholars, on the other hand, pointed out that the Qurʾān has aspects that exceed human powers in various fields, and they explained the inability to reply in the same vein to the Qurʾān due to its uniquenesses. Accordingly, some scholars have argued that miracles are perceptible, but it is never possible to define them. Other scholars, however, viewed miracles as an identifiable phenomenon and stated that the Qurʾān is an unusual and unique book in terms of verses. In this article, the questions Why was the Quran sent down as a miraculous Kalam with an attribute not found in other divine books and in what way did the Qurʾān make people weak to have a similar of it? were scrutinized, thus, some fundamental questions regarding the nature and character of iʿdjāz al-Qurʾān are elucidated. Since the topic deals with history and literature, scanning sources and data analysis were mainly used as methods in the research. The results can be summerized as follows: Although the Prophet was supported by both emotional and mental miracles in proving the Prophetic case, his greatest miracle is the Quran. The miracle of the Qurʾān is different from the other miracles, based on both the challenging verses and the Prophet's explanations of the miracles. The reason for this difference lies in the fact that the miracle of the Qurʾān is based on reason, unlike the other miracles which are emotional. Most Islamic scholars who deal with the miracle of the Qurʾān emphasize the issues of rhetoric, verse, style, and content. At this point, they emphasized that the Qurʾān has a unique expression and content that cannot be surpassed. (shrink)

This paper presents a new approach to theorizing and empirically investigating a phenomenon variously described by sociologists as internalized oppression or symbolic violence. Located at the intersection of internal worlds and external reality, the intrapsychic and the interpersonal and social, this object of inquiry—here termed self-negation—is crucial to many forms of societal domination. The paper explores its inner workings, analytically disaggregating it into an array of psychosocial processes drawn from the psychoanalytic theory of the defenses. Sosyal varlıklar olan insanlar, tarih boyunca birbirleri ile alışveriş yapma ihtiyacı hissetmişlerdir. Bu alışverişler, genellikle satış akdi yoluyla gerçekleştirilmiştir. Satış akitlerinin kurulmasında en yaygın görülen yöntem ise pazarlık usulü ile gerçekleştirilen müsâveme yöntemidir. İnsanlar satış akdini kurarken, akdin unsurları üzerinde pazarlık yaparak bir anlaşmaya varmışlardır. İslâm hukuku bu yöntemin sınırlarını belirlemiştir. İnsanların birbirlerinin haklarını ihlal etmeden pazarlık yapabilmelerini sağlayacak düzenlemeler getirmiştir. Ayrıntıları başta örf olmak üzere farklı delillerle düzenlense de, insanların satış akdini kurarken bu sınırlara dikkat etmesi gerektiği, doğrudan doğruya (...) naslar ile emredilmiştir. Bu durum hem şahsi zararların hem de toplumsal zararların önüne geçilmesi açısından büyük önem arz etmiştir. Bu kapsamda getirilen bazı sınırlamalar şu şekildedir: Satılmış olan bir malın devredilmeden bir başkasına satılmaması, fiyat yükseltmek amacıyla üçüncü kişinin pazarlığına dahil olunmaması gerektiği ve tarafların pazarlık aşamasının sonu geldiği, anlaşma meyillerinin oluştuğu durumda üçüncü kişinin pazarlığa dahil olmaması gerektiği belirtilmiştir. Bu sınırlamalardan, tarafların anlaşma meyillerinin ortaya çıkmış olduğu durumda üçüncü kişinin taraflardan birinin aleyhine pazarlığa dahil olması konusu çalışmamızda ele alınmıştır. Bu husus İslâm hukuk literatüründe sevm ale’s-sevm olarak nitelendirilmiştir. Türkçe literatürde genellikle pazarlık üzerine pazarlık olarak çevrilmiştir. Çalışmada sevm ale’s-sevm kavramına genellikle yer verilmiş olmakla birlikte, Türkçe olarak ifade edilmesi gerektiğinde pazarlık üzerine pazarlık kavramı kullanılmıştır. Taraflar pazarlığa yönelik ifadelerini akdin kurucu unsuru olan irade beyanı ile birbirlerine iletmektedirler. Dolayısıyla bu çalışmada öncelikle irade beyanına yönelik açıklamalar yapılmıştır. Pazarlığa yönelik bu irade beyanlarının icâb niteliğinde mi yoksa icâba davet niteliğinde mi olduğu hususunda açıklamalara yer verilmiştir. Bu açıklamaların ardından müsâveme yöntemi tanımlanmış ve genel olarak bu yönteme ilişkin bilgi verilmiştir. Müsâveme yöntemi ile oluşturulan akitler ile bu yönteme benzer yöntemlerin farkları hususunda açıklamalar yapılmıştır. Pazarlık yapılırken dikkat edilmesi gereken hususlara değinilmiş ve pazarlık üzerine pazarlık yapmanın yasak olduğu ifade edilmiştir. Akit kurulurken hangi aşamada pazarlığa