This paper presents a literature review on the ethics of self-tracking technologies which are utilized by users to monitor parameters related to their activity and bodily parameters. By examining a total of 65 works extracted through a systematic database search and backwards snowballing, the authors of this review discuss three categories of opportunities and ten categories of concerns currently associated with self-tracking. The former include empowerment and well-being, contribution to health goals, and solidarity. The latter are social harms, privacy and (...) surveillance, ownership control and commodification of data, autonomy, data-facilitated harm, datafication and interpretability of data, negative impact on relation to self and others, shortcomings of design, negative impact on health perception, and regulation and enforcement of rules. The review concludes with a critical analysis of the existing literature and an overview of a future research agenda that could complement the current work on ethics of self-tracking. (shrink)

Consciousness can be measured in various ways, but different measures often yield different conclusions about the extent to which awareness relates to performance. Here, we compare five different subjective measures of awareness in the context of an artificial grammar learning task. Participants expressed their subjective awareness of rules using one of five different scales: confidence ratings , post-decision wagering , feeling of warmth , rule awareness , and continuous scale . All scales were equally sensitive to conscious knowledge. PDW, however, (...) was affected by risk aversion, and both RAS and SDS applied different minimal criteria for rule awareness. CR seems to capture the largest range of consciousness, but failed to indicate unconscious knowledge with the guessing criterion. We close by discussing the theoretical implications of scale sensitivity and propose that CR’s unique features enable a finer assessment of subjective states of awareness. (shrink)

In this publication we continue the study of fuzzy Peterson’s syllogisms. While in the previous publication we focused on verifying the validity of these syllogisms using the construction of formal proofs and semantic verification, in this publication we focus on verifying the validity of syllogisms using Peterson’s rules based on grades.

Mobile health (mHealth) technologies for self-monitoring health-relevant parameters such as heart frequency, sleeping patterns or exercise regimes aim at fostering healthy behavior change and increasing the individual users to promote and maintain their health. We argue that this aspect of mHealth supports healthism, the increasing shift from institutional responsibility for public health toward individual engagement in maintaining health as well as mitigating health risks. Moreover, this healthist paradigm leads to a shift from understanding health as the absence of illness to (...) regarding health as the performance of certain rituals in order to project healthiness. By drawing from the analogy between healthiness and traditional virtues, we evaluate the promises made by proponents of mHealth technologies for self-monitoring. We argue that the implementation and use of mHealth risk entrenching existing inequalities and, more particularly, tend to exclude populations situated at the losing end of those inequalities from participating in the quasi-virtue of healthiness. Consequently, the implementation and use of mHealth technologies not only present challenges for social justice but also undermine their primary societal goal—to promote public health. Finally, we offer several suggestions on how to realize the potential benefit of mHealth. (shrink)

In this paper, I discuss the formation of habits with the help of self-tracking technologies. Although devices like Fitbit smart bands come with promises of empowerment through the means of increased control over users’ habits, existing literature does not provide conclusive findings about the validity of such claims. I contribute to the ongoing debate by relying on John Dewey’s pragmatist philosophy and its notion of intelligent habit. I demonstrate that from a pragmatist standpoint, habits that are the most likely to (...) accomplish users’ goals contribute to their flourishing need to be reflective (accompanied by adequate deliberation) and flexible (adaptable to the changing circumstances). On this basis I highlight some ethical-epistemic issues surrounding self-tracking technologies that inhibit the formation of habits desirable from a Deweyan standpoint. These include a lack of reflection on the part of the developers, difficulties for users to deliberate and consciously shape the habits developed by their devices, and dependence upon self-tracking tools that makes it difficult to adapt habits to individual needs and circumstances. I conclude the paper by discussing self-tracking’s general impact on flourishing, as well as placing my arguments in the context of the diversity of self-tracking practices and identifying how users attempt to alleviate the shortcomings of the technology and make it more suitable to their goals and needs. Despite the fact that Husserl did not write a book on aesthetics, it is widely accepted that a Husserlian aesthetics can be developed from his writings. In this article, I describe and analyze a feature of Husserlian aesthetics which I call the “radical individuality of the aesthetic object.” This radical individuality stems from Husserl’s interpretation of aesthetic consciousness in terms of the neutrality modification. I make the case for a radical reading of the neutrality modification by contrasting it with the (...) inactuality modification and the notion of foundation and I argue that the neutrality modification must be kept distinct from these concepts. I further describe the concept of the radical individuality of the aesthetic object by reference to Ingarden’s notion of the aesthetic object as monosubjective. The thesis of the radical individuality of the aesthetic object prima facie leads Husserlian aesthetics close to axiological relativism expressed in the adage that de gustibus non est disputandum. I explain that despite such proximity, Husserlian aesthetics does not entail an axiological relativism and does not preclude discussions concerning aesthetic values. On the contrary, Husserlian aesthetics ultimately shows that such discussions are necessary for keeping the possibility of aesthetic perception itself alive, and thereby encourages such discussions. I conclude with a practical demonstration of the results of my Husserlian analyses by critically engaging some aspects of Proust’s theory of art in À la recherche du temps perdu. (shrink)

