Recently, David Boonin has put forward several objections to Carlos S. Nino's 'Consensual Theory of Punishment'. In this paper I will defend Nino against the 'explicit denial objection'. I will discuss whether Boonin's interpretation of Nino as a tacit consent theorist is right. I will argue that the offender's consent is neither tacit nor express, but a special category of implicit consent. Further, for Nino the legal-normative consequences of an act (of crime) are 'irrevocable', i.e. one cannot (expressly and successfully) (...) deny liability to them. I will suggest an explanation for Nino's irrevocability claim. (shrink)

University study can be a life period of heightened psychological distress for many students. The development of new preventive and intervention programs to support well-being in university students is a fundamental challenge for mental health professionals. We designed an 8-week online mindfulness-based program combining a face-to-face approach, text, audio, video components, and support psychotherapy principles with a unique intensive reminder system using the Facebook Messenger and Slack applications in two separate runs. We assessed the program’s effect on mindful experiencing, perceived (...) stress, emotion regulation strategies, self-compassion, negative affect, and quality of life. The results of the presented pilot study confirmed that eMBP is a feasible and effective tool in university students’ mental health support. The students who completed the eMBP reported a reduction of perceived stress with a large effect size as well as a decrease of negative affect experience frequency and intensity, an increase of being mindful in their life, and a higher rate of self-compassion with a medium effect size. A small effect size was found in the frequency of using a cognitive reappraisal strategy. One new result is the observation of an eMBP effect on the decrease in attributed importance to the quality-of-life components replicated in two consecutive runs of the program. The study affirms that mindfulness-based interventions can be effectively delivered in an eHealth form to university students. (shrink)

This book is a revised translation of two works by Miroslav Hroch, which together form a pioneering comparative analysis of the various struggles for national identity in nineteenth-century Europe. It is concerned with the decisive phase of 'national renaissance', when small groups of committed patriots successfully generated mass support. When and why was their propaganda effective? The author attempts to answer this fundamental question by locating the patriots within the contemporary social structure, and uses data derived from many different (...) nationalisms. The work is divided into three sections; a theoretical examination of the origins of nationalism and nation-hood, a quantitative survey of the social and territorial structure of the patriots of eight representative national movements, and a comparative analysis of the social and professional groups that formed the milieu of patriotism. Numerous statistical tables and maps illuminate the text, which forms one of the most significant studies of the nationalist phenomenon to be published in recent years. (shrink)

This paper deals with the simple paradoxes of validity and with the possibility of solving them in terms of Bradwardinian-Buridanian semantics. The paradoxes of validity as conceived here are cases of semantic pathology, which result due to the use of terms signifying the validity of inference. Semantic paradoxes are a semantico-epistemological phenomenon which is a symptom of the need to revise several apparently acceptable semantic assumptions. The analysis of possible solutions to the paradoxes focuses on Bradwardinian-Buridanian semantics and as a (...) result on the closed, token-based semantic theories that assume the existence of an implicit meaning of propositions. The key theses, as far as the solution to the paradoxes is concerned, are the principle of truth-implication which claims that every proposition expresses or implies its own truth and the closure principle which claims that every proposition asserts or expresses everything that follows from it logically. The present paper advances on recent research in claiming that (with certain reservations) the application of these principles can effectively solve inconsistency-paradoxes but not indeterminacy-paradoxes of validity. In addition to structural issues and topic selection issues, the subject of professional interest is the interpretation of historical events, especially those that are to a certain extent controversial or play a negative role in terms of ethnic relations. It is not the intention to stop looking at national history "with our own eyes" and to try to look at the point of view of an independent observer (the emotional attitude to the history of one's own nation as a part (...) of the personal identity can not be dispensed with) - the sense should more often point to the positive mutual influences countries have enriched each other, as mutual contacts (including competition) have contributed to progress, such as the crossing of cultures and the lifestyle of their current form.--Publisher's website. The assumption of rational expectations (RE) plays two roles in economic models: it imposes restrictions on behaviour of agents, and it ensures model consistency. Dissatisfaction with RE on behavioural grounds has, in a variety of models, led to its replacement by more behaviourally plausible postulates. However, replacing RE by ad hoc behavioural postulates may result in internally inconsistent models. This work introduces a conceptual framework within which the nature of the issue can be described, and points to potential problems that (...) the abandonment of RE entails. We argue that the RE-based notion of consistency is model-specific rather than general, and introduce a weaker consistency condition that is relevant for non-RE models. To assess the consistency of these models, we propose a test and illustrate its use taking an example from the recent literature. Broader implications of the findings are discussed. (shrink)

