Tradition has it that first-person thought is somehow special. It is also commonplace to maintain that the first-person concept obeys a rule of reference to the effect that any token first-person thought is about the thinker of that thought. Following Annalisa Coliva and, more recently, Santiago Echeverri, I take the specialness claim to be the claim that thinking a first-person thought comes with a certain guarantee of its pattern of reference. Echeverri maintains that such a guarantee is explained by a (...) fairly flatfooted interpretation of the thinker-reflexive rule. I argue, however, that the explanatory aspirations of the thinker-reflexive rule are fulfilled only if we accept an epistemically loaded gloss on the notion of a thinker of a thought featuring the rule. That gloss is unpacked in terms of the subject’s ability to be acquainted with the phenomenal character of their thoughts. (shrink)

__Neurotechnology and Direct Brain Communication__ focuses on recent neuroscientific investigations of infant brains and of patients with disorders of consciousness, both of which are at the forefront of contemporary neuroscience. The pluralist sheds the more traditional ideas of truth and ontology. This is dangerous, because it threatens instability of the theory. To lend stability to his philosophy, the pluralist trades truth and ontology for rigour and other ‘fixtures’. Fixtures are the steady goal posts. They are the parts of a theory that stay fixed across a pair of theories, and allow us to make translations and comparisons. They can ultimately be moved, but we tend to keep them fixed temporarily. Apart (...) from considering rigour of proof as a fixture, I discuss fixed models, invariant notions and fixed information about objects across theories. Most scientific theories are globally inconsistent. Chunk and Permeate is a method of rational reconstruction that can be used to separate, and identify, locally consistent chunks of reasoning or explanation. This then allows us to justify reasoning in a globally inconsistent theory. We extend chunk and permeate by adding a visually transparent way of guiding the individuation of chunks and deciding on what information permeates from one chunk to the next. The visual representation is in the form of bundle diagrams. (...) We then extend the bundle diagrams to include not only reasoning in the presence of inconsistent information or reasoning in the logical sense of deriving a conclusion from premises, but more generally reasoning in the sense of trying to understand a phenomenon in science. This extends the use of the bundle diagrams in terms of the base space and the fibres. We then apply this to a case in physics, that of understanding binding energies in the nucleus of an atom using together inconsistent models: the liquid drop model and the shell model. We draw some philosophical conclusions concerning scientific reasoning, paraconsistent reasoning, the role of logic in science and the unity of science. (shrink)

This paper supports the personal data platform cooperative as a means of bringing about John Rawls’s favoured institutional realisation of a just society, the property-owning democracy. It describes personal data platform cooperatives and applies Rawls’s political philosophy to analyse the institutional forms of a just society in relation to the economic power deriving from aggregating personal data. It argues that a society involving a significant number of personal data platform cooperatives will be more suitable to realising Rawls’s principle of fair (...) equality of opportunity. (shrink)

