El presente artículo de reflexión es el resultado de una investigación que tuvo un enfoque metodológico cualitativo que se expresó en dos dimensiones: uno analítico-conceptual y otro crítico-hermenéutico, y está dirigido primordialmente a examinar el problema de la obediencia moral al derecho desde los presupuestos teóricos y conceptuales de la ética normativa. Sosteniendo como tesis principal que la ética no puede equipararse a una moral aplicada, en la medida que esto implicaría confundir la ética con la moral y por el (...) contrario, el cumplimiento de las normas se da por ser lo moralmente correcto, en consecuencia, será posible concluir a través del presente trabajo que existe una obligación moral de cumplir el derecho, salvo juicios morales concretos frente a ciertas regulaciones de conductas establecidas por normas que no estén acorde a los valores críticos o morales. How does rationality bind the agnostic, that is, the one who suspends judgment about whether a given proposition is true? In this paper I explore two alternative ways of establishing what the rational requirements of agnosticism are: the Lockean–Bayesian framework and the doxastic logic framework. Each of these proposals faces strong objections. Fortunately, however, there is a rich kernel of requirements of agnosticism that are vindicated by both of them. One can then endorse the requirements that belong to that kernel (...) without thereby committing oneself to the problematic implications that stem from either of the aforementioned proposals. While the concept of adaptive preferences is an important tool for criticizing injustice, it is often claimed that using the concept involves showing disrespect for persons judged to have adaptive preferences. In this paper, I propose an account of adaptive preferences that does the relevant political work while still showing persons two centrally important kinds of respect. My account is based in what I call an indirect substantive account of autonomy, which places substantive requirements on the options available to a (...) person, rather than on the option that she ultimately prefers. This allows us to pinpoint cases in which a person's circumstances have rendered her insufficiently autonomous, without saying that any conception of the good must be non-autonomous tout court. Evidential pluralists, like Federica Russo and Jon Williamson, argue that causal claims should be corroborated by establishing both the existence of a suitable correlation and a suitable mechanism complex. At first glance, this fits well with mixed method research in the social sciences, which often involves a pluralist combination of statistical and mechanistic evidence. However, statistical evidence concerns a population of cases, while mechanistic evidence is found in individual case studies. How should researchers combine such general statistical evidence and specific (...) mechanistic evidence? This article discusses a very recent answer to this question, ‘multi-method large-N qualitative analysis’ or multi-method LNQA, popular in political science and international relations studies of rare events like democratic transitions and cease-fire agreements. Multi-method LNQA combines a comprehensive study of all relevant event cases with statistical analysis, in an attempt to solve the issues of generalization faced by other types of qualitative research, such as selection bias and lack of representativeness. I will argue that the kind of general causal claim that multi-method LNQA is after, however, is crucially different from the average treatment effect found in statistical analysis and can in fact only be supported with mechanistic evidence. I conclude from this that mixed method research, and thereby evidential pluralism, may be inappropriate in this context. (shrink)

Everyday conversation requires listeners to quickly recognize verbal actions, so-called speech acts, from the underspecified linguistic code and prepare a relevant response within the tight time constraints of turn-taking. The goal of this study was to determine the time-course of speech act recognition by investigating oscillatory EEG activity during comprehension of spoken dialog. Participants listened to short, spoken dialogs with target utterances that delivered three distinct speech acts (Answers, Declinations, Pre-offers). The targets were identical across conditions at lexico-syntactic and phonetic/prosodic (...) levels but differed in the pragmatic interpretation of the speech act performed. Speech act comprehension was associated with reduced power in the alpha/beta bands just prior to Declination speech acts, relative to Answers and Pre-offers. In addition, we observed reduced power in the theta band during the beginning of Declinations, relative to Answers. Based on the role of alpha and beta desynchronization in anticipatory processes, the results are taken to indicate that anticipation plays a role in speech act recognition. Anticipation of speech acts could be critical for efficient turn-taking, allowing interactants to quickly recognize speech acts and respond within the tight time frame characteristic of conversation. The results show that anticipatory processes can be triggered by the characteristics of the interaction, including the speech act type. (shrink)