In 2004 in Prague, I met Slovak philosopher Miroslav Marcelli, who had attended Foucault's lectures in Paris in 80s. We talked about the legacy of Foucault and contemporary philosophy. Mr. Marcelli taught me philosophy at Comenius University in 1995.. I never visited his lectures, I only passed the exam.. The most interesting point was his answer to my 'provocations' replicating the common prejudice about impracticability of the philosophy. He answered "Do you think that e.g. Descartes didn't know about it?" (...) In fact, people tend to think that philosophers or mathematicians, are "asocial" without "social" intelligence, while their occasional isolation (e.g. Nietzsche) is a product of social exclusion, rather than their choice. In 2013 I applied Foucault's concept of Discontinuity to short 10 minutes movie: Discontinuity, projected in my exhibition "From Animation" in Holland Park, London. The film has 3 parts, ends as it starts to show the significant historical events in 4 windows, when the same idea appears to disappear to re-appear.. Foucault's philosophy doesn't seem to me so unique now, e.g. the idea that many historical changes or progress itself is often illusionary - masking the power structure, had already been explored 515 BC, in depth by Parmenides who concluded: the change is impossible. Given Bernard Suits’ stature in the philosophy of sport, his take on strategic fouling, surprisingly, hasn’t been given much attention in the literature. Rather than relying on a purely empirical or ‘ethos’ approach to justify the Strategic Foul he provides a mixed justification. Suits’ account combines a priori and a posteriori elements. He introduces a third kind of rule, which appears to be unlike rules of skill or constitutive rules, into his conceptual scheme. Suits claims that it is sometimes tactically (...) correct to break such a rule in order to gain an advantage. I will argue that the a priori element in his justification of strategic fouling is unconvincing because there is nothing special about ‘third type’ rule-violations, which incur a ‘fixed penalty’. Furthermore, the a posteriori element ultimately reduces to a rule of skill, and it is doubtful whether it has sufficient normative force to warrant breaking a rule. But, most importantly, the a posteriori element degrades the power of the a priori element. (shrink)

Martin Le Maistre , also known as Martinus Magistri, was one of the nominalists at the university of Paris from the watershed between medieval and postmedieval scholasticism. This influential logician, moral philosopher and theologian wrote a repeatedly edited treatise on logical consequence Tractatus consequentiarum. The present paper focuses on this treatise where Le Maistre, influenced by late-medieval logicians, develops a theory of validity based upon postulating abstract compound entities as sentential meanings.

Since the late thirteenth century, the counterfactual Filioque debate, i.e., the question whether the Son and the Holy Spirit were distinct persons in the Trinity if the Holy Spirit only proceeded from the Father and not also from the Son, was an interesting context for developing the methodology of extreme thought experiments and the logic of conditionals with impossible antecedents and paradoxes of implication. In the mid-1620s, Puente Hurtado de Mendoza introduced a strongly critical approach towards the scientific merits of (...) positing certain types of impossible scenarios while joining this traditional debate in his Tractatus de Trinitate. He argued that the counterfactual Filioque problem is a needless detour and either shifts to unreliable discussions of properties of fictional entities or is outright trivial for logical reasons. The present article offers a modern edition of the ninth disputation of Hurtado’s Tractatus de Trinitate and analyses logical and methodological aspects of Hurtado’s position in the counterfactual Filioque debate. Aristotle’s notion of substance presents various problems of interpretation. Many interpreters focus mainly at the notion of primary substance, especially with regard to the difference between how Aristotle defines it in Metaphysics VII and in the Categories. The present study aims at confirming mutual compatibility of these texts and touches also the problem of knowability of the primary substance. Translation: Lukáš Novák.

