: This article is a humble attempt at highlighting the controversiesregarding the legitimacy of popular resistance or revolutionary movement tobring down Muslim political regime that claimed to be despotic, unjust andeven un-Islamic. There is a growing demand for information and computational technology for surgeons help with surgical planning as well as prosthetics design. The two-dimensional images are registered to the three-dimensional (3D) model for high efficiency. To reconstruct the 3D model of knee joint including bone structure and main soft tissue structure, the evaluation and analysis of sports injury and rehabilitation treatment are detailed in this study. Mimics 10.0 was used to reconstruct the bone structure, ligament, and meniscus according to the pulse (...) diffusion-weighted imaging sequence (PDWI) and stir sequences of magnetic resonance imaging (MRI). Excluding congenital malformations and diseases of the skeletal muscle system, MRI scanning was performed on bilateral knee joints. Proton weighted sequence (PDWI sequence) and stir pulse sequence were selected for MRI. The models were imported into Geomagic Studio 11 software for refinement and modification, and 3D registration of bone structure and main soft tissue structure was performed to construct a digital model of knee joint bone structure and accessory cartilage and ligament structure. The 3D knee joint model including bone, meniscus, and collateral ligament was established. Reconstruction and image registration based on mimics and Geomagic Studio can build a 3D model of knee joint with satisfactory morphology, which can meet the requirements of teaching, motion simulation, and biomechanical analysis. Reproductive medical technology has revolutionized the natural order of human procreation. Accordingly, some have celebrated its advent as a new and liberating determinant of kinship at the global level and advocate it as a right to reproductive health while others have frowned upon it as a vehicle for “guiltless exchange of sexual fluid” and commodification of human gametes. Religious voices from both Christianity and Islam range from unthinking adoption to restrictive use. While utilizing this technology to enable the married couple (...) to have children through the use of their own sexual material is welcome, the use of third party, surrogacy, and reproductive cloning are not in keeping with the sacrosanct principles of kinship, procreation through licit sexual intercourse, and social cohesiveness for building a cohesive family as uphold by both Christianity and Islam. To examine such larger issues emanating from these new ways of human procreation, beyond the question of legality, is a point which legal scholars in both Christianity and Islam, when issuing religious decrees, have not anticipated sufficiently. The machines exhibit an intelligence which is artificial intelligence, and it is the design of intelligent agents. A system is represented by an intelligent agent who perceives its environment and the success rate is maximized by taking the action. The AI research is highly specialized and there are two subfields and each communication fails often. The popular AI approaches include the traditional symbolic AI and computational intelligence. In order to optimize the seismic design of the reinforced concrete pier structure, the (...) particle swarm optimization algorithm and the reaction spectrum analysis method are combined; they establish a regular bridge of the design variable with cross-sectional characteristics and reinforcement ratios, with the target function. The seismic optimization design framework of the pier is transformed into a multi-objective optimization problem. Calculations show that the method can quickly obtain the optimal design parameters that meet multi-objective requirements. The improved PSO main program and the calling push-over program run time are 4.32 and 1347.56 s, respectively; the push-over program running time is 99.68% of the run time of the total program. Optimization of the seismic performance of the rear bridge pier is significantly improved and is more in line with the design method; the design method proposed in this article is more practical. In this paper I shall be looking at the state of science before and after the 17th century especially with regard to the question of the nature of scientific knowledge, specifically scientific paradigms. I will argue that some of the major differences between modern science and pre-modern science are due to (i) methodological changes, (ii) the rise of paradigmatic monism in modern science as opposed to paradigmatic pluralism in pre-modern science, (iii) the integration of science with technology after the 17th (...) century. These changes, I maintain, also redefine the role of scientific knowledge in society and culture, and bring in its wake certain problems and challenges, which in turn elicit different types of responses. Pre-modern science, I argue, are admirably suited to play a cultural and religious role, partly because of a lack of a pragmatic criterion of knowledge, and the emphasis on rational coherence. This makes enchantment of nature through science, possible. However, with the further evolution of science, especially the introduction of the experimental method and the emphasis on empiricism in the 17th century, scientific knowledge now has to conform to different criteria of knowledge -pragmatic in partleading to 'paradigmatic monism' and the consequent loss of enchantment in our conception of nature. The rise of the new science beginning in the 17th century thus brings in its wake a new set of epistemological and cultural challenges which were met with in different ways. In this article, I will view realist and non-realist accounts of scientific models within the larger context of the cultural significance of scientific knowledge. I begin by looking at the historical context and origins of the problem of scientific realism, and claim that it is originally of cultural and not only philosophical, significance. The cultural significance of debates on the epistemological status of scientific models is then related to the question of ‘intelligibility’ and how science, through models, can give us (...) knowledge of the world by presenting us with an ‘intelligible account/picture of the world’, thus fulfilling its cultural-epistemic role. Realists typically assert that science can perform this role, while non-realists deny this. The various strategies adopted by realists and non-realists in making good their respective claims, is then traced to their cultural motivations. Finally I discuss the cultural implications of adopting realist or non-realist views of models through a discussion of the views of Rorty, Gellner, Van Fraassen and Clifford Hooker on the cultural significance of scientific knowledge.Keywords: Models; Intelligibility; Scientific realism; Culture. This important and comprehensive work of 18th-century Islamic religious thought written in Arabic by a pre-eminent South Asian scholar provides an extensive and detailed picture of Muslim theology and interpretive strategies on the eve of the modern period.

