Genetic testing can be used to determine if unexplained fractures in children could have resulted from a predisposition to bone fractures, e.g., osteogenesis imperfecta. However, uncertainty is introduced if a variant of unknown significance is identified. Proper interpretation of VUS in these situations is critical because of its influence on clinical care and in court rulings. This study sought to understand how VUS are interpreted and used by practitioners when there is a differential diagnosis including both osteogenesis imperfecta and non-accidental (...) injury.A 15-question survey was emailed to physicians who requested analysis of two genes, COL1A1 and COL1A2, from the University of Washington from 2005-2013 for patient cases involving suspicion of child abuse.Among the 89 participants, responses differed about when genetic testing should be ordered for osteogenesis imperfecta, who should be consulted about utilization of VUS test results, follow-up procedures, and who should receive the VUS results.There are no clear guidelines for how to interpret and follow up on VUS. In the legal setting, misinterpreted VUS could lead to unintended consequences and deleterious ramifications for family members. The need for better practice guidelines to help promote more equitable handling of these sensitive legal cases is clear. (shrink)

The essential nature of legislative power is to make the laws; that of executive power is to execute those law. The difference between the two is both substantial and significant; it is the difference between the rule of arbitrary power and the rule of law. This paper will seek to trace the genesis of an independent judicial power, in both theory and practice, through an examination of sections of The Constitutions of Clarendon, The Assize of Clarendon, Hobbes’ Leviathan, Locke’s Second (...) Treatise, Montesquieu’s Spirit of the Laws, as well as The Federalist Papers. Moreover, it will seek to establish its executive nature and to explain why it is so often (at least presently) misunderstood to be akin to the legislative power. (shrink)

Consistent with Ruchkin and colleagues' proceduralist account, recent research on grouping and verbal-spatial binding in immediate memory shows continuity across short- and long-term retention, and activation of classes of information extending beyond those typically allowed in modular models. However, Ruchkin et al.'s account lacks well-specified mechanisms for the retention of serial order, binding, and the control of activation through attention.

This book provides a compositional, truth-conditional, crosslinguistic semantics for evidentiality, the linguistic encoding of the source of information on which a statement is based. Central to the proposed theory is the distinction between what propositional content is at-issue and what content is not-at-issue. Evidentials contribute not-at-issue content, and can affect the level of commitment a sentence makes to the main proposition, contributed by sentential mood. In this volume, Sarah Murray builds on recent work in the formal semantics of evidentials (...) and related phenomena, and proposes a semantics that does not appeal to separate dimensions of illocutionary meaning. Instead, she argues that all sentences make three contributions: at-issue content, not-at-issue content, and an illocutionary relation. At-issue content is presented and made available for subsequent anaphora, but is not directly added to the common ground; not-at-issue content directly updates the common ground; and the illocutionary relation uses the at-issue content to impose structure on the common ground, which, depending on the clause type, can trigger further updates. 0The analysis is supported by extensive empirical data from Cheyenne, drawn from the author's own fieldwork, as well as from English and a variety of other languages. It is commonly supposed that metaphysical modal claims are to be evaluated with respect to a single domain of possible worlds: a claim is metaphysically necessary just in case it is true in every possible world, and metaphysically possible just in case it is true in some possible world. We argue that the standard understanding is incorrect; rather, whether a given claim is metaphysically necessary or possible is relative to which world is indicatively actual. We motivate our view by attention (...) to discussions in Salmon 1989 and Fine 2005, in which various data are taken to support rejecting the transitivity of accessibility and modal monism ; we argue that relativized metaphysical modality can accommodate these data compatible with both standard modal logic and modal monism. Noting an analogy with two-dimensional semantics, we argue that metaphysical modality has a complex structure, reflecting what is counterfactually possible, relative to each indicatively actual world. In arguing for the need for relativization, we are broadly on the same side as Crossley and Humberstone and Davies and Humberstone ; our contribution here is, first, to offer distinctively metaphysical reasons for relativization, and second, to show that relativization can be incorporated in ways minimally departing from standard modal logic. Minnesota Archive Editions uses digital technology to make long-unavailable books once again accessible, and are published unaltered from the original University of Minnesota Press editions. In contemporary philosophy the works of George Berkeley are considered models of argumentative discourse; his paradoxes have a further value to teachers because, like Zeno's, they challenge a beginning student to find the submerged fallacy. And as a final, triumphant perversion of Berkeley's intent, his central contribution is still commonly (...) viewed as an argument for skepticism - the very position he tried to refute. This limited approach to Berkeley has obscured his accomplishments in other areas of thought - his account of language, his theories of meaning and reference, his philosophy of science. These subjects and others are taken up in a collection of twenty essays, most of them given at a conference in Newport, Rhode Island, commemorating the 250th anniversary of Berkeley's American sojourn of 1728–31. The essays constitute a broad survey of problems tackled by Berkeley and still of interest to philosophers, as well as topics of historical interest less familiar to modern readers. This paper presents a computer model of cortical broadcast and competition based on spiking neurons and inspired by the hypothesis of a global neuronal workspace underlying conscious information processing in the human brain. In the model, the hypothesised workspace is realised by a collection of recurrently inter-connected regions capable of sustaining and disseminating a reverberating spatial pattern of activation. At the same time, the workspace remains susceptible to new patterns arriving from outlying cortical populations. Rationale, aims and objectives : Evidence-based medicine (EBM) claims to be based on 'evidence', rather than 'intuition'. However, EBM's fundamental distinction between quantitative 'evidence' and qualitative 'intuition' is not self-evident. The meaning of 'evidence' is unclear and no studies of quality exist to demonstrate the superiority of EBM in health care settings. This paper argues that, despite itself, EBM holds out only the illusion of conclusive scientific rigour for clinical decision making, and that EBM ultimately is unable to fulfil its (...) own structural criteria for 'evidence'. Methods : Our deconstructive analysis of EBM draws on the work of the French philosopher, Jacques Derrida. Deconstruction works in the name of justice to lay bare, to expose what has been hidden from view. In plain language, we deconstruct EBM's paradigm of 'evidence', the randomized controlled trial (RCT), to demonstrate that there cannot be incontrovertible evidence for EBM as such. We argue that EBM therefore 'auto-deconstructs' its own paradigm, and that medical practitioners, policymakers and patients alike ought to be aware of this failure within EBM itself. Results : EBM's strict distinction between admissible evidence (based on RCTs) and other supposedly inadmissible evidence is not itself based on evidence, but rather, on intuition. In other words, according to EBM's own logic, there can be no 'evidentiary' basis for its distinction between admissible and inadmissible evidence. Ultimately, to uphold this fundamental distinction, EBM must seek recourse in (bio)political ideology and an epistemology akin to faith. (shrink)

