Comprehensive historical understanding is also a central element of the information we need to be responsible moral agents. It is also a critical support of the morality that makes political cooperation possible, especially in any society shaped by a history of ethnic or racial injustice, colonialism, imperialism, or sectarian conflict. Efforts to censor the teaching of history that makes one uncomfortable are thus ethically as well as epistemically indefensible.

From nineteenth-century abolitionism to Black Lives Matter today, progressive social movements have been at the forefront of social change. Exclusionary defeat is Joseph Raz’s proposal for understanding the more complex, layered structure of practical reasoning. Exclusionary reasons are widely appealed to in legal theory and consistently arise in many other areas of philosophy. They have also been subject to a variety of challenges. I propose a new account of exclusionary reasons based on their justificatory role, rejecting Raz’s motivational account and especially contrasting exclusion with undercutting defeat. I explain the appeal and coherence of exclusionary reasons by appeal to commonsense (...) value pluralism and the intermediate space of public policies, social roles, and organizations. We often want our choices to have a certain character or instantiate a certain value and in order to do so, that choice can only be based on a restricted set of reasons. Exclusion explains how pro tanto practical reasons can be disqualified from counting towards a choice of a particular kind without being outweighed or undercut. (shrink)

When a mother kills her child, we call her a bad mother, but, as this book shows, even mothers who intend to do their children harm are not easily categorized as "mad" or "bad." Maternal love is a complex emotion rich with contradictory impulses and desires, and motherhood is a conflicted state in which women constantly renegotiate the needs mother and child, the self and the other. Applying care ethics philosophy and the work of Emmanuel Levinas, Maurice Merleau-Ponty, and Simone (...) de Beauvoir to real-world experiences of motherhood, Sarah LaChance Adams throws the inherent tensions of motherhood into sharp relief, drawing a more nuanced portrait of the mother and child relationship than previously conceived. The maternal example is particularly instructive for ethical theory, highlighting the dynamics of human interdependence while also affirming separate interests. LaChance Adams particularly focuses on maternal ambivalence and its morally productive role in reinforcing the divergence between oneself and others, helping to recognize the particularities of situation, and negotiating the difference between one's own needs and the desires of others. For at least two millennia, religious traditions, spiritual communities and secular moral thinkers have debated the nature and sources of forgiveness. But near the end of the twentieth century understanding forgiveness took on new urgency, as divided societies looked to forgiveness as a vehicle of reconciliation, governments sought forgiveness for past wrongs, and popular psychology explored the therapeutic effects of forgiveness. These developments have led to a remarkable increase in scholarship on forgiveness: philosophers examine its moral nature; psychologists seek to (...) measure it and determine its contribution to well-being; historians and political theorists consider its relevance to national projects of reconciliation.Earlier versions of this paper were delivered to audiences at Syracuse University and Seton Hall University. Among philosophers, there are at least two prevalent views about the core concept of intentional action. View I (Adams 1986, 1997; McCann 1986) holds that an agent S intentionally does an action A only if S intends to do A. View II (Bratman 1987; Harman 1976; and Mele 1992) holds that there are cases where S intentionally does A without intending to do A, as long as doing A is foreseen and S is willing to accept A as a (...) consequence of S’s action. Joshua Knobe (2003a) presents intriguing data that may be taken to support the second view.1 Knobe’s data show an asymmetry in folk judgements. People are more inclined to judge that S did A intentionally, even when not intended, if A was perceived as causing a harm (e.g. harming the environment). There is an asymmetry because people are not inclined to see S’s action as intentional, when not intended, if A is perceived as causing a benefit (e.g. helping the environment). In this paper we will discuss Knobe’s results in detail. We will raise the question of whether his ordinary language surveys of folk judgments have accessed core concepts of intentional action. We suspect that instead Knobe’s surveys are tapping into pragmatic aspects of intentional language and its role in moral praise and blame. We will suggest alternative surveys that we plan to conduct to get at this difference, and we will attempt to explain the pragmatic usage of intentional language. (shrink)