The presence of easily accessible yet unpossessed evidence seems to matter epistemically. In this chapter I offer an inquiry-theoretic explanation of this datum. I argue that agents in the target cases fail to be competent inquirers and gather the relevant easily accessible evidence. This offers a deflationary explanation of the initial datum. I then show how to inflate this explanation to vindicate the thought that unpossessed evidence has defeating power over the justificatory status of one’s beliefs. The inflationary explanation rests (...) on two main planks. First, the subject who believes that p in the target cases ought to have gathered the target piece of evidence that bears on p. Secondly, such a duty is incompatible with justifiedly believing p. Along the way, the chapter offers a framework for thinking about zetetic competence, comments on the existence of epistemic duties of inquiry, and discusses the relationship between such duties and traditional epistemic norms of belief. This article presents a fairness principle for evaluating decision-making based on predictions: a decision rule is unfair when the individuals directly impacted by the decisions who are equal with respect to the features that justify inequalities in outcomes do not have the same statistical prospects of being benefited or harmed by them, irrespective of their socially salient morally arbitrary traits. The principle can be used to evaluate prediction-based decision-making from the point of view of a wide range of antecedently specified (...) substantive views about justice in outcome distributions. This paper gives an overview of the common approach to quantification and generalised quantification in formal linguistics and philosophy of language. We point out how this usual general framework represents a departure from empirical linguistic data. We briefly sketch a different idea for proof theory which is closer to the language itself than standard approaches in many aspects. We stress the importance of Hilbert’s operators—the epsilon-operator for existential and tau-operator for universal quantifications. Indeed, these operators are helpful in the construction (...) of a semantic representation which is close to natural language in particular with quantified noun phrases as individual terms. I present a puzzle about inquiry and discuss two potential solutions. The puzzle stems from two equally compelling sets of data suggesting that, on the one hand, there’s something epistemically defective with inquiring into questions that don’t have true answers. On the other hand, however, there can be scenarios in which we are epistemically permitted to inquire into questions that don’t have true answers. How is it that inquiries into questions that don’t have true answers can both be defective and (...) permissible from an epistemic point of view? The first solution I consider maintains that inquiries into questions that don’t have true answers are always impermissible but can be excusable. The second solution maintains that inquiries into questions that don’t have true answers are bad inquiries that can be conducted by inquirers we can legitimately trust. In 2003, the South Carolina Supreme Court upheld the conviction of Regina McKnight, an African American woman who was convicted at the age of twenty‐two for committing “homicide by child abuse.” She became the first woman in the United States to be arrested, prosecuted, and convicted for experiencing a stillbirth. Rather than an outlier case in the annals of American jurisprudence that stretched law beyond reason while restraining compassion and justice, McKnight's conviction inspired similar prosecutions of other poor black women (...) and then of other women. More than one‐third of states consider pregnant women's illicit drug use a form of child abuse, resulting in unprecedented forms of criminal and civil punishment. Laws previously understood to protect pregnant women from domestic violence during pregnancy, such as fetal protection laws, now serve as the vehicles for prosecuting pregnant women. What these prosecutions and laws expose are the multitudinous ways in which the criminalization of poor pregnant women—and normalization of that criminalization, such that even doctors and nurses are expected to participate in it—serve to humiliate women, interfere with their reproductive health, and ultimately rob women of reproductive autonomy. Recent epidemiological reports of associations between socioeconomic status and epigenetic markers that predict vulnerability to diseases are bringing to light substantial biological effects of social inequalities. Here, we start the discussion of the moral consequences of these findings. We firstly highlight their explanatory importance in the context of the research program on the Developmental Origins of Health and Disease (DOHaD) and the social determinants of health. In the second section, we review some theories of the moral status of health inequalities. (...) Rather than a complete outline of the debate, we single out those theories that rest on the principle of equality of opportunity and analyze the consequences of DOHaD and epigenetics for these particular conceptions of justice. We argue that DOHaD and epigenetics reshape the conceptual distinction between natural and acquired traits on which these theories rely and might provide important policy tools to tackle unjust distributions of health. In this study, we explore the role of Chief Executive Officers’ incentives, split between monetary and non-monetary, in relation to corporate social responsibility. We base our analysis on a sample of 597 US firms over the period 2005–2009. We find that both monetary and non-monetary incentives have an effect on CSR decisions. Specifically, monetary incentives designed to align the CEO’s and shareholders’ interests have a negative effect on CSR and non-monetary incentives have a positive effect on CSR. The study has (...) important implications for the design of executive remuneration plans, as we show that there are many levers that can affect the CEO’s decisions with regard to CSR. Our evidence also confirms the prominent role of the CEO in relation to CSR decisions, while also recognizing the complexity of factors affecting CSR. Finally, we propose a research design that takes into account endogeneity issues arising when examining compensation variables. (shrink)