Although the problem of adaptiveness plays an important motivating role in her work on human capabilities, Martha Nussbaum never gives a clear account of the controversial concept of adaptive preferences on which she relies. In this paper, I aim both to reconstruct the most plausible account of the concept that may be attributed to Nussbaum and to provide a critical appraisal of that account. Although her broader work on the capabilities approach moves progressively towards political liberalism as time passes, I (...) aim to show that her account of adaptive preferences continues to maintain her earlier commitment to perfectionism about the good. I then distinguish between two obligatory kinds of respect for persons, which I call, respectively, primary and secondary recognition respect. This distinction allows us to see that her perfectionist account of adaptive preferences allows her to show persons primary but not secondary recognition respect. Evidential pluralism has been used to justify mixed-method research in political science. The combination of methodologies within case study analysis, however, has not received as much attention. This article applies the theory of evidential pluralism to causal inference in the case study method process tracing. I argue that different methodologies for process tracing commit to distinct fundamental theories of causation. I show that, problematically, one methodology may not recognize as genuine knowledge the fundamental claims of the other. By evaluating the (...) epistemic reliability of these fundamental claims, we can find a way out of such conflicts and rescue pluralism. (shrink)

Accounts of adaptive preferences are of two kinds: well-being accounts fully theorized for their own sake and political accounts theorized to facilitate the political project of reducing oppression and marginalization. Given their practical role, the latter are often less fully theorized, and are therefore less robust to theoretical criticism. In this paper, I first draw on well-being accounts to identify the well-theorized elements that political accounts should want to adopt in order to strengthen their project and avoid common criticisms. The notion of fitness is usually equated to reproductive success. However, this actualist approach presents some difficulties, mainly the explanatory circularity problem, which have lead philosophers of biology to offer alternative definitions in which fitness and reproductive success are distinguished. In this paper, we argue that none of these alternatives is satisfactory and, inspired by Mumford and Anjum’s dispositional theory of causation, we offer a definition of fitness as a causal dispositional property. We argue that, under this framework, the distinctiveness (...) that biologists usually attribute to fitness—namely, the fact that fitness is something different from both the physical traits of an organism and the number of offspring it leaves—can be explained, and the main problems associated with the concept of fitness can be solved. Firstly, we introduce Mumford and Anjum's dispositional theory of causation and present our definition of fitness as a causal disposition. We explain in detail each of the elements involved in our definition, namely: the relationship between fitness and the functional dispositions that compose it, the emergent character of fitness, and the context-sensitivity of fitness. Finally, we explain how fitness and realized fitness, as well as expected and realized fitness are distinguished in our approach to fitness as a causal disposition. (shrink)

Natura 2000 is a network of natural sites whose aim is to preserve species and habitats of relevance in the European Union. The policy underlying Natura 2000 has faced widespread opposition from land users and received extensive support from environmentalists. This paper addresses the ethical framework for Natura 2000 and the probable moral assumptions of its main stakeholders. Arguments for and against Natura 2000 were analyzed and classified according to “strong” or “weak” versions of the three main theories of environmental (...) ethics – anthropocentrism, biocentrism, and ecocentrism. Weak (intergenerational) anthropocentrism was found to underlie the Natura 2000 network itself and the positions of environmentalists, while strong (traditional) anthropocentrism pervaded the positions of economic developers. Land users seemed to fall somewhere between weak and strong anthropocentrism. The paper discusses the relation between ethics and different attitudes towards Natura 2000, highlighting some of the implications for the network’s ongoing implementation. It is shown that Natura 2000 achieves a strong reversal of the burden of proof from conservation to economic development and land use change under anthropocentrism. It is argued that the alleged theoretical divide between anthropocentrism and non-anthropocentrism in relation to the burden of proof does not seem to hold in practice. Finally, it is predicted that the weak versions of anthropocentrism, biocentrism, and ecocentrism, are likely to converge extensively in respect to nature conservation policy measures. (shrink)

Charles Peirce did not seem to have a consistent view regarding ethics. His occasional remarks on this subject appear to be contradictory at best and cynical at worst. As a result, many have suggested that his comments on ethics, especially those expressed in the 1898 Cambridge Conference lectures, should be dismissed or ignored. This chapter argues that Peirce's views on ethics can be best understood by comparing them to his views on scholastic realism and nominalism. When analyzed in this way, (...) Peirce's observations on ethics can serve as the grounds for a robust moderate moral realism that can compare favorably with contemporary metaethical theories. (shrink)

