When a physician employment relationship terminates, the physician–patient relationship may also be terminated by enforcement of a covenant not to compete, which typically forces the physician to leave the geographic area for a period of time. This gives rise to several ethical dilemmas. The public interest is compromised when enforcement of these covenants contributes to the shortage of physicians in the community, and individual patients are harmed when their physicians are no longer available. The authors undertook a unique study to (...) explore physician perspectives concerning the ethics of banning a physician from practice and the impact of the ban on both the physician and the physician’s patients. The results identified harmful effects that have not been raised in prior scholarly articles or reported court opinions. After reviewing the legal background of covenants not to compete, this paper presents the results of that study and concludes that resorting to the legal system for enforcement of covenants not to compete is not always the ethical course of action. We provide an economic interpretation of the practice consisting in incorporating risk measures as constraints in an expected prospect maximization problem. For what we call the infimum of expectations class of risk measures, we show that if the decision maker (DM) maximizes the expectation of a random prospect under constraint that the risk measure is bounded above, he then behaves as a “generalized expected utility maximizer” in the following sense. The DM exhibits ambiguity with respect to a family of utility (...) functions defined on a larger set of decisions than the original one; he adopts pessimism and performs first a minimization of expected utility over this family, then performs a maximization over a new decisions set. This economic behaviour is called “maxmin under risk” and studied by Maccheroni (Econ Theory 19:823–831, 2002). As an application, we make the link between an expected prospect maximization problem, subject to conditional value-at-risk being less than a threshold value, and a non-expected utility economic formulation involving “loss aversion”-type utility functions. Academic dishonesty has serious consequences for human lives, social values, and economy. The main aim of the study was to explore a model of relations between personal and cultural variables and academic dishonesty. The participants in the study were N = 2,586 individuals from nine countries (Pakistan, Israel, Italy, India, the USA, Peru, Romania, Ghana, and Poland). The authors administered the Academic Dishonesty Scale to measure academic dishonesty, the Kessler Psychological Distress Scale to measure distress, the Almost Perfect Scale – (...) Revised to measure perfectionism, the Brief Self-Control Scale to measure self-control, and the Singelis Scale to measure independent self-construal. The results showed that the theoretical model was well fitted to the dataset in six countries: Pakistan, the United States, Romania, Ghana, Israel, and Poland. However, it was not well fitted in Italy, India, and Peru. Our results also showed that perfectionism significantly predicted academic dishonesty, but not in all countries. Self-control significantly predicted cheating, falsification, and plagiarism in the USA. Moreover, we found that distress was related to cheating o0nly in Ghana. Finally, independent self-construal predicted academic dishonesty. Our findings provide a cross-cultural contribution to the debate on academic dishonesty by highlighting its significant predictors and may inform interventions aimed at eliminating it. Our results can be used in preventing and curbing academic dishonesty. Knowledge on cross-cultural differences can be useful in international education for example, as an indicator accepting or relaxing attitude toward academic dishonesty in students from different countries. Applying the solutions defined in the axiomatic bargaining theory to actual bargaining problems is a challenge when the problem is not described by its Utility Possibility Set (UPS) but as a social choice environment specifying the set of alternatives and utility profile underlying the UPS. It requires computing the UPS, which is an operational challenge, and then identifying at least one alternative that actually achieves the bargained solution’s outcome. We introduce the axioms of Independence of Non-Strongly-Efficient Alternatives (resp. Weakly) and (...) Independence of Redundant Alternatives. A solution satisfying these axioms can be applied to a simplified problem based on any reduced set of alternatives generating the strong (resp. weak) Pareto frontier of the initial problem, without changing the outcome, making the application of bargaining solutions to actual problems easier. We compare our axioms to usual independence axioms, and discuss their consistency with usual bargaining solutions. Then, we introduce monotonicity conditions corresponding to the existence of an interest group, i.e., agents ranking the alternatives in the same order. For such monotonic social choice environments, we provide a parameterized family of alternatives that generates the Pareto frontier of the bargaining problem, in line with our previous results. Our analysis illustrates that an axiomatic approach can be useful to foster the application of bargaining solutions, in complement to usual computational methods. (shrink)