The concept of cultural capital has been increasingly used in American sociology to study the impact of cultural reproduction on social reproduction. However, much confusion surrounds this concept. In this essay, we disentangle Bourdieu and Passeron's original work on cultural capital, specifying the theoretical roles cultural capital plays in their model, and the various types of high status signals they are concerned with. We expand on their work by proposing a new definition of cultural capital which focuses on cultural and (...) social exclusion. We note a number of theoretical ambiguities and gaps in the original model, as well as specific methodological problems. In the second section, we shift our attention to the American literature on cultural capital. We discuss its assumptions and compare it with the original work. We also propose a research agenda which focuses on social and cultural selection and decouples cultural capital from the French context in which it was originally conceived to take into consideration the distinctive features of American culture. This agenda consists in 1) assessing the relevance of the concept of legitimate culture in the U.S.; 2) documenting the distinctive American repertoire of high status cultural signals; and 3) analyzing how cultural capital is turned into profits in America. In the rapidly evolving healthcare environment, perhaps no role is in greater flux and redefinition than that of the clinical bioethicist. The discussion of ethics consultation in the bioethics literature has moved from an ambiguous concern regarding its proper place in the clinical milieu to the more provocative question of which methods and theories should best characterize the intellectual and practical work it claims to do. The American Society for Bioethics and Humanities addressed these concerns in its 1998 report, CoreCompetenciesforHealthCareEthicsConsultation. (...) The report tries to answer the question as to what disciplinary training, background experience, and levels of knowledge in ethics the clinical ethics consultant should have, and what specific skills and character traits the clinical ethics consultant should cultivate. In addition to acquiring knowledge of common bioethical issues, theoretical concepts in ethical theory and moral reasoning, and health-related law and policy, the report also recommends that ethics consultants demonstrate knowledge of the health beliefs and perspectives of patients and healthcare providers. In our opinion, this recommendation underscores a crucial aspect of the practice of ethics consultation in the increasingly multicultural settings of healthcare institutions. Clearly, the dynamic of American life and culture is permeated with diversity and variety as new groups suffuse their own beliefs and faith perspectives into the health sector. New immigrant groups force society to question traditional healthcare practices and to accommodate changing medical needs. (shrink)

Luciano Floridi was not the first to discuss the idea of group privacy, but he was perhaps the first to discuss it in relation to the insights derived from big data analytics. He has argued that it is important to investigate the possibility that groups have rights to privacy that are not reducible to the privacy of individuals forming such groups. In this paper, we introduce a distinction between two concepts of group privacy. The first, the “what happens in Vegas (...) stays in Vegas” privacy (in the following: WHVSV privacy), deals with confidential information shared with the member of a group and inaccessible to (all or a specific group of) outsiders. The second, to which we shall refer as inferential privacy, deals with the inferences that can be made about a group of people defined by a feature, or combination thereof, shared by all individuals in the group. We show why we unreservedly agree with Floridi that groups can have a form of privacy that amounts to more than the mere fact of being sets of individuals each of whom has individual privacy; moreover, like Floridi, we find it plausible that at least some groups (those satisfying our definition of type-a groups) may have a right to a species of group privacy (that is, WHVSV privacy) as groups (and not just as individuals who belong to those groups). However, by turning our attention to the context of big data analytics, we show that the relevant, new notion of group privacy is one of inferential privacy. We argue that an absolute right (either of individuals or groups) to inferential privacy is implausible. We also show that many groups generated algorithmically (those satisfying our definition of type-b groups) cannot be right holders as groups (unless they become type-a groups). (shrink)