The paper focuses on the role of quantity in the studies of communication. The first step in the examination of the quantity of participants involved in the process of communication was the transition from the telegraphic model to the orchestra model. This step was done by the representatives of the New communication as well as in the course of the development of the semiotics studies. The second step leads us to the city model that can be found in Lévi-Strauss’ early (...) works. The city model enables us to take into account not only the unconscious and unintentional activities of the participants, but also the effects of multiplicity. One of the most important achievements of this approach is the idea of a collective intelligence. (shrink)

This paper explains various strategies of contemporary Islamists extremism in Europe. The author identifies the most important variants of Islamist extremism and deals with their goals and with strategic approaches how to achieve these goals. Quasi-legalist strategies as well as violent forms of interest-empowerment are described. The author uses sources from various Islamist organizations and analyses these materials within the framework of modern insurgency. A comprehensive outlook and threat assessment of Islamist extremist strategies are included in this article.

Meet semidistributive varieties are in a sense the last of the most important classes in universal algebra for which it is unknown whether it can be characterized by a strong Maltsev condition. We present a new, relatively simple Maltsev condition characterizing the meet-semidistributive varieties, and provide a candidate for a strong Maltsev condition.

The problem of logical omniscience breaks down to the problems of the closure of knowledge under implication and of the distribution of knowledge over implication. In late medieval scholasticism these two related issues were engaged in various genres, in particular in general analysis of validity, games of obligationes, solution to self-referential antinomies and semantics of terms. The present study analyses the corpus of fourteenth-century texts with some overreaches to the subsequent two centuries, attempting to cover representatives of both the “British” (...) and the “Continental” tradition. With some degree of simplification, this results in a range of four basic positions: 1. knowledge is closed under “analytic entailment” (Buridan), 2. knowledge distributes over implication (Heytesbury), 3. knowledge distributes over implication provided that its consequent’s truth is being taken into consideration (Peter of Mantua), 4. knowledge does not distribute overimplication (Wyclif). World Rugby (WR) announced in 2020 that transwomen should not be competing at the elite level because of safety and fairness concerns. WR and Jon Pike, a philosopher of sport advising them, adopted a lexical approach to get a grip on the three values in play: safety, fairness, and inclusion. Previously, governing bodies tried to balance these competing values. Michael Burke recently published a paper taking aim at Pike’s lexical approach. This is a reply to Burke.