El presente artículo pretende, por un lado, estudiar la genealogía del término biopolítica, pasando por el término bíos. Para sostener tal reflexión, se utilizará la primera parte del libro de Roberto Esposito, Bíos. El término biopolítica pasa por una mutación, desde su primera utilización, en 1905. Por otro lado, con base en los datos presentados en la primera parte del capítulo, se hará un análisis de la consagración del término hecha por Michel Foucault. O presente texto, cujo título é “O campo como nómos biopolítico da modernidade e a figura do muçulmano” tem por objetivo geral examinar a noção de campo como nómos biopolítico presente na modernidade, segundo as afirmações da obra de Giorgio Agamben, destacando a figura do muçulmano como seu habitante e como um paradigma da vida nua em oposição à forma-de-vida. Para que se possa realizar o objetivo proposto, iniciamos com a abordagem dos conceitos de vida nua e de biopolítica em (...) Agamben, indicando alguns de seus interlocutores, tais como Michel Foucault e Hannah Arendt. Em seguida, analisamos o conceito de campo, que caracteriza o Estado de exceção permanente na modernidade, e a figura do mulçumano, no interior dele. Por último, apresentamos breves considerações acerca da enigmática noção de forma-de-vida, com hífen, enquanto oposta a vida nua, na medida em que uma torna inoperante a politização da vida, a biopolítica. Les frontières des peuples souverains sont-elles sacrées, naturelles et absolues, voire irréfragables ? Le territoire a-t-il une importance identitaire ? Si oui, cette relation identitaire repose-t-elle sur l’attachement sentimental des citoyens ou sur une préférence rationnelle ? Doit-on plutôt l’expliquer par un rapport historique ? Le territoire est-il un élément constitutif de l’identité d’un peuple ? Le principe (...) de l’intégrité du territoire a-t-il une priorité absolue sur le principe affirmant le droit à l’autodétermination des peuples ? Tel est l’éventail de questions qui peuvent être posées en ce qui concerne la relation entre les peuples et leurs territoires. Je veux présenter une perspective qui me semble être originale. Dans la perspective du libéralisme politique, je pars d’une conception institutionnelle du peuple. Je me propose d’indiquer ensuite comment cette approche permet d’envisager des réponses à ces questions. | : In this paper, I examine in a programmatic fashion the relationship between peoples and territories. Are the borders of sovereign peoples sacred, natural and absolute, or even irrebuttable ? Does territory plays an important role for identity ? If so, is this relationship based on the sentimental attachment of citizens or on a rational preference ? Should it be explained instead by a historical relationship ? Is territory even constitutive of the identity of a people ? Does the principle of territorial integrity have priority over the principle asserting the right to self-determination of peoples ? Such are the issues that can be raised concerning the relationship between peoples and their territories. I want to present an account that I take to be original. Cela se passe très différemment en Amérique Latine et en Afrique, même s’il y a des emprunts, même si dans le local partout quelque chose se mondialise. Il y a une prise de l’espace à ce moment-là, une occupation, qui fait peur aux autorités. Le modèle en est le carnaval, mais les télévisions communautaires qui surgissent sur les écrans africains sont une autre modalité, comme l’était le théâtre des townships. (...) L’important, ce sont les espaces interstitiels dans lesquels peut surgir une création, une activité à dimension rituelle. L’anthropologie des émergences existe autant que celle qui déterre les traces du passé. Il s’agit d’approcher le monde à partir d’événements ou de situations plus que de structures. Ce qu’il est important de saisir, c’est le mouvement, pas la négociation qui a lieu après et qui réinstalle les structures connues ; ce qui est important, c’est l’image qui reste du changement. Ce qui se passe en Afrique en ce moment c’est le retour d’enfants d’émigrés qui veulent y installer le marché. L’anthropologue fait passer les récits des événements, les descriptions de ces espaces intermédiaires qui se maintiennent entre les camps et les gated communities. (shrink)

La Francophonie joue le rôle de vecteur dans le développement culturel et économique local, en proposant les logiciels libres et les normes ouvertes comme faisant partie du bien public régional dans le cadre du (...) développement durable. Les États partenaires devraient participer aux négociations ISO pour promouvoir les normes ouvertes.The cultural and linguistic diversity inherent to Francophony provides the conditions to create an interesting alternative to globalization. Regulation carried out through open standards facilitates the adaptation of knowledge access processes to specific cultural approaches. Francophony plays a leading role in cultural and economic local development by proposing open source software and open standards as part of regional public facilities within the framework of sustainable development. Anfractuosité et unification consiste en une introduction à la pensée de Nishida Kitarô (1870-1945), au moyen du fil directeur interprétatif qu’est la notion d’« unification » (tôitsusuru). Que signifie unifier : atteindre une unité dernière, ou bien poursuivre « sans cesse » l’unité ? Une telle poursuite ne revient-t-elle pas à un « néant pur et simple » ? En fait, cette crainte ne proviendrait-elle pas de ce que l’homme ne peut faire face à l’« infini » qui se trouve (...) derrière l’être même ? Dès lors, à quel « lieu » correspondrait un tel « au-delà » ? La finitude serait-elle la limite du « soi », la notion d’être est-elle l’unique clé de l’histoire de la réalité ? Un « néant absolu » a-t-il encore quelque chose à voir avec l’être ? Michel Dalissier examine les réponses de Nishida à la faveur de trois explorations de ses oeuvres majeures, en insistant sur sa relation intellectuelle avec la philosophie occidentale, ainsi que sur les « annotations manuscrites » qu’il laissait dans ses livres. Cet article présente des notes inédites de Michel Henry préparatoires à son ouvrage « Incarnation ». Elles donnent de précieux aperçus sur la manière dont Henry concevait l’articulation – profondément nouvelle dans son œuvre – des problématiques de la chair et de l’incarnation et soulignent explicitement les enjeux indissociablement éthiques et sotériologiques.