dahil olmanın bu yasak kapsamında sayılacağı ve hangi aşamadaki müdahalenin yasak kapsamına dahil olmayacağı belirtilmiştir. Bu yasağın neden gerekli olduğu konusunda yapılmış olan açıklamalara yer verilmiştir. Sevm ale’s-sevmin söz konusu olduğu akitlerin genel olarak diyaneten haram kabul edildiği bununla birlikte kazaen bu akitlerin geçerli olduğu ifade edilmiştir. Bu yasağın kapsamına sadece müslümanların değil aynı zamanda müslüman olmayan vatandaşların ve müste’menlerin de dahil olduğu ifade edilmiştir. Buna göre müslüman olmayan bir vatandaş veya müste’men aleyhine böyle bir pazarlığa dahil olmanın hukuka uygun kabul edilmeyeceği açıklanmıştır. Sevm ale’s-sevmin yalnızca satış akdi açısından değil, aynı zamanda kıyas yoluyla diğer akitler bakımından da geçerli olacağı belirtilmiştir. Bu açıklamalarda Hanefî mezhebinin görüşü esas alınmış olmakla birlikte diğer mezheplerin görüşlerine de yer verilmiştir. Makale genel itibariyle Hanefî mezhebi odağında diğer mezheplerin görüşlerine de yer verilen bir yöntemle oluşturulmuştur. Tüm bu görüşlerin ardından mer’î hukukta bu yasağın uygulanıp uygulanmadığı hususunda açıklamalar yapılmıştır. (shrink)

Robert M. Adams (1979, 1987a, 1987b) defends a modified variant of the divine command theory (hereafter MDCT) to the effect that he proposes a moral argument for God’s existence driven in the form of practical reasoning with respect to rational moral agents’ beliefs in the adequacy of MDCT. For Adams, one’s commitment to MDCT as the most adequate theory legitimately provides her a practical reason for why she ought to believe in God’s existence which MDCT implies. In this paper, I (...) criticize the viability of Adams’ moral argument considering its argumentative structure and strategy. Adams’ strategy behind his moral argument, i.e. mediating theistic beliefs with deontic ones, seeks out a non-decisive medium that might be used to ubiquitously generate equally plausible arguments for/against God’s existence based on distinct sorts of allegedly adequate theories of some subject matter. Thus, his argument does not seem to distinctively ground God’s existence in comparison with a myriad of practical arguments which might follow the same argumentative strategy on the same practical grounds. More significantly, there seems to be coherent no way for Adams to disambiguate his argument on theoretical grounds. (shrink)

Justice is an important concept in philosophy since ancient times and a key phenomenon in human life (in societies). First a judge at a court, two sides, their witnesses, Lawyer-A and Lawyer-B are considered in this quasi-essay inquiry. Then pointed out that, which lawyer better develops his/her arguments, his/her side will be advantageous. Reality conceals on the one side, truth (and rightness) stands on the other. However this will be risky in social life; it may be understood by an ordinary (...) man (or someone who doesn’t have a proper philosophical insight) as “who - obeying the rules- better diverts reality and shows that (s)he is right, his/her side wins.” Not only knowledge, but also philosophy itself loses prestige in such a tableau. Stemming from ‘Gettier-pictures,’ a “murderingevent” is presented thereafter. By help of pseudo-philosophers Prof. Truth, Prof. Reality and E.G. (“eyeglasser”) some perspectives related to “knowledge” and “knowing” are discussed while trying to analyze the mentioned event. At the end, (reflecting in the place of me) E.G. states some features (which are important for him) concerning knowledge. In this paper, ‘subject-dependency’ and internalizability (or better, interiorizability) of knowledge will be traced somehow; in addition to a search towards ‘relevant’, ‘valuable’, ‘illicit’, and ‘proper’ kinds. Some of the outstanding masters of Kurdish historical schools (Medresê) are usually and rightly seen as belonging to the Aristotelian tradition. In this introductory study I briefly present some manuscripts of Kurdish glosses on Aristotelian logical texts, and show that the Aristotelian logical tradition, as inherited from early Islamic philosophers, also formed an important strand in Kurdish schools. Kurdish students' peculiar approach to Aristotelian logic affected the way in which Categories, De Interpretatione and Isagoge were studied in Kurdish schools from (...) the fifteenth century onwards. From the mid-1960s through much of the 1980s, Durkheim's contributions to historical-comparative sociology were decidedly marginalized; the title of one of Charles Tilly's essays, "Useless Durkheim," conveys this prevailing sensibility with perfect clarity. Here, by contrast, I