While heredity is predominantly controlled by what deoxyribonucleic acid (DNA) sequences are passed from parents to their offspring, a small but growing number of traits have been shown to be regulated in part by the non‐genetic inheritance of information. Transgenerational epigenetic inheritance is defined as heritable information passed from parents to their offspring without changing the DNA sequence. Work of the past seven decades has transitioned what was previously viewed as rare phenomenology, into well‐established paradigms by which numerous traits can (...) be modulated. For the most part, studies in model organisms have correlated transgenerational epigenetic inheritance phenotypes with changes in epigenetic modifications. The next steps for this field will entail transitioning from correlative studies to causal ones. Here, we delineate the major molecules that have been implicated in transgenerational epigenetic inheritance in both mammalian and non‐mammalian models, speculate on additional molecules that could be involved, and highlight some of the tools which might help transition this field from correlation to causation. This experiment investigated the effect of format (line vs. bar), viewers’ familiarity with variables, and viewers’ graphicacy (graphical literacy) skills on the comprehension of multivariate (three variable) data presented in graphs. Fifty-five undergraduates provided written descriptions of data for a set of 14 line or bar graphs, half of which depicted variables familiar to the population and half of which depicted variables unfamiliar to the population. Participants then took a test of graphicacy skills. As predicted, the format influenced viewers’ interpretations (...) of data. Specifically, viewers were more likely to describe x–y interactions when viewing line graphs than when viewing bar graphs, and they were more likely to describe main effects and “z–y” (the variable in the legend) interactions when viewing bar graphs than when viewing line graphs. Familiarity of data presented and individuals’ graphicacy skills interacted with the influence of graph format. Specifically, viewers were most likely to generate inferences only when they had high graphicacy skills, the data were familiar and thus the information inferred was expected, and the format supported those inferences. Believing that p, assuming that p, and imagining that p involve regarding p as true—or, as we shall call it, accepting p. What distinguishes belief from the other modes of acceptance? We claim that conceiving of an attitude as a belief, rather than an assumption or an instance of imagining, entails conceiving of it as an acceptance that is regulated for truth, while also applying to it the standard of being correct if and only if it is true. We argue (...) that the second half of this claim, according to which the concept of belief includes a standard of correctness, is required to explain the fact that the deliberative question whether to believe that p is transparent to the question whether p. This argument raises various questions. Is there such a thing as deliberating whether to believe? Is the transparency of the deliberative question whether to believe that p the same as the transparency of the factual question whether I do believe that p? We will begin by answering these questions and then turn to a series of possible objections to our argument. (shrink)

