ABSTRACTThis article defends the importance of epistemic safety for legal evidence. Drawing on discussions of sensitivity and safety in epistemology, the article explores how similar considerations apply to legal proof. In the legal context, sensitivity concerns whether a factual finding would be made if it were false, and safety concerns how easily a factual finding could be false. The article critiques recent claims about the importance of sensitivity for the law of evidence. In particular, this critique argues that sensitivity does (...) not have much of an effect on the value of legal evidence and that it fails to explain legal doctrine. By contrast, safety affects the quality of legal evidence, and safety better explains central features of the law of evidence, including probative value, admissibility rules, and standards of proof. This book provides a radical alternative to naturalistic theories of content, and offers a new conception of the place of mind in the world. In recent years, the debate on the problem of causal exclusion has seen an ‘interventionist turn’. Numerous non-reductive physicalists (e.g. Shapiro and Sober 2007) have argued that Woodward's (2003) interventionist theory of causation provides a means to empirically establish the existence of non-reducible mental-to-physical causation. By contrast, Baumgartner (2010) has presented an interventionist exclusion argument showing that interventionism is in fact incompatible with non-reductive physicalism. In response, a number of revised versions of interventionism have been suggested that are compatible with (...) non-reductive physicalism. The first part of this paper reconstructs the definitional details of these modified interventionist theories. The second part investigates whether the modification proposed in Woodward (2011) is not only compatible with, but moreover supports non-reductive physicalism. In particular, it is examined whether that newest variant of interventionism allows for empirically resolving the problem of causal exclusion as envisaged by Shapiro, Sober and others. (shrink)

Emmanuel Levinas was a significant contributor to the field of philosophy, phenomenology and religion. A key interpreter of Husserl, he stressed the importance of attitudes to other people in any philosophical system. For Levinas, to be a subject is to take responsibility for others as well as yourself and therefore responsibility for the one leads to justice for the many. He regarded ethics as the foundation for all other philosophy, but later admitted it could also be the foundation for theology. (...) Die Bezugnahme auf die Naturwissenschaften verleiht der Metaphysik einerseits die Berechtigung dazu, revisionär zu sein, das heißt, Erkenntnisansprüche, die aus dem alltäglichen Weltverständnis stammen, zu revidieren. Andererseits ist eine solche Metaphysik ebenso hypothetisch (...) wie die Wissenschaften selbst. In this follow-up to the highly successful _Ethnography Unbound,_ Michael Burawoy and nine colleagues break the bounds of conventional sociology, to explore the mutual shaping of local struggles and global forces. In contrast to the lofty debates between radical theorists, these nine studies excavate the dynamics and histories of globalization by extending out from the concrete, everyday world. The authors were participant observers in diverse struggles over extending citizenship, medicalizing breast cancer, dumping toxic waste, privatizing nursing homes, the degradation of (...) work, the withdrawal of welfare rights, and the elaboration of body politics. From their insider vantage points, they show how groups negotiate, circumvent, challenge, and even re-create the complex global web that entangles them. Traversing continents and extending over three years, this collaborative research developed its own distinctive method of "grounded globalization" to grasp the evaporation of traditional workplaces, the dissolution of enclaved communities, and the fluidity of identities. Radical ecology typically brings to mind media images of ecological activists standing before loggers' saws, staging anti-nuclear marches, and confronting polluters on the high seas. Yet for more than twenty years, the activities of organizations such as the Greens and Earth First! have been influenced by a diverse, less-publicized group of radical ecological philosophers. It is their work—the philosophical underpinnings of the radical ecological movement—that is the subject of _Contesting Earth's Future_. Intermediate constructs are required as bridges between complex behaviors and realistic models of neural circuitry. For cognitive scientists in general, schemas are the appropriate functional units; brain theorists can work with neural layers as units intermediate between structures subserving schemas and small neural circuits.After an account of different levels of analysis, we describe visuomotor coordination in terms of perceptual schemas and motor schemas. The interest of schemas to cognitive science in general is illustrated with the example of perceptual schemas in (...) high-level vision and motor schemas in the control of dextrous hands.Rana computatrix, the computational frog, is introduced to show how one constructs an evolving set of model families to mediate flexible cooperation between theory and experiment. Rana computatrix may be able to do for the study of the organizational principles of neural circuitry what Aplysia has done for the study of subcellular mechanisms of learning. Approach, avoidance, and detour behavior in frogs and toads are analyzed in terms of interacting schemas. Facilitation and prey recognition are implemented as tectal-pretectal interactions, with the tectum modeled by an array of tectal columns. We show how layered neural computation enters into models of stereopsis and how depth schemas may involve the interaction of accommodation and binocular cues in anurans. (shrink)

Ned Block says ‘yes’ (, ). His position is based on the phenomenon of identity-crowding. According to Block, in cases of identity-crowding, something is consciously seen even though one cannot attend to it. In taking this view, Block is opposing a position I have taken in recent work (Tye 2009a, 2009b, 2010). Simon Evnine’s Making Objects and Events: A Hylomorphic Theory of Artifacts develops amorphic hylomorphism. I critically discuss three of its main themes. One theme is its attempt to do the work of form without forms. A second theme is the requirement that hylomorphs have ‘metabolisms at work’. A third theme is the use of artifacts as the paradigms for hylomorphs. I will raise some criticisms of each of these themes. Although the themes might at first appear disconnected, I believe the (...) third underwrites the first two. So the criticisms of the third theme also bear on the rest. (shrink)

Utilizing an idea that has its first appearance in Gerhard Gentzen’s unpublished manuscripts, we generate an exhaustive repertoire of all the possible inference rules that are related to the left implication inference rule of the sequent calculus from a ground sequent, that is, a logical axiom. We discuss the similarities and differences of these derived rules as well as their interaction with the implication right rule under cut and the structural axiom. We further consider the question of analyticity of cuts (...) in calculi using one of the new rules instead of the standard left implication rule. (shrink)