ABSTRACT Schopenhauer's argument against suicide has served as a punching bag for many modern-day commentators. Dale Jacquette, Sandra Shapshay, and David Hamlyn all argue that the premises of this argument or its conclusion are inconsistent with Schopenhauer's wider metaphysical and ethical project. This paper defends Schopenhauer from these charges. Along the way, it examines the relations between suicide, death by voluntary starvation, negation of the will, compassion, and Schopenhauer's critiques of cynicism and stoicism. The paper concludes that there may be (...) gaps in Schopenhauer's system, but not where the aforementioned commentators tried to locate them. (shrink)

Giubilini and Savulescu in their recent Journal of Bioethical Inquiry symposium article presented an account of conscientious objection that argues for its recognition as a non-financial conflict of interest. In this short commentary, I highlight some problems with their account. First, I discuss their solicitor analogy. Second, I discuss some problems surrounding their objectivity claim about standards of medical care. Next, I discuss some issues arising from consistently applying their approach. Finally, I highlight that conscientious objection should be viewed not (...) as a conflict of interest but as something that society has an interest in preserving. I conclude by arguing that clinicians who have a conscientious objection can be treated in the same way as those who decide to subspecialize and do not need to give up work in their specialty. While Giubilini and Savulescu present an interesting argument about conscientious objection, theirs is not a compelling view. Indeed, the way we approach conscientious objection has more to teach us about conflicts of interest than the other way around. (shrink)

There is an ethical dilemma present when considering updating predictive clinical artificial intelligence (AI) models, which should be part of the departmental quality improvement process. One needs to consider whether withdrawing the AI model is necessary to obtain the relevant information from a naive patient population or whether to use causal inference techniques to obtain this information. Withdrawing an AI model from patient care might pose challenges if the AI model is considered standard of care, while use of causal inference (...) will not be reliable if the relevant statistical assumptions do not hold true. Hence, each of these two updating strategies is associated with patient risks, but lack of reliable data might endanger future patients. Similarly, not withdrawing an outdated AI might also expose patients to risk. Here I propose a high level ethical framework – epistemic risk management - that provides guidance for which route of model updating should be taken based on the likelihood of the assumptions used during the creation of the original AI model and the assumptions required for causal inference holding true. This approach balances our uncertainty about the status of the AI as standard of care with the risk of not obtaining the necessary data, so as to increase the probability of benefiting current and future patients for whose care the AI is being used. In my article, I present a new version of a probabilistic truth prescribing semantics for natural language indicative conditionals. The proposed truth conditions can be paraphrased as follows: an indicative conditional is true if the corresponding conditional probability is high and the antecedent is positively probabilistically relevant for the consequent or the probability of the antecedent of the conditional equals 0. In the paper, the truth conditions are defended and some of the logical properties of the proposed semantics are described.

Digraphs provide an alternative syntax for propositional logic, with digraph kernels corresponding to classical models. Semikernels generalize kernels and we identify a subset of well-behaved semikernels that provides nontrivial models for inconsistent theories, specializing to the classical semantics for the consistent ones. Direct (instead of refutational) reasoning with classical resolution is sound and complete for this semantics, when augmented with a specific weakening which, in particular, excludes Ex Falso. Dropping all forms of weakening yields reasoning which also avoids typical fallacies (...) of relevance. (shrink)

While there is a prolific debate surrounding the issue of conscientious objection of individuals towards performing certain clinical acts, this debate ignores the fact that there are other reasons why clinicians might wish to object providing specific services. This paper briefly discusses the idea that healthcare workers might object to providing specific services because they are against their professional judgement, they want to maintain a specific reputation, or they have pragmatic reasons. Reputation here is not simply understood as being in (...) good standing with a professional body. Rather, reputation is treated in the sense that a craftsman might wish to be known for providing a specific type, quality, and style of service. Professionalism is understood as acting according to the philosophical and scientific principles that are the basis of healthcare (such as acting for the benefit of the patient’s health and following well- evidenced treatment pathways). The consciousness studies are unavoidably linked to the mind-body problem, as most of the researchers are trying to investigate how a physical system generates mental property. To get around this problem the researchers often seem to endorse physicalism and identity theory but it is not clear to what extent, if any, does the research practice or the evidence based theories of consciousness depend on such assumptions. Here, we provide a few examples of studies investigating the so-called Neural Correlates of Consciousness. (...) Based on these examples and the contents of the methodological papers addressing the problem of identifying the NCCs, we provide a novel, operational definition of the NCC. This allows us to shed some light on the meaning of various claims about the causal role of consciousness within the field of empirical studies. We also provide an inference rule for identifying the NCCs and the exhaustive list of the NCC confounders in the typical research paradigms. (shrink)

