We show that the Axiom of Countable Choice is necessary and sufficient to prove that the existence of a Borel measure on a pseudometric space such that the measure of open balls is positive and finite implies separability of the space. In this way a negative answer to an open problem formulated in Górka (Am Math Mon 128:84–86, 2020) is given. The aim of this paper is to show that the meaning and significance of legal evidence is being constituted throughout the course of a singular instance of legal proceedings. This is to be achieved by describing what legal agents _do_ while appealing to different propositions of fact and inferring from them throughout the course of legal proceedings. The authors claim that the process of applying the law is ultimately rooted in the inferential discursive practices of exchanging reasons on the part (...) of the participants of legal proceedings. Therefore, they set forth a model of legal proceedings that consists of an interplay between three types of reasons, which are exchanged by the participants of legal proceedings: i.e. legal reasons, epistemic reasons and stake reasons. To illustrate this interplay, the authors deploy a metaphor of law as a game, and provide a description of legal proceedings as a particular instance of playing a game of law. The conclusion is that the legal concept of evidence is (at least in part) constituted by the role that evidence plays in affecting which reasons for action the participants to legal proceedings choose to act on. The other final assumption of this paper is metatheoretical: authors want to show that when analyzing what legal evidence is, one should begin from the perspective of a singular instance of legal proceedings, rather than from the perspective of law in general. Drug abuse is a growing social problem in Poland and is a particularly serious problem in the Military. The conditions of military service may be a factor that stimulates drug addiction among soldiers, particularly those who are psychically and physically weak and not adapted to team work. The psychical stress that results from the abrupt breaking of existing bonds and social relationships (family, colleagues, partners) is intensified by spatial limits (military barracks), and the character of military units (personal freedom limitation). (...) Another important aspect is, natural in this situation, access to weapons and the nature of tasks performed by a modern army. Yet the army continues to recruit young people who are physically and mentally weaker and weaker. In face of this problem, the commanders, supervisors and teachers are required to possess not only psychological and pedagogical knowledge, but also ethical and moral awareness. The article is based on empirical results of the test conducted in 2007 among 100 conscription soldiers of the Lublin Garrison of the Polish Army. (shrink)

This book engages the field of practice theory in order to consider law as a social practice. Taking up the theoretical concept of practices, the contributors to this volume maintain that law can be fruitfully understood as one among other social practices. Including perspectives from philosophers of language, experts in practice theory, linguists and legal philosophers, the book examines the twin questions of what it means for law to be considered a practice, and what law's place is among other social (...) practices. The book is comprised of three parts. The first provides a broad methodological framework for discussing how the concept of practice is used in the social sciences, and in law. The second deals with specific problems arising from the use of the concept of practice in the legal context, and from the intersection of different social practices. The third part identifies and addresses the consequences of applying insights from practice theory to law. Together, they offer a comprehensive consideration of what is at stake in understanding law as a social practice. Many irreconcilable accounts of ratio legis in legal science, often concerned with legal interpretation, suffer from being disconnected from practical reasoning. Different theories of legal interpretation which result in one-sided views of ratio legis are by-products of one-sided semantics. The first part of the chapter diagnoses this problem by providing a model of three types of one-sided semantics—upstream, midstream and downstream—and explaining how they translate into respective accounts of legal interpretation and ratio legis. The second part of the chapter presents (...) an alternative to one-sided semantics in legal theory. The alternative account which combines semantics and practical reasoning in legal theory is based on Brandom’s inferential pragmatism. The usefulness of inferential pragmatism in legal theory with regard to the problem of ratio legis is tested and followed by extending an inferentialist account of ratio legis provided by Canale and Tuzet. A model of agent’s actions and reasons, and their impact on the reasoning of interpreters and decision-makers is the essential part of this extension. (shrink)

The most basic aim of the psychological and pedagogical advisory centre is providing the child and its family with support at every stage of the problems arising. The target of such centres is also undertaking preventive, diagnostic, therapeutic, counselling and advisory actions. The profession of a diagnostic – therapeutic counsellor triggers ethical dilemma. Two parties meet and interact with each other in the relations occurring in such advisory centres – the counsellor and the person who needs advice and help. To (...) enable such a contact and make it effectively therapeutic instead of destructive, specialists employed in these centres have to be not only competent and highly qualified but also should possess a sufficient amount of knowledge about themselves, their system of values, opinions etc. (shrink)

Contemporary analytic theories of law attempt to provide hermeneutic answers to the metaphysical question about the nature of law with intuition playing a pivotal role in these attempts. It is doubtful, however, whether intuition can meet metaphysical and hermeneutic expectations of such theories. The article points out divergent ways of understanding intuition in analytic theories of law. Moreover, such theories face a dilemma of choosing between the „hard” ontology of law, to which intuition would have a privileged epistemic access, and (...) „soft” ontology which entails multiple types of intuition. If collective consciousness, to which the intuitions that constitute the concept of law allegedly belong, is indeed the metaphysical foundation of contemporary analytic theories, they are hardly discernible from empiricism. A promising complementary approach to such a way of theorizing about law—where the vocabulary of intuitions is prioritized—can be provided by analytic pragmatism extending analysis to the practices in which words acquire their meanings. Under the influence of today’s post-modern human sciences and their relativistic, skepticism-imbued theories the universalism idea, until recently the philosophical driving-force behind efforts to build a global human community based on universal principles of rationality, has lost much of its attractiveness to pluralism. However, despite the recognition that human rationality expresses itself in many different ways, strivings towards a universal human community have by no means ceased. Some take the form of political projects, others are more spontaneous and take place (...) beyond both politics and philosophy. The present reflections on these strivings’ success chances go out from ideas formulated by Eugeniusz Górski in his study Civil Society, Pluralism and Universalism. (shrink)

The contemporary science can be defined in a cybernetic language as a self-organising system. The development of this system is guided and controlled by streams of information items produced by science. At present this development assumes more and more clearly the shape of the evolutionary variability. In its input there are data. Their united sets constitute information items which, owing to their bringing together, form the human knowledge. Integration process of the human knowledge results in the wisdom. In this way (...) the post-industrial science has an evolutionary character coming in a form of a system \"from information towards wisdom\". It is very important to state a simple sum of data not to give any information, and as well a simple sum of information items not to give any knowledge, and then a simple sum of items which constitute knowledge not to give any wisdom. Only the process of integration causes a conversion from a lower level of cognition to its higher one. The essence of this process seems to be inspired by a creative intuition of an explorer-researcher who executes the above mentioned integration. (shrink)