When we deliberate whether to believe some proposition, we feel immediately compelled to look for evidence of its truth. Philosophers have labelled this feature of doxastic deliberation 'transparency'. I argue that resolving the disagreement in the ethics of belief between evidentialists and pragmatists turns on the correct explanation of transparency. My hypothesis is that it reflects a conceptual truth about belief: a belief that p is correct if and only if p. This normative truth entails that only evidence can be (...) a reason for belief. Although evidentialism does not follow directly from the mere psychological truth that we cannot believe for non-evidential reasons, it does follow directly from the normative conceptual truth about belief which explains why we cannot do so. BackgroundThe research shows a growing trend in using an electronic platform to supplement or replace traditional paper-based informed consent processes. Instead of the traditionally written informed consent document, electronic informed consent may be used to assess the research subject’s comprehension of the information presented. By doing so, respect for persons as one of the research ethical principles can be upheld. Furthermore, these electronic methods may reduce potential airborne infection exposures, particularly during the pandemic, thereby adhering to the beneficence and nonmaleficence (...) principle. This scoping review aims to identify the ethics related criteria that have been included in electronic informed consent processes and to synthesize and map these criteria to research ethics principles, in order to identify the gaps, if any, in current electronic informed consent processes.MethodsThe search was performed based on internet search and three main databases: PubMed, SCOPUS and EBSCO. PRISMA Extension for Scoping Reviews : Checklist and Explanation guideline was used to report this work.ResultsOf 34 studies that met the inclusion criteria, 242 essential original constructs were collated, and 7 concepts were derived. Digital content showed the highest percentage of collated original constructs followed by accessibility, comprehension engagement, autonomy, confidentiality, language, and parental consent. Twenty-five new items were synthesized for eConsent criteria which may provide guidance for ethical review of research involving eConsent.ConclusionThe current study adds significant value to the corpus of knowledge in research ethics by providing ethical criteria on electronic informed consent based on evidence-based data. The new synthesized items in the criteria can be readily used as an initial guide by the IRB/rec members during a review process on electronic informed consent and useful to the future preparation of a checklist. Over the years, there are various research on cultural development seen from socio-historical perspective. The uniqueness of Islam in Malay region as it is diverse and open to outside influences is important to be look at; as it differs greatly from "the Islam" that have been practiced in the Middle East. Based on the discussions, the ulemas or Muslim clerics of this region and the Malays themselves have already practiced the supra-madhhab model as proposed by many contemporary scholars. Using Shia (...) influences in the Malay culture, this paper attempt to show how sectarianism within Islam was never entertained by the Muslims in this region. In fact, Shi'ism was so embedded in Malay culture. Although being dominated by Sunnism, most of the Shia doctrines and pillars were widely accepted and embraced. The axiology of Shi'ism in Malay culture reflected in many religious texts, classical literature and cultural events. However, as sectarianism rising in this region, the Shia influence and its axiology slowly eroded and were victimized by unnecessary foreign interventions. (shrink)

Purpose Based on the Unified Theory of Acceptance and Use of Technology (UTAUT) model, this study aims to explore the factors influencing educators’ acceptance and utilization of chat generative pretrained transformer (ChatGPT) in the context of higher educational institutions. This study additionally examines the moderating influence of trust on the association between intention and adoption of ChatGPT. Design/methodology/approach A structured questionnaire was disseminated to 1,214 educators following the purposive sampling method. The hypothesized relationships between the extended UTAUT model constructs and (...) ChatGPT adoption were examined using structural equation modeling. Findings The results of this study indicate positive impact of ChatGPT adoption and its use behavior (UB) among educators. Performance expectancy, effort expectancy, hedonic motivation, facilitating conditions and habit have a positive impact on behavior intention to use this tool among educators in higher education institutions, However, the educators intend to use ChatGPT in a personal capacity and are negatively influenced by the social groups. Moreover, behavior intention to adopt ChatGPT has a larger effect on the UB due to the higher involvement of trust. Practical implications This research adds to the literature on technology adoption by emphasizing the significance of trust in the adoption of emerging technologies, such as big language models. This study’s findings have implications for ChatGPT technology developers, legislators and academics considering the implementation of ChatGPT for teaching and research. Originality/value This research investigates ChatGPT adoption among higher education educators using the UTAUT model. It emphasizes the role of trust in adoption, highlights key adoption factors and reveals a paradox: educators are personally inclined to use ChatGPT but hesitant due to negative social influence. This study's novelty lies in its focus on trust and its implications for developers, legislators and educators, offering valuable insights for integrating ChatGPT in education. (shrink)

Current formal dialectical models postulate normative rules that enable discussants to conduct dialogical interactions without committing fallacies. Though the rules for conducting a dialogue are supposed to apply to interactions between actual arguers, they are without exception theoretically motivated. This creates a gap between model and reality, because dialogue participants typically leave important content-related elements implicit. Therefore, analysts cannot readily relate normative rules to actual debates in ways that will be empirically confirmable. This paper details a new, data-driven method for (...) describing discussants’ actual reply structures, wherein corpus studies serve to acknowledge the complexity of natural argumentation. Rather than refer exclusively to propositional content as an indicator of arguing pro/contra a given claim, the proposed approach to dialogue structure tracks the sequence of dialogical moves itself. This arguably improves the applicability of theoretical dialectical models to empirical data, and thus advances the study of dialogue systems. (shrink)

The current global scenario calls for a more‐efficacious, acceptable, cost‐effective and reliable method of immunization for many fatal diseases. It is hoped that the adoption of oral vaccines will help to provide an effective vaccination strategy, especially in developing countries. Mucosal immunity generated by oral vaccines can serve as a strong first line of defense against most of the pathogens infecting through the mucosal lining. The concept of knowledge and its implication to national development, with reference to Malaysia; and analysis from Islamic viewpoint.