There is a nationwide resurgence of tuberculosis in the country’s urban centers; New York City stands at the forefront of this resurgence. The root causes are increased homelessness, drug addiction and poverty, all symbols of deteriorating social and economic conditions in the city. The inadequate level of public health resources devoted to TB has also contributed to its spread. Still, even with these factors, it is questionable whether the escalating number of TB cases in this country would have occurred without (...) the reservoir of immunosuppressed persons, who are less resistant to the disease, created by the AIDS epidemic. The fear and urgency of this public health crisis, which has been emerging since the beginning of the last decade, are fueled by the rise of TB strains resistant to the first-line drugs and by the disease’s contagiousness. Eliciting negative stereotypes about ageing commonly results in worse performance on many physical, memory, and cognitive tasks in adults aged over 65. The current studies explored the potential effect of this “stereotype threat” phenomenon on older adults’ emotion recognition, a cognitive ability that has been demonstrated to decline with age. In Study 1, stereotypes about emotion recognition ability across the lifespan were established. In Study 2, these stereotypes were utilised in a stereotype threat manipulation that framed an emotion recognition task (...) as assessing either cognitive ability, social ability, or general abilities. Participants then completed an emotion recognition task in which they labelled dynamic expressions of negative and positive emotions. Self-reported threat concerns were also measured. Framing an emotion recognition task as assessing cognitive ability significantly heightened older adults’ reports of stereotype threat concerns. Despite this, older adults’ emotion recognition performance was unaffected. Unlike other cognitive abilities, recognising facially expressed emotions may be unaffected by stereotype threat, possibly because emotion recognition is automatic, making it less susceptible to the cognitive load that stereotype threat produces. This essay reads J.M. Coetzee’s novel, Diary of a Bad Year, as an occasion to problematize contemporary bioethical paradigms. Coetzee’s rhetorical strategies are analyzed to better understand the “scene of address” within which ethical claims can be voiced. Drawing on Foucault’s Socratic understanding of ethics as the self’s relation to itself, self-relation is explored through the rhetorical figure of catachresis. The essay ultimately argues that the ethical voice emerges when the terms—terms by which I relate to myself, to others, to (...) my own body, and to the bodies of others—are themselves subject to catachrestic refiguration. In recent years, philosopher Jeff McMahan has solidified an influential view that moral desert is irrelevant to the ethics of self-defense. This work aims to criticize this view by demonstrating that there are cases in which moral desert has a niche position in determining whether it may be permissible to kill a person in self- (or other-)defense. This is done by criticizing McMahan’s Responsibility Account of liability as being overly punitive against minimally responsible threateners (MRTs), and by demonstrating, through reference (...) to Saba Bazargan’s Hybrid Account of liability to defensive harm, that further justification than mere liability is necessary in the justification of killing these kinds of threateners. It is also argued that other kinds of justifications like lesser-evil justifications are not necessarily strong enough to justify killing MRTs, even on top of established liability. This paper puts forward the view that, where a strong enough moral difference between threatener and innocent victim cannot be established, a justification on the basis of the implications of prior moral acts might, on some occasions, give us reasons to kill or not kill MRTs in self-defense.