Over the last decades we have witnessed a proliferation of new human rights claims (e.g. the ‘human right’ to internet access) . But Milan Kundera (1991) reminds us that not all desires are human rights. Trans women athletes (and their supporters) often claim that there is a human right to sport and they derive a further ‘human right’ from this: the right to compete in the sex category with which they identify (i.e. the female category). The purpose of this article (...) is to critically assess these two claims: 1. every person has a human right to compete in sport; 2. trans women have a human right to compete in the female category in sport. U tekstu se polazi od problemske konstatacije prema kojoj je kapitalizam kao način života toliko postao dominantan da sustavno prožima cjelokupno vrijeme pojedinca, i radno i slobodno vrijeme. Dakle, sustav je čovjekovo vrijeme u totalu stavio u zavjetrinu ekonomije. I njime upravlja i vlada .Dalje se u tekstu postavlja pitanje koliko će još proći »vremena da se deblokiraju potencijali čovjekove prirode zapreteni u ekonomiji slobodnog vremena« . U suprotnom »svaki napredak u proizvodnji s pasivnom proizvođačkom klasom može samo pospješiti izdvajanje (...) i jačanje nove gornje klase« . Tako nastaje dublja problemska situacija u kojoj se pojedinci pretvaraju u pasivne grupe i društvene zajednice i time cijelo društvo čine pasivnim i osrednjim.Rješenje se, prema Supeku, nalazi u izoštravanju »samosvijesti građanina« kojom bi se uspješno otklanjala pasivnost i nekritičnost čovjekove svijesti. Cijeli bi se taj proces mogao razvijati iz temeljne »usamljenosti« građanina, koja pretpostavlja sigurnu distancu od tržišnog konzumerizma. Samosvijest nastala usred vlastite usamljenosti, tj. usred kritičkog odmaka od svakodnevice, bila bi osnažena i kritički otvorena prema sebi i prema sredini u kojoj živi. I tada bi mogla »djelovati kako hoće«, a ne kako je diktirano odozgor.Ta temeljna i kritički distancirana usamljenost građanina razumijevala bi se kao kvalitetno novo iskustvo vremena u neovisnom i autonomnom prostoru slobode u kojem se konačno može ostvariti vlastito slobodno vrijeme bitno drugačije od pasivne besposlice.The initial concept of this text is the problem conclusion which claims that capitalism as a way of life has become so dominant that it systematically permeates the individual’s complete time, their working hours as well as their free time. In other words, man’s free time has been overtaken by the system and completely subjected to economy. And it is run by the government .Further in the text a question arises: How long “will it take to deliver the potentials of human nature which are entwined in the economy of free time” . Otherwise “every progress that is made in production using passive production classes can only help facilitate the separation and strengthening of the new upper class” . This leads to a deeper problem situation in which individuals are being turned into passive groups and social communities, which makes the entire society passive and mediocre.According to Supek, the solution is in sharpening the “citizens’ self-consciousness”, which could bring success in removing passivity and non-critical human consciousness. The entire process could be developed from the foundational “loneliness” of the citizen, which implies a safe distance from market consumerism. Self-consciousness, caused by personal loneliness, i.e., critical detachment from everyday life, would be strengthened and critically open toward itself and the society in which the person lives. And then it would be able to “do as it pleased”, and not as it has been ordered from a higher instance.This foundational and critically detached loneliness of citizens could be understood as a good and fresh experience of time in an independent and autonomous space of freedom, where a person could finally be able to achieve their own free time in a way that is largely different than just mere passive doing nothing. The paper aims to present Spinoza’s understanding of the ontological status of finite beings, which was heavily influenced by mathematics, i.e. geometry. Spinoza stratified finite beings into two fairly incompatible layers: the one subjectively conceived, while the other is the objective level. The first level is related to the essence of being that is caused by God through immanent causality: here, we speak of entailment on the logical and epistemological level, and not the level of reality. Unlike essence, existence represents (...) the second level of being: existence is caused by the real finite being through transeunt cause. The first level, by its ontological status, is very close to mathematical entities, therefore the qualification that Spinoza ‘geometrized reality under a species of the essences’. Namely, he geometrized the segment under the scope of ontology, i.e. the essences of finite modes. The final part of the paper is dedicated to one of the main reasons why Spinoza failed to provide a satisfactory solution to this ontological problem, which is not the only such problem of his system. This would be that Spinoza paid too much attention on ethics, to the detriment of metaphysics, i.e. ontology as general metaphysics. For Spinoza, ontology is subjected to epistemology and ethics, therefore the name ‘functional metaphysics’. (shrink)

One of the prominent debates of post-Tridentine scholasticism addressed probability, often expressed by the term “moral” (or adverbially, “morally”), originally motivated by the epistemology of decision-making and the debates on predestination and “middle knowledge”. Puente (or Pedro) Hurtado de Mendoza (1578–1641), an Iberian Jesuit and the author of one of the earliest Jesuit philosophy courses, entered this debate in the early-seventeenth century. This paper presents his 1610s and 1620s analyses of different forms or degrees of evidence, certainty, and necessity or (...) impossibility, addressing the commonly-used trichotomy of the “metaphysical”, “physical”, and “moral”, in which “moral” is the weakest form of a modality, together with the paradigmatic examples and interesting applications of the framework. Fourteenth-century logic gave rise, among others, to the genre De scire et dubitare, which offered a unified framework for discussing different forms of epistemic sophisms by utilising the underlying systems of epistemic logic. One of the problems introduced in this context already by the founding father of this genre, William Heytesbury, was the so-called axiom of positive introspection, i.e., the principle that an agent who knows that something is the case, knows that she knows that it is the case. Owing (...) to Heytesbury’s enormous popularity in the subsequent centuries, discussion of this problem became relatively widespread. This debate was addressed already in Boh’s seminal Epistemic Logic in the Later Middle Ages, which, despite its limitations acknowledged by its author, is a standard source. The present study elaborates on Boh by extending the corpus of his works and drawing new connections based on that. The core of the survey consists of an analysis of the positions of William Heytesbury and John Wyclif, their Italian reception by Peter of Mantua, and the “continental” reception of Heytesbury by John of Holland. The main goals of this study are to formalise the key arguments, which makes it possible to address the underlying systems of epistemic logic and their respective “strength”, and to articulate the conceptual background of those arguments and systems. The gist of the debate is, on one of the sides, an attempt to prove that it is impossible to doubt whether one knows that something is the case by employing whether the principles of positive introspection and of distribution of knowledge over implication, or the principles of positive and negative introspection combined.