This paper aims to present some of the dilemmas about screening in Israel and the difficulties in following the WHO's helpful criteria.

Wonderful Knowledge. Aquinas on the Immutability and Eternity of God’s Knowledge The general concept of knowledge is a kind of concept closely akin to transcententals: its use is not restricted to a certain kind of being, and it does not itself designate a kind of entity. Such concepts may be applied to God not as metaphors: when we grasp (through the analysis of cases of finite knowledge) some general traits of knowledge as such, we can show that God has knowledge, (...) and his knowledge, as opposed to ours, is infinitely perfect. We have no insight into this realization of knowledge as opposed to ours, but as far as we know what general traits of knowledge are, it is important to know that God has infinitely perfect knowledge. To grasp the general traits of knowledge, I focus on the topic of mutability and immutability of knowledge analyzed systematically by Aquinas, and thus on the topic of identity criteria specific for knowledge in general: the question of when knowledge that p and knowledge that q are (in a certain knower) one and the same knowledge; the criteria of identity of knowledge vary according to natures of knowers. I think that the problem of the criteria of identity of knowledge is rather neglected in omniscience-immutability discussions. I analyze Aquinas’ arguments for the thesis that human knowledge is mutable, and God’s knowledge is absolutely immutable (they concern the role of tense). The analysis sheds light on some general traits of knowledge: it is always something formulated by the knower which manifests some truth to him, and in general the way it is formulated corresponds to (i) the way it manifests some truth, (ii) its identity criteria, (iii) the way it is propositional, (iv) the way it is related to tense, and finally (v) the nature of the knower. Focusing on the criteria of the identity of knowledge shows that God’s knowledge is absolutely immutable, and that time and change in its objects are nevertheless undoubtedly real. Current developments in reproductive technology forecast that in the foreseeable future artificially generated gametes might be presented as a possible fertility treatment for infertile couples and for homosexual couples desiring to have children genetically originating from both partners. It is important to evaluate the ethical issues connected to this technology before its emergence. This article first reviews the meaning that gametes (sperm and eggs) might have to those who procreate, as well as their ontology. From this, suggestions are made as (...) to what qualities artificially generated gametes need to be truly called gametes. Finally, different proposed routes for artificial gamete generation are examined on the basis of these qualities, with their prospective problems and advantages highlighted. Autotransplanted gametes (or their progenitors) generated solely from patient-derived tissue are deemed to be the most ethically suitable route for the development of this technology. (shrink)

Judgments differ from decisions. Judgments are more abstract, decontextualized, and bear fewer consequences for the agent. In pursuit of experimental control, psychological experiments on bias create a simplified, bare-bone representation of social behavior. These experiments resemble conditions in which people judge others, but not how they make real-world decisions.

Roman Ingarden’s theory of the musical work is usually criticized for not being able to handle the problems of avant-garde music. The most important reason for this criticism is its dependence on the musical score and, generally, on the conventions of pre-twentieth century European classical music. In my article I offer a revision of Ingarden’s theory, which on the one hand leaves its substantial arguments intact and on the other allows the theory to tackle the problem of avant-garde music successfully. This article presents a new model aimed at predicting behavior in games involving a randomized allocation procedure. It is designed to capture the relative importance and interaction between procedural justice (defined crudely in terms of the difference between one’s expected payoff and average expected payoff in the group) and distributive justice (difference between own and average actual payoffs). The model is applied to experimental games, including “randomized” variations of simple sequential bargaining games, and delivers qualitatively correct predictions. In view of (...) the model redistribution of income can be seen as a substitute for vertical social mobility. This contributes to the explanation of greater demand for redistribution in European countries vis-a-vis the United States. I conclude with suggestions for further verification of the model and possible extensions. (shrink)