Environmentalists often argue that, in order to address fundamentally the harmful impact of their activities on the environment, western industrial societies need to change their attitude to nature. Specifically, they need to see nature as sacred, and to acknowledge that humanity is a part of nature rather than separate from it. In this paper, I seek to show that these tow ideas are incompatible in the context of western culture. Drawing particularly on ideas expressed by western conservationists, I argue that (...) nature is already seen as sacred, and that its sacredness depends on it being seen as separate from humanity, an idea which effectively contradicts the scientific knowledge on which many conservationists base their actions. Goodin's green theory of value is used as a source of ideas about why non-human nature is experienced as sacred, and can be extended to suggest that other values, such as 'development' and progress', are also seen as sacred. In this paper, I deal with a version of the epistemic regress problem. After rejecting foundationalism as a solution to it, I consider two versions of infinitism. The first one is found to be unacceptable, for it fails both to cohere with certain attributions of justification and also to maintain its internal coherence. The second one avoids both problems, and it is found to be the best way of addressing the epistemic regress problem. As the successful version of infinitism makes (...) use of the notion of a rational disposition to form and deploy reasons, I also manage to explicate that notion. (shrink)

Prior research on corporate misconduct pays extensive attention to single misconduct behaviors. However, little research has addressed recidivism – the repeated behaviors of corporate misconduct. Based on institutional theory and using the context of emerging economies where recidivism plays a considerable role, we propose the path dependency of corporate recidivism and suggest that three influential factors exist: internal preconditioning, inter-organizational imitation, and the prevailing external evaluation. Our event history analysis of 1,036 listed companies in China over the period 2001–2008 statistically (...) confirms our hypotheses. The biological theories of dreaming provide no explanation for the transduction from neuronal discharge to dreaming or waking consciousness. They cannot account for the variability in dream content between individuals or within individuals. Mind-brain isomorphism is poorly supported, as is dreaming's link to REM sleep. Biological theories of dreaming do not provide a function for dreaming nor a meaning for dreams. Evolutionary views of dreaming do not relate dream content to the current concerns of the dreamer and using the nightmare (...) as the paradigm dream minimizes the impact of poor sleep on adaptations. RESUMO O trabalho apresenta uma discussão polêmica, complexa e enigmática para a teoria do conhecimento: a elaboração da dialética negativa na concepção da teoria crítica frankfurtiana – sobretudo, adorniana – na interface com a dialética materialista, do marxismo. Do estudo emerge uma proposta de reestruturação do universo objetivo no sentido de indicar elementos subjetivos – por intermédio da teoria psicanalítica – como possibilidade de superação do estado da alienação ampla: intelectual, política, cultural e humana. Trata de confrontar aspectos metodológicos, teóricos (...) e subjetivos em âmbito social amparado por uma perspectiva crítica. As contribuições, para além dos embates entre o idealismo clássico e o materialismo moderno, atravessam, entre outras, as perspectivas heideggeriana, hegeliana, kantiana, freudiana, marxiana e adorniana, visando apresentar fundamentos epistemológicos e teóricos que embasam a teoria crítica ao tempo que identifica diferenças e convergências entre o materialismo sócio-histórico dialético e a dialética negativa; componentes relevantes para compreender a incursão desta teoria no âmbito das diversas áreas do conhecimento. ABSTRACT This paper presents a controversial, complex and enigmatic discussion for knowledge theory: the development of the concept of negative dialectic Frankfurtian critical theory – especially Adornian – on the interface with the materialist dialectics of Marxism. From this study emerges a restructuring proposal of the objective universe as to indicate subjective elements – through psychoanalytic theory – as a possibility to overcome the alienation state: intellectual, political, cultural and human. It is about confronting methodological, theoretical and subjective aspects of the social field supported by a critical perspective. The contributions, beyond the clashes between classical idealism and modern materialism cross, among others, the Heidegger, Hegel, Kant, Freud, Marx and Adorno's perspectives, aiming to present epistemological and theoretical foundations that underlie critical theory at the time that it identifies differences and convergences between historical social dialectic materialism and the negative dialectic; relevant components to understand the incursion of this theory in the context of various areas of knowledge. The contemporary research on "meta-function", closely associated with names as Breton, Ricoeur, Greisch, is located in continuity with the traditional question on metaphysics, which metaphysics itself has posed in its historical development starting from Aristotle, followed by the exegetical readings in the late antiquity, in the Arabic philosophy and in the Scholasticism. The analysis of meta-function as peculiar character of metaphysics highlights the double movement of transcendence and immanence, of going beyond and coming back. It shows how metaphysics overcomes physis (...) to rediscover it in a formal way on a deeper ontological level by posing the question about "being as being", which is not a natural object. In this way metaphysics displays its eidetical nature according to which metaphysics and phenomenology no longer appear as opposed in front of phenomena. (shrink)