The widespread use of algorithms for prediction-based decisions urges us to consider the question of what it means for a given act or practice to be discriminatory. Building upon work by Kusner and colleagues in the field of machine learning, we propose a counterfactual condition as a necessary requirement on discrimination. To demonstrate the philosophical relevance of the proposed condition, we consider two prominent accounts of discrimination in the recent literature, by Lippert-Rasmussen and Hellman respectively, that do not logically imply (...) our condition and show that they face important objections. Specifically, Lippert-Rasmussen’s definition proves to be over-inclusive, as it classifies some acts or practices as discriminatory when they are not, whereas Hellman’s account turns out to lack explanatory power precisely insofar as it does not countenance a counterfactual condition on discrimination. By defending the necessity of our counterfactual condition, we set the conceptual limits for justified claims about the occurrence of discriminatory acts or practices in society, with immediate applications to the ethics of algorithmic decision-making. Over the last decades the problem of the existence of Byzantine philosophy has been posed in terms of the determination of its status, its function, and its subject matter. To a certain extent, this approach to Byzantine philosophy has been motivated by the increasing disciplinary autonomy reached by the other branches of what is nowadays called «medieval philosophy». A series of significant scholarly achievements over the last twenty years have contributed to the development of more-or-less well defined scholarly fields of (...) research concerning the medieval Latin, Arabic, and Jewish philosophical traditions. In regard to Byzantine philosophy the situation is much more complicated. In the first chapter of his La philosophie médiévale, Alain de Libera devotes his first words to the retarded scholarly development of the study of Byzantine philosophy. He claims that Byzantine philosophy has been mainly ignored and misunderstood, and has not been deeply studied. However, from the second half of the twentieth century one can find relevant and extremely important attempts to establish not only the basic features and developments, but the very existence of Byzantine philosophy. In this Forschungsbericht I shall attempt to reconstruct the scholarly debate on this topic, testing the main interpretive attitudes against some concrete cases of thinkers who lived in the area of the Eastern Roman Empire and who are labelled by most modern historians as «Byzantine». The intriguing issue of pain and suffering in patients with disorders of consciousness (DOCs), particularly in Unresponsive Wakefulness Syndrome/Vegetative State (UWS/VS) and Minimally Conscious State (MCS), is assessed from a theoretical point of view, through an overview of recent neuroscientific literature, in order to sketch an ethical analysis. In conclusion, from a legal and ethical point of view, formal guidelines and a situationist ethics are proposed in order to best manage the critical scientific uncertainty about pain and suffering in DOCs (...) and ensure the best possible care for the patient. In the literature, there have been several methods and definitions for working out whether two theories are “equivalent” or not. In this article, we do something subtler. We provide a means to measure distances between formal theories. We introduce two natural notions for such distances. The first one is that of axiomatic distance, but we argue that it might be of limited interest. The more interesting and widely applicable notion is that of conceptual distance which measures the minimum number of (...) concepts that distinguish two theories. For instance, we use conceptual distance to show that relativistic and classical kinematics are distinguished by one concept only. (shrink)

Le célèbre incipit du Peri theon (80 B 4 DK = 31 D 10 Laks-Most), dans lequel Protagoras affirmait être dans l’incapacité de savoir si les dieux existent ou non, joue sans aucun doute un rôle important dans l’histoire de l’athéisme ancien dans la mesure où il permet, comme le souligne David Sedley, de reconstruire un contexte culturel dans lequel la négation de l’existence des dieux était considérée comme une thèse philosophique digne d’être discutée. La présente contribution portera sur les (...) principaux problèmes exégétiques relatifs au fragment protagoréen. Dans un premier moment, nous nous occuperons de la question de la constitution du texte. Nous considérerons ensuite l’historicité de la tradition biographique concernant la persécution judiciaire du sophiste, qui est évoquée par la plupart des sources citant le fragment. Finalement, nous essayerons d’étudier le fragment de Protagoras dans le cadre de la tradition philosophique et littéraire qui le précède et de l’analyser à la lumière de la réflexion philosophique du sophiste lui-même, afin de mieux comprendre le point de vue sur les dieux et la religion que Protagoras exprimait dans son écrit. The paper explores the idea that some singular judgements about the natural numbers are immune to error through misidentification by pursuing a comparison between arithmetic judgements and first-person judgements. By doing so, the first part of the paper offers a conciliatory resolution of the Coliva-Pryor dispute about so-called “de re” and “which-object” misidentification. The second part of the paper draws some lessons about what it takes to explain immunity to error through misidentification. The lessons are: First, the so-called Simple Account (...) of which-object immunity to error through misidentification to the effect that a judgement is immune to this kind of error just in case its grounds do not feature any identification component fails. Secondly, wh-immunity can be explained by a Reference-Fixing Account to the effect that a judgement is immune to this kind of error just in case its grounds are constituted by the facts whereby the reference of the concept of the object which the judgement concerns is fixed. Thirdly, a suitable revision of the Simple Account explains the de re immunity of those arithmetic judgements which are not wh-immune. These three lessons point towards the general conclusion that there is no unifying explanation of de re and wh-immunity. (shrink)