draw upon writings from Durkheim's later "religious" period to show how Durkheim has special relevance today for debates in the historical-comparative field. I examine how his substantive writings shed light on current discussions regarding civil society; how his analytical insights help to show how (...) action within civil society as well as other historical contexts is channelled by cultural, social-structural, and social-psychological configurations (plus transformative human agency); and how his ontological commitment to a "relational social realism" contributes to ongoing attempts to rethink the foundations of historical-comparative investigation. It is possible to mention many scholars and their studies that have been the milestone in the formation and evolution of the differences in recitation, which started with the Prophet’s permission in different recitation, as a scientific discipline. One of these scholars, Ahmad b. Muhammad al-Dimyātī (d. 1117/1705), was a versatile figure who was skilled in various branches of science, especially in the science of recitation. He owes his fame mostly to his authorship of Ithāf al-fudalāʾ al-bashar, one of the (...) most well-known studies in the field of recitation. The study on the author is important because of his work on the science of recitation and his influence on this field. In particular, the author’s influence on the teaching of recitation in Egypt and the Ottoman period enriches this study even more meaningful. In this regard, it is aimed in this study to briefly introduce Dimyātī and his studies, who wrote Ithāfu fudalāʾ al-bashar, which is one of the important reference sources in learning the methodical differences of the schools expressed as tarīq (route) and profession in the science of Qiraat since the Ottoman period in our country, and it is also aimed to make a modest contribution to the scholarly research to be conducted on this great Qiraat scholar. This article will try to make an evaluation of Dimyātī’s life, scholarly personality, studies and place in the science of recitation, about whom there is no academic study in our country except for the item of Encyclopaedia of Islam. It is seen that Dimyātī lived in a period when explanation, annotation and ta‘likāt (depending upon or deriving from a text) were in vogue and he was significantly influenced by the dominant understanding of the period to a certain extent. The explanations and annotations he wrote on studies belonging to different branches of science show that he was significantly influenced by the scholarly understanding of the period. The author’s study titled Ithāf al-fudalāʾ al-bashar written especially on the science of recitation especially on the science of recitation, continues to be valued as a primary source even today. One of the famous studies of the literature of the fourteen recitation, Ithāf is one of the basic sources of the “Takrīb” phase of the process called “Ashara-Takrîb-Tayyib” in teaching of recitation. The effectiveness of a compliance management framework can be guaranteed only if the framework is based on sound conceptual and formal foundations. In particular, the formal language used in the CMF is able to expressively represent the specifications of normative requirements that impose constraints on various activities of a business process. However, if the language used lacks expressiveness and the modelling constructs proposed in the CMF are not able to properly represent different types of norms, it can significantly impede the (...) reliability of the compliance results produced by the CMF. This paper investigates whether existing CMFs are able to provide reasoning and modeling support for various types of normative requirements by evaluating the conceptual foundations of the modeling constructs that existing CMFs use to represent a specific type of norm. The evaluation results portray somewhat a bleak picture of the state-of-the-affairs when it comes to represent norms as none of the existing CMFs is able to provide a comprehensive reasoning and modeling support. Also, it points to the shortcomings of the CMFs and emphasises exigent need of new modeling languages with sound theoretical and formal foundations for representing legal norms. (shrink)