Dans les sociétés pluralistes, qui n'ont pas en commun un ensemble de valeurs éthiques, sociales et politiques, l'interprétation juridique est sous tension permanente. Les interprétations justes - c'est-à-dire les interprétations qui reflètent une conception partagée de la justice - peuvent être juste des interprétations ; autrement dit, des interprétations qui correspondent seulement aux aspirations et aux intérêts de différents groupes sociaux. Dans ce livre, Michel Rosenfeld s'affronte à cette crise de l'interprétation juridique. Il présente une évaluation critique des principaux (...) courants de la théorie du droit contemporaine aux Etats-Unis et en France et propose une approche différente. L'analyse de Michel Rosenfeld porte aussi bien sur le néo-formalisme, le pragmatisme, la théorie du discours, que la théorie autopoiétique. Elle comporte un examen des thèses des principaux auteurs et notamment de Habermas, Rorty, Posner, Luhmann, Dworkin, Fish et Weinrib. Pour remédier à certaines insuffisances de ces thèses, à propose la théorie du pluralisme compréhensif, fondée sur une conception matérielle du pluralisme. Cette approche transforme le fait du pluralisme en un principe normatif. A partir des intuitions de la déconstruction, il répond à cet appel de Derrida, auquel on n'a pas prêté une attention suffisante, à un engagement à combler la distance entre soi et l'autre, sans sacrifice de l'un ou de l'autre. Michel Rosenfeld montre que la théorie du pluralisme compréhensif permet de surmonter les limitations du libéralisme, du républicanisme et du communautarisme, tout en évitant les apories du monisme et du relativisme. " Les interprétations justes " est un outil pour s'orienter et sortir des labyrinthes théoriques et, à ce titre, il s'adresse à ceux qui s'occupent de théorie du droit, de droit constitutionnel, de philosophie sociale, de science politique ou de théorie critique, comme à ceux qui, à partir de points de vue disciplinaires divers, s'intéressent aux textes, à l'interprétation et qui partagent, dans une perspective postmoderne, le souci de la justice. Here I investigate the possibility of a phenomenological approach to Christianity, with the understanding that this would not be a matter of proposing an interpretation, but that such an “approach” would be able to lead directly to the heart of Christianity. I will say immediately that a phenomenology that would be able to undertake such a task is not the historical phenomenology that was born with Husserl. Only an ideal phenomenology that would become what is required would be able to (...) respond to our investigation. This ideal phenomenology is a phenomenology of life. (shrink)

There are two sorts of scientists: Dionysians, who rely on intuition, and Apollonians, who are more systematic. Self-experimentation is a Dionysian approach that is likely to open new lines of research. Unfortunately, the Dionysian approach does not allow one to predict the results of experiments. That is one reason why self-experimentation is not popular among granting agencies.

Henri Bouillard est initié par Kant à un regard critique. Sa rencontre avec saint Thomas le solidarise avec la «nouvelle théologie», et l'ouvre à une démarche herméneutique. Sa rencontre avec Maurice Blondel l'amène à opérer le tournant anthropologique en théologie. Sa rencontre avec Karl Barth le conduit à se rallier avec réserve à la position de celui-ci. Sa rencontre avec Éric Weil l'entraîne à approfondir le tournant anthropologique, mais à récuser les théologies politiques, et à repousser le recours aux sciences (...) humaines en théologie. Bref, ces quatre rencontres l'engagent à passer d'une démarche dogmatique à une approche herméneutique, mais à écarter une méthode généalogique entée sur les sciences humaines. (shrink)