The idea of moral progress is a necessary presupposition of action for beings like us. We must believe that moral progress is possible and that it might have been realized in human experience, if we are to be confident that continued human action can have any morally constructive point. I discuss the implications of this truth for moral psychology. I also show that once we understand the complex nature and the complicated social sources of moral progress, we will appreciate why (...) we cannot construct a plausible comprehensive action-guiding theory of moral progress. Yet while the nature and sources of moral progress consistently thwart many theoretical hopes, the idea of moral progress is a plausible, critically important and morally constructive principle of historical interpretation. The imaginative context in which artificial intelligence is embedded remains a crucial touchstone from which to understand and critique both the histories and prospective futures of an AI-driven world. A recent article from Cave and Dihal sets out a narrative schema of four hopes and four corresponding fears associated with intelligent machines and AI. This article seeks to respond to the work of Cave and Dihal by presenting a gendered reading of this schema of hopes and fears. I offer a (...) brief genealogy of narratives which feature female automata, before turning to examine how gendered technology today—particularly AI assistants like Siri and Alexa—reproduces the historical narratives associated with intelligent machines in new ways. Through a gendered reading of the hopes and fears associated with AI, two key responses arise. First, that the affective reactions to intelligent machines cannot be readily separated where such machines are gendered female. And second, that the gendering of AI technologies today can be understood as an attempt to reconcile the opposing hopes and fears AI produces, and that this reconciliation is based on the association of such technologies with traditional notions of femininity. Critically, a gendered reading enables us to problematize the narratives associated with AI and expose the power asymmetries that lie within, and the technologies which arise out of, such narratives. Political legitimacy is best understood as one type of a broader notion, which I call institutional legitimacy. An institution is legitimate in my sense when it has the right to function. The right to function correlates to a duty of non-interference. Understanding legitimacy in this way favorably contrasts with legitimacy understood in the traditional way, as the right to rule correlating to a duty of obedience. It helps unify our discourses of legitimacy across a wider range of practices, especially including (...) the many evaluations we increasingly make of international institutions of various sorts, but also including domestic institutions. Progressive social movements correctly presume that justice demands treating people with humane regard: combining respect for human agency with concern for human vulnerability to suffering. Promoting humane regard is a critical means of acknowledging the moral claims of humanity. Some critics reject the underlying concept of a universal humanity, in virtue of which human beings form a distinct community of reciprocal moral obligation. Critics charge that the concept presumes indefensible dualisms (of mind and body, and humanity and nature); that it (...) wrongly assigns a privileged status to reason; and that it involves an unsupportable belief in human exceptionalism. I argue that we can assert the moral claims of humanity without privileging reason, repudiating nature, or denying that there are many valuable ways to be human. I also defend an account of human moral exceptionalism that does not imply human moral superiority, to show that we can meet morally weighty obligations to humans while affirming morally substantive connections to non-human communities and domains. I argue that legitimacy discourses serve a gatekeeping function. They give practitioners telic standards for riding herd on social practices, ensuring that minimally acceptable versions of the practice are implemented. Such a function is a necessary part of implementing formalized social practices, especially including law. This gatekeeping account shows that political philosophers have misunderstood legitimacy; it is not secondary to justice and only necessary because we cannot agree about justice. Instead, it is a necessary feature of actual human social practices, (...) which must be implemented via practitioners' discretion in changing contexts. (shrink)

The essays collected in this special issue explore what legitimacy means for actors and institutions that do not function like traditional states but nevertheless wield significant power in the global realm. They are connected by the idea that the specific purposes of non-state actors and the contexts in which they operate shape what it means for them to be legitimate and so shape the standards of justification that they have to meet. In this introduction, we develop this guiding methodology further (...) and show how the special issue’s individual contributions apply it to their cases. In the first section, we provide a sketch of our purpose-dependent theory of legitimacy beyond the state. Standard accounts of civil disobedience include nonviolence as a necessary condition. Here I argue that such accounts are mistaken and that civil disobedience can include violence in many aspects, primarily excepting violence directed at other persons. I base this argument on a novel understanding of civil disobedience: the special character of the practice comes from its combination of condemnation of a political practice with an expressed commitment to the political. The commitment to the political is a commitment to engaging with (...) others as co-members in the on-going political project of living together. I show how such an understanding of civil disobedience is superior to the Rawlsian strain of thought, which focuses on fidelity to law. Rawls was concerned with civil disobedience solely in the context of overriding political obligation. The project of characterizing a contestatory political practice that can be distinguished and used in a wider variety of contexts than Rawls is concerned with, including under illegitimate regimes, beyond the nation-state, or on behalf of anarchism, requires a different understanding of civil disobedience.