The recent revival of the theme of hospitality in the humanities and social sciences reflects a shared concern with issues of belonging, identity and placement that arises out of the experience of globalized social life. In this context, migration — or spatial dislocation and relocation — is often equated with demands for hospitality. There is a need to engage more carefully with the ‘proximities’ that prompt acts of hospitality and inhospitality; to attend more closely to their spatial and temporal dimensions. (...) Is the stranger or the Other primarily one who is recognisably ‘out of place’? Or is there more to being estranged than moving from one territory to another? This brings us to the question of human finitude, and to the possibility of encounters with others that do not simply only occur in time or space, but are themselves generative of new times and spaces. The attempt in this article is to reflect on the notion of hospitality, building on Derrida's engagement with the notion. In doing so, I visit some of the debates on cosmopolitanism, a term which, I believe, is sometimes used overenthusiastically, neglecting the negative implications it might carry. Besides, I observe the same uncritical stance towards the reception of Kant's notion of `universal hospitality', developed in his famous piece on `Perpetual Peace', a text that has been at the core of the (...) recent debates on cosmopolitanism. I revisit Kant's text to discuss the implications of his project. I distinguish between `the other' and `the stranger', and try to develop a politics and ethics of hospitality due to the stranger. Elias and Foucault ended up making the same core discovery about the same fundamental social process, which we term the ‘social constraints towards self-discipline’ process. We show how three distinct biographical and intellectual factors were important in guiding them toward this discovery: (1) their shared exposure to philosophical traditions associated with Heidegger’s break from Husserl; (2) their common, sustained contact with ‘clinical’ practices; and (3) the traumatic events each experienced in relation to intentional injury and death.

Muhammed es-Semerkandî'nin (öl. 701/1301) "Risâle fî ḥaḳîḳati’l-‘âlemi’l-kebîr ve’s-ṣağîr/Büyük ve Küçük Âlemin Hakikati Hakkında Bir Risâle" adlı eserini tahkîk etmeyi, müellifin hayatı ve eserin içeriğini incelemeyi amaçlamaktadır. Rükneddin es-Semerkandî'nin müteahhir/geç dönem Mâtürîdî ve Hanefî âlimlerinden biri olduğu; kelâm, tasavvuf, tefsir, fıkıh usulü, hadis ve diğer alanlardaki eserleriyle İslâm medeniyeti tarihinde belirgin izler bıraktığı belirtilmelidir. Semerkandî'nin eserlerinde de görüldüğü gibi o, sûfî kelâmcılardan veya kelâmcı sûfîlerinden biridir. Üslubu, kelâm, tasavvuf ve - zaman zaman geniş anlamıyla - felsefe (...) ile karışık olan bir sentezdir. Bu da şaşırtıcı bir şey değildir. Zira Semerkandî, ilimlerin iç içe geçtiği ve kelâm ile tasavvufun felsefe boyasıyla boyandığı (Gazâlî (öl. 505/1111) ve Fahreddin er-Râzî (öl. 606/1210) sonrası) bir dönemde yaşamıştır. Elimizdeki risâlesi aracılığıyla, Rükneddin es-Semerkandî'nin kelâmcı ve mutasavvıf olmasının yanı sıra felsefeden de etkilendiğini görüyoruz. Zira insan ile büyük âlem arasındaki benzetme veya insan ve âlem arasında bir bağ kurma meselesi, kökleri eski felsefelere dayanan eski bir bakış açısıdır; daha sonra İslâm felsefesi ve İslâm düşüncesi bütünüyle bu felsefî perspektiften etkilenmiş ve insanı küçük bir âlem olarak görmüşlerdir. Rükneddin es-Semerkandî, insanı küçük bir âlem olarak veya kendi ifadesiyle büyük âlemin fihristi olarak gören Müslüman düşünürler veya âlimlerden biridir. The principles underpinning Islam's ethical framework applied to routine clinical scenarios remain insufficiently understood by many clinicians, thereby unfortunately permitting the delivery of culturally insensitive healthcare. This paper summarises the foundations of the Islamic ethical theory, elucidating the principles and methodology employed by the Muslim jurist in deriving rulings in the field of medical ethics. The four-principles approach, as espoused by Beauchamp and Childress, is also interpreted through the prism of Islamic ethical theory. Each of the four principles is investigated (...) in turn, looking in particular at the extent to which each is rooted in the Islamic paradigm. This will provide an important insight into Islamic medical ethics, enabling the clinician to have a better informed discussion with the Muslim patient. It will also allow for a higher degree of concordance in consultations and consequently optimise culturally sensitive healthcare delivery. (shrink)

