Suppose one hundred prisoners are in a yard under the supervision of a guard, and at some point, ninety-nine of them collectively kill the guard. If, after the fact, a prisoner is picked at random and tried, the probability of his guilt is 99%. But despite the high probability, the statistical chances, by themselves, seem insufficient to justify a conviction. The question is why. Two arguments are offered. The first, decision-theoretic argument shows that a conviction solely based on the statistics (...) in the prisoner scenario is unacceptable so long as the goal of expected utility maximization is combined with fairness constraints. The second, risk-based argument shows that a conviction solely based on the statistics in the prisoner scenario lets the risk of mistaken conviction surge potentially too high. The same, by contrast, cannot be said of convictions solely based on DNA evidence or eyewitness testimony. A noteworthy feature of the two arguments in the paper is that they are not confined to criminal trials and can in fact be extended to civil trials. (shrink)

Many philosophers have pointed out that statistical evidence, or at least some forms of it, lack desirable epistemic or non-epistemic properties, and that this should make us wary of litigations in which the case against the defendant rests in whole or in part on statistical evidence. Others have responded that such broad reservations about statistical evidence are overly restrictive since appellate courts have expressed nuanced views about statistical evidence. In an effort to clarify and reconcile, I put forward an interpretive (...) analysis of why statistical evidence should raise concerns in some cases but not others. I argue that when there is a mismatch between the specificity of the evidence and the expected specificity of the accusation, statistical evidence—as any other kind of evidence—should be considered insufficient to sustain a conviction. I rely on different stylized court cases to illustrate the explanatory power of this analysis. (shrink)

En este artículo buscamos explicar lo que llamamos “la nueva preponderancia de la dimensión política en las relaciones internacionales”, entendiendo por aquello la creciente importancia que han adquirido últimamente tanto los actores políticos como el apostar por estrategias multidimensionales en política exterior –en contraposición a estrategias unidimensionales basadas en el contractualismo económico-comercial-, para tratar de dar respuesta a las inquietantes y complejas interrogantes que presenta el actual escenario mundial. La tesis del trabajo es que esta “vuelta a la política” en (...) el plano internacional se explica por la confluencia de dos fenómenos-procesos: por un lado el cambio de ciclo económico –propulsado en gran parte por la crisis financiera global-, que implica el inicio de lo que el economista inglés Robert Skidelsky llama ciclo “liberal-keynesiano”, y por otro lado la transformación del sistema internacional y el paso a lo que el académico estadounidense Richard Haass llama “la era de la no polaridad”. The literature on algorithmic fairness has examined exogenous sources of biases such as shortcomings in the data and structural injustices in society. It has also examined internal sources of bias as evidenced by a number of impossibility theorems showing that no algorithm can concurrently satisfy multiple criteria of fairness. This paper contributes to the literature stemming from the impossibility theorems by examining how informational richness affects the accuracy and fairness of predictive algorithms. With the aid of a computer simulation, we (...) show that informational richness is the engine that drives improvements in the performance of a predictive algorithm, in terms of both accuracy and fairness. The centrality of informational richness suggests that classification parity, a popular criterion of algorithmic fairness, should be given relatively little weight. But we caution that the centrality of informational richness should be taken with a grain of salt in light of practical limitations, in particular, the so-called bias-variance trade off. (shrink)

Many oppose the use of profile evidence against defendants at trial, even when the statistical correlations are reliable and the jury is free from prejudice. The literature has struggled to justify this opposition. We argue that admitting profile evidence is objectionable because it violates what we call “equal protection”—that is, a right of innocent defendants not to be exposed to higher ex ante risks of mistaken conviction compared to other innocent defendants facing similar charges. We also show why admitting other (...) forms of evidence, such as eyewitness, trace, and motive evidence, does not violate equal protection. (shrink)

Smith argues that, unlike other forms of evidence, naked statistical evidence fails to satisfy normic support. This is his solution to the puzzles of statistical evidence in legal proof. This paper focuses on Smith’s claim that DNA evidence in cold-hit cases does not satisfy normic support. I argue that if this claim is correct, virtually no other form of evidence used at trial can satisfy normic support. This is troublesome. I discuss a few ways in which Smith can respond.