This research examines the complex interplay of religiosity, sexuality, and infidelity. We adopted a case study approach in this research, and discourse was made central to the analysis. There were two participants; both identified as homosexuals. One participant, Fahrin, is married while the other, Muzz, is divorced at the time of the interview. The participants were subjected to an in-depth, semi-structured interview to gauge their experiences, perceptions, opinions, beliefs, and thoughts on their sexuality, Islamic faith as well as relationship with (...) their spouses. The data were then transcribed and analyzed using the Discursive Action Model and Discursive Psychology frameworks. From the analysis, two overarching themes were identified. They are the allocation of blame and accountability and the participants’ attachment to their Islamic identity. The discussion then revolves around the societal role that pressures gay men to marry women and contextualizes the position of Islam on Homosexuality. (shrink)

Cet article examine la théorie de la connaissance immédiate d' ʿAbd al-Jabbār à partir de sonMughnī, ainsi que de textes écrits par ses élèves ou par (...) des Muʿtazilites tardifs. Est aussi étudié le rapport entre cette théorie et les arguments théologiques d'ʿAbd al-Jabbār. Ce travail est divisé en deux parties: en premier lieu, j'étudie la définition de la connaissance immédiate par ʿAbd al-Jabbār et les réactions de ses successeurs; en second lieu, j'analyse sa conception des types de connaissance immédiate étroitement liés à ses arguments théologiques. Mark Schroeder has recently presented apparent counterexamples to the standard account of the distinction between the right and the wrong kinds of reasons. We argue that these examples appear to refute the standard account only because they blur the distinction between two kinds of reasoning: reasoning about whether to intend or believe that p and reasoning about whether to take up the question of whether to intend or believe that p.