The debate on the possibility of attaining metaphysical knowledge by the method of reasoning began with the ancient Greek philosophers and continues to this day. This article aims to examine how Râzî argues for the possibility of attaining metaphysical knowledge through the method of reasoning. He first argues that existence has two parts, the sensed and the thought, in order to demonstrate that metaphysical knowledge can be obtained through the method of reasoning. Then he tries to prove that existence is (...) not limited to the material. After presenting evidence for the existence of things other than the sensible in existence that can be perceived with the intellect, he tries to discuss our devices to relate to this sphere of existence in a comparative manner. In this comparison, two possible devices for attaining metaphysical knowledge emerge: the theoretical intellect and the purified soul. After revealing the positive and negative aspects of both in this comparison, he argues that the most reliable device is the theoretical intellect and the technique is the method of reasoning Râzî gives various answers to those who object to the possibility of obtaining metaphysical knowledge through the method of reasoning. Râzî tries to put forward the grounds on which the groups who object to the method of reasoning are based. He then evaluates their justifications in terms of accuracy and consistency. Thus, he tests both the relevance of each group's objection to the subject and its consistency with the group's other beliefs. He then presents the justifications for his own opinion on the method of reasoning and the consistency of this method with his other beliefs. Following this method, Râzî first divides those who object to the method of reasoning into two categories according to whether or not they accept a metaphysical sphere of existence. According to this division, those who object to the method because they do not accept a metaphysical sphere of existence are the Sophists, Sumeniyya, Mujasimah, Dhahriyya, and Hashawiyya. Although this group does not accept a metaphysical sphere of existence, they are divided into two classes: those who believe in God and those who do not. According to Râzî, the group that accepts the metaphysical sphere of existence but objects to the method of reasoning is the Talimiyya. They claim that metaphysical knowledge can only be attained through the teaching of an innocent instructor, not by the method of reasoning. The different approaches of these groups are the reason why Râzî sometimes emphasizes accuracy, sometimes consistency, and sometimes proving the metaphysical domain of existence in his answers to those who object to the method of reasoning. Death is an undeniable fact of life. Whether it is a bad or feared thing is an important discussion that can be brought back to the ancient Greek philosophers. This article is primarily concerned with the discussion on what grounds Epicurus's thesis "death, is nothing to us; since when we exist, death is not yet present, and when death is present, then we do not exist," and to what extent satisfactory results are reached. Later, it tries to investigate how Lucretius, (...) who is regarded as the successor of Epicurus, derives the result of meaningless of fear of death from the symmetrical relationship between prenatal and post-mortem non-existences. Finally, it refers to the modern asymmetric approaches which argue that, contrary to Lucretius's claim, the relationship between these two periods of non-existence is not symmetrical, because there are serious differences between the later birth and the later death of people, given their deprivations. This article argues that death has a mystery that raises the anxiety that comes from the nature of death; however, it defends the idea that it makes a significant contribution to the meaning of life. In this study, the tahrîj method, which is used in answering contemporary Fiqh issues throughout the history of Fiqh, will be described and some sample fatwas given by the High Board of Religious Affairs based on this method will be analysed. Tahrîj is firstly to define the procedural and legal principles on which the singular views of a madhhab imam is based on, and then to determine the verdict of the issues in which an opinion from that imam is not (...) conveyed, according to the rules reached. Firstly the High Board of Religious Affairs will be introduced briefly highlighting issues such the effort put forward by the Board in the answering current fiqh issues, its contributions to the unity of fatwa and that it is a continuation of the Islamic Meşîhat-ı İslamiyye in the Ottoman Empire. Tahrîj, will be defined and its types, history, and its role in the development of fiqh and in solving current fiqh issues will be explained. Among the issues resolved by the High Board of Religious Affairs by applying the Tahrîj method or by making use of this method; commercial