Most anyone interested in such topics as creation mythology, Jungian theory, or the idea of "secret teachings" in ancient Judaism and Christianity has found "gnosticism" compelling. Yet the term "gnosticism," which often connotes a single rebellious movement against the prevailing religions of late antiquity, gives the false impression of a monolithic religious phenomenon. Here Michael Williams challenges the validity of the widely invoked category of ancient "gnosticism" and the ways it has been described. Presenting such famous writings and movements as (...) the Apocryphon of John and Valentinian Christianity, Williams uncovers the similarities and differences among some major traditions widely categorized as gnostic. He provides an eloquent, systematic argument for a more accurate way to discuss these interpretive approaches.The modern construct "gnosticism" is not justified by any ancient self-definition, and many of the most commonly cited religious features that supposedly define gnosticism phenomenologically turn out to be questionable. Exploring the sample sets of "gnostic" teachings, Williams refutes generalizations concerning asceticism and libertinism, attitudes toward the body and the created world, and alleged features of protest, parasitism, and elitism. He sketches a fresh model for understanding ancient innovations on more "mainstream" Judaism and Christianity, a model that is informed by modern research on dynamics in new religious movements and is freed from the false stereotypes from which the category "gnosticism" has been constructed. Many Sides is the first full-length study of Protagorean antilogic, an argumentative practice with deep roots in rhetorical history and renewed relevance for contemporary culture. Founded on the philosophical relativism of Protagoras, antilogic is a dynamic rather than a formal approach to argument, focused principally on the dialogical interaction of opposing positions (anti-logoi) in controversy. In ancient Athens, antilogic was the cardinal feature of Sophistic rhetoric. In Rome, Cicero redefined Sophistic argument in a concrete set of dialogical procedures. In turn, (...) Quintilian inherited this dialogical tradition and made it the centrepiece of his own rhetorical practice and pedagogy. Many Sides explores the history, theory, and pedagogy of this neglected rhetorical tradition and, by appeal to recent rhetorical and philosophical theory, reconceives the enduring features of antilogical practice in a dialogical approach to argumentation especially suited to the pluralism of our own age and the diversity of modern classrooms. Environmental pragmatists such as Ben Minteer and Bryan Norton have argued that there is an anti-democratic strain to be found in the work of some nonanthropocentrists. I examine three possible sources of the pragmatists’ concern: the claim that nonanthropocentrists know the political truth, the claim that those who disagree with their basic principle should be excluded from discussions of policy and the claim that their basic principle is self-evident. I argue here that none of these claims are objectionably anti-democratic when (...) understood properly. (shrink)

This article outlines the work of a group of US mathematicians called the American Postulate Theorists and their influence on Tarski's work in the 1930s that was to be foundational for model theory. The American Postulate Theorists were influenced by the European foundational work of the period around 1900, such as that of Peano and Hilbert. In the period roughly from 1900???1940, they developed an indigenous American approach to foundational investigations. This made use of interpretations of precisely formulated axiomatic theories (...) to prove such metatheoretic properties as independence, consistency, categoricity and, in some cases, completeness of axiom sets. This approach to foundations was in many respects similar to that later taken by Tarski, who frequently cites the work of American Postulate Theorists. Their work served as paradigm examples of the theories and concepts investigated in model theory. The article also examines the possibility of a more specific impetus to Tarski's model theoretic investigation, arising from his having studied in 1927???1929 a paper by C. H. Langford proving completeness for various axiom sets for linear orders. This used the method of elimination of quantifiers. The article concludes with an examination of one example of Langford's methods to indicate how their correct formulation seems to call for model-theoretic concepts. (shrink)

Promises raise two main philosophical problems, one moral and the other conceptual. The moral problem concerns the normative significance of promising: what is the nature and basis of the obligations and rights to which promises typically give rise? The conceptual problem is to say what a promise is: what is involved in making a promise? In this paper I defend three controversial claims about promising. One is about the moral problem of promising, one is about the conceptual problem, and the (...) last one is about the relationship between my conceptual claim and my moral claim. My conceptual claim is that a speaker makes a promise only if he communicates an intention to undertake an obligation to the hearer. (I refer to this as the “Obligation Conception Thesis.”) My moral claim is that the obligations typically attached to promises are such that they can be acquired only by those who communicate an intention to undertake an obligation. (I refer to this as the “Voluntary Obligation Thesis.”) My third claim is that if the Obligation Conception Thesis is true, the Voluntary Obligation Thesis is true. (shrink)

Through autobiography, I explain why I cannot accept conventional Christianity or any other form of religious belief. I sketch how, through modern evolutionary theory, I try to find an alternative world‐picture, one which is, however, essentially agnostic about ultimate meanings. I characterize my position as being that of “David Hume brought up‐to‐date by Charles Darwin.” I express sad skepticism about ever realizing the hopes on which Zygon was founded.

Relates Eastern concepts to Western religion, art, and modern science, and suggests their relevance to the reader.

The philosophical significance of Dmitri Mendeleev’s successful predictions of the properties of gallium and scandium vis a vis the acceptance of the Periodic Table 1874–1886 has been debated recently. This author presents evidence that De Boisbaudran and Cleve both respectively predicted the possible existence of gallium and scandium, but on the basis of the old TRIAD methodology. This suggests that these successful Mendeleev predictions were therefore not independent corroboration of the concept of the Periodic System. Instead the significantly independent predictive (...) successes for Mendeleev’s system were the determination of the atomic weight of the known element uranium as 240 instead of the previously accepted 120 in 1874 and the isolation of germanium by Winkler in 1886.