The paper deals with Martin Buber’s claim that responsibility “is the basic theme of my work in general.” As I show in the opening section of the article, his statement applies to the dialogical period of his work, but not the pre-dialogical. In the mystical phase of Buber’s thought there is no place for responsibility because the very nature of mysticism excludes that possibility. The incompatibility of mysticism and interpersonal responsibility is confirmed in the autobiographical fragment “conversion,” one of the (...) two biographical moments I discuss in relation to the shift in his thinking on responsibility. The second is his relationship with his wife Paula Winkler, which profoundly influenced his thinking about the importance of love and marriage for an understanding of responsibility. I then explore his view of responsibility as a doctrine, which developed along with his dialogical philosophy. Finally, I examine his critical views on four basic ways of avoiding responsibility, which highlight the close connection between freedom and responsibility: belief in fate, individualism, collectivism, and religious acosmism. Recent progress in geroscience holds the promise of significantly slowing down or even reversing ageing and age-related diseases, and thus increasing our healthspans. In this paper, I offer a novel argument in favour of developing such technology and making it unconditionally available to everyone. In particular, I argue that justice requires that each person be provided with sufficient opportunities to have a ‘complete life’, that many people currently lack such opportunities, and that we would substantially improve the status quo by (...) giving them access to anti-ageing technology. The purpose of this article is to discuss Kant’s concept of juridical state as the foundation of the contemporary rule of law. Therefore, the article tries to answer two questions: (1) what character can be attributed to Kant’s concept of juridical state taking into account the obligations arising from it; (2) can the analysis of the Kantian juridical state have any impact on the contemporary understanding of the rule of law and if so, what can this impact be. In order (...) to accomplish this task, moral presuppositions of Kant’s juridical state are discussed, according to the commonly accepted view that Kant’s political philosophy is closely linked with his moral and ethical reflection. Then, two interpretations of Kant’s juridical state – the liberal one and the authoritarian one – are analysed. The crucial difference between these interpretations lies in establishing the circumstances in which the duty of obedience to state power should be carried out. Then, Kantian juridical state is compared with two ways of understanding the rule of law – the material one and the formal one – in order to evaluate whether the rule of law should be considered as continuity of or rupture with the Kantian concept. This is the editorial of the monothematic issue of the journal Filozofia dedicated to Martin Buber (1878 – 1965) on the occasion of the centenary of the first publication of his most famous and popular book, I and Thou, on his philosophy of dialogue.

It causes many difficulties for jurisprudence to define the notion of judicial activism. At the very beginning it had rather a journalistic character, but but over time it has become a serious charge against these judges who act on the basis of their vision of what the law ought to be like rather than what it actually is like. On the ground of the polish legal theory the echoes of the dispute about judicial activism are reflected in the discussions about (...) the nature of legal interpretation. Transposing the problem of activism into the problem of interpretation allows the use of analysis tools that were previously unavailable. One of these tools are concepts emerged on the neopragmatist philosophy of Stanley Fish. Fish tries to describe the nature of the interpretation in the context of reader-response criticism and the concept of interpretive communities. Application of Fish's philosophy in the field of legal theory provides constructive conclusions about the concepts of judicial activism and judicial law-making. (shrink)

In the posthumously published ‘Future People, the Non-Identity Problem, and Person-Affecting Principles’, Derek Parfit presents a novel axiological principle which he calls the Wide Dual Person-Affecting Principle and claims that it does not imply the Repugnant Conclusion. This paper shows that even the best version of Parfit's principle cannot avoid this conclusion. That said, accepting such a principle makes embracing the Repugnant Conclusion more justifiable. This paper further addresses important questions which Parfit left unanswered concerning: the relative importance of individual (...) and collective goodness, comparisons involving unequal outcomes, how to understand individual goodness, and whether incomparability at the level of individual goodness implies incomparability at the level of overall goodness. This paper provides an analysis of the way in which two foundational principles of medical ethics–the trusted doctor and patient autonomy–can be undermined by the use of machine learning (ML) algorithms and addresses its legal significance. This paper can be a guide to both health care providers and other stakeholders about how to anticipate and in some cases mitigate ethical conflicts caused by the use of ML in healthcare. It can also be read as a road map as to what (...) needs to be done to achieve an acceptable level of explainability in an ML algorithm when it is used in a healthcare context. (shrink)

This paper has three main goals. Firstly – to draw attention to the phenomenon of the democratic paradigm in the study of modern state systems (especially monarchical ones), characterise it and outline its sources. Also - to question the basis of this phenomenon (by pointing out, among other things, the durability of monarchical systems and the phenomenon of partial ‘re-monarchization’ – real or apparent – of certain contemporary republican systems on the examples of: Montenegro, Romania, the Czech Republic, Hungary and (...) Poland). Secondly, to present the negative consequences of the functioning of the democratic paradigm, also (paradoxically) those affecting the political practice of republics. Thirdly, to propose a way to reduce these negative consequences by changing the optics adopted in comparative studies about monarchies and republics. This change is based on the restoration, in comparative analyses of contemporary state systems (including monarchical ones), of the concepts of ‘mixed system’ and ‘monarchical principle’, which are still used in research on the history of the state and law, and should be disseminated in research on contemporary political systems and constitutional law. An explanation of the terms ‘mixed system’ and ‘monarchical principle’ as I use them here will follow in the final part of the paper. (shrink)

