I had assumed (...) that while I was operating on that 26–year–old woman with new abdominal pain that moved towards the left lower quadrant, my attending staff on call was sleeping soundly. I didn’t even know where he lived, or how long it would take if something catastrophic were to happen. I phoned the white–haired man to get his blessing just before midnight. “Have you done this operation before?” he asked. “Yes, several, but not completely alone” I confessed. “Go for it and call me when you are done. Oh, and be safe!” Click. Gulp.As I drive in tonight, again past midnight, I reflect upon that night. Was it practice? A right of passage? The most appropriate treatment for the patient? Perhaps it was even safer this way since my attending really had never done this operation the way it is now done—laparoscopically—by residents. I clearly recall telling the patient and her mother, “We do this all the time! The staff surgeon on call will come in if I need him, but the chief residents always do this operation and I feel comfortable taking care of you.” Sign on the dotted line and make sure you read the part where you are told this is a teaching hospital. Not only was independence an expectation, but I was also supposed to teach the more junior house staff how to emulate what I was so expertly performing.That night I took out the rotting appendix without incident and called the grey haired surgeon in the wee hours. “Merry Christmas Doctor. Sorry to bother you. I just wanted to let you know that the patient is awake and doing well.” “Yes I know. Good work” he replied. “I was in my office. Just in case.”As a resident, I was often torn between the need to gain independence in order to learn and grow as a surgeon, and the idea that I was practicing. As most budding surgeons do, I wanted to be the person doing the surgery. Working on my technical skills was clearly an important part of expertise. Surgery is inherently different than other types of medicine. It seemed slightly more difficult for someone to stop my cutting, than to catch the error in a prescription, before some damage is done. Perhaps a little more like driving a car, than learning to use a calculator. Recently a more modern surgical education is evolving, whereby students practice by simulations on machines. Yet educators know that ultimately many “firsts” need to occur with real patients. That proficiency and expertise are more than a diagnosis, a steady hand, or even the two combined. If the experience of operating as the primary surgeon without immediate supervision, on a patient with acute appendicitis never occurred until we passed licensing exams wouldn’t that be more harmful? I may have been the least legally responsible for outcomes, that night of my own first, when the grey–haired surgeon took the [End Page E1] responsibility of trusting me. But in fact, the obligation I felt was enormous. We cannot simulate the weight of responsibility that comes when responsible for another human being, who you have met and who provides their trust in you. Furthermore, as the teachers of this art and science, we need to balance our obligations to each individual patient with our obligation to society to train competent and caring future surgeons. Surgery would have no history if the “practice” of surgery had nothing to do with practice, defined in its simplest form, yet how do we cover all of this during the late night conversation that is called informed consent. Professor Merrie Bergmann presents an accessible introduction to the subject of many-valued and fuzzy logic designed for use on undergraduate and graduate courses in non-classical logic. Bergmann discusses the philosophical issues that give rise to fuzzy logic - problems arising from vague language - and returns to those issues as logical systems are presented. For historical and pedagogical reasons, three-valued logical systems are presented as useful intermediate systems for studying the principles and theory behind fuzzy logic. The major fuzzy (...) logical systems - Lukasiewicz, Gödel, and product logics - are then presented as generalisations of three-valued systems that successfully address the problems of vagueness. A clear presentation of technical concepts, this book includes exercises throughout the text that pose straightforward problems, that ask students to continue proofs begun in the text, and that engage students in the comparison of logical systems. This article positions ‘safety’ and ‘risk’ as key public health problems in mental health. I demonstrate that discourse about safety occurs extensively in relation to mental health, but it does not occur in a way where the mental health system gets any safer for the key actors involved. Ongoing unproductive discourse occurs because the different actors involved are speaking at cross purposes and about different things against the background of a ‘public’ discourse focused on safety crises. I map the general (...) interests of the main set of actors to demonstrate the conflicted and complex nature of discourse around mental health safety. In response I outline a dialogical approach to safety and risk based on the work of Habermas and values of recovery. This is presented as a framework from which to assess whether discourse is occurring effectively to develop shared meanings. Shared understandings of safety will mean that the safety needs of relevant actors can be understood and negotiated rather than giving way to an actuarial process which does not take into consideration the context of a person’s life. _Virtue as Social Intelligence: An Empirically Grounded Theory_ takes on the claims of philosophical situationism, the ethical theory that is skeptical about the possibility of human virtue. Influenced by social psychological studies, philosophical situationists argue that human personality is too fluid and fragmented to support a stable set of virtues. They claim that virtue cannot be grounded in empirical psychology. This book argues otherwise. Drawing on the work of psychologists Walter Mischel and Yuichi Shoda, Nancy E. Snow argues that (...) the social psychological experiments that philosophical situationists rely on look at the wrong kinds of situations to test for behavioral consistency. Rather than looking at situations that are objectively similar, researchers need to compare situations that have similar meanings _for the subject_. When this is done, subjects exhibit behavioral consistencies that warrant the attribution of enduring traits, and virtues are a subset of these traits. Virtue can therefore be empirically grounded and virtue ethics has nothing to fear from philosophical situationism. (shrink)