The use of pig derivatives in medicine is forbidden in Islamic law texts, despite the fact that certain applications offer medical advantages. Pigs can be one of the best human organ hosts; therefore, using human–pig chimeras may generate beneficial impact in organ transplantation, particularly in xenotransplantation. In Islam, medical emergencies may allow some pig-based treatments and medical procedures to be employed therapeutically. However, depending on the sort of medical use, emergency situation might differ. Using Islamic legal maxim as bioethical framework, (...) the purpose of this study is to examine the use of pigs for the purpose of human–pig chimeric transplant from the perspective of Islamic bioethics. Why, when asking oneself whether to believe that p, must one immediately recognize that this question is settled by, and only by, answering the question whether p is true? Truth is not an optional end for first-personal doxastic deliberation, providing an instrumental or extrinsic reason that an agent may take or leave at will. Otherwise there would be an inferential step between discovering the truth with respect to p and determining whether to believe that p, involving a bridge premise that (...) it is good (in whichever sense of good one likes, moral, prudential, aesthetic, allthings-considered, etc.) to believe the truth with respect to p. But there is no such gap between the two questions within the first-personal deliberative perspective; the question whether to believe that p seems to collapse into the question whether p is true. The “dead-donor rule” states that, in any case of vital organ donation, the potential donor should be determined to be dead before transplantation occurs. In many countries around the world, neurological criteria can be used to legally determine death (also referred to as brain death). Nevertheless, there is considerable controversy in the bioethics literature over whether brain death is the equivalent of biological death. This international legal review demonstrates that there is considerable variability in how different jurisdictions have evolved to (...) justify the legal status of brain death and its relationship to the dead-donor rule.In this article, we chose to review approaches that are representative of many different jurisdictions—the United States takes an approach similar to that of many European countries; the United Kingdom’s approach is followed by Canada, India, and influences many other Commonwealth countries; Islamic jurisprudence is applicable to several different national laws; the Israeli approach is similar to many Western countries, but incorporates noteworthy modifications; and Japan’s relatively idiosyncratic approach has received some attention in the literature. Illuminating these different justifications may help develop respectful policies regarding organ donation within countries with diverse populations and allow for more informed debate about brain death and the deaddonor rule. This study aims to draw a gender based analysis of social and economic conditions of child labourers living in Karachi. Globally the issue of child labour is growing constantly and children are engaged in all sorts of hazardous forms of work, like adults, which deprives them from education, healthy life, child hood activities and balanced diet. In Pakistan the child labour is very common in all economic sectors, but it is mainly found in the informal sector and the household sector. (...) Purposive and convenience sampling techniques of non-probability sampling are used to collect data through structured questionnaire from 900 respondents from eighteen administrative districts of Karachi, which is based upon primarily quantitative and narrowly focused qualitative research methods. The findings of the study reveal that mostly children between the ages of 12 to 14 years are commonly inducted in different economic sectors. This clear violation of child rights makes them vulnerable to health and safety threats and putting them forcefully in hazardous occupations to earn bread and butter for their family by compromising their education. Ambas obras contienen material de una gran originalidad y son bastante completas, ofreciendo detallada información sobre temas relativos tanto al nombramiento como al cese de los jueces durante los primeros (...) siglos de la historia islámica de Egipto. Se estudia la biografía de cada juez para averiguar cuáles fueron las razones que determinaron su nombramiento y su cese. Workers can be fired from jobs, citizens sent to jail, and adolescents more likely to experience depression, all because of algorithms. Algorithms have considerable impacts on our lives. To increase user satisfaction and trust, the most common proposal from academics and developers is to increase the transparency of algorithmic design. While there is a large body of literature on algorithmic transparency, the impact of unethical data collection practices is less well understood. Currently, there is limited research on the factors that (...) affect users’ trust in data collection practices and algorithmic transparency. In this research, we explore the relative impact of both factors as they relate to important outcome measures such as user’s trust, comfort level, and moral acceptability. We conducted two pilot studies to learn what real users consider to be ethical and unethical data collection practices, as well as high and low transparency for algorithms. We then used these findings in a 2 × 2 design to examine how transparency and the acceptability of data collection practices impact users’ acceptance, comfort, and trust in algorithms. Our results suggest that the singular emphasis on algorithmic transparency may be misplaced. Given the difference in their impact to increase acceptance, trust, and user satisfaction, a more effective strategy would be to also understand and abide by users’ views of ethical data collection practices. Why can't deliberation conclude in an intention except by considering whether to perform the intended action? I argue that the answer to this question entails that reasons for intention are determined by reasons for action. Understanding this feature of practical deliberation thus allows us to solve the toxin puzzle.

Advances in life-saving technologies in the past few decades have challenged our traditional understandings of death. Traditionally, death was understood to occur when a person stops breathing, their heart stops beating and they are cold to the touch. Today, physicians determine death by relying on a diagnosis of ‘total brain failure’ or by waiting a short while after circulation stops. Evidence has emerged, however, that the conceptual bases for these approaches to determining death are fundamentally flawed and depart substantially from (...) the established biological conception of death. We argue that the current approach to determining death consists of two different types of unacknowledged legal fictions. These legal fictions were developed for practices that are largely ethically legitimate but need to be reconciled with the law. The considerable debate over the determination of death in the medical and scientific literature has not informed the public that vital organs are being procured from still-living donors and it seems unlikely that this information can remain hidden for long. Given the instability of the status quo and the difficulty of making the substantial legal changes required by complete transparency, we argue for a second-best policy solution: acknowledging the legal fictions involved in determining death to move in the direction of greater transparency. This may someday result in more substantial legal change to directly confront the challenges raised by life-sustaining and life-preserving technologies without the need for fictions. (shrink)

: This article analyses the roles of ‘ulamā’ in propagating the messageof Islam in the Malay world. Islam managed to reach many corners of the Malayworld in the 17th century. Evidence has indicated that ‘ulamā’ were amongthose who had participated actively in propagating the messages of Islam tothe local people. Classical Malay texts served as the best available records tounderstand the roles of these ‘ulamā’ at that time. Hence, analysis are made onselected classical Malay texts in order to understand the (...) actual roles played bythe ‘ulamā’ in the Malay world at that time in transforming the understandingof the local Malay people from the beliefs in Hindu-Buddhist and animism toIslam. Three significant roles of the ‘ulamā’ at that time have been identifiednamely propagating knowledge to the local people, religious advisors to therulers as well as engaging with the non-Muslims. South Asian regional integration is seemingly confronting many challenges. The aim of this paper is to identify those challenges and also look for prospects. Although regional integration in South Asia has adopted a kind of institutionalization, it is yet to deliver any concrete outcomes. High-politics and the not-so-conducive regional economic structures hinder any effectual culmination. However, constructivism, as a theory, is given due credence in this paper when looking for future prospects. On advance medical directives in Malaysia from Islamic bioethics; papers of a seminar.