The purpose of the paper is to analyze the thesis that an agreement between representatives of two different cultures can and should be reached at a theoretical level. The author tries to verify the Theory of Communicative Action proposed by Jürgen Habermas in the light of philosophical reflections of American neopragmatist Stanley Fish. Habermas is one of the most important and widely read social theorists in the post-Second World War era. He is also one of the authors of the concept (...) of deliberative democracy, which holds that, for a democratic decision to be legitimate, it must be preceded by authentic deliberation – disinterested exchange of reasons – not merely the aggregation of preferences that occurs in voting. The foundation of deliberative democracy is, according to the German thinker, a communicative action based on communicative rationality. Stanley Fish, in turn, is one of the most eminent American philosophers of the twentieth and twenty-first centuries. The main area of his scientific activity is the theory of literature, law, and history. In the course of his reflections, Fish constructed the concept of an interpretive communities, which implies an original view on the nature of the process of cognition, status of human convictions or beliefs, nature of communication situation and capabilities of theory. The final conclusion stemming from the reflection on Fish’s philosophy explains why Habermas’ theory is not an adequate tool to reach an intercultural agreement. (shrink)

This paper provides an analysis of Martin Buber’s not very well-known essay “Distance and Relation”, which is his most relevant contribution to philosophical anthropology. In the essay, which was published almost thirty years after the publication of his most famous book, I and Thou, Buber elaborated on the anthropological foundations of his cosmic vision of dialogical life. The central question is “How is man possible?” Buber’s answer is very important to the further development of his principle of dialogue in psychology (...) (primarily his notion of confirmation) and philosophy of art, but it is not quite clear how compatible it is with some of his earlier theses from I and Thou. In particular, the relation between “distance” and the I-It relation is unclear. There are two seemingly contradictory statements: “In the beginning is the relation” and “The primal distance is a presupposition of the relation”. The aim of this paper is to examine these anthropological foundations and to elucidate this apparent contradiction. (shrink)

The purpose of this paper is to analyse a particularly influential case of memory continuity in Portugal, that of _Padrão dos Descobrimentos_. Spaces of collective memory (such as public monuments) raise questions about what we celebrate, remember or rescue from oblivion, providing an opportunity to rethink the trauma. As such, care for public spaces is associated with ethical and cultural values. One of the difficulties with certain monuments has to do with the fact that they recall actions that today we (...) see as traumatic acts. Thus, it is important to reflect on a critical use of memory. On August 8, 2021, _Padrão dos Descobrimentos_ was the subject of a graffiti. One of the sides of the monument could read: “Blindly sailing for money, humanity is drowning in a scarlet sea”. A great controversy immediately arose around the meaning of this gesture, as well as the role played by a monument that, after being temporarily built in 1940 for the Portuguese World Exhibition, was, in its current version, inaugurated in 1960, on the occasion of the fifth centenary of the death of Infante D. Henrique. This episode reignited a deeper cleavage around the uses of history and memory, the Portuguese colonial past, and the role of the _Padrão dos Descobrimentos_ as an instrument for the reproduction of nationalism. In this sense, and with the authors proposing a new theoretical frame of reference based on the thought of Arendt and Ricoeur, its critical reading becomes relevant. (shrink)

In this paper, I discuss the differences between ontic and epistemic conceptions of scientific explanation, mainly in relation to the so-called new mechanical philosophy. I emphasize that the debate on conceptions of scientific explanation owes much to Salmon’s ontic/epistemic distinction, although much has changed since his formulations. I focus on the interplay between ontic and epistemic norms and constraints in providing mechanistic explanations. My conceptual analysis serves two aims. Firstly, I formulate some suggestions for recognising that both sets of norms (...) and constraints, ontic and epistemic, are necessary for scientific theorising. Secondly, I emphasize that there are multiple dimensions involved in scientific explanation, rather than clear-cut alternatives between ontic and epistemic aspects. I conclude with a general observation that although contextual aspects of explanations are unavoidable, the epistemic-relativity of our categories, explanations and models can in fact be compatible with their objectivity. Instead of making hastily drawn ontological implications from our theories or models, we should carefully scrutinize them from the ontic-epistemic perspective. (shrink)