In this paper I am concerned with two questions: What is sexist humor? and what is wrong with it? To answer the first question, I briefly develop a theory of humor and then characterize sexist humor as humor in which sexist beliefs (attitudes/norms) are presupposed and are necessary to the fun. Concerning the second question, I criticize a common sort of argument that is supposed to explain why sexist humor is offensive: although the argument explains why sexist humor feels offensive, (...) it does not place responsibility for the offense in the humorist or audience that enjoys sexist humor. I develop an alternate account of the offense in sexist humor that places responsibility for offense in precisely those quarters. (shrink)

This article is concerned with the childhood experience that seems to be preparatory for the onset of bulimia. Three women's serial experiences of bulimia were investigated and one pattern of experiencing that led to bulimia emerged. As the interview process deepened, the data moved from symptom-related to life-related. The general structure that captured the essence of the lived experience of bulimia remained the same but the individual experiences varied as these women live out their unique lives. In understanding the totality (...) of the phenomenon of bulimia, it is important to remember that although each of the six key constituents is described separately, in the life-world all the constituents merge together as they interact with each other and with the whole of the experience. These bulimic women reported having family backgrounds in which they experienced a sense of diminished self and dissatisfaction in interactions with significant others and self. They found themselves pressured to maintain a less than integrated life, and in rapid transition from 'awareful' behaving to automatic and anonymous functioning. A psychological hunger seems to possess them and this is lived out during the anonymous phase of their existence. Their need for the mastery and control ordinarily lacking in their lives becomes a symptomatic expression that has relevance for them in respect to the deep psychological pain that is only partially expressed. The phenomenal body and self are given priority over objective reality, resulting in distorted perceptions of "fatness" and feelings of terror of "fat.". (shrink)

This article critiques Jack Halberstam's concept of queer failure through a feminist cripistemological lens. Challenging Halberstam's interpretation of Erika Kohut in The Piano Teacher as a symbol of postcolonial angst rather than a figure of psychosocial disability, the article establishes a critical coalition between crip feminist theory and queer-of-color theory to promote a materialist politics and literal-minded reading practice designed to recognize minority subjectivities rather than exploiting them for their metaphorical resonance. In asserting that Erika Kohut is better understood as (...) a woman with borderline personality disorder , and in proposing borderline personality disorder as a critical optic through which to read both The Piano Teacher and The Queer Art of Failure , the article challenges the usual cultural undermining of epistemic authority that comes with the BPD diagnosis. It asserts instead that BPD might be a location of more, rather than less, critical acumen about the negative affects that accompany queer failures, and reflect on what we might call a borderline turn in queer theory. On a broader level, the article joins an emergent conversation in crip theory about the reluctance of queer theory to address disability in meaningful and substantive ways. (shrink)

In this article I argue that while an attachment to one's country is both natural and even partially justifiable, cultivating loyal patriotism in schools is untenable insofar as it conflicts with the legitimate aims of education. These aims include the epistemological competence necessary for ascertaining important truths germane to the various disciplines; the cultivation of critical thinking skills ; and developing the capacity for economic self‐reliance. I argue that loyal patriotism may result in a myopic understanding of history, an unhealthy (...) attitude of superiority relative to other cultures, and a coerced sense of attachment to one's homeland. In this paper I argue that self-respect constitutes an important value, and further, serves as an important basis for equality. I also argue that under conditions of inequality-producing segregation, voluntary separation in schooling may be more likely to provide the resources necessary for self respect. Accordingly, I defend a prima facie case of voluntary separation for stigmatized minorities when equality – as equal status and treatment – is not an option under either the terms of integration or involuntary segregation.