insurance, organ transplantation, gold-based lease certificate and the effect of injection/vaccine on fasting will be analysed. Given these exemplary fatwas, it will be tried to show that the method of Tahrîj is important today as it was in the past, both in terms of maintaining the consistency of fiqh and its contribution to the development of fiqh. It can be said that Westerners have always seen Muslims and Islam as an obstacle to their own existence. They constantly see themselves as superior and try to belittle those who are not like them. The prejudice created by this point of view has prevented them from seeing Islamic civilization. Although many scientists and thinkers have tried to evaluate this accumulation by being influenced by Islamic thought, governments and people have always viewed the issue as such an opposition. This hatred (...) increased even more when Muslims began to conquer the countries of Western (Christian) societies through conquests. The aim of the "Orientalism Research Centers", which was established with the support of the Vienna Church Council, was to make this struggle more systematic by recognizing the Easterners/Muslims instead of understanding them in all their aspects and through the weak sides they could find. Thus, Westerners wanted to place in the Muslim mind The notion they were superior in every field, that Muslims had always been reactionary and that they had to be corrected. In the modern era, the idea that religion is contrary to science and progress and is the source of all conflicts has prevailed in the West. For this reason, it is aimed to create a human and society free from religion and religious.. In the modern era, a secular society experiment was made, people could not be happy. When it comes to the post-modern period, people, whose spiritual and belief aspects were neglected, showed a tendency to turn to religion again with the longing for this. Western governments, politicians and global capitals have resorted to all kinds of remedies to prevent this tendency towards Islam. The construction of Islamophobia has been a concrete proof of this pursuit. The fact that the perpetrators of the September 11 events in the USA and the terrorist attacks in many other western states which is following them, consist of Muslims, has been the pillar of the construction of “Islamophobia” in the West. Capital appetites of global capitals and ancient hostilities have opened the door to direct intervention in Muslim countries with “Islamophobia”. Thanks to Islamophobia, this intervention has been accepted as legitimate in both Western and many Eastern societies. In this study, it is focused on how the “Islamophobia” built into a pragmatic tool is transformed. It has been emphasized that Islamophobia is a legitimate basis for the West to control the energy and oil resources of the Middle East, which has whetted the appetite of the USA. At this point, it has been seen that the West and the USA have achieved their goals to a large extent. However, it was emphasized that in the intervened societies, problems such as poverty, terrorist incidents, ethnic and sectarian divisions, and the masses being forced to migrate could not be solved in the recent past. In this study, an analysis has been made by dealing with a qualitative method, why Westerners behave like this and what they aim with it. (shrink)

In the report the parity of true and knowledge on the basis of reconsideration of communication of true opinion and knowledge, and also interpretation of the term "opinion" in Plato’s gnosiology is considered. Described Set of cognitive procedures of the subject of the knowledge in it, necessary for reception of knowledge from true, is comparable to functions and results of influence of criterion of true in cognitive process. The importance of these efforts of the subjectguarantees Plato and Aristotle theory of (...) knowledge against suspicions of poststructuralists and postmodernists in «decentralization, « death of «subject».Thus the author finds out not only discrepancy, but also the certain continuity of gnosiological ideas of postmodernism with the standard concept of knowledge, which basis were put in pawn by Plato. In opinion of the author, such comparative analysis allows to reconsider settled representations on communication of categories «true» and «knowledge», and also to narrow an empirical field of «false knowledge» due to introduction of the term «imaginary knowledge». The parity of trueproved in given clause and knowledge to some extent reflects metamorphosises of true which in postmodernism are designated as «game of true».