This paper attempts to examine the paradigm shift in ASEAN from a state-based to a people-based organization. We argue that by adopting a people-based organization, ASEAN now enters an era of Neo-Communitarianism replacing the Old Communitarianism of the old generation of ASEAN. By using communitarian perspectives, we look at the continuities and changes in ASEAN with regard to how it deals with issues involving their members. Three important issues namely the debates on intervention principle; the adoption of the three pillars (...) of the ASEAN Community; and the inclusion of human rights are seen as the signposts where ASEAN departs from their Old to a Neo-Communitarianism. Although there have been a lot of challenges to the realization of the people-based organization, we see that the dynamics of debates and the active participation of the community in the debates show good prospects for the new paradigm to realize. In this paper, we use debate on the formation of ASEAN Intergovernmental Commission on Human Rights (ICHR), to show the involvements of people in setting the agendas for the future ASEAN. (shrink)

Visual masking of primes lowers prime visibility but spares processing of primes as reflected in prime–target congruence and prime–response compatibility effects. However, the question is how to appropriately measure prime visibility. Here, we tested the influence of three procedural variables on prime visibility measures: prime–target similarity, prime–response similarity, and the variability of prime–response mappings. Our results show that a low prime–target similarity is a favorable condition for a prime visibility measure because it increases the sensitivity of this measure in comparison (...) to a high prime–target similarity. The religious rites of Shia remain a mystery to Malaysia’s Sunnite majority. One such rite is the ziyarat (visits to sacred sites). This essay highlights the ritualsconducted and performed by Malaysian Shi’ites during their seasonal pilgrimage to Iran and Iraq. Their rituals and behaviors during these pilgrimages to holy shrines in Iran and Iraq were documented from the standpoint of a cultural anthropologist. Rites from two sites, Mashad and Karbala, are presented in this study. Applying Herbert Blumer’s symbolic interactionism as (...) a conceptual framework, and Charles Brooks’s methodology through social interaction and participant-observation, this essay aims to analyze and understand their rites, and the values and significance of these rites. By doing so, the axiological aspects of the rites were observed and clarified, thus enabling non Shi’ite Muslims to perceive greyest area of Shia rites, as performed by Shi’ites from Malaysia in their pilgrimage to Iran and Iraq. This paper is diagnostic type rather than a solution one. There are claims among certain quarters that The Universal Declaration of Human Rights 1948 is a Western mould human rights. However, I will argue that human rights are benchmark for modernization and progress in democracy, and it is traceable within Islam. Using Syed Hussein Alatas‘s Ideal of Excellence as thereotical framework, my attempt is to highlight the memory of Tanzimat during Ottoman empire as one triumph heritage and successful story of (...) human rights modernization within Islam, and not the moment or starting point of failure for the Ottoman. Unfortunately, this modernization does not reflected in the Malay world as it is perceived as the weakening process of Ottoman. Today, similar challenges faced by Ottoman are being faced by the Malay world. Legalistic Islam and Wahhabism are among others that slowing down the modernization of human righs within Malay world. This article presents the Islamic bioethical deliberation on the issue of sex assignment surgery for infants with disorders of sex development or intersexed as a case study. The main objective of this study is to present a different approach in assessing a biomedical issue within the medium of the Maqasid al-Shari’ah. Within the framework of the maqasidic scheme of benefits and harms, any practice where benefits are substantial is considered permissible, while those promoting harms are prohibited. The concept of Maqasid (...) al-Shari’ah which is the mechanistic interpretation of Qur’an and Hadith presents the holistic attention of Islam on many life activities, including healthcare. Indeed, this concept encompasses many aspects of worldly life, both for the human individual and collectively for the whole society. In healthcare, the practice of SAS on DSD newborns has presented an assortment of implications on the future livelihood of the affected individual. The process of decision-making seems to be very multifaceted since every element such as the determination of the ‘correct’ sex and the urgency of early surgery must consider the benefits and harms, as well as the child’s rights and best interest. The application of the concept of Maqasid al-Shari’ah, would convey a pragmatic approach that is often disregarded in Western medicine. This approach considers the right of the individual to live life optimally, individually and socially and practice his faith, precisely, in accordance with the assigned gender. (shrink)