Con la entrada en el Collège de France, en 1953, Merleau-Ponty comienza una reflexión sobre el problema de la filosofía que no cesa hasta sus últimos cursos en la célebre institución. Termina su conferencia, Elogio de la filosofía, poniendo énfasis en la filosofía como expresión, a la luz de las aportaciones de la lingüística, y sobre la voluntad de hablar del filósofo. Ni una palabra sobre la fenomenología y el existencialismo en esta ocasión. Pero seis años más tarde elogia la (...) filosofía de la existencia, como mirada al mundo de una época y sus problemas. Dedica los últimos cursos en el Collège a justificar la posibilidad de la filosofía, a partir de Husserl sobre todo; entiende que la nueva filosofía, como interrogación del saber (de los saberes) y del ser, es por ello una nueva ontología. In queste pagine è delineata la vicenda esistenziale e intellettuale di Edith Stein. Donna straordinaria, è stata capace di racchiudere nella sua persona molte "possibili" vite. Le ha realizzate come ebrea e cattolica, fenomenologa e filosofa cristiana, docente e monaca carmelitana, agnostica e santa. Si tratta di un processo vitale dagli apparenti salti qualitativi, i quali si volgono all'ascolto di un medesimo nucleo identitario. Questa viva "formazione di sé" ha condotto Edith Stein a una "donazione di sé", culminata nell'Olocausto. Il (...) Diario di Edith si sovrappone ai pensieri di Angela Ales Bello, in veste di narratrice d'eccezione. Con la sentita partecipazione della narratrice, e insieme mantenendo il distacco critico della studiosa, viene scoperta la storia di un'anima. Le emozioni e le conquiste intellettuali trovano una sintesi grazie al peculiare approccio ai "fenomeni" che Edith Stein aveva appreso alla scuola di Edmund Husserl, di Tommaso d'Aquino e di Teresa D'Avila. El objetivo propuesto en el siguiente trabajo es elucidar cómo desde la finitud de la existencia puede establecerse la problemática de la temporalidad dentro del entramado de pensamiento de Martin Heidegger. Para ello realizaremos un análisis de la conferencia de 1924 Der Begriff der Zeit, uno de los textos que allanan el camino a Sein und Zeit, en lugar de centrar la investigación en la considerada obra magna de Heidegger. Una reflexión acerca de este texto previo permitirá avanzar en el (...) análisis de la existencia al mostrar cómo el tiempo está arraigado en la existencia individual, no como un solipsismo, sino como apertura de posibilidades respecto del mundo (a la postre compartido con los otros). Una descripción fenomenológica de la muerte posibilitará la apertura al mundo, definiendo una temporalidad existencial que incluye no sólo al instante presente, sino también al pasado (concebido bajo la forma del «haber-sido») y al futuro. My aim in this paper is to deal with E. Husserl’s and E. Stein’s analyses on the anthropological and metaphysical questions. To perform this task it is necessary to explain the meaning of the phenomenological method, first of all in Husserl and then in E. Stein, underscoring the novelty of their approach to the knowledge of human being, world and God. The essay is divided in four parts; two are dedicated to Husserl’s and Stein’s investigation on the human being and (...) two to their development of metaphysical themes. Regarding the first topic we discover a significant connection between the two thinkers, regarding the second one we notice that it is possible to find a metaphysical approach to reality even in Husserl and an original development of the theme in Stein’s analysis linked up with the medieval philosophy and theology. El trabajo enfoca la emigración desde la ética de la alteridad de Emmanuel Levinas, lo cual exige ciertas decisiones metódicas. Primero reivindicar para la alteridad la misma legitimidad filosófica de categorías consoliddadas como la identidad. Después explorar las diferencias internas a la alteridad en su despliegue temporal o histórico y espacial o (multi)cultural. Tercero, asociar la alteridad a la ética y sus diferencias para, en cuarto lugar, centrar el argumento en la alteridad ética de Emmanuel Levinas articulada, como se sabe, (...) en torno a la categoría del “otro” que, al presentarse como “rostro”, aparece como la expresión de la vulnerabilidad misma. Esta vulnerabilidad abstracta – en quinto lugar – se concreta como vulnerabilidad migratoria, efecto de condiciones socio-culturales determinadas cuyo portador, el emigrante (sobre todo el musulmán y el subshariano) encarna por derecho propio la figura filosófica del otro levinasiano y su interpelación por la justicia. En este contexto, finalmente, la responsabilidad asimétrica se revela como la imposibilidad de que los interpelados no den/demos una respuesta. . (shrink)

¿Ha inventado la libertad el siglo XVIII? El análisis, que podría hacerse desde la triple experiencia de la libertad artística, "libertina" y política, se limita aquí al examen de esta última tanto desde la perspectiva de la Revolución Gloriosa teorizada por Locke en Two Essays of Government, como desde la experiencia de la Revolución Francesa, anticipada teóricamente en Du contrat social, así como desde la perspectiva de la "meta soñada" prevista por Kant.Is freedom an XVIIIth Century invention? Such a question (...) could be analysed involving the artistic, the "libertin" and the political aspects of the experience of freedom. Here, the political one is considered only, not only from the perspective of Lockets "Glorious Revolution" dealt with in Two Essays of Government, but in the light of the Du contrat social theorically anticipated French Revolution as well, and also from the prospective of Kant’s "dreamt goal". Este artículo aborda la contextualización de la ética de Butler en un marco teórico que da por supuesta la perspectiva deconstructiva y que, por su parte, es reconstruido de acuerdo a dos criterios, las nociones de “matriz disciplinal” y de “paradigma”. Mediante ellas se trata de proporcionar un sistema de conceptos o categorías usuales en la teoría ética en general, pero redefinidas en términos butlerianos. Estas categorías a las que nos referimos son la acción, los sujetos, los juicios y los (...) criterios morales y, que, aplicadas a la ética de Butler, dan lugar a una ética precaria en la que la humanidad normativa se revela como imposible universalmente y, por tanto, no puede ser utilizada como “fundamento” de un juicio moral universal. Por ejemplo, la que se sugiere mediante las manifestaciones de duelo por la humanidad de “los nuestros”, víctimas de la violencia, de las que queda excluida estructuralmente la humanidad de “los otros”. The primary aim of this chapter is to explain the nature of evidential reasoning, the characteristic difficulties encountered, and the tools to address these difficulties. Our focus is on evidential reasoning in criminal cases. There is an extensive scholarly literature on these topics, and it is a secondary aim of the chapter to provide readers the means to find their way in historical and ongoing debates.