Objective: a legal analysis of Lobong pineapple from the perspective of Geographical Indication law; Supporting industry and Creative Economy. Method: This study is a qualitative study using a normative approach and an empirical legal approach, namely related to the rules and implementation of the Geographical Indication law for registering Lobong pineapple in supporting the industry and creative economy of the community. Findings: Lobong pineapple is one of the horticultural plants that has advantages in Bolaang Mongondow Regency because of its sweet (...) fruit quality. Uniquely, this pineapple only tastes sweet when planted in Lobong village, if planted outside Lobong village, the taste is different, not as sweet as that planted in Lobong village. From the perspective of Geographical Indication (IG) law, Lobong pineapple can be given IG legal protection through registration with the Office of the Ministry of Law and Human Rights (HAM). Registration of Lobong pineapple IG is very important in supporting sustainable industry and creative economy in the utilization and productivity as well as commercialization of Lobong pineapple. The Ministry of Law and Human Rights Office has attempted to register the IG of Lobong pineapple through assistance, but the problems that arise are due to the lack of seriousness and lack of legal awareness of the Bolaang Mongondow district government to register the IG. The government's lack of seriousness regarding administration such as the absence of a Decree of the Regent of the Geographical Indication Protection Community (MPIG) and the absence of academic IG manuscript documents so that IG registration has not been able to be carried out until now. Another obstacle is the lack of concern from related agencies regarding IG registration. The absence of legal protection for Geographical Indication registration will have an impact on farmers, entrepreneurs and also local governments if there is utilization of Lobong pineapple by other parties, both foreign and domestic, for individual interests and will certainly harm the community that has been making and trading the results of the product. Originality: the originality of this study shows the lack of seriousness and lack of legal awareness of the local government about the importance of legal protection of Lobong pineapple through IG registration which will ultimately harm the MPIG community who make and produce derivative products of Lobong pineapple in the form of smoked, crackers, and pickles. In this essay I defend the following prima facie argument: civic virtue is not dependent on integration and in fact may be best fostered under conditions of segregation. I demonstrate that civic virtue can and does take place under conditions of involuntary segregation, but that voluntary separation—as a response to segregation—is a more effective way to facilitate it. While segregation and disadvantage commonly coexist, spatial concentrations, particularly when there is a strong voluntary aspect present, often aid in fostering civic virtue. (...) An education for cultural coherence tends to the child’s well-being through identity construction and maintenance. Critics charge that this sort of education will not bode well for the future autonomy of children. I will argue that culturally coherent education, provided there is no coercion, can lend itself to eventual autonomy and may assist minority children in countering the negative stereotypes and discrimination they face in the larger society. Further, I will argue that few individuals actually possess an entirely coherent identity; (...) rather, most of us possess hybrid identities that lend themselves to multiple, not necessarily conflicting allegiances. In this paper we aim to demonstrate the enormous ethical complexity that is prevalent in child obesity cases. This complexity, we argue, favors a cautious approach. Against those perhaps inclined to blame neglectful parents, we argue that laying the blame for child obesity at the feet of parents is simplistic once the broader context is taken into account. We also show that parents not only enjoy important relational prerogatives worth defending, but that children, too, are beneficiaries of that relationship in (...) ways difficult to match elsewhere. Finally, against the backdrop of growing public concern and pressure to intervene earlier in the life cycle, we examine the perhaps unintended stigmatizing effects that labeling and intervention can have and consider a number of risks and potential harms occasioned by state interventions in these cases. Against the backdrop of the recent emergence of disturbing currents of populism in several countries, including the United States, this article argues for a conception of hope as a democratic civic virtue. In section 1, it offers a general overview of hope and sketches an initial conception of hope as a democratic civic virtue. In section 2, the stage is set for further theorizing of this conception in the present American context. Drawing on the work of Ghassan Hage, the article (...) makes the point that the United States is in the process of becoming a nation of worriers in part because of the failure of the government to distribute social hope. Section 3 fleshes out what hope as a democratic civic virtue could look like in the United States today. The result is not only new findings of substantive and methodological interest, but also an interesting glimpse into the thinking of the researchers as they sought interdisciplinary common ground in their research. In this paper I examine in detail the continued – and curious – popularity of religious schools in an otherwise ‘secular’ twenty-first century Europe. To do this I consider a number of motivations underwriting the decision to place one’s child in a religious school and delineate what are likely the best empirically supported explanations for the continued dominant position of Protestant and Catholic schools. I then argue that institutional racism is an explanatory variable that empirical researchers typically avoid, though it (...) informs both parental assessments of school quality as well as selective mechanisms many mainstream religious schools use to function as domains of exclusion. I then distinguish between religious schools in a dominant position from those serving disadvantaged minorities and argue that the latter are able to play a crucially important function other schools only rarely provide and hence that vulnerable minorities may have reason to value. Our primary aim in this paper is to sketch the account of virtue that we think most amenable to virtue measurement. Our account integrates Whole Trait Theory from psychology with a broadly neo-Aristotelian approach to virtue. Our account is ‘ecumenical’ in that it has appeal for a wide range of virtue ethicists. According to WTT, a personality trait is composed of a set of situation-specific trait-appropriate responses, which are produced when certain “social-cognitive” mechanisms are triggered by the perception of trait-relevant (...) stimuli in a person’s external and/or internal environment. Moving from this starting point, we discuss our conception of a virtue and respects in which it both aligns with and diverges from Aristotle’s conception. We discuss roles for practical wisdom and motivation in our conception of virtue, and highlight respects in which WTT provides an amenable empirical framework into which key Aristotelian elements can be integrated. We conclude with brief remarks about our conception as an empirically adequate and measurable account. (shrink)

A wealth of literature has been devoted to the problem of developing an adequate semantic analysis of sortally incorrect statements. The motivation is clear, albeit controversial: sortally incorrect statements appear to exhibit an unusual behavior when coupled with other statements in logically complex statements. For instance, two senses of negation are distinguishable when the operation is applied to sortally incorrect statements. In this paper, I shall reopen the question of the "correct" semantic analysis of sortally incorrect statements.

Dual process theorists in psychology maintain that the mind’s workings can be explained in terms of conscious or controlled processes and automatic processes. Automatic processes are largely nonconscious, that is, triggered by environmental stimuli without the agent’s conscious awareness or deliberation. Automaticity researchers contend that even higher level habitual social behaviors can be nonconsciously primed. This article brings work on automaticity to bear on our understanding of habitual virtuous actions. After examining a recent intuitive account of habitual actions and habitual (...) virtuous actions, the author offers her own explanation in terms of goal-dependent automaticity. This form of automaticity provides an account of habitual virtuous actions that explains the sense in which these actions are rational, that is, done for reasons. Habitual virtuous actions are rational in the sense of being purposive or goal-directed and are essentially linked with the agent’s psychological states. Unlike deliberative virtuous actions, the agent’s reasons for habitual virtuous actions are not present to her conscious awareness at the time of acting. (shrink)

In 1987, Crispin Wright argued that degree-theoretic solutions to the Sorites paradox fail because the solutions do not work when the paradox is restated using a conjunctive major premise. I show that Wright is incorrect: degree-theoretic solutions also work when the paradox is stated with a conjunctive major premise.

In this article, I make a philosophical case for the state to fund religious schools. Ultimately, I shall argue that the state has an obligation to fund and provide oversight of all schools irrespective of their religious or non-religious character. The education of children is in the public interest and therefore the state must assume its responsibility to its future citizens to ensure that they receive a quality education. Still, while both religious schools and the polity have much to be (...) gained from direct funding, I will show that parents and administrators of these schools may have reasons to be diffident toward the state and its hypothetical interference. While the focus of the paper is primarily on the American educational context, the philosophical questions related to state funding and oversight of religious schools transcend any one national context . In this article we challenge the notion that diversity serves as a good proxy for educational justice. First, we maintain that the story about how diversity might be accomplished and what it might do for students and society is internally inconsistent. Second, we argue that a disproportionate share of the benefits that might result from greater diversity often accrues to those already advantaged. Finally, we propose that many of the most promising and pragmatic remedies for educational injustice are often rejected (...) by liberal proponents of “diversity first” in favor of remedies that in most cases are practically impossible, and often problematic on their own terms. We argue that schools that are by geography and demography not ethnically or socioeconomically diverse still can successfully confront the obstacles that their students face in creating a life they have reason to value. The central claim of this comparative study of Kant and Kierkegaard is that the aesthetic experience of the sublime is both autonomous and formative for extra-aesthetic ends. Aesthetic autonomy is thus inseparable from aesthetic heteronomy. In Part I, through an examination of Kant’s Critique of Judgement and his essays on the French Revolution, the Kantian sublime is shown to conflict with our existing cognitive, moral and political frames of meaning, at the same time that the engagement of the aesthetic judge (...) (Chapter 1) or the enthusiastic spectator (Chapter 2) with this conflict furthers our pursuit of cognitive, moral and political ends. The Kantian sublime is built on the autonomy of aesthetic judgement, which nevertheless has non-aesthetic value. Part II argues that certain aesthetic and ethical-religious figures in Kierkegaard’s work can be shown to be transfigurations of the Kantian sublime, despite the absence of the term. Antigone and the silhouettes from Either/Or embody what I coin the tragic sublime and sublime grief. The God-man in Practice in Christianity is interpreted as a sublime image of contradiction. The figures are submitted to aesthetic representation, while their contradictory interior lives are unrepresentable. The Kierkegaardian sublime is built on a radical critique of aesthetic autonomy, whose failure serves the end of ethico-religious self-formation. (shrink)
